Organizaciones Pesqueras, interesadas en poner a derecho a una\ngran cantidad de pescadores propietarios de embarcaciones que han venido\nejerciendo la pesca en todo el territorio nacional sin contar con la respectiva\nLicencia de Pesca Comercial. \n\nQue\nes atribución del INCOPESCA la protección efectiva de los intereses nacionales\nrelacionados con la pesca y el aprovechamiento responsable de los recursos\nacuáticos pesqueros, que optimice los beneficios económicos en armonía con la\npreservación del ambiente y de la salud de las personas y con la conservación\nde la biodiversidad, así como el establecimiento de las condiciones que\npropicien el desarrollo de la flota pesquera nacional, previo estudio técnico,\ncientífico y económico. Por tanto,\n\n \n\nSE ACUERDA:\n\n \n\nAprobar\nla siguiente normativa:\n\n \n\nRegistro\nNacional de Embarcaciones pertenecientes a la Flota Pequeña Escala, Mediana\nEscala y Avanzada, sin Licencia de Pesca Comercial o con Licencia de Pesca\nComercial vencidas. \n\n \n\nArtículo\n1º-Se autoriza al Departamento de Protección y Registro, Departamento de\nExtensión y Capacitación, a las Direcciones Regionales de Guanacaste y Limón, a\nlas Oficinas Auxiliares de Nicoya y La Cruz y a las Oficinas Regionales de\nQuepos y Golfito, la recepción de Boletas de Registro de todas aquellas embarcaciones\npertenecientes a la Flota Pequeña Escala, Mediana Escala y Avanzada, que antes\ny después de la entrada en vigencia de la Ley Nº 8436, Ley de Pesca y\nAcuicultura, estuviesen realizando la actividad pesquera sin contar para ello\ncon la respectiva Licencia de Pesca Comercial o que la misma se les haya\nvencido por cualquier motivo, para efecto de conocer el esfuerzo pesquero, lo\ncual no implica necesariamente el otorgamiento de la licencia.\n\nArtículo\n2º—Además de la Boleta de Registro los permisionarios deberán de presentar los\nsiguientes requisitos:\n\n \n\n1) Personas físicas:\n\n \n\na. Fórmula de registro\ndebidamente llena y firmada por el interesado.\n\n \n\nb. Presentar documento\nde identidad idóneo, vigente, en original y aportar fotocopia por ambos lados.\n\n \n\nc.  Aportar una\ncertificación del Registro Nacional de Buques con un máximo de un mes de haber sido\nexpedida, que demuestre que la embarcación está inscrita a su nombre, con un mínimo de\ndos años de haber sido inscrita o en su defecto documento idóneo que demuestre o permita\nacreditar el inicio o presentación del tramite de inscripción y la propiedad o posesión\nde la embarcación por el termino indicado o documento veras o pruebas, que permitan\ndeterminar fehacientemente que la embarcación cuyo registro se pretende es propiedad o\nposesión del interesado y que se ha dedicado a la actividad por un periodo no menor a los\ndos años establecidos en el presente, para la cual la Comisión podrá requerir los\ndocumentos o pruebas que considere necesarias o convenientes para verificar\nsatisfactoriamente el cumplimiento del requisito y su espíritu.\n\n(Así reformado\neste inciso, mediante acuerdo 174 de 7 de abril del 2006)\n\n \n\nd. Presentar\nCertificado de Navegabilidad vigente, o inspección técnica del MOPT, emitida en el\núltimo mes calendario, en original y aportar fotocopia.\n\n \n\ne. Presentar Carné de\nPesca Comercial Vigente, en original y aportar fotocopia.\n\n \n\nf. Presentar Carta de\nRecomendación debidamente firmada por el Representante Legal de la Organización Pesquera\nrespectiva. En aquellas\ncomunidades pesqueras que carezcan de una Organización de Pescadores legalmente\nconstituida y cuya personería jurídica se encuentre vigente, será de recibo ante las\nDependencias señaladas en el artículo 1º del Acuerdo AJDIP/060- 2006; las Cartas de\nRecomendación extendidas por cualquier Organización Comunal o Eclesiástica debidamente\nconstituida en la comunidad, para lo cual deberá acompañarse de la acreditación\ncorrespondiente de dicha Organización.\n\n \n\n(Así\nampliado el inciso anterior por acuerdo AJDIP/098-2006 del 3 de marzo del 2006)\n\n \n\ng. Therefore,\n\n \n\nIT IS AGREED:\n\n \n\nTo approve\nthe following regulation:\n\n \n\nNational\nRegistry of Vessels belonging to the Small-Scale, Medium-Scale, and Advanced Fleet, without a Commercial Fishing License or with expired Commercial Fishing Licenses.\n\n \n\nArticle\n1.—The Department of Protection and Registry, the Department of\nExtension and Training, the Regional Directorates of Guanacaste and Limón,\nthe Auxiliary Offices of Nicoya and La Cruz, and the Regional Offices of\nQuepos and Golfito are authorized to receive Registration Forms for all those vessels\nbelonging to the Small-Scale, Medium-Scale, and Advanced Fleet, which before\nand after the entry into force of Law No. 8436, the Fisheries and\nAquaculture Law, were conducting fishing activity without the corresponding Commercial Fishing License or whose license has\nexpired for any reason, for the purpose of assessing the fishing effort, which does not necessarily imply the granting of the license.\n\nArticle\n2.—In addition to the Registration Form, the permit holders must submit the\nfollowing requirements:\n\n \n\n1) Natural persons:\n\n \n\na. Registration form\nduly completed and signed by the interested party.\n\n \n\nb. Present a suitable, valid\nidentification document, in original, and provide a photocopy of both sides.\n\n \n\nc. Provide a\ncertification from the National Vessel Registry with a maximum of one month since it was\nissued, demonstrating that the vessel is registered in their name, with a minimum of\ntwo years since it was registered, or in the absence thereof, a suitable document that demonstrates or allows\naccreditation of the commencement or submission of the registration process and the ownership or possession\nof the vessel for the indicated term, or truthful documents or evidence that allow\nit to be reliably determined that the vessel whose registration is sought is the property or\npossession of the interested party and that it has been engaged in the activity for a period of no less than the\ntwo years established herein, for which the Commission may require the\ndocuments or evidence it deems necessary or convenient to satisfactorily verify\ncompliance with the requirement and its spirit.\n\n(Thus amended\nthis subparagraph, by agreement 174 of April 7, 2006)\n\n \n\nd. Present a valid\nCertificate of Seaworthiness, or a technical inspection from MOPT, issued within the\nlast calendar month, in original, and provide a photocopy.\n\n \n\ne. Present a valid\nCommercial Fishing License card, in original, and provide a photocopy.\n\n \n\nf. Present a Letter of\nRecommendation duly signed by the Legal Representative of the respective Fishing Organization. In those\nfishing communities that lack a legally constituted Fishers' Organization\nwhose legal status is valid, Letters of Recommendation issued by any Community or Ecclesiastical Organization duly\nconstituted in the community shall be receivable before the\nOffices indicated in Article 1 of Agreement AJDIP/060-2006, for which the corresponding accreditation\nof that Organization must be attached.\n\n \n\n(Thus\namended the preceding subparagraph by agreement AJDIP/098-2006 of March 3, 2006)\n\n \n\ng. Certification\nissued by the Costa Rican Social Security Fund, with a Payroll Study of the last\ntwo years.\n\n \n\nh. Only in\nthose cases where the Commercial Fishing License has expired, the interested party\nmust provide a photocopy of the same.\n\n \n\n2) Legal persons\n\n \n\na. Provide a\nCertification from the National Vessel Registry, with a maximum of three calendar months,\nsince it was issued, and with a minimum of two years since it was registered.\n\n \n\nf. Present a valid\nCertificate of Seaworthiness, in original, and provide a photocopy.\n\n \n\ng. Present a Letter of\nRecommendation duly signed by the Legal Representative of the respective Fishing Organization. This Commission shall be responsible\nfor assessing the availability of fishery resources and the needs for\nsustainable development of the fishing sector.\n\nSaid\nCommission shall review the information submitted by the interested parties and shall prepare a\nTechnical Report, which it must forward for the consideration of the Board of Directors,\nwithin a period of no more than one calendar month counted from the expiry of the deadline\nestablished in Article No. 2.\n\nArticle\n6.—It shall take effect upon its publication in the Official Gazette La Gaceta.\n\n \n\nFinal\nagreement." }
