Este refugio se extendería en los doscientos metros de\nla zona marítimo-terrestre desde la margen derecha de la desembocadura del Río\nNosara hasta Punta India. \n\n2º-Que\nel objetivo principal del Refugio es la protección de la tortuga lora\n(Lepidochlys olivacea) y sus respectivas anidaciones. \n\n3º-Que\nmediante Decreto Ejecutivo N° 16531 de fecha 18 de julio de 1985, publicado en La\nGaceta Nº 183 del 26 de setiembre de 1985, se amplió el área del Refugio\nhasta el sector de Punta Guiones, comprendiendo desde el sector de Punta India\nen el Cantón de Santa Cruz hasta el sector de Punta Guiones en el cantón de\nNicoya, ambos de la provincia de Guanacaste.\n\n4º-Que\nesta delimitación del área fue ratificada por el Transitorio Primero de la Ley\nde Conservación de la Vida Silvestre Nº Ley Nº 7317 del 30 de octubre de 1992,\npublicada en La Gaceta Nº 235 del 7 de diciembre de 1992 y su Reglamento\nNº 22545, publicado en La Gaceta Nº 195 del 13 de octubre de 1993.\n\n5º-Que\nel Decreto Ejecutivo Nº 22551 de fecha 14 de setiembre de 1993, publicado en La\nGaceta 193 del 8 de octubre de 1993, incorporó dentro de los límites de\nprotección del Refugio, el sector de aguas costeras en una franja de tres\nmillas marítimas, con el objetivo de proteger los sitios de anidamiento de las\ntortugas loras.\n\n6º-Que\nel 20 de agosto de 1999, mediante Decreto Ejecutivo Nº 28203, publicado en La\nGaceta Nº 232 del 30 de noviembre de 1999, el Ministerio de Ambiente y\nEnergía, le otorgó a la Asociación de Desarrollo Integral de Ostional, el\nderecho de aprovechar como única persona jurídica, la recolección de huevos\npara su comercialización, basados en una serie de regulaciones que garantizaban\nla protección y supervivencia de la especie. \nLa actividad de la comercialización es regulada actualmente por el\nInstituto Costarricense de Pesca y Acuacultura.\n\n7º-Que\nel 4 de noviembre del 2002 mediante artículo 4 de la Ley Nº 8325, publicada en La\nGaceta Nº 230 del 28 de noviembre del 2002, se declara de interés\neco-turístico el anidamiento y desove de las tortugas marinas en playa\nOstional. Por tanto,\n\n \n\nDECRETAN:\n\n \n\n \n\nReglamento de uso público del Refugio\n\nNacional de Vida Silvestre Ostional\n\nDisposiciones generales\n\n \n\nArtículo\n1º-El presente Reglamento de Uso Público regirá para el sector comprendido\nentre Punta India y la Boca del Río Nosara.\n\nArtículo\n2º-El horario general para la atención al público será únicamente de las 18:00 horas\na las 24:00 horas, excepto durante los días de arribada, el cual será entre las\n6:00 horas y las 24: 00 horas.\n\nArtículo\n3º-Los funcionarios del Refugio, Comité de Vigilancia de los Recursos\nNaturales, guías y guardas locales, deberán cumplir las siguientes\ndisposiciones:\n\n \n\na)\nExcelente presentación personal, con uniforme completo y su respectiva identificación.\n\nb)\nGuardar un comportamiento intachable dentro de las normas y principios de la\nmoral, buenas costumbres y respeto mutuo.\n\nc)\nNunca presentarse y/o trabajar bajo los efectos del licor o cualquier droga.\n\nd)\nFumar sólo en sitios autorizados por la Administración del Refugio (casetas de\ningreso).\n\ne)\nBrindar un servicio de alta calidad al visitante.\n\nf)\nComunicar al visitante las regulaciones del presente Reglamento y otras\ndisposiciones legales pertinentes.\n\ng)\nAcatar y hacer cumplir todas las disposiciones del presente Reglamento.\n\nh)\nVelar por la seguridad del visitante y del recurso.\n\nArtículo\n4º-Los guías locales deberán participar en toda actividad que promueva la\neducación ambiental, ecoturismo, protección y control de las tortugas marinas y\ndemás recursos naturales del Refugio y responsabilizarse por el uso adecuado y\napropiado del equipo y materiales que le sean entregados.\n\nArtículo\n5º-La exoneración por concepto de ingreso al Refugio deberá ser tramitada por\nla Dirección Regional del Área de Conservación o la Administración de Éste. La\nexoneración por servicio de guiado se realizará por mutuo acuerdo entre los\nguías locales, la Asociación de Desarrollo y la Administración del Refugio.\nEste artículo considera las exoneraciones referidas en el Decreto Ejecutivo Nº\n30355, del 23 de abril del 2002, publicado en La Gaceta Nº 92 del 15 de\nmayo del 2002, además de las reguladas en el artículo 6º de este Decreto.\n\nArtículo\n6º-Se exonerarán del costo de ingreso y servicio de guiado al Refugio, todas\nlas personas físicas residentes de las comunidades de Ostional, Nosara,\nGuiones, Santa Marta, la Esperanza y las comunidades que van desde Venado,\ncantón Santa Cruz hasta Barco Quebrado, cantón Nicoya. Deberán identificarse en\nla caseta de ingreso al Refugio, mediante su cédula de identidad en caso de ser\nnacional o cédula de naturalización o residencia los extranjeros.\n\nArtículo\n7º-Las solicitudes para los permisos de filmación, documentales u otro material\naudiovisual deberán ser por escrito y justificadas técnica y científicamente al\nmenos diez días hábiles antes de la fecha de inicio de la actividad. Durante\neste periodo, la Administración responderá por escrito al solicitante su\ndecisión. Los costos serán los contemplados en el Decreto Ejecutivo Nº 30355,\ndel 23 de abril del 2002, publicado en La Gaceta Nº 92 del 15 de mayo\ndel 2002, para las áreas silvestres protegidas bajo la administración del\nSistema Nacional de Áreas de Conservación. Copia de estas solicitudes serán\nentregadas a la Asociación de Desarrollo y guías locales.\n\nArtículo\n8º-Durante los días de arribada, los recorridos guiados para observar tortugas\nen el área terrestre deberán regirse por las siguientes disposiciones:\n\n \n\na)\nEl inicio y el final del período oficial para observación de tortugas, será\ndeterminado y divulgado por la Asociación de Desarrollo, la Universidad de\nCosta Rica y/o la Administración del Refugio.\n\nb)\nSin excepción, los visitantes interesados en observar la arribada deberán\ncancelar la cuota de ingreso y ser acompañados por uno(a) de los guías locales\nautorizados.\n\nc)\nEl tamaño máximo de cada grupo de visitantes por guía será de 10 personas\n(incluyendo menores de edad y guía). Este número podrá ser modificado por la\nAdministración cuando los estudios respectivos así lo determinen. De igual\nforma, para mejorar el servicio, se pondrá en marcha un sistema de\nreservaciones a cargo de la Dirección Regional del Área de Conservación y la\nadministración del Refugio.\n\nd)\nSólo se permitirá el uso de la luz roja a los investigadores y a los guías\ndurante las caminatas en horario nocturno. La vigilancia encargada del\nmonitoreo de anidación usará luz blanca.\n\nArtículo\n9.-Con el propósito de proteger el desove y anidación de las tortugas no se\npermitirán las siguientes actividades:\n\n \n\na)\nExcavación y recolección de huevos, neonatos y cualquier producto de tortuga\nmarina, así como la extracción de conchas, caracoles, piedras y cualquier otro\nproducto animal, vegetal o mineral de la zona marino costera. La excavación y\nrecolección de huevos con .nes comerciales solamente se permitirá a la\nAsociación de Desarrollo Ostional durante el período, sector de la playa y\nhorario legal establecido en el Plan de Aprovechamiento de Huevos.\n\nb)\nProducir ruidos y golpes fuertes que puedan afectar el comportamiento de las\nhembras anidadoras. Por tanto, no se permite el uso de radios, grabadoras o\ncualquier equipo de sonido similar.\n\nc)\nEl tránsito de vehículos automotores por la playa y sus accesos.\n\nd)\nHacer fogatas, fogones y el uso de asadores, plantillas de gas o carbón y\nsimilares en la playa.\n\ne)\nTomar fotografías con .flash o filmar con lámpara o luces artificiales durante\nla noche entre las 18:00 horas y las 6:00 horas. Solo se permitirá durante el\ndía entre las 6:00 horas y las 18:00 horas.\n\nf)\nAcampar dentro del Refugio.\n\ng)\nIngresar a la playa con maletas, maletines, salveques, hieleras.\n\nh)\nParticipar en la observación del desove bajo los efectos del licor o drogas,\nasí como el ingreso de cualquier tipo de mascotas y animales domésticos, salvo\naquellos que sean considerados extensiones sensoriales para los no videntes.\n\ni)\nIngresar con cualquier tipo de arma blanca, armas de fuego, arpones y arbaletas\no similares.\n\nj)\nFumar durante el recorrido, explicación u observación de las tortugas.\n\nSólo\nse permitirá fumar en las casetas de ingreso y control.\n\nk)\nPracticar surf, realizar cabalgatas y usar motores de combustión interna y\neléctricos, así como embarcaciones de uso recreativo, como jet ski y botes de\nalta velocidad, durante las arribadas dentro de las 3 millas marítimas del\nRefugio.\n\nl)\nRealizar cualquier conducta activa u omisiva, no autorizada expresamente por\neste reglamento o por las autoridades competentes, tanto administrativas como\njudiciales; que afecte de manera negativa el desove y anidación de la tortugas\no el comportamiento normal y común de éstas durante las etapas mencionadas.\n\nm)\nDesarrollar cualquier actividad que altere las condiciones de la .ora y fauna y\nrecursos minerales de cualquier tipo del área silvestre protegida.\n\nArtículo\n10.-Las personas que incumplan la normativa aquí considerada recibirán una\nllamada de atención y explicación de las posibles consecuencias de su acción.\nSi persistieran serán expulsadas del Refugio.\n\nArtículo\n11.-Rige a partir de su publicación.\n\n \n\nDado\nen la Presidencia de la República.-San José, al primer día del mes de marzo del\ndos mil cinco.", "body_en_text": "throughout the text\n\n-\n\nComplete Text of Regulation 32627\n\nPublic Use Regulation for the Ostional National Wildlife Refuge\n\nComplete Text file: 93701\nNo. 32627\n\nNo. 32627\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred by subsections 3 and 18 of article 140 and article 146 of the Political Constitution, articles 1 and 3 of the National Parks Law No. 6084 of August 24, 1977, published in La Gaceta of September 7, 1977, and the Biodiversity Law No. 7788 of April 30, 1998, published in La Gaceta No. 101 of May 27, 1998.\n\nConsidering:\n\n1°-That the Ostional National Wildlife Refuge was created by means of the Sole Transitory Provision of the Wildlife Conservation Law No. 6919 of November 17, 1983. This refuge would extend along the two hundred meters of the maritime-terrestrial zone from the right bank of the mouth of the Río Nosara to Punta India.\n\n2°-That the main objective of the Refuge is the protection of the olive ridley turtle (Lepidochelys olivacea) and its respective nestings.\n\n3°-That by means of Executive Decree No. 16531 of July 18, 1985, published in La Gaceta No. 183 of September 26, 1985, the area of the Refuge was extended to the Punta Guiones sector, encompassing from the Punta India sector in the Cantón de Santa Cruz to the Punta Guiones sector in the cantón de Nicoya, both in the province of Guanacaste.\n\n4°-That this delimitation of the area was ratified by the First Transitory Provision of the Wildlife Conservation Law No. 7317 of October 30, 1992, published in La Gaceta No. 235 of December 7, 1992, and its Regulation No. 22545, published in La Gaceta No. 195 of October 13, 1993.\n\n5°-That Executive Decree No. 22551 of September 14, 1993, published in La Gaceta 193 of October 8, 1993, incorporated within the protection limits of the Refuge the coastal waters sector in a strip of three nautical miles, with the objective of protecting the nesting sites of the olive ridley turtles.\n\n6°-That on August 20, 1999, by means of Executive Decree No. 28203, published in La Gaceta No. 232 of November 30, 1999, the Ministry of Environment and Energy granted the Asociación de Desarrollo Integral de Ostional the right to harvest, as the sole legal entity, the collection of eggs for commercialization, based on a series of regulations that guaranteed the protection and survival of the species. The commercialization activity is currently regulated by the Instituto Costarricense de Pesca y Acuacultura.\n\n7°-That on November 4, 2002, by means of article 4 of Law No. 8325, published in La Gaceta No. 230 of November 28, 2002, the nesting and spawning of sea turtles on Ostional beach is declared of eco-tourism interest. Therefore,\n\nDECREE:\n\nPublic Use Regulation of the Ostional National Wildlife Refuge\n\nGeneral Provisions\n\nArticle 1.-This Public Use Regulation shall govern the sector between Punta India and the Boca del Río Nosara.\n\nArticle 2.-The general hours for public attention shall be solely from 18:00 hours to 24:00 hours, except during nesting events (arribadas), when it shall be between 6:00 hours and 24:00 hours.\n\nArticle 3.-The officials of the Refuge, the Natural Resources Vigilance Committee, guides, and local guards must comply with the following provisions:\n\na) Excellent personal presentation, with a complete uniform and their respective identification.\n\nb) Maintain impeccable behavior within the norms and principles of morality, good customs, and mutual respect.\n\nc) Never present themselves and/or work under the effects of alcohol or any drug.\n\nd) Smoke only in sites authorized by the Refuge Administration (entrance kiosks).\n\ne) Provide a high-quality service to the visitor.\n\nf) Inform the visitor of the regulations of this Regulation and other pertinent legal provisions.\n\ng) Obey and enforce all the provisions of this Regulation.\n\nh) Ensure the safety of the visitor and the resource.\n\nArticle 4.-Local guides must participate in any activity that promotes environmental education, ecotourism, protection, and control of sea turtles and other natural resources of the Refuge, and take responsibility for the adequate and appropriate use of the equipment and materials given to them.\n\nArticle 5.-The exoneration for the Refuge entrance fee must be processed by the Regional Directorate of the Conservation Area or the Administration thereof. Exoneration for the guide service shall be carried out by mutual agreement among the local guides, the Asociación de Desarrollo, and the Refuge Administration. This article considers the exonerations referred to in Executive Decree No. 30355 of April 23, 2002, published in La Gaceta No. 92 of May 15, 2002, in addition to those regulated in article 6 of this Decree.\n\nArticle 6.-All individual residents of the communities of Ostional, Nosara, Guiones, Santa Marta, La Esperanza, and the communities from Venado, cantón Santa Cruz to Barco Quebrado, cantón Nicoya, shall be exonerated from the entrance fee and guide service cost to the Refuge. They must identify themselves at the Refuge entrance kiosk by means of their identity card if they are nationals, or naturalization or residency card for foreigners.\n\nArticle 7.-Requests for filming permits, documentaries, or other audiovisual material must be in writing and technically and scientifically justified at least ten business days before the start date of the activity. During this period, the Administration shall respond in writing to the applicant with its decision. The costs shall be those contemplated in Executive Decree No. 30355 of April 23, 2002, published in La Gaceta No. 92 of May 15, 2002, for protected wild areas under the administration of the National System of Conservation Areas. Copies of these requests shall be provided to the Asociación de Desarrollo and local guides.\n\nArticle 8.-During nesting events (arribadas), guided tours to observe turtles in the terrestrial area must be governed by the following provisions:\n\na) The start and end of the official period for turtle observation shall be determined and disclosed by the Asociación de Desarrollo, the Universidad de Costa Rica, and/or the Refuge Administration.\n\nb) Without exception, visitors interested in observing the nesting event (arribada) must pay the entrance fee and be accompanied by one of the authorized local guides.\n\nc) The maximum size of each group of visitors per guide shall be 10 people (including minors and the guide). This number may be modified by the Administration when the respective studies so determine. Similarly, to improve service, a reservation system managed by the Regional Directorate of the Conservation Area and the Refuge administration shall be implemented.\n\nd) Only the use of red light by researchers and guides during nocturnal walks shall be permitted. The vigilance staff in charge of nesting monitoring shall use white light.\n\nArticle 9.-For the purpose of protecting the spawning and nesting of turtles, the following activities shall not be permitted:\n\na) Excavation and collection of eggs, hatchlings, and any sea turtle product, as well as the extraction of shells, snails, stones, and any other animal, plant, or mineral product from the coastal marine zone. The excavation and collection of eggs for commercial purposes shall only be permitted to the Asociación de Desarrollo Ostional during the period, beach sector, and legal hours established in the Egg Harvesting Plan.\n\nb) Producing loud noises and bangs that may affect the behavior of nesting females. Therefore, the use of radios, recorders, or any similar sound equipment is not permitted.\n\nc) The transit of motor vehicles on the beach and its accesses.\n\nd) Making campfires, bonfires, and the use of grills, gas or charcoal stoves, and similar items on the beach.\n\ne) Taking flash photographs or filming with lamps or artificial lights at night between 18:00 hours and 6:00 hours. This shall only be permitted during the day between 6:00 hours and 18:00 hours.\n\nf) Camping within the Refuge.\n\ng) Entering the beach with suitcases, bags, backpacks, or coolers.\n\nh) Participating in spawning observation under the effects of alcohol or drugs, as well as the entry of any type of pets and domestic animals, except those considered sensory extensions for the visually impaired.\n\ni) Entering with any type of bladed weapon, firearms, harpoons, and crossbows, or similar.\n\nj) Smoking during the tour, explanation, or observation of turtles.\n\nSmoking shall only be permitted at the entrance and control kiosks.\n\nk) Practicing surfing, horseback riding, and using internal combustion and electric engines, as well as recreational watercraft, such as jet skis and high-speed boats, during nesting events within the 3 nautical miles of the Refuge.\n\nl) Performing any active or omissive conduct, not expressly authorized by this regulation or by the competent administrative or judicial authorities, that negatively affects the spawning and nesting of turtles or their normal and common behavior during the mentioned stages.\n\nm) Developing any activity that alters the conditions of the flora, fauna, and mineral resources of any type in the protected wild area.\n\nArticle 10.-Persons who fail to comply with the regulations considered herein shall receive a warning and an explanation of the potential consequences of their action.
