Se compone de dos secciones, la zona pública que es\nla franja de los cincuenta metros de ancho desde la línea de la pleamar\nordinaria y las zonas que quedan al descubierto durante la marea baja, además\ncomprende los islotes, peñascos y demás pequeñas y formaciones naturales que\nsobresalgan del mar, los manglares de los litorales continentales e insulares y\nesteros del territorio nacional; la zona restringida, que comprende los ciento\ncincuenta metros restantes o por los demás terrenos en el caso de las islas.\n\n2º-Que el artículo 73 de la Ley 6043 sobre la\nZona Marítimo Terrestre que dispone que la misma no aplica en las zonas\nmarítimo terrestres incluidas en parques nacionales y reservas equivalentes,\nlas cuales se regirán por la legislación respectiva.\n\n3º-Que el dictamen de la Procuraduría General de\nla República C-297-2004 del 19 de octubre del 2004, estableció que \"reservas equivalentes\"\ncomprenden todas aquellas áreas silvestres protegidas, como lo son refugios\nnacionales de vida silvestre, parques nacionales, reservas biológicas, reservas\nforestales, monumentos naturales y humedales, siendo competente para conservarlos\ny administrarlos el Ministerio del Ambiente y Energía. Asimismo reconoce que\nlos terrenos con bosque o que son de vocación forestal ubicados dentro de la\nZona Marítimo Terrestre, compete al Ministerio del Ambiente y Energía su\nadministración, siendo necesario que este Ministerio elabore los instrumentos\nde ordenamiento de esas áreas.\n\n4º-Que es necesario que el Ministerio del\nAmbiente y Energía, defina a corto plazo, las áreas de bosque y los terrenos de\naptitud forestal dentro de la Zona Marítimo Terrestre, por ser parte integrante\ndel Patrimonio Natural del Estado. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Declarar de interés público, la\nlabor de definición por parte del Ministerio del Ambiente y Energía de las\náreas de bosque y terrenos de aptitud forestal dentro de la zona marítimo\nterrestre.\n\nArtículo 2º-Toda dependencia del Poder Ejecutivo\ne Instituciones Autónomas, Semiautónomas, podrá en la medida de sus\nposibilidades presupuestarias y materiales prestar la colaboración requerida\npor el Ministerio del Ambiente y Energía para el cumplimiento de la labor encomendada.\n\nArtículo 3º-Rige a partir de su publicación.\n\n \n\nDado en la Presidencia de la República.-San\nJosé, a los once días del mes de agosto del dos mil cinco.",

It is composed of two sections: the public zone, which is\nthe strip of fifty meters in width from the ordinary high-water mark\nand the areas that are exposed during low tide, and also\ncomprises the islets, rocks, and other small natural formations that\nprotrude from the sea, the mangroves of the continental and insular coastlines, and\nestuaries of the national territory; the restricted zone, which comprises the remaining one hundred\nfifty meters or the remaining lands in the case of the islands.\n\n2nd-That Article 73 of Law 6043 on the\nMaritime Terrestrial Zone provides that it does not apply in the maritime\nterrestrial zones included in national parks and equivalent reserves,\nwhich shall be governed by the respective legislation.\n\n3rd-That the opinion of the Procuraduría General de\nla República C-297-2004 of October 19, 2004, established that \"equivalent reserves\"\ncomprise all those protected wilderness areas (áreas silvestres protegidas), such as national\nwildlife refuges, national parks, biological reserves, forest\nreserves, natural monuments, and wetlands, the competence for their conservation\nand administration being with the Ministry of the Environment and Energy (Ministerio del Ambiente y Energía). Likewise, it recognizes that\nthe administration of lands with forest or that are of forest vocation located within the\nMaritime Terrestrial Zone falls to the Ministry of the Environment and Energy,\nit being necessary for this Ministry to elaborate the planning\ninstruments for those areas.\n\n4th-That it is necessary for the Ministry of the\nEnvironment and Energy to define, in the short term, the areas of forest and the lands of\nforest aptitude within the Maritime Terrestrial Zone, as they form an integral part\nof the Natural Heritage of the State (Patrimonio Natural del Estado). Therefore,\n\nDECREE:\n\nArticle 1-To declare of public interest, the\ntask of definition by the Ministry of the Environment and Energy of the\nareas of forest and lands of forest aptitude within the Maritime Terrestrial Zone.\n\nArticle 2-Any agency of the Executive Branch\nand Autonomous and Semi-autonomous Institutions may, to the extent of their\nbudgetary and material possibilities, lend the collaboration required\nby the Ministry of the Environment and Energy for the fulfillment of the entrusted task.\n\nArticle 3-It shall be effective as of its publication.\n\nGiven at the Presidency of the Republic.-San\nJosé, on the eleventh day of the month of August of two thousand five."
