32549\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\n    En ejercicio de las\nfacultades conferidas por los incisos 3) y 18) el artículo 140 de la Constitución\nPolítica, los artículos 82, 84 y 87 de la Ley de Conservación de la Vida Silvestre N°\n7317, publicada en La Gaceta N° 235 de 7 de diciembre de 1992 y los artículos 32,\n35 y 36 de la Ley Orgánica del Ambiente N° 7554, publicada en La Gaceta N° 215\nde 13 de noviembre de 1995, y\n\nConsiderando:\n\n    1º—Que de\nconformidad con los artículos 35 y 36 de la Ley Orgánica del Ambiente N° 7554 y el\nartículo 102 del Decreto N° 26435- MINAE, Reglamento a la Ley de Conservación de Vida\nSilvestre, se establecen los requisitos y objetivos para crear nuevas áreas silvestres\nprotegidas, específicamente Refugios de Vida Silvestre, acordes con los objetivos de\nprotección y conservación de los recursos naturales.\n\n    2º—Que la Ley de\nConservación de la Vida Silvestre N° 7317, en sus artículos 82 y 84 faculta al Poder\nEjecutivo para crear refugios de vida silvestre, así mismo se establece que la\ncompetencia y manejo de los recursos naturales incluidos en dichos refugios le\ncorresponden a MINAE, específicamente a la Dirección General de Vida Silvestre, cuya\ncompetencia actualmente le atañe a SINAC.\n\n    3º—Que es interés\ndel Estado fortalecer la participación de la sociedad en el campo de la protección de\nlos recursos naturales, contribuyendo así con las políticas de conservación que se\nsiguen en Costa Rica, garantizando el uso racional de los mismos.\n\n    4º—Que el\ndieciséis de enero del año mil novecientos noventa y siete, en La Gaceta número\nonce, se publicó el Decreto Ejecutivo número veinticinco siete cero dos-MINAE, en donde\nse crea el Refugio de Vida Silvestre de Propiedad Privada HARA, por un periodo de cinco\naños, con una extensión de trece y media hectáreas ubicadas en Punta Cuchillo de\nPaquera, Puntarenas, propiedad del señor Hendrik Arno Reinier Ambrosius, de nacionalidad\nHolandesa, pasaporte número D- cero ciento siete - cero seiscientos seintisiete.\n\n    5º—Que el cuatro\nde febrero del año dos mil cuatro, el señor Hendrik Amo Reinier Ambrosius, en su\ncondición de propietario de los inmuebles ubicadas en Punta Cuchillo de Paquera,\nPuntarenas, solicita someter dichas propiedades, que suman treinta y tres hectáreas, con\nmil metros cuadrados, a la categoría de Refugio Privado de Vida Silvestre por un periodo\nde diez años, denominándolo con el nombre de La Nicoyana.\n\n    6º—Que junto a la\nsolicitud de crear el refugio de Vida Silvestre privado La Nicoyana por un periodo de diez\naños, el señor Ambrosius presentó el respectivo Plan de Manejo, elaborado por el\nIngeniero Forestal y Biólogo Jorge Adrián Mendoza Gutiérrez, número de colegiado 4201.\nIncluyendo la documentación legal de cuatro inmuebles que estarían incluidos dentro del\nrefugio que tendrá una extensión total de trescientos treinta y un mil sesenta metros\ncuadrados con veintiún decímetros cuadrados (331.060,21 m2). Including the legal documentation of four properties that would be included within the refuge, which will have a total area of three hundred thirty-one thousand sixty square meters and twenty-one square decimeters (331,060.21 m2). Which together total an area of three hundred thirty-one thousand sixty square meters and twenty-one square decimeters (331,060.21 m2).\n\n2º—The aforementioned properties are located in the province of Puntarenas, central Canton, district of Paquera, whose location is found on the Tambor Cartographic Sheet, N° 3245III.\n\n3º—The owner of said properties undertakes to carry out the activities stipulated in the Management Plan approved by the Área de Conservación Tempisque, through Resolution N° ACT-OR-054, signed by the director of the Área de Conservación Tempisque, and to request in writing the approval of any modification or change to said management plan, before MINAE, Área de Conservación Tempisque, PALECO Subregion.\n\n4º—The owner of the indicated properties shall provide all possible collaboration to the officials of the Ministry of Environment and Energy, as well as to COVIRENAS groups, forest fire brigades, or volunteers, for the purpose of protecting biodiversity or carrying out environmental education activities in the Refuge or in its area of influence.\n\n5º—Said properties shall be subject to the Private Property Wildlife Refuge regime for a period of ten years, renewable for equal periods, if both parties deem it appropriate and the owner states it in writing at least three months before the expiration of the term, pursuant to Article 102 of Executive Decree N° 26435, Regulations to the Wildlife Conservation Law.\n\nEffective as of its publication.\n\nGiven at the Presidency of the Republic, in the city of San José, at eight o'clock on the twenty-eighth day of February, two thousand five." }
