No existen evidencias de trochas ni claros producidos por aprovechamientos\nanteriores, ya que fueron colonizados por especies heliófitas. Que la .ora y fauna que lo componen\nes variada y concordante con la que se establece en el Plan de Manejo, como: Ceibo, Fruta Dorada,\nGuarumos y Jinocuaves. Así como Escalera de mono, Uña de Gato, entre otras. También se logró\napreciar durante el recorrido realizado por funcionarios del MINAE, gran variedad de aves como el\npájaro chanco y tucancillo; ranas y huellas de reptiles, anfibios y mamíferos.\n\n5º-Que el área descrita, constituye un núcleo\nmuy importante para la conservación de la Vida Silvestre dentro de la categoría\nde manejo de Refugio de Vida Silvestre Privado, localizada claramente en la\nzona donde se ubica el inmueble, por las características propias del medio\nambiente.\n\nQue por continuar desapareciendo de nuestro\nmedio y por ende de nuestro planeta los bosques y las especies de vida\nsilvestre esa categoría de manejo permite conservarlas y manejarlas dentro de\nun desarrollo sostenible sirviendo a la vez como regulador ambiental.\n\n6º-Que en el documento técnico presentado\nefectuado en la zona, se demuestra que es un área silvestre que protege la\nbiodiversidad y que sirve para brindar oportunidades a la investigación\ncientí.ca, la recreación y la educación; siendo objetivos primordiales de este\nrefugio, conservar y proteger el bosque natural.\n\n7º-Que el propietario de dicho inmueble accedió\nvoluntariamente a incorporarse a este régimen de protección de la vida\nsilvestre, comprometiéndose a no desarrollar ninguna actividad que ponga en\npeligro la fragilidad de los diferentes ecosistemas, existentes en la zona. Asimismo por el numeral 3° del decreto ejecutivo antes referido dicho\ninmueble estará sometido a la categoría de Refugio Nacional de Vida Silvestre Privado. durante un\nperiodo de diez años, prorrogables en periodos iguales en forma automática si el propietario no\nmanifiesta dentro del término de tres meses antes del vencimiento del plazo, su deseo de no\nsometimiento de Su propiedad a la categoría de Refugio Nacional de Vida Silvestre Privado.)\n\nArtículo 2º-El propietario de dicho inmueble se comprometió a no desarrollar ninguna actividad que\nno se encuentre estipulada en el respectivo plan de manejo o sus adendum y que comprometa la\nexistencia o afecte negativamente la .ora y fauna silvestres sin el permiso del Ministerio del\nAmbiente y Energía y dará toda la colaboración necesaria a los funcionarios del MINAE, para las\nlabores de control y verificación de las políticas ambientales mediante el Área de Conservación\nCordillera Volcánica Central del Sistema Nacional de Áreas de Conservación; así como a los\ninvestigadores e inspectores de recursos naturales, estudiantes y otros que esporádicamente visiten\ndicha área en las funciones propias de sus respectivos cargos, estudios e investigaciones. Asimismo,\nse comprometen a cumplir con las disposiciones que al efecto señalan la Ley de Conservación de la\nVida Silvestre, la Ley Forestal, sus respectivos reglamentos, y las demás disposiciones vigentes en\nmateria de normativa jurídica ambiental.\n\nArtículo 3º-Dicho inmueble estará sometido a la categoría de Refugio de Vida Silvestre Privado,\ndurante un período de diez años, prorrogables por períodos iguales, para lo cual el propietario\ndeberá solicitarlo con un mínimo de tres meses de antelación a la finalización de dicho período. There is no evidence of skid trails or clearings produced by previous harvesting, as they were colonized by heliophyte species. That the flora and fauna that compose it are varied and consistent with that established in the Management Plan (Plan de Manejo), such as: Ceibo, Fruta Dorada, Guarumos, and Jinocuaves. As well as Escalera de mono, Uña de Gato, among others. Also observed during the visit carried out by MINAE officials was a great variety of birds such as the pájaro chanco and tucancillo; frogs and tracks of reptiles, amphibians, and mammals.\n\n5th—That the described area constitutes a very important nucleus for the conservation of Wildlife within the management category of Private Wildlife Refuge, clearly located in the zone where the property is situated, due to the inherent characteristics of the environment.\n\nThat as forests and wildlife species continue to disappear from our environment and therefore from our planet, this management category allows them to be conserved and managed within a framework of sustainable development, simultaneously serving as an environmental regulator.\n\n6th—That the technical document presented and carried out in the zone demonstrates that it is a wild area that protects biodiversity and serves to provide opportunities for scientific research, recreation, and education; the primary objectives of this refuge being to conserve and protect the natural forest.\n\n7th—That the owner of said property voluntarily agreed to join this wildlife protection regime, committing not to develop any activity that endangers the fragility of the different ecosystems existing in the zone. Likewise, by paragraph 3 of the aforementioned Executive Decree, said property shall be subject to the category of Private National Wildlife Refuge (Refugio Nacional de Vida Silvestre Privado) for a period of ten years, extendable for equal periods automatically if the owner does not express, within the term of three months before the expiration of the term, their desire not to subject their property to the category of Private National Wildlife Refuge.)\n\nArticle 2—The owner of said property committed not to develop any activity that is not stipulated in the respective management plan (plan de manejo) or its addenda and that jeopardizes the existence or negatively affects wild flora and fauna without the permission of the Ministry of Environment and Energy (Ministerio del Ambiente y Energía) and shall provide all necessary collaboration to MINAE officials for control and verification tasks of environmental policies through the Cordillera Volcánica Central Conservation Area (Área de Conservación Cordillera Volcánica Central) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación); as well as to natural resource researchers, inspectors, students, and others who sporadically visit said area in the functions inherent to their respective positions, studies, and research. Likewise, they commit to complying with the provisions set forth for this purpose by the Wildlife Conservation Law, the Forest Law, their respective regulations, and other current provisions regarding environmental legal regulations.\n\nArticle 3—Said property shall be subject to the category of Private Wildlife Refuge (Refugio de Vida Silvestre Privado) for a period of ten years, extendable for equal periods, for which the owner must request it at least three months in advance of the end of said period. In the event of not wishing to maintain said management category, the owner must express their desire to release the property from this designation by means of a written submission presented to the competent sub-region of the Cordillera Volcánica Central Conservation Area.\n\nArticle 4—The administration of the Refuge is the responsibility of the property owner, but MINAE shall be the entity that dictates policy regarding the management and use of natural resources and the environment.\n\nArticle 5—The present declaration shall be repealed by the Administration in the event that non-compliance with the approved management plan (plan de manejo) and the environmental legal regulations governing wildlife refuges is verified.
