  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 28979\n\n                        Prorroga Declaratoria de Refugio de Vida Silvestre Propiedad Mixto, Finca\nBarú del Pacífico por un Período de cinco años\n\nTexto Completo acta: 9569A\nNo 28979-MINAE\n\nNo\n28979-MINAE\n\n \n\nEL PRESIDENTE DE\nLA REPÚBLICA Y LA MINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nEn el ejercicio de\nlas facultades conferidas por el artículo 140, incisos 3) y 18) de la Constitución\nPolítica y con fundamento en lo dispuesto en los artículos 82 y 87, de la Ley de\nConservación de la Vida Silvestre número 7317 de 7 de diciembre de 1992 y los artículos\n6, 11 y 27, de la Ley General de la Administración Pública.\n\nConsiderando:\n\n \n\n1°—Que es\ninterés del Gobierno fortalecer las estructuras administrativas en el campo de los\nrecursos naturales, a fin de contar con políticas definidas que garanticen el uso\nracional de dichos recursos. \n\n2°—Que\nmediante Decreto No 24639-MIRENEM, publicado en la Gaceta No 190 del\n6 de octubre de 1995, se creó el Refugio Nacional de Vida Silvestre, Propiedad Mixto,\nFinca Barú del Pacífico. \n\n3°—Que el\nDecreto citado, establece que la Declaratoria del Refugio, tiene una vigencia de cinco\naños, prorrogables por periodos iguales, previa solicitud de los propietarios\n\n4°—Que el\npropietario solicitó formalmente la prórroga de\nla declaratoria Refugio de Vida Silvestre, Propiedad Mixto, Finca Barú del Pacífico,\npor un periodo de cinco  años prorrogables,\naccediendo voluntariamente a mantener incorporada su propiedad al régimen de protección\nde flora y fauna.\n\n5°—Que dicha\nárea constituye un núcleo muy importante para la\nconservación de la vida silvestre en esa zona.\n\n6°—Que según\ninforme técnico del encargado de Áreas Silvestres Protegidas del Área de Conservación\nPacífico Central, los propietarios del inmueble afectado han cumplido con los compromisos\nde protección y conservación adquiridos con la Declaratoria del Refugio, han realizado\nel manejo y aprovechamiento de la vida silvestre de acuerdo a lo establecido en el Plan de\nmanejo, y en virtud de ello han desarrollado con autorización del Área de Conservación\nPacífico Central, programas de educación\n\nambiental en la\nzona, de manejo en vivero de huevos de tortuga lora, de reforestación de especies\nnativas, actividades de ecoturismo e investigación científica, razones por las cuales\nrecomienda la prórroga de la Declaratoria del Refugio de Vida Silvestre, Propiedad Mixto,\nFinca Barú del Pacífico.\n\n7°—Que la\nprotección de los recursos naturales asociados y el manejo racional integrado de los\nmismos, contribuye a satisfacer las necesidades regionales para la investigación,\nrecreación y educación ambiental.\n\n8°—Que la\nadministración de la vida silvestre y la recomendación de medidas que aseguren la\nperpetuidad de las especies es función del Ministerio del Ambiente y Energía.   "body_en_text": "in the entire text\n\n                    -\n\n                        Complete Text of Regulation 28979\n\n                        Extension of the Declaration of the Mixed-Property Wildlife Refuge, Finca\nBarú del Pacífico for a Period of five years\n\nComplete Text Record: 9569A\nNo 28979-MINAE\n\nNo\n28979-MINAE\n\nTHE PRESIDENT OF\nTHE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn the exercise of\nthe powers conferred by Article 140, subsections 3) and 18) of the Political\nConstitution and based on the provisions of Articles 82 and 87 of the Wildlife\nConservation Law No. 7317 of December 7, 1992, and Articles\n6, 11, and 27 of the General Law of Public Administration.\n\nConsidering:\n\n1°—That it is in the\nGovernment's interest to strengthen administrative structures in the field of natural\nresources, in order to have defined policies that guarantee the rational\nuse of said resources.\n\n2°—That\nthrough Decree No 24639-MIRENEM, published in La Gaceta No 190 of\nOctober 6, 1995, the Mixed-Property National Wildlife Refuge, Finca Barú del Pacífico, was created.\n\n3°—That the\ncited Decree establishes that the Declaration of the Refuge is valid for five\nyears, extendable for equal periods, upon prior request by the owners.\n\n4°—That the\nowner formally requested the extension of\nthe declaration of the Mixed-Property Wildlife Refuge, Finca Barú del Pacífico,\nfor a period of five extendable years,\nvoluntarily agreeing to keep their property subject to the flora and fauna protection regime.\n\n5°—That said\narea constitutes a very important core for the\nconservation of wildlife in that zone.\n\n6°—That according\nto the technical report of the person in charge of Protected Wilderness Areas of the Central Pacific Conservation Area, the owners of the affected property have fulfilled the protection and conservation commitments acquired with the Declaration of the Refuge, have carried out the management and use of wildlife in accordance with the provisions of the Management Plan, and by virtue of this, with authorization from the Central Pacific Conservation Area, have developed environmental education\n\nprograms in the\nzone, management programs in a hatchery (vivero) for olive ridley sea turtle (tortuga lora) eggs, reforestation of native\nspecies, ecotourism activities, and scientific research, reasons for which\nthey recommend the extension of the Declaration of the Mixed-Property Wildlife Refuge, Finca Barú del Pacífico.\n\n7°—That the\nprotection of the associated natural resources and the integrated rational management thereof,\ncontributes to meeting regional needs for research,\nrecreation, and environmental education.\n\n8°—That the\nadministration of wildlife and the recommendation of measures that ensure the\nperpetuity of species is a function of the Ministry of Environment and Energy.
