Que de esa finca\nmadre separó una finca para desarrollo turístico con una extensión de 25 hectáreas\n5 227,72 metros cuadrados, que corresponde al plano catastrado Nº\nP-982065-2005. El resto de la finca con una extensión de 38 hectáreas 8 965,15\nmetros cuadrados, lo somete al Régimen de Refugio Mixto de Vida Silvestre.\n\n3º-Que al no existir amojonamiento, se\ncomprobaron en el campo los linderos, que corresponden a las coordenadas\ndesignadas.\n\n4º-Que adyacente a esta finca se encuentra la\nfranja de la Zona Marítimo Terrestre, de conformidad con lo que delimitan los\nmojones del Instituto Geográfico Nacional comprendidos entre el N° 452 y el N°\n499, que pertenece al Estado y que por estar cubierta de bosque forma parte del\nPatrimonio Natural del Estado.\n\n5º-Que el sistema rocoso de la zona costera\nindicada es una formación litoral natural con características geológicas,\nbiológicas, ecológicas y paisajísticas únicas en Costa Rica, debe ser objeto de\nprotección dada su susceptibilidad e importancia biológica. En los estudios\npreliminares se identificó varios bancos de corales con diversidad de especies\nde algas, moluscos y equinodermos; así como importantes bancos de al menos 35 especies\nde peces.\n\n6º-Que dicha área esta mayoritariamente cubierta\nde bosque primario y secundario avanzado y escasas zonas de repastos.\n\n7º-Que en los inventarios preliminares en el\nárea se han identificado al menos 159 especies de plantas (98 especies de\nárboles, 21 especies de arbustos, 21 especies de bejucos, 3 especies de palmas,\n2 especies de epífitas y 14 especies de hierbas). Entre las especies encontradas\ndestaca Phyllocarpus riedelli, una especie muy rara que solo había sido\ncolectada en el sur del país y que representa un nuevo registro para el Pacífico\nCentral. Se identificaron además otras especies en vías de extinción como el Tachigali\nversicolor y el ajillo (Caryocar costarricense); así como un banco\nde germoplasma de especies de interés forestal. Además se identificaron 20\nespecies de reptiles y an.bios (7 especies de ranas, 8 especies de lagartijas y\n5 especies de serpientes), 116 especies de aves y 35 especies de mamíferos.\n\n8º-Que debido al estado actual de los recursos\nnaturales de la región y a la apertura nacional hacia la protección de las\náreas silvestres y a la diversidad ecológica regional, es necesario preservar\nesa zona en la región.\n\n9º-Que el manejo racional integrado de los\nrecursos naturales del área (bosques, flora, fauna); contribuyen a satisfacer\nlas necesidades regionales para la investigación, recreación, educación\nambiental, así como el aprovechamiento de los recursos naturales explotados\nracionalmente.\n\n10.-Que la administración de la vida silvestre y\nla recomendación de medidas que aseguren la perpetuidad de las especies es\nfunción del Sistema Nacional de Áreas de Conservación del Ministerio del\nAmbiente y Energía\n\n11.-Que el propietario del terreno privado\naccedió voluntariamente a incorporarse a este régimen de protección de la flora\ny la fauna silvestre por un período de diez años prorrogables. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Declárese Refugio Nacional de Vida\nSilvestre \"Ara Macao\" de Propiedad Mixta, los terrenos que comprenden el\nárea ubicada en los distritos de Jacó y Tárcoles, cantón de Garabito,\nprovincia de Puntarenas demarcada con base en la Hoja Cartográfica\nTárcoles, 3245II del mapa básico de Costa Rica escala 1:50.000, edición\n2 del Instituto Geográfico Nacional y cuyo detalle de linderos se\ndescribe seguidamente:\n\n \n\nZona Privada: Se inicia al final de la zona\nrestringida que demarca del mojón 497 del Instituto Geográfico Nacional,\ndirección noreste, en el vértice 119 del plano sin catastrar que consta en este\nexpediente con coordenadas aproximadas (462716 E y 185207 N), de allí hacía al\nsureste con un azimut de 19° aproximadamente, hasta llegar al vértice 123\n(462884 E - 185184 N), de aquí hasta el vértice 125 (463224 E - 185013 N) en\ndirección este. Posteriormente el lindero continúa en línea recta hacia el\nsureste llegando al vértice 129 (463224 E - 185013 N), después en la línea\nrecta hacia el este hasta al vértice 135 (463380 E - 185023 N), sigue al\nsureste hasta llegar al vértice 139 (463440 E - 184994 N), continúa en línea\nrecta hacia al este, llegando al vértice 142 (463508 E - 184994 N), sigue posteriormente\nhacia el sur al vértice 158 (463547 E - 184842 N), continúa en línea recta\nhacia el sureste hasta el vértice 161 (463584 E - 184800 N), continúa al\nvértice 1 (463550 E - 184759 N) luego hasta el vértice 28 (463658 E - 184498\nN). Del vértice 28 continúa en dirección suroeste hasta el vértice 40 (463637 E\n- 184394 N), posteriormente directo al sureste hasta el vértice 51 (463699 E - 184177\nN), luego hasta el vértice 60 (463554 E -184083 N) luego al noreste hasta el\nvértice 62 (463573 E - 184102 N), de allí al vértice 63 (463574 E - 184151 N),\nen este se inicia una curva constituida por los siguientes vértices y los\npuntos: 64 (463553 E - 184175 N); 5 (463555 E - 184188 N); 66 (463579 E -\n184197 N); 67 (463593 E - 184226 N) y de estos hasta el vértice 80 (463547 E -\n184491 N) de allí hasta el vértice 85 (463436 E - 184529 N), continuando hacia el\nsureste hasta el vértice 89 (463302 E - 184496 N), posteriormente al vértice 93\n(463199 E - 184376 N) hasta topar con zona restringida que demarca el mojón\n473. De allí sigue por el límite de la zona restringida que demarca los mojones\ndel 473 al 497. Los valores suministrados de las coordenadas según cuadrícula\nLambert Costa Rica Sur de los linderos supracitados, corresponden a los valores\naproximados, por lo que en el campo deberán ser respetados los linderos\ndescritos por los planos catastrados que en cada caso fueron citados.\n\nZona Marítimo Terrestre: Se proyecta, desde el\nmojón 452, hasta el mojón 499, incluyendo la Zona Restringida y la Zona\nPública.\n\nArtículo 2º-El manejo y aprovechamiento de la\nvida silvestre será responsabilidad de una Comisión Bipartita conformada por la\npropietaria del inmueble y el Sistema Nacional de Áreas de Conservación y\nestará sujeto al Plan de Manejo aprobado por el Sistema Nacional de Áreas de Conservación;\nel cual será revisado en forma bianual. La visita de\nparticulares a éste refugio requerirá de un permiso escrito del dueño.\n\nArtículo 4º-Dichos terrenos estarán sometidos a la categoría de Refugio Nacional de Vida Silvestre\nde categoría mixta durante un período, de diez años prorrogables por períodos iguales, para lo cual\nla propietaria privada deberá solicitarlo con un mes de antelación a la finalización de dicho\nperíodo ante el Sistema Nacional de Áreas de Conservación.\n\nArtículo 5º-Rige a partir de su publicación.\n\n \n\nDado en la Presidencia de la República.-San\nJosé, a los veintiocho días del mes de junio del dos mil cinco.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Regulation 32611\n\n Declares \"Ara Macao\" National Wildlife Refuge\n\nComplete Text act: 9371E\nN° 32611\n\nN°\n32611\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nIn the exercise of the powers conferred upon us by\narticle 140, subsections 3) and 18) of the Political Constitution and articles\n7, 82, 84 and 87 of the Wildlife Conservation Law, N° 7317, of October 30,\n1992, published in La Gaceta N° 235 of December 7,\n1992, articles 32 and 38 of the Organic Law of the Environment N° 7554, of October 4,\n1995, published in La Gaceta N° 215 of November 13,\n1995, the Ley Forestal and its amendments, N° 7575, dated February 13, 1996, published\nin La Gaceta N° 72 of April 16, 1996 and articles 11, 27 and\n28.2.b of the General Law of Public Administration, N° 6227, of May 2,\n1978, and\n\n \n\nConsidering:\n\n \n\n1º-That it is in the interest of the Costa Rican State\nto ensure that all of the country's ecosystems are represented within\nthe system of protected wild areas, particularly within those\nmanagement categories whose purpose is the protection, conservation and management of\nbiodiversity.\n\n2º-That B & A Fiduciarios Sociedad Anónima,\nlegal identification number N° 3-101-304702, registered in the Public Registry, Mercantile\nRegistry volume 1340, is the owner of the farm that corresponds to cadastral plan N°\nP-927086-2004 and which has an area according to the plan of 64 hectares with 5\n539.67 square meters, registered under Folio Real Nº 6020175-000, located in\ndistrict one Jacó, canton Garabito, province of Puntarenas. That from this parent farm\nit separated a farm for tourism development with an area of 25 hectares\n5,227.72 square meters, which corresponds to cadastral plan Nº\nP-982065-2005. The remainder of the farm, with an area of 38 hectares 8,965.15\nsquare meters, is subjected to the Mixed Wildlife Refuge Regime.\n\n3º-That in the absence of demarcation, the\nboundaries were verified in the field, which correspond to the designated coordinates.\n\n4º-That adjacent to this farm is the\nstrip of the Maritime-Terrestrial Zone, in accordance with the delimitation of the\nmarkers of the Instituto Geográfico Nacional between N° 452 and N°\n499, which belongs to the State and which, being covered with forest, forms part of the\nNatural Heritage of the State.\n\n5º-That the rocky system of the indicated coastal zone\nis a natural littoral formation with geological,\nbiological, ecological and scenic characteristics unique in Costa Rica, and must be subject to\nprotection given its susceptibility and biological importance. In preliminary\nstudies, several coral banks were identified with a diversity of species\nof algae, mollusks and echinoderms; as well as important banks of at least 35 species\nof fish.\n\n6º-That said area is mostly covered\nwith primary and advanced secondary forest and scarce areas of pastureland (repastos).\n\n7º-That in preliminary inventories in the\narea, at least 159 plant species have been identified (98 species of\ntrees, 21 species of shrubs, 21 species of vines (bejucos), 3 species of palms,\n2 species of epiphytes and 14 species of herbs). Among the species found,\nPhyllocarpus riedelli stands out, a very rare species that had only been\ncollected in the south of the country and that represents a new record for the Central\nPacific. Other species in danger of extinction were also identified, such as Tachigali\nversicolor and ajillo (Caryocar costarricense); as well as a germplasm\nbank of species of forestry interest. Furthermore, 20\nspecies of reptiles and amphibians were identified (7 species of frogs,\n8 species of lizards and 5 species of snakes), 116 species of birds and 35 species of mammals.\n\n8º-That due to the current state of the natural\nresources of the region and the national opening towards the protection of\nwild areas and regional ecological diversity, it is necessary to preserve\nthat zone in the region.\n\n9º-That the integrated rational management of\nthe natural resources of the area (forests, flora, fauna); contributes to satisfying\nregional needs for research, recreation, environmental\neducation, as well as the utilization of rationally exploited\nnatural resources.\n\n10.-That the administration of wildlife and\nthe recommendation of measures that ensure the perpetuity of species is\na function of the National System of Conservation Areas of the Ministry\nof Environment and Energy\n\n11.-That the owner of the private land\nvoluntarily agreed to join this protection regime for the flora\nand wild fauna for a period of ten years, renewable. Therefore,\n\n \n\nDECREET:\n\n \n\nArticle 1º-The \"Ara Macao\" Mixed-Ownership National Wildlife Refuge (Refugio Nacional de Vida\nSilvestre \"Ara Macao\" de Propiedad Mixta) is hereby declared, for the lands comprising the\narea located in the districts of Jacó and Tárcoles, canton of Garabito,\nprovince of Puntarenas, demarcated based on the Cartographic Sheet\nTárcoles, 3245II of the basic map of Costa Rica, scale 1:50,000, edition\n2 of the Instituto Geográfico Nacional, and whose boundary details are\ndescribed as follows:\n\n \n\nPrivate Zone: It begins at the end of the restricted\nzone demarcated by marker 497 of the Instituto Geográfico Nacional,\nnortheast direction, at vertex 119 of the uncadastered plan contained in this\nfile with approximate coordinates (462716 E and 185207 N), from there towards the\nsoutheast with an azimuth of approximately 19°, until reaching vertex 123\n(462884 E - 185184 N), from here to vertex 125 (463224 E - 185013 N) in\nan easterly direction. The execution of the Management Plan shall be\nsupervised by the Commission, which may indicate future technical and\nscientific provisions that must be followed by the owners.\n\nArticle 3º-The owner of the registered\nproperties undertakes not to develop any activity that deviates from\nthe provisions of the Management Plan, that compromises the existence of the flora and\nfauna, and shall provide all necessary collaboration to researchers and\nofficials of MINAE who visit said area on official business.
