la Ley Forestal (Ley Nº 7575, publicada en La Gaceta Nº\n72 del 16 de abril de 1996); la Ley de Biodiversidad (Ley Nº 7788, publicada en\nLa Gaceta Nº 101, del 27 de mayo de 1998); y el Convenio sobre la\nDiversidad Biológica rati.cado por Costa Rica en el año 1994, mediante la Ley\nNº 7416, publicada en La Gaceta Nº 143, del 28 de julio de 1994.\n\n \n\nConsiderando:\n\n \n\n1º-Que\nla Ley de Conservación de la Vida Silvestre, en sus artículos 3º, 4º, 5º y 36\nal 51, faculta al Ministerio de Ambiente y Energía otorgar permisos de\ninvestigación científica, otorgar licencias por recolecta científica, a establecer\nlos requisitos por trámites y procedimientos para otorgar dichos permisos, a\ninscribir y registrar las investigaciones y a otorgar permisos de importación y\nexportación de flora y fauna, entre otros.\n\n 2º-Que el Reglamento de Investigaciones del Servicio\nde Parques Nacionales, en sus artículos del 1º al 19, establece el\nprocedimiento para realizar investigaciones en los Parques Nacionales y\nReservas Biológicas. \n\n3º-Que\nel Reglamento a la Ley de Conservación de la Vida Silvestre, en el artículo 27\nestablece los requisitos para inscribir investigaciones. \n\n4º-Que\nla Ley Orgánica del Ambiente, en sus artículos 15, 16, 26, inciso a), 35,\ninciso d), 36, 46, inciso d, declaran el interés del Estado en la promoción y\nmantenimiento de las acciones de investigación y en el artículo 47 declara de\ninterés público las acciones de investigación. \n\n5º-Que\nla Ley Forestal en los artículos 6º, inciso e); inciso h), inciso i), inciso\nj), 18, 37 y 38, inciso e), establecen acciones de investigación que son\ncompetencias de la Administración Forestal del Estado.\n\n 6º-Que la Ley de Biodiversidad, en los\nartículos 6º, 44, 47, 50, 55 y 89, otorga potestades para llevar a cabo\nacciones de investigación al Ministerio del Ambiente y Energía.\n\n7º-Que\nCosta Rica suscribió la Convención sobre la Diversidad Biológica, con lo el\npaís adquiere la responsabilidad de realizar acciones en materia de\ninvestigación, transferencia tecnológica e información (artículos 12, 13, 15,\n16, 17 y 18).\n\n8º-Que\nse creó el Comité Técnico de Investigaciones del Sistema Nacional de Áreas de\nConservación, con las funciones descritas en el Decreto Ejecutivo Nº 28993,\npublicado en La Gaceta Nº 203 del 24 de octubre del 2000.\n\n9º-Que\nes prioridad y responsabilidad del Ministerio del Ambiente y Energía, la promoción\nde la investigación básica y aplicada, que resulte en un mayor conocimiento de\nlos recursos naturales (renovables y no renovables) y culturales del país.\n\n10.-Que\nlas investigaciones básicas y aplicadas contribuyen a proteger, conservar y\nmanejar la biodiversidad y los recursos culturales, dentro y fuera de las Áreas\nSilvestres Protegidas, que son administrados por el Ministerio del Ambiente y\nEnergía.\n\n11.-Que\nes función del Ministerio del Ambiente y Energía contribuir al desarrollo\nsocial y económico del país, a través de la investigación y a la divulgación y\naplicación de sus resultados.\n\n12.-Que\nla investigación es un proceso identificado en la Estrategia Nacional de\nBiodiversidad y es un eje prioritario en materia de cooperación nacional e\ninternacional.\n\n \n\nDECRETAN:\n\n \n\nEl\nsiguiente,\n\n \n\nManual de\nProcedimientos para realizar Investigación\n\nen\nBiodiversidad y Recursos Culturales\n\nen las Áreas\nde Conservación\n\n \n\nCAPÍTULO I\n\nDisposiciones\ngenerales\n\n \n\nArtículo\n1º-Objetivo. Establecer las normas y procedimientos en materia de\ninvestigación en biodiversidad y recursos culturales asociados; para trámite,\nevaluación, seguimiento y supervisión de los permisos de investigación que sean\notorgados por el Sistema Nacional de Áreas de Conservación.\n\nArtículo\n2º-Alcance. Este procedimiento se aplicará a toda solicitud de permisos\nde investigación, trámite correspondiente, su análisis, evaluación, resolución\ny seguimiento a efectuarse en todas las oficinas regionales del Sistema\nNacional de Áreas de Conservación (SINAC), o a nivel de SINAC Central, cuando\nproceda.\n\nArtículo\n3º-Exclusiones. Se excluyen de este procedimiento los permisos de acceso\na los elementos y recursos genéticos y bioquímicos de la biodiversidad los\ncuales serán regulados por la Ley de Biodiversidad y el Decreto Ejecutivo Nº\n31514-MINAE referente a \"Normas Generales para el Acceso a los Elementos y\nRecursos Genéticos y Bioquímicos de la Biodiversidad\", publicado en La\nGaceta Nº 241 del 15 de diciembre del año 2003.\n\nArtículo\n4º-Autoridad competente. Es competencia del Sistema Nacional de Áreas de\nConservación proponer las políticas, normas y procedimientos para regular,\nevaluar, otorgar o denegar y dar seguimiento a los permisos de investigación en\nbiodiversidad, tal como se establece en la normativa vigente en materia de\ninvestigación científica.\n\nArtículo\n5º-Definiciones\n\n \n\n1)\nBiodiversidad: Variabilidad de organismos vivos de cualquier fuente, ya\nsea que se encuentren en ecosistemas terrestres, aéreos, marinos, acuáticos o\nen otros ambientes ecológicos. Comprende la diversidad dentro de cada especie,\nasí como entre las especies y los ecosistemas de los que forman parte (Ley de\nBiodiversidad, artículo 7º, inciso 2)).\n\n \n\n2)\nCaptura científica: Captura temporal del individuo en estudio en la que\nse aplica un método riguroso que asegura que su uso no dañará ni temporal ni\npermanentemente la población de la especie y luego el individuo se libera en\nlas condiciones y lugares en que fuera capturado o en otro lugar previamente\nautorizado.\n\n \n\n3)\nRecolecta científica: Actividad científica que aplica un método científico\nriguroso, que realiza una colecta permanente de una cantidad determinada de\nindividuos en proceso de estudio, que serán trasladados a laboratorios de\ninvestigación; previa autorización para la colecta y la exportación cuando sea\neste el caso.\n\n \n\n4)\nFicha Técnica: Formulario donde aparecerá toda la información relativa\nal investigador (a) en aquellas investigaciones autorizadas y que se llevará en\nuna base de datos para el seguimiento administrativo y técnico respectivo.\n\n \n\n5)\nPasaporte científico: Documento oficial emitido por los encargados(as)\nde investigación de las Áreas de Conservación o por el Programa de\nInvestigación de SINAC Central, del Sistema Nacional de Áreas de Conservación,\nque busca mantener un registro de los investigadores(as) que realizan\ninvestigación en las Áreas de Conservación. Este contiene la información que\nidentifica a los solicitantes, el título de su investigación y los términos en\nlos que fue aprobada, cantidades y condiciones de captura o recolecta científica,\ncuando corresponda y el sello por los pagos respectivos.\n\n \n\n6)\nRecursos históricos y culturales: Comprende el uso, costumbres y conocimientos\ntradicionales asociados a los recursos naturales, por parte de las comunidades\nlocales y pueblos indígenas. Al rescate del conocimiento popular y las\nrelaciones entre estos recursos y el ser humano. Comprende también todo\nmaterial arqueológico o histórico que se encuentre dentro del territorio\nnacional.\n\n \n\n7)\nSeguimiento Administrativo: Actividades en las que el personal del SINAC-MINAE,\nda seguimiento a los estudios autorizados, una vez concluida la fase de campo;\npara asegurar entre otras cosas la entrega de los informes de avance y de\ninforme final de la investigación.\n\n \n\n8)\nSupervisión Administrativa: Actividad en la que el personal del SINAC-MINAE,\nverifica que las labores que realiza el investigador (a) se encuentran dentro\ndel permiso de investigación y la resolución emitida al respecto. Asimismo,\nverifica que se este brindando al investigador los servicios solicitados y\nautorizados durante el tiempo que realice el trabajo de campo.\n\n \n\n9)\nSupervisión Técnica: Actividad en la que el personal profesional del\nSINAC-MINAE verifica que el investigador (a) esté realizando las labores\ntécnicas descritas en el proyecto de investigación y que le fueron autorizadas.\nPara ello puede apoyarse en las consultas con especialistas. Además vela porque\nla estrategia de comunicación de resultados de investigación, se realice e\nimplemente.\n\n \n\n10)\nSistema Nacional de Áreas de Conservación: Sistema de gestión y\ncoordinación institucional, desconcentrado y participativo, que integrará las\ncompetencias en materia forestal, vida silvestre, áreas protegidas y el\nMinisterio del Ambiente y Energía, con el fin de dictar políticas, planificar y\nejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los\nrecursos naturales de Costa Rica.\n\nCAPÍTULO II\n\n \n\nArtículo\n6º-Integrantes del Comité Técnico de Investigación. El Comité Técnico de\nInvestigación en Biodiversidad y Recursos Culturales del Sistema Nacional de\nÁreas de Conservación; que será nombrado por el Director Ejecutivo del Sistema\nNacional de Áreas de Conservación, estará constituido por:\n\n \n\n1)\nUn coordinador (a) nacional, quien fungirá a su vez como coordinador (a) del\nPrograma de Investigación SINAC y del Comité Técnico de Investigación SINAC.\n\n \n\n2)\nCada uno de los encargados (as) de investigación de las Áreas de Conservación.\n\n \n\n3)\nEl encargado (a) del componente de investigación de la Gerencia de Manejo de\nRecursos Naturales del SINAC.\n\n \n\n4)\nEl encargado (a) del componente de investigación de la Gerencia de Áreas\nSilvestres Protegidas del SINAC.\n\nArtículo\n7º-Funciones del Comité Técnico de Investigación del SINAC:\n\n \n\n1)\nAsesorar como órgano técnico del SINAC en lo concerniente a investigación.\n\n \n\n2)\nPromover, coordinar y facilitar la ejecución y seguimiento de las Estrategias\nRegionales y la Nacional de Investigación en Biodiversidad y Recursos\nCulturales.\n\n \n\n3)\nPropiciar la capacidad de gestión para formular propuestas de cooperación\ntécnica y financiera para la implementación de las estrategias regionales y la\nnacional y otras acciones de investigación.\n\n \n\n4)\nEstablecer canales de coordinación y alianzas estratégicas con universidades,\norganismos, centros de investigación, investigadores independientes, y otros;\npara la implementación de las estrategias.\n\n \n\n5)\nVelar porque los resultados de investigación sean divulgados apropiadamente.\n\n \n\n6)\nPropiciar espacios para la divulgación de la investigación tales como, pero no\nlimitado a: foros, seminarios y otros; nacionales y regionales.\n\n \n\n7)\nApoyar la gestión de los componentes de investigación regionales.\n\n \n\n8)\nMediar y resolver controversias que se susciten entre el permisionario y la\nAdministración, en materia de permisos de investigaciones en las Áreas de\nConservación.\n\n \n\n9)\nParticipar en la definición de políticas, reglamentos, manuales de procedimientos,\nconvenios y otros atinentes a la investigación, dentro del Sistema Nacional de\nÁreas de Conservación.\n\n \n\n10)\nIdentificar la problemática y necesidades de investigación que contribuyan en\nla resolución de las prioridades y de su aplicación en la administración de los\nrecursos naturales en las Áreas de Conservación.\n\n \n\n11)\nPropiciar espacios para la actualización de las estrategias de investigación.\n\n \n\n12)\nPresentar los informes técnicos requeridos por la Unidad de Investigación de la\nDirección del SINAC.\n\n \n\n13)\nPromover la capacitación e intercambio de experiencias en materia de\ninvestigación, en el ámbito nacional e internacional.\n\n \n\n14)\nOtras que le asigne la Dirección Ejecutiva del SINAC.\n\nArtículo 8º-Funciones de los\nEncargados(as) de Investigación de las Áreas de Conservación:\n\n \n\n1)\nTramitar, evaluar y resolver los proyectos de investigación que se presenten\nante su oficina regional, para realizar estudios científicos en su área de\nconservación. Cuando un investigador (a) requiera realizar la misma\ninvestigación en más de un Área de Conservación, el trámite, evaluación y\nresolución, corresponderá al Programa de Investigaciones del SINAC Central.\n\n \n\n2)\nElaborar las resoluciones respectivas y otorgar el pasaporte científico o\nlicencia de recolecta científica; de aquellas solicitudes de investigación que hayan\nsido autorizadas por la Oficina Regional del Área de Conservación, para\nrealizar estudios en ésta.\n\n \n\n3)\nSuscribir Acuerdos de Transferencia de Material (ATM), entre interesados y\nproveedores de los recursos biológicos, en forma obligatoria cuando se trate de\npermisos de exportación de material biológico o para uso local cuando el\nevaluador lo considere necesario según los objetivos del proyecto de investigación\no los fines de la recolecta científica. Estos con el fin de atender mejor el\nregistro y control por trasiego de material biológico.\n\n \n\n4)\nEnviar copia de toda resolución de las investigaciones autorizadas o\nrechazadas, con la respectiva información de material de colecta autorizado, a\nla (las) Área (s) Silvestre (s) Protegida (s) y al Programa de investigaciones\ndel SINAC.\n\n \n\n5)\nMantener actualizada la base de datos regional sobre las investigaciones\nautorizadas y rechazadas. Ésta deberá ser enviada semestralmente al Programa de\nInvestigación del SINAC; donde se establecerá la base de datos nacional.\n\n \n\n6)\nMantener actualizada la lista de investigadores (as) que luego del periodo\nautorizado no han entregado los informes finales de la investigación y dar\nseguimiento a la misma.\n\n \n\n7)\nElaborar la .cha técnica de investigación correspondiente, enviar copia de ésta\na las áreas silvestres protegidas y a las oficinas subregionales donde se\nrealizará el estudio.\n\n \n\n8)\nElaborar y remitir al Programa de investigaciones del SINAC, copia de los\ninformes finales de los estudios autorizados e inventario de resultados de\ninvestigación (documentos inéditos o publicados).\n\n \n\n9)\nCoordinar con las oficinas subregionales y el administrador (a) del Área\nSilvestre Protegida, para que el estudio autorizado pueda realizarse con una\nefectiva relación entre el investigador (a) y estos.\n\n \n\n10)\nEjecutar las labores de supervisión técnica y administrativa que permita\ngarantizar que en la investigación aprobada se realicen aquellas actividades\nque fueron autorizadas.\n\n \n\n11)\nRealizar las labores de seguimiento necesarias durante el período de ejecución\nde la investigación y asegurarse que los investigadores (as) hagan entrega de\nlas copias de documento final de las investigaciones a las Áreas de\nConservación y a la Biblioteca Nacional.\n\n \n\n12)\nCapacitar y brindar información a funcionarios de las subregiones del área de\nconservación y de las áreas silvestres protegidas, sobre procedimientos y\ntrámites de permisos de investigación.\n\n \n\n13)\nDisponer a través de un centro de documentación del área de conservación, de\nlas publicaciones resultado de investigación científica y/o documentos técnicos\ngenerados por los investigadores (as) y el personal del MINAE en materia de\nmanejo y conservación de los recursos naturales.\n\n \n\n14)\nParticipar en las reuniones ordinarias y extraordinarias del Comité Técnico de\nInvestigación del SINAC.\n\n \n\n15)\nPromover conjuntamente con los investigadores (as), la implementación de las\nestrategias de comunicación de resultados de investigación a las Áreas de\nConservación.\n\n \n\n16)\nPromover la investigación científica en su área de conservación; ante universidades,\ninstitutos, organismos, proyectos u organizaciones de investigación, nacionales\no internacionales.\n\n \n\n17)\nAsesorar a la Dirección y al Comité Técnico de su respectiva área de conservación,\nen materia de investigación científica, en apoyo a la toma de decisiones sobre\nlos recursos que administran.\n\nArtículo 9º-Funciones del Programa\nde Investigaciones del SINAC Central:\n\n \n\n1)\nRecibir, evaluar y resolver, previa consulta a las Áreas de Conservación\ninvolucradas; los proyectos de investigación que presenten los (las)\ninvestigadores (as), que soliciten realizar una misma investigación en\ndiferentes Áreas de Conservación.\n\n \n\n2)\nEstablecer una base de datos nacional actualizada de las solicitudes aprobadas\no rechazadas, estudios autorizados, en ejecución e inventario de resultados de\ninvestigación (documentos impresos o inéditos) de estudios que hayan concluido\nen cada Área de Conservación.\n\n \n\n3)\nApoyar a los encargados de los Programas de Investigación de las áreas de\nconservación en las labores de supervisión y seguimiento de los estudios\nautorizados.\n\n \n\n4)\nMantener actualizada la lista nacional de investigadores (as) que luego del\nperiodo autorizado no han entregado las copias de los resultados finales de la\ninvestigación y dar seguimiento.\n\n \n\n5)\nTramitar las solicitudes de exportación e importación según se establece en la\nnormativa vigente, cuando éstas se traten de permisos de recolecta de los\nrecursos de la biodiversidad para fines de investigación científica. Se\nexcluyen de éstas las que competen a la CONAGEBIO para acceso a los elementos y\nrecursos genéticos y bioquímicos de la biodiversidad.\n\n \n\n6)\nSuscribir Acuerdos de Transferencia de Material Biológico (ATM) entre\ninteresados y proveedores de los recursos biológicos, en forma obligatoria\ncuando se trate de permisos de exportación de material biológico o para uso\nlocal cuando el evaluador lo considere necesario según los objetivos del proyecto\nde investigación o los fines de la recolecta científica. Estos con el fin de\natender mejor el registro y control por trasiego de material biológico de\nconformidad con la normativa vigente.\n\n \n\n7)\nMantener una base de datos actualizada de las exportaciones e importaciones\nautorizadas.\n\n \n\n8)\nMantener un listado actualizado de especialistas asesores (as) Ad hoc que\nbrinden y apoyen con criterio técnico científico, a los encargados del Programa\nde Investigaciones de las Áreas de Conservación o a nivel central, cuando\ncorresponda.\n\nArtículo 10.-Funciones del Personal\nde las Áreas Silvestres Protegidas en materia de Investigación:\n\n \n\n1)\nRegistrar el ingreso y salida de investigadores(as) autorizados (as), a las\nÁreas Silvestres Protegidas, siguiendo el formato establecido.\n\n \n\n2)\nVerificar que el investigador (a) cuente con la autorización correspondiente\nsea la copia de la resolución o pasaporte científico.  Si la persona interesada no cuenta con el\npermiso respectivo, se deberá informar sobre el procedimiento, requisitos y\npersonas contacto, para iniciar el trámite respectivo, anotando el nombre y la identificación.\n\n \n\n3)\nLlevar un registro de las muestras que transportan los investigadores (as) o\npersonas autorizadas para la captura o recolecta científica.\n\n \n\n4)\nPrestar la colaboración al investigador (a) respecto a las facilidades de uso\nde instalaciones y servicios que hayan sido previamente autorizados o que el\nárea silvestre protegida tenga la posibilidad de brindar.\n\n \n\n5)\nPresentar reportes trimestrales a los encargados(as) de investigación de las\nÁreas de Conservación, sobre los (las) investigadores (as) que han ingresado al\nÁrea Silvestre Protegida.\n\nCAPÍTULO III\n\nRequisitos y\nprocedimientos para\n\ntramitar permisos de investigación\n\n \n\n \n\nArtículo\n11.-Requisitos\n\n \n\n| Requisito: | Observaciones: | | --- | --- | | Currículum vitae del solicitante | | | | Datos\npersonales, último grado académico, experiencia laboral y científica; publicaciones, entre otros. La entrega de estos informes será requisito para una renovación o nuevos permisos. |\n\n.\n\nArtículo 12.-Procedimiento para\ntramitar un permiso de investigación:\n\n \n\na)\nToda solicitud de permiso para investigación debe presentarse en forma escrita\nante el Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y\nEnergía.\n\n \n\nb)\nCuando se trate de un permiso de investigación que se realice para un área de\nconservación específica deberá presentarse ante la Oficina Regional del Área\nque corresponda. Cuando un investigador (a) requiera realizar la misma\ninvestigación en más de un Área de Conservación, el trámite corresponderá al\nPrograma de Investigaciones del SINAC Central\n\n \n\nc)\nEl usuario presenta el formulario de solicitud de permiso de investigación en\nla Oficina Regional del Área de Conservación correspondiente o al Programa de\nInvestigación del SINAC Central, cuando corresponda. A esta se le adjuntarán\nlos requerimientos antes citados.\n\n \n\nd)\nSi el proyecto cuenta con varios investigadores (as) principales, uno de ellos\ndeberá ser el coordinador que firme la solicitud y ser responsable por los\ncompromisos adquiridos. Los demás deberán ser citados en el mismo como\nco-investigadores(as). Cualquier otra persona participante deberá ser mencionada\nen el formulario como asistente(s), especialmente cuando su estudio requiera el\ningreso a áreas silvestres protegidas estatales.\n\n \n\ne)\nCualquier cambio en la información contenida en dicho formulario será\nobligatorio para el investigador responsable informarlo a la oficina donde\nentregó la solicitud.\n\n \n\nf)\nEn caso de renovación de un permiso de investigación, deberá presentar la\nfórmula del depósito bancario, un nuevo formulario de solicitud de permiso y\ncopia de informe de avance o final si procede de la investigación anterior o\ninforme anual en el caso de estudios que continuarán.\n\n \n\ng)\nFinalizado el trámite y autorizado el estudio o renovación presentadas, el\ninvestigador solicitante recibe un original de la resolución con las\nregulaciones al permiso y un pasaporte científico o licencia de recolecta\ncientífica.\n\nTodo\ninvestigador autorizado deberá presentarse ante la Administración del área silvestre\nprotegida o ante la oficina subregional para reportar su ingreso al área de\nestudio, aún cuando se trate de investigaciones fuera de las Áreas Silvestres\nProtegidas.\n\nArtículo 13.-Análisis de una\nsolicitud de permiso de investigación:\n\n \n\n1)  Análisis administrativo:\n\n \n\na.\nTodos los espacios del formulario deberán estar debidamente llenos o completos\ny cumplir con todos los requisitos anotados anteriormente.\n\n \n\nb.\nSi la solicitud recibida en un área de conservación requiere la consulta de\notras áreas de conservación, del Comité Técnico de Investigación del SINAC o\ndel Programa de Investigación del SINAC Central, remitirá una copia completa\ndel expediente para su estudio y resolución. Si no hay respuesta en los\nsiguientes 8 días naturales de su envío, será resuelta en el Área que\ncorresponda o por el Programa de Investigaciones del SINAC Central, de conformidad\ncon el plazo establecido por el artículo 42 de la Ley de Conservación de la\nVida Silvestre.\n\n \n\nc.\nSi alguno de los requisitos o solicitud de permiso de investigación requiere\nser mejorado o actualizado, se informará al interesado por escrito para que\nproceda según indicación al efecto.\n\n \n\n2)\nAnálisis técnico:\n\n \n\na.\nVerificar que los objetivos y metodología presentados en el proyecto de\ninvestigación, sean compatibles con los objetivos de conservación y protección\nde la biodiversidad, competencia del Ministerio del Ambiente y Energía.\n\n \n\nb.\nRecomendar al investigador, si procede, que presente modificaciones o ajustes a\nla propuesta para que sean compatibles con los objetivos institucionales en\nmateria de investigación.\n\n \n\nc.\nInducir a los investigadores (as) a colaborar con las temáticas identificadas\nen las estrategias regionales y en la nacional de investigación. Esto\nprincipalmente en los casos que el investigador (a) requiere de servicios o\nfacilidades en áreas silvestres protegidas, o solicite exoneraciones de los\ncánones exigidos por investigación dentro de ellas.\n\n \n\nd.\nEl encargado (a) del Programa de Investigaciones del Área de Conservación,\npodrá enviar copia del proyecto de investigación a especialistas en la materia\npara consultas técnicas y poder resolver adecuadamente la solicitud recibida,\ncuando corresponda.\n\n \n\ne.\nEl encargado (a) del Programa de Investigaciones del Área de Conservación,\nprocederá a emitir la resolución respectiva y el pasaporte científico\ncorrespondiente y sus copias serán enviadas al Programa de Investigación del\nSINAC Central y viceversa, si le corresponde resolver a esta última.\n\nArtículo\n14.-Plazos para el trámite y vigencia de permisos:\n\n \n\na)\nUna vez presentados los requisitos para solicitar un permiso de investigación y\nsi al investigador (a) le faltaren documentos, se le otorgan 10 días hábiles\npara aportarlos, sino la solicitud se archivará.\n\n \n\nb)\nEl Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y\nEnergía, contará con 30 días naturales para su resolución a partir de la fecha\nde recibo de la solicitud.\n\n \n\nc) Toda solicitud de licencia para la recolecta científica o cultural deberá contar con la\naprobación escrita, por parte de las autoridades respectivas de la institución en la cual labore o\nestudie el solicitante.  En el caso de extranjeros, la solicitud de licencia deberá ser emitida por\nla entidad correspondiente y autenticada por el representante del servicio consular costarricense.\nEl Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía tramitará las\nsolicitudes de licencia en un período máximo de un mes calendario.\n\n \n\nd)\nLa licencia de recolecta científica o cultural se expedirá por un periodo máximo\nde un año a los nacionales o residentes y hasta por 6 meses a los extranjeros.\nEn ambos casos la licencia podrá ser suspendida por el Sistema Nacional de\nÁreas de Conservación, cuando quien la posea contravenga la normativa vigente\nen la materia o cuando se considere su uso inconveniente para los intereses\nnacionales.\n\n \n\ne)\nSi la solicitud recibida en un área de conservación requiere la consulta de\notras Áreas de Conservación, del Comité Técnico de Investigación del SINAC o\ndel Programa de Investigación del SINAC Central, se remitirá una copia completa\ndel expediente para lo que corresponda.  Si\nno hay respuesta en los siguientes 8 días naturales de su envío, la misma será\nresuelta en el Área que corresponda o por el Programa de Investigaciones del\nSINAC Central.\n\n \n\nf)\nTodo científico o investigador al que se le haya inscrito un proyecto de\ninvestigación deberá rendir informes anuales, cuando la investigación se\nrealice en un periodo mayor a un año, y trimestrales cuando la misma sea\ninferior al año; todo ello ante el Sistema Nacional de Áreas de Conservación,\nlos cuales versarán sobre el estado de avance del proyecto, así como de las\nrecolectas realizadas.  En caso de\nproyectos institucionales, la institución que inscribe el proyecto será\nresponsable de las actividades realizadas por sus funcionarios e investigadores\nasociados dentro del contexto del proyecto de investigación.\n\n \n\ng)\nEl investigador (a) contará con 15 días hábiles, posteriores a la fecha establecida\npara la entrega de los informes requeridos. De necesitar más tiempo el\ninvestigador deberá solicitar en forma razonada y por escrito una ampliación de\nlos plazos establecidos al encargado (a) del Programa de Investigación del Área\nde Conservación o en SINAC Central, según corresponda, quienes contarán con un\nplazo de 8 días naturales para notificar lo resuelto al (a la) investigador\n(a).\n\n \n\nh)\nLos plazos para la entrega de informes se indicarán en la resolución\nrespectiva, por parte del encargado(a) del Programa de Investigaciones del Área\n(as) de Conservación respectiva (s); o del Programa de Investigaciones del\nSINAC Central.\n\n \n\ni)\nCuando un investigador(a) incumpla con los informes que se indiquen, y no se\ncuente con una justificación, el Encargado(a) del Programa de Investigaciones\niniciará los contactos con el investigador para solicitar los informes. De no\ncontar con una respuesta satisfactoria en 15 días naturales, se iniciará la\ncomunicación con la institución o persona que respaldo la investigación a fin\nque responda la excitativa.  En todos los\ncasos, la presentación de informes será requisito para solicitar renovación o\naprobar una nueva solicitud.\n\n \n\nj)\nCuando se detecte irregularidades en la ejecución de un proyecto de investigación,\nserá suspendido temporalmente mientras se analiza la situación. En un plazo no\nmayor a 15 días naturales, se emitirá la resolución final, en la cual se\ndeclarará si el proyecto de investigación científica termina permanentemente.\n\nArtículo 15.-Coordinación para el\nseguimiento de las Investigaciones en cada Área de Conservación.\n\n \n\n1)\nEntre las oficinas subregionales y el encargado(a) del Programa de\ninvestigaciones del Área de Conservación:\n\n \n\na.\nOtorgado el permiso de investigación, se remitirá copia de la ficha técnica y\nla resolución del permiso de investigación a la oficina subregional respectiva.\n\n \n\nb.\nLa oficina subregional llevará un archivo con información sobre las\ninvestigaciones autorizadas incluyendo las fichas técnicas y resoluciones.\n\n \n\nc.\nLa oficina subregional solicitará a los funcionarios(as) bajo su cargo,\ninformación para la elaboración de reportes trimestrales de ingreso de\ninvestigadores(as) al área respectiva y los remite al encargado(a) del Programa\nde Investigaciones del Área de Conservación.\n\n \n\nd.\nLa oficina subregional se comunicará con el encargado(a) del Programa de\ninvestigaciones para consultar cualquier inquietud que se presente en lo\nreferente con estudios científicos, dentro o fuera de las Áreas Silvestres\nProtegidas.\n\n \n\ne.\nLos jefes de las oficinas subregionales deberán aplicar los resultados de\ninvestigaciones en el manejo de los recursos naturales bajo su administración.\n\n \n\nf.\nLos Encargados (as) del Programa de Investigaciones conjuntamente con los jefes\nde las oficinas subregionales del Área de Conservación, deberán identificar\ntemas prioritarios de investigación o información necesarios para la gestión de\nlos recursos naturales en su área.\n\n \n\ng.\nLos Encargados (as) del Programa de Investigaciones conjuntamente con los jefes\nde las oficinas subregionales del Área de Conservación, deberán poner a\ndisposición y planear actividades de transferencia de información a grupos\ncomunales tomadores de decisiones, dentro del ámbito de la oficina subregional\nrespectiva.\n\n \n\n2) Entre el encargado(a) del Programa de investigaciones del Área de\nConservación y las Áreas Silvestres protegidas:\n\n \n\na.\nAprobada la investigación por parte del encargado(a) de investigación del Área\nde Conservación, éste remitirá copia de la ficha técnica y de la resolución\nrespectiva, al Administrador(a) del área silvestre protegida que corresponda.\n\n \n\nb.\nLa administración del área silvestre protegida llevará un expediente con las fichas\ntécnicas y resoluciones enviadas y un libro de ingresos y salidas que deben firmar\nlos investigadores (as), según el formato establecido.\n\n \n\nc.\nLa administración del área silvestre protegida solicitará al investigador (a)\nla identificación que corresponda, el pasaporte científico o la resolución, a\nfin de verificar las condiciones de aprobación del estudio y regular la salida\nde material colectado cuando este sea autorizado. Personas que visitan el área\ncon fines de investigación y que no cuenten con el respectivo permiso serán\ninformadas del procedimiento y los requisitos que deben presentar.\n\n \n\nd.\nEl administrador (a) del Área Silvestre Protegida reportará trimestralmente al\nencargado de investigación del área de conservación, el ingreso de\ninvestigadores (as) al Área Silvestre Protegida.\n\n \n\ne.\nLa administración del área silvestre protegida se comunicará con el\nencargado(a) del Programa de investigaciones para consultar cualquier inquietud\nque se presente en lo referente a estudios científicos.\n\nArtículo\n16.-Supervisión de la investigación autorizada:\n\n \n\na)\nEl encargado (a) del Programa de Investigaciones de cada Área de Conservación\npodrá realizar visitas periódicas a los proyectos de investigación que hayan\nsido autorizados. Para ello contará con el apoyo técnico y logístico, que\nconsistirá en el acompañamiento de personal profesional, transporte y viáticos,\nde la oficina subregional y la administración del área silvestre protegida,\ncuando corresponda.\n\n \n\nb)\nPara efectos de la supervisión, durante cada visita programada se procederá a\ncompletar el formulario de supervisión, el cual deberá firmar el (la)\ninvestigador(a). El original de la formula será entregada al investigador y la\ncopia depositada en el expediente respectivo.\n\n \n\nc)\nEl investigador(a) deberá acatar las indicaciones y recomendaciones establecidas\nen dicha supervisión, así como las ya establecidas en el permiso original y la\nnormativa vigente.\n\n \n\nd)\nCuando se detecte irregularidades en la ejecución de un proyecto de investigación,\nserá suspendido temporalmente mientras se analiza la situación. En un plazo no\nmayor a 15 días naturales, se emitirá la resolución final en la que se declare\nsi el proyecto continúa o si termina en forma permanente.\n\n \n\ne)\nCuando se detecten pequeños cambios que no modifiquen sustancialmente los\ntérminos del permiso, tales como, pero no limitado a registro de participantes,\npequeños ajustes o ampliaciones al proyecto, ampliación de períodos, cambios en\nel cronograma u otro; deberán ser indicados en el formulario de supervisión y\nel investigador (a) informará detalladamente al (a la) encargado (a) del Programa\nde Investigación del Área de Conservación, los ajustes efectuados y su debida\njustificación.\n\n \n\nf)\nDe considerarse que las actividades realizadas afectan los términos del permiso\notorgado, este será suspendido de forma de.nitiva, debiendo aplicarse lo\nestablecido en la normativa vigente. Esto no impedirá la aplicación de otras\nacciones civiles y sanciones previstas por el ordenamiento costarricense.\n\nArtículo\n17.-Seguimiento a los permisos de investigación:\n\n \n\na)\nEl encargado (a) del Programa de Investigaciones mantendrá contacto con el\ninvestigador(a), para solicitar la entrega de los informes respectivos.\n\n \n\nb)\nEl investigador (a) autorizado (a) podrá usar como formato básico el\nestablecido para entrega de informes parciales. El investigador (a) deberá\nentregar como donación 2 copias de las publicaciones que genere con las\ninvestigaciones realizadas en Costa Rica y entregará a la institución, copia de\nla estrategia de comunicación de resultados. \nLas publicaciones deberán enviarse a la Biblioteca Nacional y una al\nÁrea de Conservación donde se realizó la investigación. Si la investigación se\nrealizara en más de un área de Conservación, el investigador deberá entregar\ncopia a las que corresponda.  Los\ninformes de avance, anuales o finales de investigación aplica la normativa\ncorrespondiente en materia de derechos de autor los cuales le pertenecerán al\ninvestigador(a) autorizado. Él (la) encargado(a) del Programa de\nInvestigaciones del Área de Conservación respectiva; o del Programa de\nInvestigaciones del SINAC Central; mantendrá la documentación remitida por el\ninvestigador(a) como información preliminar hasta que la misma sea publicada,\nsi así lo solicita el autor.\n\n \n\nc)\nDe no contarse con informes de avance, el permisionario deberá enviar al (a la)\nencargado (a) del Programa de Investigación del Área de Conservación, una\njustificación indicando las razones por las cuales los informes no se presentan\nen la fecha indicada, ya que de lo contrario se le tendrá como moroso, lo que\nimplica que no se le renueve el permiso otorgado o que no se le apruebe otro\nque solicite para una nueva investigación. Dichos informes serán requisito para\nsolicitar una renovación del permiso otorgado o para la solicitud de una nueva\ninvestigación.\n\n \n\nd)\nLos informes de avance o final deberán entregarse en idioma español.\n\n \n\ne)\nCuando se autorice un estudio hasta por 6 meses, se solicitará sólo un informe\n.nal. En el caso de estudios de más tiempo, se solicitarán dos informes\ntrimestrales y uno final (anual). En todos los casos, la presentación de\ninformes será requisito para solicitar renovación o aprobar una nueva\nsolicitud.\n\n \n\nf)\nEl investigador (a) contará con 15 días hábiles, posteriores a la fecha establecida\npara la entrega del informe requerido. De necesitar más tiempo el investigador\ndeberá solicitar en forma razonada y por escrito una ampliación de los plazos\nestablecidos, al (a la) encargado (a)        del\nPrograma de Investigación del Área de Conservación, quién contará con 8 días\nnaturales para notificar la resolución.\n\n \n\ng)\nLos plazos para la entrega de informes se indicarán en la resolución\nrespectiva, por parte del encargado(a) del Programa de Investigaciones del Área\n(as) de Conservación respectiva (s); o del Programa de Investigaciones del\nSINAC Central.\n\n \n\nh)\nCuando un investigador(a) incumpla con los compromisos indicados, y no se\ncuente con una justificación apropiada y oportuna, el encargado(a) del programa\nde investigaciones iniciará los contactos con el investigador para solicitar\nlos informes. De no contar con una respuesta satisfactoria en 15 días\nnaturales, se iniciará la comunicación con la institución o persona que\nrespaldó la investigación a fin de que responda por la solicitud.\n\n \n\ni)\nNo se aprobará una nueva investigación hasta que el investigador(a) esté al día\ncon sus responsabilidades.\n\n \n\nj)\nLa aprobación de cualquier futura solicitud de permiso del investigador(a) con\ninformes pendientes, estará sujeta a la entrega del mismo. Igual condición\naplicará para renovaciones.\n\nArtículo\n18.-Suspensión de una Investigación Autorizada. Cualquier investigación\npodrá suspenderse en cualquiera de las siguientes situaciones:\n\n \n\na)\nSi registrase información falsa en la solicitud de permiso de investigación o\ncualquiera de los requisitos presentados.\n\n \n\nb)\nSe compruebe que el investigador autorizado se encuentra realizando actividades\nde investigación no autorizadas tales como pero no limitadas a colecta,\naplicación de métodos indebidos.\n\n \n\nc)\nNo se acate las regulaciones establecidas para el área silvestre protegida\ndonde se encuentre realizando el estudio. Ello incluye que se compruebe que ha\ncausado daño o deterioro de alguno de los servicios e infraestructura que se le\nhalla facilitado. Para ello, el Administrador (a) del área silvestre protegida\ncomunicará por escrito la situación al encargado (a) de investigación del Área\nde Conservación.\n\n \n\nd)\nCuando se compruebe que se ha reincidido en la falta o no entrega oportuna de\ninformes de avance o final de investigación de acuerdo con los plazos notificados\npor escrito al investigador; mediante los registros que lleva el encargado de\ninvestigación que corresponda.\n\n \n\ne)\nQue el encargado (a) de investigación del Área de Conservación o del SINAC\nCentral, compruebe que el investigador(a) se encuentre ocultando información o\nutilizando el material biológico o cultural, con otros fines que no son los\nautorizados.\n\n \n\nf)\nNo cancele los cánones respectivos de acuerdo con el decreto de tarifas vigente\no realice colectas no autorizadas o las realice en áreas de conservación no\nautorizadas; lo cual tendrá que ser comprobado por el encargado de\ninvestigación del Área de Conservación respectiva o del SINAC Central.\n\n \n\ng)\nSea reincidente en no portar alguno de los documentos oficiales sea el\npasaporte científico o resolución, que lo acredite como investigador(a)\nautorizado. Para ello, el Administrador (a) del área silvestre protegida\ncomunicará por escrito la situación al encargado (a) de investigación del Área\nde Conservación.\n\n \n\nh)\nCuando se compruebe que el investigador(a) ha incumplido con las indicaciones y\nllamadas de atención que por escrito se le hayan remitido, por parte del\nencargado de investigación del Área de conservación respectiva o del encargado\nde investigación en SINAC Central.\n\n \n\ni)\nRealice actividades de reintroducción de especies sin la debida autorización de\nacuerdo al procedimiento establecido en la normativa vigente. Para ello, el\nAdministrador (a) del área silvestre protegida comunicará por escrito la\nsituación al encargado (a) de investigación del Área de Conservación.\n\n \n\nComprobada\nalguna de las situaciones arriba expuestas, el encargado(a) de investigación\ndel Área de Conservación o del Programa de Investigaciones del SINAC Central,\ninformará a la persona interesada de la suspensión del permiso de investigación\ncon copia a las Áreas de Conservación, cuando proceda. La investigación podrá\ncontinuarse solamente cuando la infracción haya sido corregida de forma\nsatisfactoria para la administración.\n\nDe\nno corregirse la situación se aplicarán las sanciones que para tal efecto establece\nla normativa vigente.\n\nArtículo 19.-Para la entrega de\nInformes de Avance o Finales de las Investigaciones:\n\n \n\na)\nEl investigador deberá presentar el (los) informe (s) parciales y final en las\nfechas indicadas para tal efecto en la resolución que autoriza el estudio, la\nficha técnica y/o el pasaporte científico.\n\n \n\nb)\nSolicitud para cambios en las fechas de entrega de dicha información deberá\nhacerse por escrito previo al vencimiento de la primera de las fechas y\ndirigida al encargado (a) de investigación del Área de Conservación respectiva\no al encargado de investigación del SINAC Central.\n\n \n\nc)\nLos informes de avance podrán presentarse con las guías elaboradas para este\nefecto. El informe final podrá ser el documento publicado.\n\nLos\ninformes de avance se presentarán a los encargados (as) de investigación del\nÁrea de Conservación respectiva. Los documentos finales o publicaciones se\nregirán por lo establecido en el inciso b del artículo 17 de este manual.\n\n \n\nd)\nEl informe de avance o final de investigación deberá entregarse en idioma\nespañol y se presentarán de acuerdo con el inciso anterior.\n\n \n\ne)\nCuando el investigador (a) autorizado (a) no entregue los informes parciales o\ninforme final; recibirá una nota de llamada de atención en la cual se indicará\nla situación y el plazo para atenderla.\n\n \n\nf)\nSi el investigador (a) no entregase alguno de los informes solicitados en el\nplazo establecido no podrá realizar ningún tipo de investigación dentro de las\náreas silvestres protegidas hasta tanto no entregue la documentación pendiente.\n\n \n\ng)\nSi el investigador (a) incumpliera reiteradamente con lo dispuesto por alguno\nde los incisos anteriores, no se aplicará la renovación o nuevo permiso.\n\nArtículo\n20.-Criterios para autorizar o denegar el permiso para recolecta biológica o\ncultural. Los criterios que se considerarán para otorgar o no un permiso de\nrecolecta de material biológico o cultural para efectos de estudios científicos,\na nivel nacional o internacional, dentro o fuera de las áreas silvestres\nprotegidas; serán los siguientes:\n\n \n\nLa especie en estudio (flora o fauna)\ncon intención de colecta se encuentra:\n\n \n\nDeclarada\nen peligro de extinción.\n\n \n\nDeclarada\ncomo poblaciones reducidas.\n\n \n\nDeclarada\no catalogada como especies en peligro, por alguna organización científica o\nacadémica relacionada (WWF, SICA, CCAD, UICN, CITES, otra).\n\n \n\nDentro\ndel grupo de especies carismáticas, representativas o emblemáticas del área de\nconservación donde se solicita la investigación. \n\nDentro\ndel grupo de especies poco estudiados o con poca información sobre su estado\npoblacional.\n\nSe\nencuentren dentro de ecosistemas poco representados o únicos del país.\n\nSe\nencuentren dentro de ecosistemas de valor económico para las comunidades\nlocales (humedales por ejemplo). \n\nReconocidas\ncomo especies endémicas para el Área de Conservación.\n\nReconocidas\ncomo especies de valor comercial para los pobladores aledañas al Área de\nConservación.\n\nSer\ncapturadas con métodos autorizados y de bajo impacto para esa especie, para\notras o para el ecosistema del que forma parte. \n\nSer\ntransportadas de forma adecuada o inadecuada. \nLos métodos propuestos para la colecta o captura no son los idóneos.\n\nQue\nla persona que realiza la colecta demuestre contar con la experiencia suficiente\no cuenta con asesores reconocidos. \n\nEn\nel caso de evidencias culturales (históricas y arqueológicas) se recomienda\nverificar que los investigadores hayan iniciado la solicitud de permiso de\ninvestigación de la comisión arqueológica nacional. En este caso todo el\nmaterial arqueológico deberá ser colectado para ser trasladado al Museo\nNacional de Costa Rica o la Sección de Arqueología de la Universidad de Costa\nRica.\n\n (NOTA:\nMediante\nel artículo 9° del decreto ejecutivo N° 34312 del 6 de febrero de 2008, se\nestablece que se exceptúa al ICE en materia de prohibiciones y condiciones).\n\nArtículo\n21.-Métodos autorizados para recolecta científica. El SINAC autorizará\nlos siguientes métodos para la recolecta científica de fauna silvestre con fines\nde investigación:\n\n \n\na)\nLa utilización de trampas tipo cajón.\n\n \n\nb)\nLas redes de niebla, redes de caída, las impulsadas por cañones, las redes\nagalleras y redes manuales.\n\n \n\nc)\nTodos los métodos permitidos para la caza menor, la pesca y los rifles,\npistolas y cerbatanas equipadas con dardos tranquilizantes.\n\n \n\nd)\nCualquier otro método nuevo que el SINAC autorice expresamente para tal efecto.\n\nArtículo 22.-Métodos para la\nrecolecta o extracción comercial y científica de la flora silvestre:\n\n \n\na)\nPoda.\n\n \n\nb)\nDeshija.\n\n \n\nc)\nFraccionamiento.\n\n \n\nd)\nArranque manual o con instrumentos.\n\n \n\ne)\nOtro método que autorice el SINAC.\n\nArtículo\n23.-El incumplimiento de alguna de estas obligaciones será sancionado por el\nSistema Nacional de Áreas de Conservación del Ministerio del Ambiente, con la\nimposibilidad, para el científico o investigador en forma personal o para la\ninstitución que representa, de obtener las nuevas autorizaciones propuestas, de\nestudios o investigaciones, dentro del territorio nacional hasta por un período\nde dos años. Se estipula lo anterior, sin perjuicio de las otras acciones\nlegales que correspondieren.\n\nArtículo\n24.-Bases de Datos de Investigaciones. El encargado (a) del Programa de\nInvestigaciones de cada Área de Conservación deberá:\n\n \n\na)\nAbrir un expediente a nombre del investigador que realizó el trámite de permiso\nde investigación e incluir en él toda la documentación aportada. Asimismo, el\nPrograma de Investigación del SINAC Central, deberá establecer la base de datos\nnacional.\n\n \n\nb)\nDigitar la información requerida en la base de datos establecida.\n\nTodos\nlos espacios de la base de datos deberán ser completados.\n\n \n\nc)\nEl manual para el uso de la base de datos será elaborado y tendrá que ser\nutilizado en forma obligatoria para el registro y seguimiento de los permisos\nde investigación.\n\n \n\nd)\nLa base de datos de investigación del SINAC, esta conformada por módulos que\ncontengan:\n\n \n\n1.\nFicha del investigador (a): Contendrá toda la información acerca del investigador(a)\ny contiene una ficha al dorso con información complementaria.\n\n \n\n2.\nDatos Administrativos: Datos relativos a las Áreas donde realizará el estudio,\ninicio y termino del estudio, análisis y resolución, entre otros. También\ncontiene información complementaria al dorso.\n\n \n\n3.\nDatos científicos: Corresponde al proyecto de investigación: título, objetivos,\nmetodología, colecta y su justificación, entre otros.  Además al dorso contiene otra información\ncomplementaria.\n\n \n\n4.\nFicha de seguimiento: datos de la relación investigador(a) y encargado(a) de\ninvestigación en las AC respecto al seguimiento del estudio. Mide la eficiencia\nde la tramitología y supervisión.\n\n \n\ne)\nLas bases de datos se mantendrán actualizadas y se emitirán copias de las fichas\ntécnicas al investigador, la subregión, al área silvestre protegida y copia al\nexpediente.\n\n \n\nf) Deberá asegurarse la integridad física y lógica de la base de datos, contando con un respaldo de\nla información digitada y actualizada.  Actualizaciones digitales de la base de datos deberán ser\nenviadas a la base nacional unificada de investigación del SINAC (Programa de Investigación del\nSINAC), cada 6 meses y en formato digital.\n\nAdemás\ncopia de este material podrá ser enviado a cada encargado (a) de Programa de\nInvestigación de cada área de conservación; a todas aquellas oficinas\nsubregionales y áreas silvestres protegidas que dispongan del equipo adecuado.\n\nArtículo\n25.-Formularios para solicitudes y otros documentos. Los formularios\npara realizar las solicitudes de permisos y otra documentación de requisito\nserán elaborados y oficializados por el Sistema Nacional de Áreas de\nConservación y puestos a disposición al usuario mediante forma impresa o\nelectrónica.\n\nArtículo\n26.-Convenios y contratos. Las universidades públicas, centros de\ninvestigación, organismos de investigación u otros, podrán suscribir contratos\no convenios marco en materia de investigación con el MINAE. En estos casos, los\nrepresentantes legales de las universidades o instituciones que se acojan a\neste beneficio, serán penal, administrativa y civilmente responsables por el\nuso del convenio o contratos que se suscriban.\n\nArtículo\n27.-Modifícase el Decreto Ejecutivo Nº 28993-MINAE, publicado en La Gaceta Nº\n203 del 24 de octubre de 2000, en su artículo 2º, sobre la integración del\nComité Técnico de Investigación del Sistema Nacional de Áreas de Conservación,\nque quedará constituido como establece el artículo 6º del presente Decreto.\n\nArtículo\n28.-Rige a partir de su publicación.\n\n \n\n Dado en la Presidencia de la República.-San\nJosé, a los veintinueve días del mes de marzo del dos mil cinco.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Standard 32553\n\n Procedures Manual for Conducting Biodiversity and\nCultural Resources Research in the Conservation Areas\n\nFull Text of record: 9434F\nNo. 32553\n\nNo.\n32553\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nIn accordance with the provisions set forth in subsections 3) and 18) of Article 140 and 146 of the\nPolitical Constitution; the National Parks Service Creation Law (Law No. 6084, published in La Gaceta No. 169 on September 7, 1977);\nthe Research Regulations for the National Parks Service\n(Executive Decree No. 12329-A, published in La Gaceta No. 46 on May 6, 1981); the Wildlife Conservation Law (Law No. 7317\npublished in La Gaceta No. 235 on December 7, 1992); the\nEnvironmental Organic Law (Law No. 7554, published in La Gaceta No. 215 on November 13, 1995); the Forest Law (Ley Forestal, Law No. 7575, published in La Gaceta No.\n72 on April 16, 1996); the Biodiversity Law (Law No. 7788, published in\nLa Gaceta No. 101 on May 27, 1998); and the Convention on\nBiological Diversity ratified by Costa Rica in 1994, through Law\nNo. 7416, published in La Gaceta No. 143 on July 28, 1994.\n\n \n\nWhereas:\n\n \n\n1st- That the Wildlife Conservation Law, in its Articles 3, 4, 5, and 36 to 51, empowers the Ministry of Environment and Energy to grant scientific research permits, grant scientific collection licenses, establish the requirements for processing and procedures to grant such permits, register and record research, and grant import and export permits for flora and fauna, among others.\n\n 2nd- That the Research Regulations of the National Parks Service, in its Articles 1 to 19, establishes the procedure for conducting research in National Parks and Biological Reserves. \n\n3rd- That the Regulations to the Wildlife Conservation Law, in Article 27, establishes the requirements for registering research projects.\n\n4th- That the Environmental Organic Law, in its Articles 15, 16, 26, subsection a), 35, subsection d), 36, 46, subsection d, declares the State's interest in the promotion and maintenance of research activities, and in Article 47 declares research activities to be of public interest.\n\n5th- That the Forest Law in Articles 6, subsection e); subsection h), subsection i), subsection j), 18, 37, and 38, subsection e), establishes research activities that fall under the jurisdiction of the State Forest Administration.\n\n 6th- That the Biodiversity Law, in Articles 6, 44, 47, 50, 55, and 89, grants powers to the Ministry of Environment and Energy to carry out research activities.\n\n7th- That Costa Rica signed the Convention on Biological Diversity, through which the country acquires the responsibility to carry out actions in the field of research, technology transfer, and information (Articles 12, 13, 15, 16, 17, and 18).\n\n8th- That the Technical Research Committee of the National System of Conservation Areas was created, with the functions described in Executive Decree No. 28993, published in La Gaceta No. 203 on October 24, 2000.\n\n9th- That the promotion of basic and applied research, which results in greater knowledge of the country's natural (renewable and non-renewable) and cultural resources, is a priority and responsibility of the Ministry of Environment and Energy.\n\n10.- That basic and applied research contributes to protecting, conserving, and managing biodiversity and cultural resources, within and outside of the Protected Wild Areas administered by the Ministry of Environment and Energy.\n\n11.- That it is a function of the Ministry of Environment and Energy to contribute to the social and economic development of the country, through research and the dissemination and application of its results.\n\n12.- That research is a process identified in the National Biodiversity Strategy and is a priority axis in regard to national and international cooperation.\n\n \n\nHEREBY DECREE:\n\n \n\nThe following,\n\n \n\nProcedures Manual for Conducting Research\n\non Biodiversity and Cultural Resources\n\nin the Conservation Areas\n\n \n\nCHAPTER I\n\nGeneral Provisions\n\n \n\nArticle 1- Objective. To establish the rules and procedures regarding biodiversity and associated cultural resources research, for the processing, evaluation, monitoring, and supervision of research permits granted by the National System of Conservation Areas.\n\nArticle 2- Scope. This procedure shall apply to all requests for research permits, the corresponding process, their analysis, evaluation, resolution, and monitoring, to be carried out in all regional offices of the National System of Conservation Areas (SINAC), or at the SINAC Central level, when applicable.\n\nArticle 3- Exclusions. Access permits for the genetic and biochemical elements and resources of biodiversity are excluded from this procedure, which shall be regulated by the Biodiversity Law and Executive Decree No. 31514-MINAE regarding \"General Rules for Access to the Genetic and Biochemical Elements and Resources of Biodiversity\", published in La Gaceta No. 241 on December 15, 2003.\n\nArticle 4- Competent Authority. It is the competence of the National System of Conservation Areas to propose the policies, rules, and procedures for regulating, evaluating, granting or denying, and monitoring biodiversity research permits, as established in the current regulations on scientific research.\n\nArticle 5- Definitions\n\n \n\n1) Biodiversity: Variability of living organisms from any source, whether found in terrestrial, aerial, marine, aquatic, or other ecological environments. It comprises diversity within each species, as well as between species and the ecosystems of which they are a part (Biodiversity Law, Article 7, subsection 2).\n\n \n\n2) Scientific capture (Captura científica): Temporary capture of the individual under study in which a rigorous method is applied that ensures its use will not harm, either temporarily or permanently, the population of the species, and the individual is then released under the conditions and in the locations where it was captured or in another previously authorized location.\n\n \n\n3) Scientific collection (Recolecta científica): Scientific activity that applies a rigorous scientific method, involving a permanent collection of a determined quantity of individuals in the study process, which will be transferred to research laboratories, with prior authorization for the collection and export, when applicable.\n\n \n\n4) Technical File (Ficha Técnica): Form containing all the information related to the researcher for those authorized research projects, which will be kept in a database for the respective administrative and technical monitoring.\n\n \n\n5) Scientific passport (Pasaporte científico): Official document issued by the research coordinators of the Conservation Areas or by the Research Program of SINAC Central, of the National System of Conservation Areas, which seeks to maintain a record of researchers conducting research in the Conservation Areas. It contains information identifying the applicants, the title of their research, and the terms under which it was approved, quantities and conditions of scientific capture (captura científica) or scientific collection (recolecta científica), when applicable, and the seal for the respective payments.\n\n \n\n6) Historical and cultural resources: Includes the use, customs, and traditional knowledge associated with natural resources by local communities and indigenous peoples. The recovery of popular knowledge and the relationships between these resources and the human being. It also includes all archaeological or historical material found within the national territory.\n\n \n\n7) Administrative Monitoring (Seguimiento Administrativo): Activities in which SINAC-MINAE personnel monitor the authorized studies, once the field phase is completed, to ensure, among other things, the delivery of progress reports and the final research report.\n\n \n\n8) Administrative Supervision (Supervisión Administrativa): Activity in which SINAC-MINAE personnel verify that the work carried out by the researcher is within the scope of the research permit and the resolution issued regarding it. Likewise, it verifies that the researcher is being provided with the services requested and authorized during the time the field work is performed.\n\n \n\n9) Technical Supervision (Supervisión Técnica): Activity in which the professional staff of SINAC-MINAE verifies that the researcher is performing the technical tasks described in the research project and that were authorized. For this purpose, consultations with specialists may be used. It also ensures that the research results communication strategy is implemented and executed.\n\n \n\n10) National System of Conservation Areas: A deconcentrated and participatory institutional management and coordination system that integrates competencies in forestry, wildlife, protected areas, and the Ministry of Environment and Energy, with the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.\n\nCHAPTER II\n\n \n\nArticle 6- Members of the Technical Research Committee. The Technical Committee for Biodiversity and Cultural Resources Research of the National System of Conservation Areas, which shall be appointed by the Executive Director of the National System of Conservation Areas, shall be composed of:\n\n \n\n1) A national coordinator, who shall also serve as the coordinator of the SINAC Research Program and the SINAC Technical Research Committee.\n\n \n\n2) Each of the research coordinators from the Conservation Areas.\n\n \n\n3) The person in charge of the research component of the SINAC Natural Resources Management Directorate.\n\n \n\n4) The person in charge of the research component of the SINAC Protected Wild Areas Directorate.\n\nArticle 7- Functions of the SINAC Technical Research Committee:\n\n \n\n1) Advise as the technical body of SINAC in matters concerning research.\n\n \n\n2) Promote, coordinate, and facilitate the execution and monitoring of the Regional and National Strategies for Biodiversity and Cultural Resources Research.\n\n \n\n3) Foster management capacity to formulate technical and financial cooperation proposals for the implementation of the regional and national strategies and other research activities.\n\n \n\n4) Establish coordination channels and strategic alliances with universities, organizations, research centers, independent researchers, and others, for the implementation of the strategies.\n\n \n\n5) Ensure that research results are appropriately disseminated.\n\n \n\n6) Facilitate spaces for the dissemination of research, such as, but not limited to: forums, seminars, and others, at national and regional levels.\n\n \n\n7) Support the management of regional research components.\n\n \n\n8) Mediate and resolve disputes that arise between the permit holder and the Administration regarding research permits in the Conservation Areas.\n\n \n\n9) Participate in the definition of policies, regulations, procedures manuals, agreements, and other matters pertaining to research within the National System of Conservation Areas.\n\n \n\n10) Identify research problems and needs that contribute to resolving priorities and their application in the management of natural resources within the Conservation Areas.\n\n \n\n11) Facilitate spaces for updating research strategies.\n\n \n\n12) Present the technical reports required by the Research Unit of the SINAC Directorate.\n\n \n\n13) Promote training and exchange of experiences in research at the national and international levels.\n\n \n\n14) Other functions assigned by the Executive Directorate of SINAC.\n\nArticle 8- Functions of the Research Coordinators of the Conservation Areas:\n\n \n\n1) Process, evaluate, and resolve research projects submitted to their regional office for conducting scientific studies in their conservation area. When a researcher requires conducting the same research in more than one Conservation Area, the processing, evaluation, and resolution shall correspond to the Research Program of SINAC Central.\n\n \n\n2) Prepare the respective resolutions and grant the scientific passport (pasaporte científico) or scientific collection (recolecta científica) license for those research requests that have been authorized by the Regional Office of the Conservation Area for conducting studies therein.\n\n \n\n3) Sign Material Transfer Agreements (MTAs) between interested parties and providers of biological resources, mandatorily when dealing with export permits for biological material or for local use when the evaluator deems it necessary according to the objectives of the research project or the purposes of the scientific collection (recolecta científica). These are for the purpose of better managing the registration and control of the transfer of biological material.\n\n \n\n4) Send a copy of every resolution for authorized or rejected research, with the respective information on authorized collection material, to the relevant Protected Wild Area(s) and to the SINAC Research Program.\n\n \n\n5) Keep the regional database on authorized and rejected research updated. This shall be sent semi-annually to the SINAC Research Program, where the national database will be established.\n\n \n\n6) Keep the list of researchers who have not submitted the final research reports after the authorized period updated and follow up on it.\n\n \n\n7) Prepare the corresponding research technical file (ficha técnica), send a copy thereof to the protected wild areas and to the subregional offices where the study will be conducted.\n\n \n\n8) Prepare and send to the SINAC Research Program copies of the final reports of the authorized studies and an inventory of research results (unpublished or published documents).\n\n \n\n9) Coordinate with the subregional offices and the administrator of the Protected Wild Area so that the authorized study can be carried out with an effective relationship between the researcher and them.\n\n \n\n10) Execute the technical supervision (supervisión técnica) and administrative supervision (supervisión administrativa) tasks that guarantee that only those activities that were authorized are carried out in the approved research.\n\n \n\n11) Perform the necessary monitoring (seguimiento) tasks during the research execution period and ensure that researchers deliver copies of the final research document to the Conservation Areas and the National Library.\n\n \n\n12) Train and provide information to officials of the subregions of the conservation area and of the protected wild areas regarding procedures and processes for research permits.\n\n \n\n13) Maintain, through a documentation center in the conservation area, the publications resulting from scientific research and/or technical documents generated by researchers and MINAE personnel regarding the management and conservation of natural resources.\n\n \n\n14) Participate in ordinary and extraordinary meetings of the SINAC Technical Research Committee.\n\n \n\n15) Jointly promote with researchers the implementation of strategies for communicating research results to the Conservation Areas.\n\n \n\n16) Promote scientific research in their conservation area to universities, institutes, organizations, projects, or national or international research organizations.\n\n \n\n17) Advise the Directorate and the Technical Committee of their respective conservation area on scientific research matters, supporting decision-making regarding the resources they administer.\n\nArticle 9- Functions of the Research Program of SINAC Central:\n\n \n\n1) Receive, evaluate, and resolve, after consulting the involved Conservation Areas, research projects submitted by researchers requesting to conduct the same research in different Conservation Areas.\n\n \n\n2) Establish an updated national database of approved or rejected applications, authorized studies, studies in execution, and inventory of research results (printed or unpublished documents) of studies that have concluded in each Conservation Area.\n\n \n\n3) Support the coordinators of the Research Programs of the conservation areas in the supervision (supervisión) and monitoring (seguimiento) tasks for authorized studies.\n\n \n\n4) Keep the national list of researchers who have not submitted copies of the final research results after the authorized period updated and follow up.\n\n \n\n5) Process export and import requests as established in current regulations, when these involve collection permits for biodiversity resources for scientific research purposes. Excluded from these are those falling under the purview of CONAGEBIO for access to the genetic and biochemical elements and resources of biodiversity.\n\n \n\n6) Sign Biological Material Transfer Agreements (MTAs) between interested parties and providers of biological resources, mandatorily when dealing with export permits for biological material or for local use when the evaluator deems it necessary according to the objectives of the research project or the purposes of the scientific collection (recolecta científica). These are for the purpose of better managing the registration and control of the transfer of biological material in accordance with current regulations.\n\n \n\n7) Maintain an updated database of authorized exports and imports.\n\n \n\n8) Maintain an updated list of ad hoc specialist advisors who provide and support the coordinators of the Research Program of the Conservation Areas or at the central level with scientific and technical criteria, when applicable.\n\nArticle 10.- Functions of Personnel of the Protected Wild Areas in Research Matters:\n\n \n\n1) Record the entry and exit of authorized researchers to the Protected Wild Areas, following the established format.\n\n \n\n2) Verify that the researcher has the corresponding authorization, whether a copy of the resolution or scientific passport (pasaporte científico). If the interested person does not have the respective permit, they must be informed about the procedure, requirements, and contact persons to initiate the respective process, noting their name and identification.\n\n \n\n3) Keep a record of the samples transported by researchers or authorized persons for scientific capture (captura científica) or scientific collection (recolecta científica).\n\n \n\n4) Provide collaboration to the researcher regarding the use of facilities and services that have been previously authorized or that the protected wild area is able to offer.\n\n \n\n5) Present quarterly reports to the research coordinators of the Conservation Areas regarding the researchers who have entered the Protected Wild Area.\n\nCHAPTER III\n\nRequirements and Procedures for\n\nProcessing Research Permits\n\n \n\n \n\nArticle 11.- Requirements\n\n \n\n| Requirement: | Observations: |\n| --- | --- |\n| Applicant's curriculum vitae | | | Personal data, highest academic degree, work and scientific experience; publications, among others. The submission of these reports is a requirement for a renewal or new permits. |\n\n.\n\nArticle 12.- Procedure for Processing a Research Permit:\n\n \n\na) Every research permit application must be submitted in writing to the National System of Conservation Areas of the Ministry of Environment and Energy.\n\n \n\nb) When it concerns a research permit to be conducted for a specific conservation area, it must be submitted to the corresponding Regional Office of that Area. When a researcher requires conducting the same research in more than one Conservation Area, the process shall correspond to the Research Program of SINAC Central.\n\n \n\nc) The user submits the research permit application form at the corresponding Regional Office of the Conservation Area or to the Research Program of SINAC Central, when applicable. The aforementioned requirements shall be attached thereto.\n\n \n\nd) If the project involves several principal researchers, one of them must be the coordinator who signs the application and is responsible for the commitments made. The others must be cited in the same application as co-investigators. Any other participating person must be mentioned on the form as an assistant(s), especially when their study requires entry to state protected wild areas.\n\n \n\ne) Any change in the information contained in said form must be reported by the responsible researcher to the office where the application was submitted.\n\n \n\nf) In case of renewal of a research permit, the bank deposit slip, a new permit application form, and a copy of the progress or final report from the previous research, or annual report in the case of studies that will continue, must be presented.\n\n \n\ng) Once the process is completed and the submitted study or renewal is authorized, the applicant researcher receives an original of the resolution with the permit regulations and a scientific passport (pasaporte científico) or scientific collection (recolecta científica) license.\n\nEvery authorized researcher must report to the Administration of the protected wild area or to the subregional office to report their entry to the study area, even when conducting research outside of Protected Wild Areas.\n\nArticle 13.- Analysis of a Research Permit Application:\n\n \n\n1) Administrative Analysis:\n\n \n\na. All spaces on the form must be duly filled in or complete and comply with all the requirements noted above.\n\n \n\nb. If the application received in a conservation area requires consultation with other conservation areas, the SINAC Technical Research Committee, or the Research Program of SINAC Central, a complete copy of the file shall be sent for study and resolution. If no response is received within the next 8 calendar days from its submission, it shall be resolved by the corresponding Area or by the Research Program of SINAC Central, in accordance with the period established by Article 42 of the Wildlife Conservation Law.\n\n \n\nc. If any of the requirements or the research permit application needs to be improved or updated, the interested party shall be informed in writing so they may proceed as indicated accordingly.\n\n \n\n2) Technical Analysis:\n\n \n\na. Verify that the objectives and methodology presented in the research project are compatible with the biodiversity conservation and protection objectives under the competence of the Ministry of Environment and Energy.\n\n \n\nb. Recommend to the researcher, if applicable, that they submit modifications or adjustments to the proposal so that they are compatible with the institutional objectives in research matters.\n\n \n\nc. Encourage researchers to collaborate on the themes identified in the regional and national research strategies. This is mainly in cases where the researcher requires services or facilities in protected wild areas, or requests exoneration from the fees required for research within them.\n\n \n\nd. The coordinator of the Conservation Area Research Program may send a copy of the research project to specialists in the field for technical consultations in order to properly resolve the application received, when applicable.\n\n \n\ne. The coordinator of the Conservation Area Research Program shall proceed to issue the respective resolution and the corresponding scientific passport (pasaporte científico), and copies shall be sent to the Research Program of SINAC Central, and vice versa if it falls to the latter to resolve.\n\nArticle 14.- Deadlines for Processing and Validity of Permits:\n\n \n\na) Once the requirements for applying for a research permit have been submitted, and if the researcher is missing documents, they are granted 10 business days to provide them, otherwise the application will be archived.\n\n \n\nb) The National System of Conservation Areas of the Ministry of Environment and Energy shall have 30 calendar days for its resolution from the date of receipt of the application.\n\n \n\nc) Every application for a scientific or cultural collection license must have written approval from the respective authorities of the institution where the applicant works or studies. In the case of foreigners, the license application must be issued by the corresponding entity and authenticated by the representative of the Costa Rican consular service. The National System of Conservation Areas of the Ministry of Environment and Energy shall process the license applications within a maximum period of one calendar month.\n\n \n\nd) The scientific or cultural collection license shall be issued for a maximum period of one year for nationals or residents and up to 6 months for foreigners. In both cases, the license may be suspended by the National System of Conservation Areas if the holder contravenes current regulations on the matter or when its use is considered inconvenient for national interests.\n\ne)\nIf the request received in a conservation area requires consultation with other Conservation Areas, the SINAC Technical Research Committee, or the SINAC Central Research Program, a complete copy of the case file will be forwarded for the appropriate action. If there is no response within the following 8 calendar days of its submission, the matter will be resolved in the corresponding Area or by the SINAC Central Research Program.\n\nf)\nEvery scientist or researcher who has had a research project registered must submit annual reports, when the research is conducted over a period longer than one year, and quarterly reports when it is less than one year; all of this before the National System of Conservation Areas, which shall cover the project's state of progress, as well as the collections made. In the case of institutional projects, the institution registering the project will be responsible for the activities carried out by its officials and associated researchers within the context of the research project.\n\ng)\nThe researcher will have 15 business days, following the date established for the delivery of the required reports. If the researcher needs more time, they must request, in a reasoned and written form, an extension of the established deadlines from the person in charge of the Research Program of the Conservation Area or in SINAC Central, as applicable, who will have a period of 8 calendar days to notify the decision to the researcher.\n\nh)\nThe deadlines for the delivery of reports will be indicated in the respective resolution, by the person in charge of the Research Program of the respective Conservation Area(s); or by the SINAC Central Research Program.\n\ni)\nWhen a researcher fails to comply with the indicated reports, and there is no justification, the Person in Charge of the Research Program will initiate contacts with the researcher to request the reports. If there is no satisfactory response within 15 calendar days, communication will be initiated with the institution or person who endorsed the research in order for them to respond to the request. In all cases, the submission of reports will be a requirement for requesting a renewal or approving a new application.\n\nj)\nWhen irregularities are detected in the execution of a research project, it will be temporarily suspended while the situation is analyzed. Within a period not exceeding 15 calendar days, the final resolution will be issued, in which it will be declared whether the scientific research project is terminated permanently.\n\nArticle 15.-Coordination for the follow-up of Research in each Conservation Area.\n\n1)\nBetween the subregional offices and the person in charge of the Research Program of the Conservation Area:\n\na.\nOnce the research permit is granted, a copy of the technical data sheet and the research permit resolution will be forwarded to the respective subregional office.\n\nb.\nThe subregional office will keep a file with information on the authorized research, including the technical data sheets and resolutions.\n\nc.\nThe subregional office will request from the officials under its charge, information for the preparation of quarterly reports on the entry of researchers into the respective area and will forward them to the person in charge of the Research Program of the Conservation Area.\n\nd.\nThe subregional office will communicate with the person in charge of the Research Program to consult on any concerns that may arise regarding scientific studies, inside or outside of the Protected Wilderness Areas.\n\ne.\nThe heads of the subregional offices must apply the research results in the management of the natural resources under their administration.\n\nf.\nThe Persons in Charge of the Research Program, jointly with the heads of the subregional offices of the Conservation Area, must identify priority research topics or information necessary for the management of natural resources in their area.\n\ng.\nThe Persons in Charge of the Research Program, jointly with the heads of the subregional offices of the Conservation Area, must make available and plan information transfer activities to community decision-making groups, within the scope of the respective subregional office.\n\n2)\nBetween the person in charge of the Research Program of the Conservation Area and the Protected Wilderness Areas:\n\na.\nOnce the research is approved by the person in charge of research of the Conservation Area, they will forward a copy of the technical data sheet and the respective resolution to the Administrator of the corresponding protected wilderness area.\n\nb.\nThe administration of the protected wilderness area will keep a file with the technical data sheets and resolutions sent and a logbook of entries and exits that the researchers must sign, according to the established format.\n\nc.\nThe administration of the protected wilderness area will request from the researcher the corresponding identification, the scientific passport, or the resolution, in order to verify the conditions of the study's approval and regulate the exit of collected material when it is authorized. Persons visiting the area for research purposes who do not have the respective permit will be informed of the procedure and the requirements they must present.\n\nd.\nThe administrator of the Protected Wilderness Area will report quarterly to the person in charge of research of the conservation area, the entry of researchers into the Protected Wilderness Area.\n\ne.\nThe administration of the protected wilderness area will communicate with the person in charge of the Research Program to consult on any concerns that may arise regarding scientific studies.\n\nArticle 16.-Supervision of authorized research:\n\na)\nThe person in charge of the Research Program of each Conservation Area may conduct periodic visits to the research projects that have been authorized. For this purpose, they will have technical and logistical support, which will consist of the accompaniment of professional personnel, transportation, and per diem expenses, from the subregional office and the administration of the protected wilderness area, as applicable.\n\nb)\nFor supervision purposes, during each scheduled visit, the supervision form will be completed, which must be signed by the researcher. The original of the form will be given to the researcher and the copy deposited in the respective case file.\n\nc)\nThe researcher must comply with the instructions and recommendations established in said supervision, as well as those already established in the original permit and the current regulations.\n\nd)\nWhen irregularities are detected in the execution of a research project, it will be temporarily suspended while the situation is analyzed. Within a period not exceeding 15 calendar days, the final resolution will be issued in which it is declared whether the project continues or is permanently terminated.\n\ne)\nWhen small changes are detected that do not substantially modify the terms of the permit, such as, but not limited to, the registration of participants, small adjustments or extensions to the project, extension of periods, changes in the schedule, or others; these must be indicated in the supervision form, and the researcher will inform, in detail, the person in charge of the Research Program of the Conservation Area of the adjustments made and their due justification.\n\nf)\nIf it is considered that the activities carried out affect the terms of the granted permit, it will be definitively suspended, and the provisions of the current regulations must be applied. This will not prevent the application of other civil actions and sanctions provided for by the Costa Rican legal system.\n\nArticle 17.-Follow-up on research permits:\n\na)\nThe person in charge of the Research Program will maintain contact with the researcher to request the delivery of the respective reports.\n\nb)\nThe authorized researcher may use the established format as a basic format for the delivery of partial reports. The researcher must donate 2 copies of the publications generated by the research conducted in Costa Rica and will deliver to the institution a copy of the results communication strategy. The publications must be sent to the National Library and one to the Conservation Area where the research was conducted. If the research was conducted in more than one Conservation Area, the researcher must deliver a copy to the corresponding ones. The progress, annual, or final research reports are subject to the corresponding regulations on copyright, which will belong to the authorized researcher. The person in charge of the Research Program of the respective Conservation Area, or the SINAC Central Research Program, will maintain the documentation submitted by the researcher as preliminary information until it is published, if so requested by the author.\n\nc)\nIf progress reports are not available, the permit holder must send to the person in charge of the Research Program of the Conservation Area a justification indicating the reasons why the reports are not submitted on the indicated date, since otherwise they will be considered in default, which implies that the granted permit will not be renewed or that another one requested for a new investigation will not be approved. Said reports will be a requirement for requesting a renewal of the granted permit or for the application for a new investigation.\n\nd)\nThe progress or final reports must be submitted in the Spanish language.\n\ne)\nWhen a study is authorized for up to 6 months, only one final report will be requested. In the case of studies of longer duration, two quarterly reports and one final (annual) report will be requested. In all cases, the submission of reports will be a requirement for requesting a renewal or approving a new application.\n\nf)\nThe researcher will have 15 business days, following the date established for the delivery of the required report. If the researcher needs more time, they must request, in a reasoned and written form, an extension of the established deadlines from the person in charge of the Research Program of the Conservation Area, who will have 8 calendar days to notify the resolution.\n\ng)\nThe deadlines for the delivery of reports will be indicated in the respective resolution, by the person in charge of the Research Program of the respective Conservation Area(s); or by the SINAC Central Research Program.\n\nh)\nWhen a researcher fails to comply with the indicated commitments, and there is no appropriate and timely justification, the person in charge of the research program will initiate contacts with the researcher to request the reports. If there is no satisfactory response within 15 calendar days, communication will be initiated with the institution or person who endorsed the research so that they respond to the request.\n\ni)\nA new investigation will not be approved until the researcher is up to date with their responsibilities.\n\nj)\nThe approval of any future permit application from the researcher with pending reports will be subject to the delivery of the same. The same condition will apply to renewals.\n\nArticle 18.-Suspension of Authorized Research. Any research may be suspended in any of the following situations:\n\na)\nIf false information is recorded in the research permit application or any of the submitted requirements.\n\nb)\nIt is verified that the authorized researcher is conducting unauthorized research activities such as, but not limited to, collection, application of improper methods.\n\nc)\nThe regulations established for the protected wilderness area where the study is being conducted are not complied with. This includes verifying that damage or deterioration has been caused to any of the services and infrastructure provided. For this, the Administrator of the protected wilderness area will communicate the situation in writing to the person in charge of research of the Conservation Area.\n\nd)\nWhen it is verified that there has been a recurrence in the failure or untimely delivery of progress or final research reports in accordance with the deadlines notified in writing to the researcher; through the records kept by the corresponding person in charge of research.\n\ne)\nThat the person in charge of research of the Conservation Area or SINAC Central verifies that the researcher is hiding information or using the biological or cultural material for purposes other than those authorized.\n\nf)\nFails to pay the respective fees in accordance with the current fee decree or makes unauthorized collections or makes them in unauthorized conservation areas; which will have to be verified by the person in charge of research of the respective Conservation Area or SINAC Central.\n\ng)\nIs a repeat offender in not carrying any of the official documents, whether the scientific passport or resolution, that accredit them as an authorized researcher. For this, the Administrator of the protected wilderness area will communicate the situation in writing to the person in charge of research of the Conservation Area.\n\nh)\nWhen it is verified that the researcher has failed to comply with the instructions and warnings that have been sent in writing by the person in charge of research of the respective Conservation Area or by the person in charge of research in SINAC Central.\n\ni)\nCarries out species reintroduction activities without the proper authorization according to the procedure established in the current regulations. For this, the Administrator of the protected wilderness area will communicate the situation in writing to the person in charge of research of the Conservation Area.\n\nOnce any of the situations described above is verified, the person in charge of research of the Conservation Area or the SINAC Central Research Program will inform the interested party of the suspension of the research permit, with a copy to the Conservation Areas, when applicable. The research may only be continued when the infraction has been corrected to the satisfaction of the administration.\n\nIf the situation is not corrected, the sanctions established for this purpose by the current regulations will be applied.\n\nArticle 19.-For the delivery of Progress or Final Reports of the Research:\n\na)\nThe researcher must present the partial and final report(s) on the dates indicated for this purpose in the resolution authorizing the study, the technical data sheet, and/or the scientific passport.\n\nb)\nA request for changes in the delivery dates of said information must be made in writing prior to the expiration of the first of the dates and addressed to the person in charge of research of the respective Conservation Area or to the person in charge of research of SINAC Central.\n\nc)\nProgress reports may be submitted using the guides prepared for this purpose. The final report may be the published document.\n\nProgress reports will be submitted to the persons in charge of research of the respective Conservation Area. The final documents or publications will be governed by the provisions of subsection b of article 17 of this manual.\n\nd)\nThe progress or final research report must be delivered in the Spanish language and will be submitted in accordance with the previous subsection.\n\ne)\nWhen the authorized researcher does not deliver the partial reports or final report; they will receive a warning notice indicating the situation and the deadline to address it.\n\nf)\nIf the researcher fails to deliver any of the requested reports within the established deadline, they will not be able to conduct any type of research within the protected wilderness areas until they deliver the pending documentation.\n\ng)\nIf the researcher repeatedly fails to comply with the provisions of any of the previous subsections, the renewal or new permit will not be applied.\n\nArticle 20.-Criteria for authorizing or denying the permit for biological or cultural collection. The criteria to be considered for granting or not granting a permit for the collection of biological or cultural material for scientific study purposes, at a national or international level, inside or outside of the protected wilderness areas; will be the following:\n\nThe species under study (flora or fauna) intended for collection is:\n\nDeclared as endangered.\n\nDeclared as having reduced populations.\n\nDeclared or cataloged as endangered species by some related scientific or academic organization (WWF, SICA, CCAD, IUCN, CITES, another).\n\nWithin the group of charismatic, representative, or emblematic species of the conservation area where the research is requested.\n\nWithin the group of little-studied species or species with little information about their population status.\n\nAre found within ecosystems that are poorly represented or unique in the country.\n\nAre found within ecosystems of economic value for local communities (wetlands, for example).\n\nRecognized as endemic species for the Conservation Area.\n\nRecognized as species of commercial value for the residents adjacent to the Conservation Area.\n\nBeing captured using authorized and low-impact methods for that species, for others, or for the ecosystem of which it is a part.\n\nBeing transported adequately or inadequately. The proposed methods for the collection or capture are not suitable.\n\nThat the person carrying out the collection demonstrates having sufficient experience or has recognized advisors.\n\nIn the case of cultural evidence (historical and archaeological), it is recommended to verify that the researchers have initiated the research permit application with the national archaeological commission. In this case, all archaeological material must be collected to be transferred to the Museo Nacional de Costa Rica or the Archaeology Section of the Universidad de Costa Rica.\n\n(NOTE: Pursuant to article 9 of executive decree No. 34312 of February 6, 2008, it is established that ICE is exempted from prohibitions and conditions.)\n\nArticle 21.-Authorized methods for scientific collection. SINAC will authorize the following methods for the scientific collection of wild fauna for research purposes:\n\na)\nThe use of box-type traps.\n\nb)\nMist nets, drop nets, cannon-driven nets, gill nets, and hand nets.\n\nc)\nAll methods permitted for small game hunting, fishing, and rifles, pistols, and blowguns equipped with tranquilizer darts.\n\nd)\nAny other new method that SINAC expressly authorizes for this purpose.\n\nArticle 22.-Methods for the commercial and scientific collection or extraction of wild flora:\n\na)\nPruning.\n\nb)\nSucker removal.\n\nc)\nFractionation.\n\nd)\nManual or instrument-assisted uprooting.\n\ne)\nAnother method authorized by SINAC.\n\nArticle 23.-Failure to comply with any of these obligations will be sanctioned by the National System of Conservation Areas of the Ministry of the Environment, with the impossibility, for the scientist or researcher personally or for the institution they represent, of obtaining the proposed new authorizations, for studies or research, within the national territory for a period of up to two years. The foregoing is stipulated, without prejudice to other legal actions that may apply.\n\nArticle 24.-Research Databases. The person in charge of the Research Program of each Conservation Area must:\n\na)\nOpen a case file in the name of the researcher who processed the research permit application and include in it all the documentation provided. Likewise, the SINAC Central Research Program must establish the national database.\n\nb)\nEnter the required information into the established database.\n\nAll spaces in the database must be completed.\n\nc)\nThe manual for the use of the database will be prepared and must be used mandatorily for the registration and follow-up of research permits.\n\nd)\nThe SINAC research database is composed of modules containing:\n\n1.\nResearcher's data sheet: It will contain all the information about the researcher and contains a data sheet on the back with complementary information.\n\n2.\nAdministrative Data: Data relating to the Areas where the study will be conducted, start and end of the study, analysis and resolution, among others. It also contains complementary information on the back.\n\n3.\nScientific data: Corresponds to the research project: title, objectives, methodology, collection and its justification, among others. In addition, on the back it contains other complementary information.\n\n4.\nFollow-up data sheet: data on the relationship between the researcher and the person in charge of research in the Conservation Areas regarding the follow-up of the study. It measures the efficiency of the procedures (tramitología) and supervision.\n\ne)\nThe databases will be kept updated, and copies of the technical data sheets will be issued to the researcher, the subregion, the protected wilderness area, and a copy to the case file.\n\nf)\nThe physical and logical integrity of the database must be ensured, with a backup of the entered and updated information. Digital updates of the database must be sent to the unified national research database of SINAC (SINAC Research Program), every 6 months and in digital format.\n\nAdditionally, a copy of this material may be sent to each person in charge of the Research Program of each conservation area; to all those subregional offices and protected wilderness areas that have the appropriate equipment.\n\nArticle 25.-Forms for applications and other documents. The forms for making permit applications and other required documentation will be prepared and made official by the National System of Conservation Areas and made available to the user in printed or electronic form.\n\nArticle 26.-Agreements and contracts. Public universities, research centers, research organisms, or others may enter into framework contracts or agreements on research matters with MINAE. In these cases, the legal representatives of the universities or institutions that avail themselves of this benefit will be criminally, administratively, and civilly responsible for the use of the agreement or contracts that are signed.\n\nArticle 27.-Executive Decree No. 28993-MINAE, published in La Gaceta No. 203 of October 24, 2000, is amended in its article 2, regarding the composition of the Technical Research Committee of the National System of Conservation Areas, which will be constituted as established in article 6 of this Decree.\n\nArticle 28.-It shall be effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the twenty-ninth day of March, two thousand five." }
