  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 32694\n\n                        Se prohíbe las prácticas de fangueo en las actividades agrícolas del\ndistrito de Riego Arenal\n\nTexto Completo acta: 94691\nNº 32694\n\nNº\n32694\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE AGRICULTURA Y GANADERÍA\n\nY DEL AMBIENTE Y ENERGÍA\n\n \n\nEn ejercicio de las facultades conferidas en los\nartículos 140 incisos 3), 8), 18) y 20) y 146 de la Constitución Política, los\nartículos 25, 27.1, 28.2b, de la Ley Nº 6227 del 2 de mayo de 1978, Ley General\nde la Administración Pública, la Ley Nº 7554 de 4 de octubre de 1995; Ley\nOrgánica del Ambiente, la Ley Nº 6877 de 18 de julio de 1983, Ley de Creación\ndel Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, la Ley Nº 276\ndel 27 de agosto de 1942, Ley de Aguas y la Ley Nº 7779 de 30 de abril de 1998,\nLey de Uso, Manejo y Conservación de Suelos.\n\n \n\nConsiderando:\n\n \n\n1º-Que las prácticas de fangueo que muchos\nagricultores han venido utilizando en el Distrito de Riego Arenal durante la\népoca seca (diciembre a abril), han impedido un manejo, conservación y\nrecuperación adecuados de los suelos, generando un efecto erosivo/degradativo\nsobre el suelo; con arrastre de partículas hacia las partes bajas de las fincas\ny hacia los drenajes naturales y una degradación progresiva de las\ncaracterísticas físicas, químicas y biológicas del suelo, lo cual constituye\nuna limitante para la producción agrícola y la sostenibilidad ambiental.\n\n2º-Que la protección de los suelos y la\nsostenibilidad ambiental de los mismos en el distrito de Riego Arenal, reviste\nparticular importancia debido a su colindancia con el Parque Nacional Palo\nVerde y el Refugio Nacional de Fauna Silvestre Rafael, Lucas Rodríguez, debido\na que el uso, óptimo y justo de los recursos tierra y agua son uno de los\nobjetivos para los que fue creado el distrito.\n\n3º-Que en razón de lo anterior y en aras de la\nprotección del interés público, resulta necesario limitar las prácticas de\nmecanización agrícola que afectan el equilibrio y la relación\nsuelo-agua-ambiente y conforme lo establece la Ley Nº 7779, Ley de Uso, Manejo\ny Conservación de Suelos, corresponde al Ministerio de Agricultura y Ganadería,\nen coordinación con el Ministerio del Ambiente y Energía y demás instituciones\ncompetentes, velar por el cumplimiento de dicha ley en materia de manejo,\nconservación y recuperación de suelos y en particular con el Servicio Nacional\nde Aguas Subterráneas, Riego y Avenamiento, en los distritos de riego, según lo\nestablecido en la Ley Nº 6877.   "body_en_text": "Nº 32694\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF AGRICULTURE AND LIVESTOCK\n\nAND OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred by articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7554 of October 4, 1995, Organic Law of the Environment, Law No. 6877 of July 18, 1983, Law Creating the National Service for Groundwater, Irrigation, and Drainage (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento), Law No. 276 of August 27, 1942, Water Law, and Law No. 7779 of April 30, 1998, Law on the Use, Management, and Conservation of Soils.\n\nConsidering:\n\n1º—That the puddling practices (prácticas de fangueo) that many farmers have been using in the Arenal Irrigation District (distrito de Riego Arenal) during the dry season (December to April) have prevented adequate management, conservation, and recovery of soils, generating an erosive/degradative effect on the soil, with the dragging of particles toward the lower parts of the farms and toward natural drainages, and a progressive degradation of the physical, chemical, and biological characteristics of the soil, which constitutes a constraint for agricultural production and environmental sustainability.\n\n2º—That the protection of soils and their environmental sustainability in the Arenal Irrigation District is of particular importance due to its adjacency to the Palo Verde National Park and the Rafael Lucas Rodríguez National Wildlife Refuge, because the optimal and fair use of land and water resources is one of the objectives for which the district was created.\n\n3º—That by reason of the foregoing and for the sake of protecting the public interest, it is necessary to limit the agricultural mechanization practices that affect the balance and the soil-water-environment relationship, and in accordance with the provisions of Law No. 7779, Law on the Use, Management, and Conservation of Soils, it is the responsibility of the Ministry of Agriculture and Livestock, in coordination with the Ministry of Environment and Energy and other competent institutions, to ensure compliance with said law regarding the management, conservation, and recovery of soils, and in particular with the National Service for Groundwater, Irrigation, and Drainage (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento) in the irrigation districts, as established in Law No. 6877. Therefore,\n\nTHEY DECREE:\n\nArticle 1—Puddling practices (prácticas de fangueo) are hereby prohibited in the agricultural activities of the Arenal Irrigation District, during the period from December to April of each year.\n\nArticle 2—It shall become effective upon its publication.\n\nIssued at the Presidency of the Republic.—San José, on the ninth day of August of two thousand five."
