N°\n7384, Ley de Creación del INCOPESCA establece en su artículo 17, inciso k), como\natribución y facultad del Instituto, determinar los montos a cobrar por la venta de\nbienes y servicios que preste y genere el mismo.\n\n    2º—Que es\nnecesario eliminar los términos \"flota artesanal pequeña escala, flota palangrera\nmedia, flota palangrera avanzada y flota semiindustrial\" empleados para definir en el\nAcuerdo AJDIP/419 a las flotas de pesca comercial y sustituirlas por las establecidas en\nla Ley N° 8436, Ley de Pesca y Acuicultura.\n\n    3º—Que el\nartículo 68 de la Ley N° 8436 establece como pesca deportiva la actividad de pesca que\nrealizan personas físicas, nacionales o extranjeras, con el fin de capturar, con un\naparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas\ncontinentales, jurisdiccionales o en zona económica exclusiva, sin fines de lucro y con\npropósito de deporte, recreo, turismo o pasatiempo.\n\n    4º—Que el\nartículo 79 de la Ley N° 8436 indica que la pesca turística es la actividad pesquera\nque realizan personas físicas, nacionales o extranjeras, con el fin de capturar, con un\naparejo de pesca personal apropiado para el efecto, recursos acuáticos pesqueros en aguas\ncontinentales, jurisdiccionales o en la zona económica exclusiva, con fines comerciales y\npropósitos exclusivamente turísticos, llevados a cabo en forma permanente, por lo cual\nes necesario establecer los requisitos para el otorgamiento de las licencias y carné de\npesca para esta actividad, asimismo, a la pesca turística le serán aplicables, por\nanalogía, las disposiciones establecidas en los artículos 69 a 76 de la presente ley.\n\n    5º—Que el\nartículo 75 de la Ley N° 8436 señala que tanto la tripulación como quienes practiquen\nla pesca deportiva o turística, a bordo de una embarcación o de manera subacuática,\ndeberán portar el respectivo carné de pesca deportiva extendido por el INCOPESCA.\n\n    6º—Que para el\ncobro de los carnés para pesca deportiva continental y pesca turística continental o\nmarina, cuyas tarifas fueron propuestas por esta Comisión en el Acta CT001-2005, es\nnecesario establecer los requisitos que deben cumplir las personas físicas y jurídicas\nque van a solicitar el servicio.\n\n    7º—Que el\nartículo 73 de la Ley N° 8436 indica que INCOPESCA establecerá los cánones, las\népocas, las zonas y las tallas mínimas, así como el número máximo de ejemplares que\npueda capturar un pescador deportista o turístico en aguas continentales, de acuerdo con\nlas condiciones del recurso de que se trate y las características particulares del lugar\ndonde se desarrolle la actividad.\n\n    8º—Que esta Junta\nDirectiva acogerá la recomendación presentada por la Comisión de Tarifas, debiéndose\nrealizar las correcciones y adiciones pertinentes en los acuerdos AJDIP/238-2002, en el\nque se establecen los requisitos, y AJDIP/419-2005 en el que se establecen las tarifas\naplicables durante el período económico 2005.\n\nPor tanto, se acuerda:\n\n    Artículo\n1º—Eliminar del Acuerdo AJDIP/419 los términos \"flota artesanal pequeña\nescala, flota palangrera media, flota palangrera avanzada y flota semi-industrial\" y\najustar las definiciones de los tipos de flotas de pesca comercial para las Licencias,\nPermisos y Autorizaciones que otorgue el INCOPESCA, según lo establecido en el artículo\n43 de la Ley N° 8436, Ley de Pesca y Acuicultura, para que se lea de la siguiente manera:\n\na) Pequeña escala: Pesca realizada\n artesanalmente por personas físicas, sin mediar el uso de embarcación, en las aguas\n continentales o en la zona costera, o la pesca practicada a bordo de una embarcación con\n una autonomía para faenar hasta un máximo de tres millas náuticas del mar territorial\n costarricense.\n\nb) Mediana escala: Pesca realizada\n por personas físicas o jurídicas, a bordo de una embarcación con autonomía para faenar\n hasta un máximo de cuarenta millas náuticas inclusive.\n\nc) Avanzada: Pesca que realizan, por\n medios mecánicos, personas físicas o jurídicas, a bordo de una embarcación con\n autonomía para faenar superior a las cuarenta millas náuticas, orientada a la captura de\n especies pelágicas con palangre, y de otras especies de importancia comercial.\n\nd) Semi-industrial: Pesca realizada\n por personas físicas o jurídicas, a bordo de embarcaciones orientadas a la extracción\n del camarón con red de arrastre, de la sardina y del atún con red de cerco.\n\n    Artículo\n2º—Adicionar al acuerdo AJDIP/419-2005, deportiva continental o pesca turística continental (se completa en la oficina\n respectiva).\n\nCancelación de la tarifa\n correspondiente.\n\n    Artículo\n4º—Definición de lugares y especies que se prohíben y se autorizan pescar en aguas\ncontinentales. Se prohíben pescar en aguas continentales, lo cual se aplica tanto para\npesca deportiva continental como para pesca turística continental, quedando de la\nsiguiente manera:\n\n    Se prohíbe la pesca\ndeportiva continental y turística continental de las siguientes especies y en los\nsiguientes lugares:\n\na. De todas las especies de peces de agua\n dulce en todos los ríos incluyendo sus afluentes, lagos y lagunas) exceptuando lo\n establecido en los incisos e) y d) de este artículo), entre el 1° de setiembre y el 30\n de noviembre inclusive. Fuera de ese plazo se podrá pescar con un límite de 5 piezas con\n un tamaño mínimo de 25 cm. de longitud, por persona con licencia y carné de pesca\n continental al día. Se exceptúa el tepemechín (Agonostomus monticola), para el cual no\n se establece límite de longitud y gaspar (Atractosteus tropicus) para el cual se fija un\n tamaño mínimo de 60 cm.\n\nd. Del langostino o camarón de río\n (Macrobrachium spp), en todos los ríos nacionales entre el 15 de mayo y el 30 de\n noviembre inclusive. Fuera de este periodo, se podrá pescar con un límite de diez piezas\n por persona por día.\n\ne. La pesca deportiva y la pesca turística\n en la Laguna de Hule, ubicada en el Refugio de Fauna Privado Bosque Alegre, Cariblanco.\n\nf. En las Reservas Indígenas (excepto la\n pesca de subsistencia que realicen los indígenas).\n\ng. 100 metros en ambas márgenes del Río\n San Rafael en Muelle de San Carlos, entre el puente sobre la carretera que comunica la\n comunidad de Muelle con Pital y la desembocadura del Río San Rafael en el Río San\n Carlos.\n\nh. La pesca por tiempo indefinido en los\n ríos Sarapiquí, entre la confluencia del Río Peje hasta la unión con el Puerto Viejo,\n entre la confluencia con el Río Sábalo Esquina, hasta la unión con el Sarapiquí.\n\n    Para la pesca deportiva\ncontinental y pesca turística continental se autoriza lo siguiente:\n\na. La pesca con caña y carrete, así como\n cuerdas de mano, en un horario de 6:00 a. m. a 5:00 p.m.\n\n                   \nb.  La pesca todos los días del año en:\n\nb.1. El Río Reventazón desde Palomo de\n Orosi hasta su desembocadura con excepción de sus     afluentes. El\n límite de piezas se establece en cinco peces con un tamaño superior a 25 cm. por\n pescador con licencia de pesca deportiva o pesca turística continental, por día.\n\nb.2. La que se realice con cuerda de mano o\n caña y carrete en el Embalse de Arenal. Se establece el límite de piezas en 10 peces por\n pescador con licencia, por día.\n\nb.3. likewise, the provisions established in Articles 69 to 76 of this law shall apply, by analogy, to tourist fishing.\n\n    5º—That\nArticle 75 of Law No. 8436 states that both the crew and those practicing sport or tourist fishing, aboard a vessel or underwater, must carry the respective sport fishing card issued by INCOPESCA.\n\n    6º—That for the\ncharging of fees for inland sport fishing and inland or marine tourist fishing cards, whose rates were proposed by this Commission in Minutes CT001-2005, it is necessary to establish the requirements that natural and legal persons applying for the service must meet.\n\n    7º—That\nArticle 73 of Law No. 8436 indicates that INCOPESCA shall establish the fees, seasons, zones, and minimum sizes, as well as the maximum number of specimens that a sport or tourist fisher may catch in inland waters, in accordance with the conditions of the resource in question and the particular characteristics of the place where the activity is carried out.\n\n    8º—That this Board\nof Directors will accept the recommendation presented by the Tariff Commission, and the pertinent corrections and additions must be made to Agreements AJDIP/238-2002, which establishes the requirements, and AJDIP/419-2005, which establishes the applicable rates during the 2005 fiscal period.\n\nTherefore, it is agreed:\n\n    Article\n1º—To eliminate from Agreement AJDIP/419 the terms \"small-scale artisanal fleet, medium longline fleet, advanced longline fleet, and semi-industrial fleet\" and to adjust the definitions of the commercial fishing fleet types for the Licenses, Permits, and Authorizations granted by INCOPESCA, as established in Article 43 of Law No. 8436, the Fisheries and Aquaculture Law, to read as follows:\n\na) Small-scale: Fishing carried out\n artisanally by natural persons, without the use of a vessel, in inland waters or in the coastal zone, or fishing practiced aboard a vessel with an autonomy to operate up to a maximum of three nautical miles of Costa Rican territorial sea.\n\nb) Medium-scale: Fishing carried out\n by natural or legal persons, aboard a vessel with an autonomy to operate up to a maximum of forty nautical miles inclusive.\n\nc) Advanced: Fishing carried out, by\n mechanical means, by natural or legal persons, aboard a vessel with an autonomy to operate greater than forty nautical miles, aimed at the capture of pelagic species with longline, and other species of commercial importance.\n\nd) Semi-industrial: Fishing carried out\n by natural or legal persons, aboard vessels aimed at the extraction of shrimp with trawling nets, sardine, and tuna with purse seine nets.\n\n    Article\n2º—To add the following rates to Agreement AJDIP/419-2005:\n\nIdentification card for inland or marine sport\nfishing\n\n(per year/ per application)\n\n \n\n| Inland sport fishing (national or resident) | Card | ¢6,800.00 |\n| --- | --- | --- |\n| Inland sport fishing (foreigner) | Card | $24.00 |\n| Crew member of inland or marine sport fishing vessel | Card | ¢3,400.00 |\n| Inland sport underwater fishing | Card | ¢9,850.00 |\n\n \n\nIdentification card for inland or marine tourist\nfishing\n\n (per year/ per application)\n\n \n\n| Inland or marine tourist fishing (national or resident) | Card | ¢6,800.00 |\n| --- | --- | --- |\n| Inland or marine tourist fishing (foreigner) | Card | $24.00 |\n| Crew member of tourist fishing vessel | Card | ¢3,400.00 |\n\n    Article\n3º—To add to Agreement AJDIP/238-2002, the requirements for granting cards for inland sport fishing and inland and marine tourist fishing, reading as follows:\n\nPresent an identity card, residency card, or passport.\n\nRecent passport-size photograph.\n\nApplication form for an inland sport fishing card or inland tourist fishing card (completed at the respective office).\n\nPayment of the corresponding fee.\n\n    Article\n4º—Definition of places and species that are prohibited and authorized to fish in inland waters. Fishing in inland waters is prohibited, which applies to both inland sport fishing and inland tourist fishing, reading as follows:\n\n    Inland sport\nfishing and inland tourist fishing of the following species and in the following places is prohibited:\n\na. Guapote (Parachromis spp), róbalo\n (Centropomus undecimalis), sábalo (Megalops atlanticus), and other\n           fish species, in the\n following rivers and their tributaries: Frío, Zapote, Niño or Pizote, lagoons of the Refugio de Fauna Silvestre of Caño Negro and the Refugio de Fauna Silvestre Las Camelias, between April 1st and July 31st inclusive. Outside this period, fishing is permitted with a limit of five fish with a minimum size of 25 cm in length, per person per day.\n\nb. Gaspar (Atractosteus tropicus) in\n the following rivers and their tributaries: Frío, Zapote, Niño or Pizote, lagoons of the Refugio de Fauna Silvestre of Caño Negro and the Refugio de Fauna Silvestre Las Camelias, between March 1st and August 31st inclusive. Outside this period, fishing is permitted with a limit of two fish with a minimum size of 60 cm in length, per person per day.\n\nc. All species of freshwater fish in all rivers (including their tributaries, lakes, and lagoons), except as established in subsections e) and d) of this article, between September 1st and November 30th inclusive. Outside this period, fishing is permitted with a limit of 5 pieces with a minimum size of 25 cm in length, per person with a current inland fishing license and card. Exceptions are made for tepemechín (Agonostomus monticola), for which no length limit is established, and gaspar (Atractosteus tropicus), for which a minimum size of 60 cm is set.\n\nd. River shrimp (Macrobrachium spp), in all national rivers between May 15th and November 30th inclusive. Outside this period, fishing is permitted with a limit of ten pieces per person per day.\n\ne. Sport fishing and tourist fishing in the Laguna de Hule, located in the Refugio de Fauna Privado Bosque Alegre, Cariblanco.\n\nf. In Indigenous Reserves (except for subsistence fishing carried out by Indigenous people).\n\ng. 100 meters on both banks of the Río San Rafael in Muelle de San Carlos, between the bridge on the road connecting the community of Muelle with Pital and the mouth of the Río San Rafael into the Río San Carlos.\n\nh. Fishing indefinitely in the Sarapiquí rivers, between the confluence of the Río Peje until its junction with the Puerto Viejo, between the confluence with the Río Sábalo Esquina, until its junction with the Sarapiquí.\n\n    For inland sport\nfishing and inland tourist fishing, the following is authorized:\n\na. Fishing with rod and reel, as well as hand lines, from 6:00 a.m. to 5:00 p.m.\n\n                   \nb.  Fishing every day of the year in:\n\nb.1. The Río Reventazón from Palomo de\n Orosi to its mouth, with the exception of its tributaries. The limit of pieces is established at five fish with a size greater than 25 cm per fisher with an inland sport fishing or inland tourist fishing license, per day.\n\nb.2. Fishing carried out with hand line or rod and reel in the Embalse de Arenal. The limit of pieces is established at 10 fish per licensed fisher, per day.\n\nb.3. In the Barras de Colorado, Parismina,\n Tortuguero, and Matina. The limit of pieces in the cited river bars will be five fish per licensed fisher, per day. A river bar shall be understood as the riverbed extending up to one kilometer upstream, starting from the mouth.\n\n                   \nc.     The subsistence fishing carried out by Indigenous people in the Indigenous Reserves.\n\n                   \nEffective as of its publication.\n\n                   \nPuntarenas, July 26, 2005." }
