Por\nlo tanto,\n\n \n\n \n\nACUERDA:\n\n \n\nAprobar el siguiente Reglamento\n\n \n\n \n\nREGLAMENTO SOBRE MATERIALES Y CARACTERÍSTICAS DE\n\nLOS DISPOSITIVOS EXCLUIDORES DE TORTUGAS (DET's),\nPOR\n\nPARTE DE\nLA FLOTA CAMARONERA\nDE ARRASTRE DE ORILLA\n\n \n\n \n\nArtículo 1º-De los DET's construidos con tubo\nde aluminio. En aquellos casos en que el marco de los DET's y las barras\ndeflectoras se construyan con tubo de aluminio, éste deberá tener un diámetro\nmínimo exterior de 1,5\n pulgadas y un mínimo de 1/8 de pulgada de grosor, la\nparrilla un mínimo de 39,0\n pulgadas de ancho por 48 3/4 pulgadas de alto y el\nespacio entre las barras deflectoras y el marco de la parrilla no podrá exceder\nlas 6 pulgadas.\n\nArtículo 2.-De los DET's construidos con\nmateriales diferentes al aluminio. Si el marco de los DET's y las barras\ndeflectoras fuesen construidos con tubo de material diferente al\naluminio, éste deberá tener un diámetro mínimo exterior de 1,5 pulgadas\ny un mínimo de 1/8 de pulgada de grosor, la parrilla un mínimo de 39,0\npulgadas de ancho por 48 3/4 pulgadas de alto y el espacio entre las\nbarras deflectoras y el marco de la parrilla no podrá exceder las 4\npulgadas.\n\nArtículo 3º-De los requisitos de construcción\nde la abertura de escape de 71 pulgadas para las tortugas marinas. En\naquellos DET en que el espacio entre las barras deflectoras y el marco\nde la parrilla sea de 6 pulgadas, se debe seguir el siguiente\nprocedimiento para construir la abertura de escape:\n\n \n\nA. Se coloca el DET en forma vertical.\n\n \n\nB. Se miden 2 pulgadas a la izquierda de la base\nde la primera barra deflectora de la izquierda y de este punto se realiza un\ncorte vertical de 26 pulgadas.\n\n \n\nC. Se miden 2 pulgadas a la derecha de la base\nde la primera barra deflectora de la derecha y de este punto se realiza un\ncorte vertical de 26 pulgadas.\n\n \n\nD. Se hace un corte que una la parte superior de\nlos dos cortes verticales, creándose la abertura que deberá tener 71 pulgadas\nde ancho, cuando las mallas están estiradas.\n\n \n\nSi el espacio entre las barras deflectoras y el\nmarco de la parrilla del DET es de 4 pulgadas, se sigue el procedimiento\nanterior salvo que los cortes se inician en la base de la primera barra deflectora\nde la izquierda y en la base de la primera barra deflectora de la derecha.\n\nLa tapa de la abertura de escape, conocida también\ncomo solapa, se construye cortando un pedazo de malla con un alto de 133\npulgadas y un ancho de 58 pulgadas. El borde del lado de 133 pulgadas se cose 2\na 1 nudos en la parte delantera superior de la salida, en el borde de 71\npulgadas, es decir, por cada nudo de la red principal se amarran 2 nudos del\nmaterial de la solapa, mientras que el borde de 58 pulgadas se cose 1 a 1 nudo,\nen los dos bordes de 26 pulgadas de la parte delantera de la salida, iniciando en\nla parte superior.\n\nEl resto de la salida de escape que queda\ncolgando, puede fijarse a los lados hasta un máximo de 6 pulgadas, medidas\ndesde el borde inferior de marco del DET hacia abajo.\n\nEl largo de la tapa puede extenderse hasta un\nmáximo de 24 pulgadas, medidas desde el borde inferior del marco del DET hacia\nabajo.\n\nLa salida de escape, medida a la altura del\nborde inferior del marco del DET, debe medir al menos 71 pulgadas, estirando la\nparte inferior de la tapa en línea recta a esa altura.\n\nLa solapa debe medir 71 pulgadas con la malla\nestirada, en la parte superior, en el medio y también en la parte inferior,\npara así asegurar que la salida de escape tenga las dimensiones apropiadas.\n\nArtículo 4º-Del ángulo correcto de\ninstalación y operación de los DET's. En todos los casos los DET's deberán\nestar instalados y operar en las redes de arrastre durante las faenas de\npesca, en un ángulo que podrá oscilar entre un mínimo de 40 grados y un\nmáximo de 55 grados. Se recomienda que en cada embarcación camaronera de\narrastre de orilla, deberá portarse un calibrador o medidor de ángulos\nque permita verificar el grado de instalación de los DET's en forma\nperiódica.\n\nArtículo 5º-Del sistema de flotación en los\nDET's. Cada uno de los DET e independientemente de que la abertura de\nescape o salida de las tortugas marinas haya sido instalada para operar hacia\narriba o hacia abajo, deberá estar provisto de un sistema de flotación, el cual\nconsistirá de un mínimo de 2 boyas con un diámetro mínimo de 6 3/4 pulgadas y\nuna longitud mínima de 8 3/4 pulgadas, que deberán estar colocadas de la mitad del\nmarco hacia arriba.\n\nSi las boyas fuesen instaladas dentro de la red,\nestas deberán estar ubicadas detrás del marco de tal manera que no interfieran\ncon el escape o salida de las tortugas marinas.\n\nArtículo 6º-De los DET's de repuesto.\nDurante el viaje de pesca en cada embarcación se deberán de llevar a bordo, un\nmínimo de dos DET's en buen estado como repuestos.\n\nArtículo 7.-De la derogatoria. Este\nacuerdo deroga cualquier otra disposición que se le oponga.\n\nArtículo 8º-De la vigencia. Rige a partir\nde su publicación en el Diario Oficial La Gaceta.\n\nTransitorio primero.\nSe permitirá el uso de los DET's construidos con varilla sólida de aluminio u\notro material, hasta un año después de haber sido publicado este acuerdo, con\nel objetivo de que los dispositivos construidos antes de la promulgación de\neste acuerdo puedan ser usados y gastados.\n\nTransitorio segundo.\nEn el caso de los DET's construidos con varilla de aluminio sólida, éstos\ndeberán de tener un diámetro mínimo exterior de 3/4 de pulgadas, la parrilla un\nmínimo de 34 1 /2 pulgadas de ancho por 42,0 pulgadas de alto y el espacio\nentre las barras deflectoras y el marco de la parrilla no podrá exceder las 6\npulgadas.\n\nTransitorio tercero.\nEn el caso de los DET's construidos con varilla sólida de materiales diferentes\nal aluminio, éstos deberán tener las mismas dimensiones de los DET's\nconstruidos con varilla de aluminio sólida, pero el espacio entre las barras\ndeflectoras y el marco de la parrilla no podrá exceder las 4 pulgadas.",

Therefore,\n\n \n\n \n\nAGREES:\n\n \n\nTo approve the following Regulation\n\n \n\n \n\nREGULATION ON MATERIALS AND CHARACTERISTICS OF\n\nTURTLE EXCLUDER DEVICES (TEDs), BY\n\nTHE SMALL-SCALE SHRIMP TRAWL FLEET\n\n \n\n \n\nArticle 1º-Of TEDs constructed with aluminum\ntubing. In those cases where the frame of the TEDs and the deflector\nbars are constructed with aluminum tubing, this shall have a minimum outer\ndiameter of 1.5\n inches and a minimum of 1/8 inch thickness, the\ngrid a minimum of 39.0\n inches wide by 48 3/4 inches high, and the\nspace between the deflector bars and the grid frame may not exceed\n6 inches.\n\nArticle 2.-Of TEDs constructed with\nmaterials other than aluminum. If the frame of the TEDs and the deflector\nbars were constructed with tubing of material other than\naluminum, this shall have a minimum outer diameter of 1.5 inches\nand a minimum of 1/8 inch thickness, the grid a minimum of 39.0\ninches wide by 48 3/4 inches high, and the space between the\ndeflector bars and the grid frame may not exceed 4\ninches.\n\nArticle 3º-Of the construction requirements\nfor the 71-inch escape opening for sea turtles. In\nthose TEDs where the space between the deflector bars and the grid\nframe is 6 inches, the following\nprocedure must be followed to construct the escape opening:\n\n \n\nA. The TED is placed vertically.\n\n \n\nB. Measure 2 inches to the left of the base\nof the first deflector bar on the left and from this point make a\nvertical cut of 26 inches.\n\n \n\nC. Measure 2 inches to the right of the base\nof the first deflector bar on the right and from this point make a\nvertical cut of 26 inches.\n\n \n\nD. Make a cut joining the upper part of the\ntwo vertical cuts, creating the opening that shall have a width of 71\ninches, when the meshes are stretched.\n\n \n\nIf the space between the deflector bars and the\ngrid frame of the TED is 4 inches, the previous procedure is followed except that the\ncuts begin at the base of the first left-side deflector\nbar and at the base of the first right-side deflector bar.\n\nThe flap for the escape opening, also known\nas the cover (solapa), is constructed by cutting a piece of mesh with a height of 133\ninches and a width of 58 inches. The edge of the 133-inch side is sewn 2\nto 1 meshes (nudos) on the upper front part of the opening, on the 71-inch\nedge, that is, for every mesh of the main net, 2 meshes of the\ncover material are tied, while the 58-inch edge is sewn 1 to 1 mesh,\non the two 26-inch edges of the front part of the opening, starting at\nthe top.\n\nThe remainder of the escape opening that is left\nhanging, may be fixed to the sides up to a maximum of 6 inches, measured\nfrom the lower edge of the TED frame downwards.\n\nThe length of the cover may extend up to a\nmaximum of 24 inches, measured from the lower edge of the TED frame\ndownwards.\n\nThe escape opening, measured at the height of the\nlower edge of the TED frame, must measure at least 71 inches, stretching the\nlower part of the cover in a straight line at that height.\n\nThe cover must measure 71 inches with the mesh\nstretched, at the top, in the middle, and also at the bottom,\nthus ensuring that the escape opening has the appropriate dimensions.\n\nArticle 4º-Of the correct installation angle\nand operation of the TEDs. In all cases, the TEDs must\nbe installed and operate in trawl nets during fishing\noperations, at an angle that may range between a minimum of 40 degrees and a\nmaximum of 55 degrees. It is recommended that each small-scale shrimp trawl\nvessel carry an angle calibrator or gauge\nallowing periodic verification of the degree of installation of the TEDs.\n\nArticle 5º-Of the flotation system on the\nTEDs. Each TED, regardless of whether the\nescape opening for sea turtles has been installed to operate upwards\nor downwards, must be provided with a flotation system, which\nshall consist of a minimum of 2 floats with a minimum diameter of 6 3/4 inches and\na minimum length of 8 3/4 inches, which must be placed from the middle of the\nframe upwards.\n\nIf the floats were installed inside the net,\nthey must be located behind the frame in such a way that they do not interfere\nwith the escape of sea turtles.\n\nArticle 6º-Of the spare TEDs.\nDuring the fishing trip, each vessel must carry on board a\nminimum of two TEDs in good condition as spares.\n\nArticle 7.-Of the derogation. This\nagreement repeals any other provision that opposes it.\n\nArticle 8º-Of the validity. It takes effect upon\nits publication in the Official Gazette La Gaceta.\n\nFirst Transitory Provision.\nThe use of TEDs constructed with solid aluminum rod or\nother material shall be permitted, up to one year after this agreement has been published, with\nthe objective that devices constructed before the promulgation of\nthis agreement can be used and worn out.\n\nSecond Transitory Provision.\nIn the case of TEDs constructed with solid aluminum rod, these\nmust have a minimum outer diameter of 3/4 inches, the grid a\nminimum of 34 1/2 inches wide by 42.0 inches high, and the space\nbetween the deflector bars and the grid frame may not exceed 6\ninches.\n\nThird Transitory Provision.\nIn the case of TEDs constructed with solid rod of materials other\nthan aluminum, these must have the same dimensions as TEDs\nconstructed with solid aluminum rod, but the space between the\ndeflector bars and the grid frame may not exceed 4 inches."
