Ministerio de Obras Públicas y Transportes la competencia en lo\nrelativo a la regulación y control del transporte marítimo internacional, de\ncabotaje y por vías de navegación interior y lo constituye en la autoridad oficial\núnica en todo lo relativo a los objetivos nacionales, haciendo extensiva esa\nautoridad a las actividades de cualquier orden que tengan relación o sean\nconsecuencia de ella.\n\n2º-Que mediante Decreto Ejecutivo Nº 29547-MOPT,\npublicado en La Gaceta Nº 108, del 6 de junio del 2001, se modificaron\nlas funciones de la Dirección de Navegación y Seguridad de la División Marítimo\nPortuaria del Ministerio de Obras Públicas y Transportes y se estableció que la\nprecitada Dirección velará por la adecuada planificación, construcción, operación\ny mantenimiento de los servicios de señalización marítima y ayudas a la\nnavegación en aguas y costas nacionales.\n\n3º-Que mediante Decreto Ejecutivo Nº 31845-MOPT,\npublicado en La Gaceta Nº 119, del 18 de junio del 2004, con el\npropósito de tomar medidas preventivas para evitar las amenazas a los buques e\ninstalaciones portuarias, se incorporó a nuestra legislación nacional el Código\nInternacional para la Protección de las Instalaciones Portuarias, (Código PBIP),\nel cual establece entre otras disposiciones, la necesidad de adoptar medidas\ntendientes a mejorar la protección de las instalaciones portuarias, en este\ncaso la zona a proteger es el Puerto de Punta Morales, en el cual se requiere\nse adopten medidas específicas para prevenir cualquier amenaza o atentado\nterrorista que se pueda producir al arribar a este puerto por vía marítima. Por\ntanto,\n\n \n\nDECRETAN:\n\n \n\nEl siguiente:\n\n \n\nReglamento sobre la Definición de\nuna Zona de\n\nAcceso Restringido y una Zona de\nFondeo en las\n\nCercanías del Muelle en Punta\nMorales\n\n \n\nArtículo 1º-Para los propósitos del presente\nreglamento se tienen las siguientes definiciones:\n\n \n\na) Baliza: Todo instrumento, aparato o cuerpo\ninstalado por la autoridad correspondiente, que sirve para señalar un peligro o\nbrindar indicaciones precisas a la navegación, principalmente a la entrada de ríos,\ncanales y puertos.\n\n \n\nb) Duque de Alba: Elemento proyectado para\ndefensa o amarre, formado por un haz de pilotes hundidos en el fondo marino y\ncuyas cabezas salen fuera del agua y quedan amarradas entre sí formando un\nbloque.\n\n \n\nc) AISM: Siglas de la Asociación Internacional\nde Señalización Marítima. Es una organización internacional no gubernamental\ncuyo objetivo es reunir los servicios de señales marítimas, para velar por la\nmejora y la armonización de las ayudas a la navegación y de los métodos de\ngestión del tráfico marítimo.\n\n \n\nd) Zona de acceso restringido: Área de forma\ncircular en la superficie marítima ubicada en el puerto de Punta Morales, en\ndicha zona se restringe la navegación de embarcaciones menores, tales como\nbotes y lanchas.\n\n \n\ne) Zona de fondeo: Zona marítima con suficiente\nprofundidad para que las embarcaciones internacionales puedan asegurarse o\nmantenerse fijas en la superficie del mar por medio de anclas.\n\nArtículo 2º-Zona de acceso restringido: se define\ncomo un área de forma circular con un radio de 300 metros, cuyo centro se ubica\nen el punto de las coordenadas siguientes:\n\n \n\nLongitud norte: 84º 58' 12\"; latitud oeste: 10º\n03'45.5\". El punto de centro anterior se ubica en el extremo del muelle o la\npantalla de atraque. La ubicación de dicha zona deberá aparecer señalada en la carta náutica\nNº CR.007.\n\nArtículo 4º-En la zona de fondeo sólo podrá\nfondear temporalmente aquella embarcación autorizada por la Dirección de\nOperaciones Portuarias del Instituto Costarricense de Puertos del Pacífico\n(INCOP).\n\nArtículo 5º-Se deberán colocar, por parte de la\nAdministración de la Terminal Portuaria, balizas o señales flotantes luminosas\ninformativas a ambos extremos de la zona de acceso restringido, para informar\nal navegante particular que no está permitida la navegación en ésta área ni\ndebajo de la pasarela que comunica la plataforma de atraque con las instalaciones\nterrestres. La ubicación aproximada de estas balizas será a trescientos metros\ndel punto definido en el artículo Nº 2 de este decreto, ese equipo deberá\ncumplir con las especificaciones técnicas internacionales que se establecen\nconforme a la AISM. También se podrán colocar balizas luminosas y rótulo en los\nduques de alba existentes, con el mismo propósito de informar y orientar al\nnavegante sobre estas restricciones.\n\nArtículo 6º-El Instituto Geográfico Nacional\n(IGN.) realizará las gestiones pertinentes para que las zonas establecidas en\nel presente decreto figuren en la carta náutica correspondiente.\n\nArtículo 7º-La correcta aplicación del presente\ndecreto será responsabilidad de la Capitanía de Puerto de Puntarenas,\ndependencia que podrá solicitar la colaboración del INCOP para remolcar\ncualquier embarcación que se encuentre en una zona no autorizada y del Servicio\nNacional de Guardacostas del Ministerio de Seguridad Pública para colaborar en\nla vigilancia y resguardo de la operación de remolque o bien para conminar a\nabandonar las zonas restringidas a las embarcaciones que se encuentren\nirregularmente en dichos espacios.\n\nArtículo 8º-El Ministerio de Obras Públicas y\nTransportes, por medio de la Dirección de Navegación y Seguridad de la División\nMarítimo Portuaria brindará la asesoría que la Administración de la Terminal Portuaria\nde Punta Morales le requiera, con el propósito que se adquieran los equipos\nnecesarios para la debida señalización de las áreas descritas en el presente\ndecreto.\n\nArtículo 9º-Las coordenadas mencionadas en este\ndecreto se tomaron con base en la \"Carta Náutica Nº CR-004 de Punta Morales. Proyección\nMercator, Datum Norteamericano de 19271, escala 1:10 000\", elaborada según\nlevantamiento en 1975-76 por la Dirección General de Obras Portuarias, del\nMinisterio de Obras Públicas y Transportes en colaboración con el U.S. Naval\nOceanographic Of.ce (NAVOCEANO), preparada por el Instituto Geográfico Nacional\ncon colaboración del Servicio Geodésico Interamericano (I.A.G.S) e impresa por\nDefense Mapping Agency Hydrographic Center. 1 edición, 1978.\n\nArtículo 10.-Rige a partir de su publicación.\n\nTransitorio único: se establece un plazo de seis\nmeses a partir de la publicación de este decreto ejecutivo para que la\nAdministración del Puerto de Punta Morales proceda a colocar el equipo que\npermita señalar las áreas y puntos marítimos establecidos en este decreto.\n\n \n\nDado en la Presidencia de la República, a los\nveintisiete días del mes de julio del dos mil cinco.", "body_en_text": "en la totalidad del texto\n\n -\n\n Complete Text of Regulation 32698\n\n Regulation on the Definition of a Restricted Access Zone and an\nAnchorage Zone in the Vicinity of the Pier at Punta Morales\n\nComplete Text of Act: 946C9\nNº 32698\n\nNº\n32698\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nTHE MINISTER OF PUBLIC WORKS AND TRANSPORT\n\nAND THE MINISTER OF PUBLIC SECURITY\n\n \n\nIn accordance with the powers conferred upon them\nby Articles 140 subsections 3) and 18) and Article 146 of the Political\nConstitution, Articles 1, 2 subsection c) and 3 of the Law for the Creation of the Ministry\nof Public Works and Transport (Law No. 4786 of July 5, 1971 and its\nreforms), the Organic Law of the Ministry of Public Security (Law No. 5482 of December\n24, 1973), the Law of the National Coast Guard Service (Law No. 8000\nof May 5, 2000) and Articles 4, 11, 27, 28.1 and 28.2 subsections a) and b)\nof the General Law of Public Administration (Law No. 6227 of May 2,\n1978) and Executive Decree No. 31845-MOPT, published on June 18, 2004.\n\n \n\nConsidering:\n\n \n\n1º-That Law No. 4786 of July 5, 1971,\nconfers upon the Ministry of Public Works and Transport the competence in\nmatters relating to the regulation and control of international maritime transport,\ncabotage and inland waterway navigation and constitutes it as the sole official\nauthority in all matters relating to national objectives, extending that\nauthority to activities of any kind that are related to or are a consequence\nthereof.\n\n2º-That through Executive Decree No. 29547-MOPT,\npublished in La Gaceta No. 108, of June 6, 2001, the\nfunctions of the Directorate of Navigation and Safety of the Maritime Port\nDivision of the Ministry of Public Works and Transport were modified and it was established that the\naforementioned Directorate shall ensure the adequate planning, construction, operation\nand maintenance of maritime signaling services and aids to\nnavigation in national waters and coasts.\n\n3º-That through Executive Decree No. 31845-MOPT,\npublished in La Gaceta No. 119, of June 18, 2004, with the\npurpose of taking preventive measures to avoid threats to vessels and\nport facilities, the International\nCode for the Security of Ships and Port Facilities (ISPS Code) was incorporated into our national legislation,\nwhich establishes, among other provisions, the need to adopt measures\naimed at improving the security of port facilities, in this\ncase the zone to be protected is the Port of Punta Morales, in which it is required\nthat specific measures be adopted to prevent any threat or terrorist\nattack that could occur when arriving at this port by sea. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nThe following:\n\n \n\nRegulation on the Definition of\na Restricted Access Zone and an\n\nAnchorage Zone in the\nVicinity of the Pier at Punta\nMorales\n\n \n\nArticle 1-For the purposes of this\nregulation, the following definitions apply:\n\n \n\na) Beacon (Baliza): Any instrument, apparatus or body\ninstalled by the corresponding authority, which serves to signal a danger or\nprovide precise indications for navigation, mainly at the entrance of rivers,\nchannels and ports.\n\n \n\nb) Dolphin (Duque de Alba): Element designed for\ndefense or mooring, formed by a bundle of piles driven into the seabed\nand whose heads protrude from the water and are tied together forming a\nblock.\n\n \n\nc) IALA (AISM): Acronym for the International Association\nof Marine Aids to Navigation and Lighthouse Authorities. It is an international non-governmental organization\nwhose objective is to bring together maritime signal services, to ensure the\nimprovement and harmonization of aids to navigation and maritime\ntraffic management methods.\n\n \n\nd) Restricted access zone (Zona de acceso restringido): A circular-shaped area\non the maritime surface located in the port of Punta Morales, in\nsaid zone the navigation of small vessels, such as\nboats and launches, is restricted.\n\n \n\ne) Anchorage zone (Zona de fondeo): Maritime zone with sufficient\ndepth for international vessels to secure themselves or remain\nfixed on the sea surface by means of anchors.\n\nArticle 2-Restricted access zone (Zona de acceso restringido): is defined\nas a circular-shaped area with a radius of 300 meters, whose center is located\nat the point of the following coordinates:\n\n \n\nNorth longitude: 84º 58' 12\"; west latitude: 10º\n03'45.5\". The above center point is located at the end of the pier or the\nberthing screen. In the zone comprised by this circle, the\nnavigation of small boats or private launches is prohibited, especially those that\nusually approach the pier with the aim of passing under the access\nbridge or walkway.\n\nSaid vessels must make a detour,\nskirting the Port facilities at a minimum distance of 300 meters from\nit. Similarly, the anchoring of vessels in the zone defined\nas a restricted access zone is prohibited. Excepted from this prohibition are those\nvessels whose final destination is the facilities of the Port of Punta Morales,\nin which case the shipowner of said vessel or their representative must request\nthe respective authorization from INCOP and the Port Terminal\nAdministration.\n\nArticle 3-Anchorage zone (Zona de fondeo): a circular-shaped anchorage zone (zona de fondeo) is defined,\nwith a radius of 800 meters, whose center is located at\nthe point of the following coordinates: North longitude 84º 58' 00\", west latitude\n10º 02' 30\". The location of said zone must appear indicated on nautical chart\nNo. CR.007.\n\nArticle 4-Only that\nvessel authorized by the Port Operations\nDirectorate of the Costa Rican Institute of Pacific Ports\n(INCOP) may temporarily anchor in the anchorage zone (zona de fondeo).\n\nArticle 5-Informative luminous floating beacons (balizas) or signals\nmust be placed, by the Port Terminal\nAdministration, at both ends of the restricted access zone (zona de acceso restringido), to inform\nthe private navigator that navigation in this area is not permitted, nor\nunder the walkway that connects the berthing platform with the onshore\nfacilities. The approximate location of these beacons (balizas) will be three hundred meters\nfrom the point defined in Article No. 2 of this decree, this equipment must\ncomply with the international technical specifications established\nin accordance with the IALA (AISM). Luminous beacons (balizas) and a sign may also be placed on the\nexisting dolphins (duques de alba), for the same purpose of informing and guiding the\nnavigator about these restrictions.\n\nArticle 6-The National Geographic Institute\n(IGN) shall carry out the pertinent procedures so that the zones established in\nthis decree appear on the corresponding nautical chart.\n\nArticle 7-The correct application of this\ndecree shall be the responsibility of the Port Captaincy of Puntarenas,\nwhich may request the collaboration of INCOP to tow\nany vessel found in an unauthorized zone and of the National\nCoast Guard Service of the Ministry of Public Security to collaborate in\nthe surveillance and safeguarding of the towing operation or to compel\nvessels found irregularly in said spaces to leave\nthe restricted zones.\n\nArticle 8-The Ministry of Public Works and\nTransport, through the Directorate of Navigation and Safety of the Maritime Port\nDivision, shall provide the advisory services that the Port Terminal Administration\nof Punta Morales may require, for the purpose of acquiring the necessary\nequipment for the proper signaling of the areas described in this\ndecree.\n\nArticle 9-The coordinates mentioned in this\ndecree were taken based on the \"Nautical Chart No. CR-004 of Punta Morales.
