de 1996.\n\n \n\nConsiderando:\n\n \n\n1º-Que\nlos artículos 19, inciso b) y 34 de la ley 7575 prohíben el cambio de uso de\nsuelo y la corta de árboles en terrenos cubiertos de bosque y en áreas de\nprotección, exceptuando aquellos proyectos estatales o privados que el Poder\nEjecutivo declare de Conveniencia Nacional. \n\n2º-Que\nel Decreto Ejecutivo Nº 26728-MP-MINAE del 20 de febrero de 1998, dispone en su\nartículo 1º, declarar de interés público los proyectos de generación,\ntransmisión y distribución de energía eléctrica. \n\n3º-Que\nel suministro eficiente y oportuno de los servicios eléctricos no sólo forma\nparte de los lineamientos fundamentales para el desarrollo del país, sino que\nconlleva una mejora en la calidad de vida para sus habitantes.\n\n4º-Que\nla Compañía Nacional de Fuerza y Luz S. A., (CNFL), es una empresa del sector\neléctrico, que brinda servicios públicos en el mercado nacional, que está\ncomprometida con la satisfacción del cliente y uso adecuado de los recursos\npara contribuir con el crecimiento económico, social y ambiental del país.\n\n5º-Que\nla CNFL iniciará la construcción del Proyecto Hidroeléctrico el Encanto, con el\naprovechamiento de las aguas de la cuenca del Río Aranjuez, en los cantones de\nPuntarenas y Montes de Oro, que aportará 8.4 MW de potencia al sistema\neléctrico interconectado. \n\n6º-Que\nel artículo 3º inciso m) de la Ley Forestal Nº 7575 declara como actividades de\nconveniencia nacional las realizadas por las dependencias centralizadas del\nEstado, instituciones autónomas o empresas privadas, cuyos beneficios sociales\nsean mayores a los costos socioambientales. \n\n7º-Que\nel Estudio de Impacto Ambiental para el Proyecto Hidroeléctrico El Encanto fue\ndebidamente aprobado por la Secretaría Técnica Nacional Ambiental mediante\nresolución Nº 1006-2002-SETENA, actualizada mediante la resolución\n782-2005-SETENA. \n\n8º-Que\nel desarrollo del proyecto hidroeléctrico implica obras que llevan a una\nmodificación de uso del suelo, particularmente con la definición de sitios de\nembalse y construcción de infraestructura aledaña al río Aranjuez.\n\n9º-Que\nla CNFL es una empresa comprometida con un uso responsable de los recursos\nnaturales, que ha implementado una intervención proactiva en la cuenca del río\nAranjuez desde el año 2000, aportando recursos humanos, económicos y materiales\npara desarrollar un plan de manejo y el pago por servicios ambientales en dicha\ncuenca. \n\n10.-Que\npara un adecuado desarrollo de los proyectos hidroeléctricos deben tramitarse\nlos respectivos permisos ambientales y de construcción específicos ante las\ninstancias reguladoras del Estado y gobiernos locales. \n\n11.-Que\nla CNFL inició un proceso de comunicación con las comunidades del área de\ninfluencia del proyecto desde hace 10 años.
