it shall be a decentralized\nand participatory institutional management and coordination system within the\nadministrative structure of the System. \n\n5º-That\nwith the enactment of the Organic Law of the Environment Nº 7554 of October 4,\n1995, the Ministry of Environment and Energy assumed new functions, for which it\nrequires the modernization of the legal provisions governing\nlabor relations with its officials, in order to adequately fulfill them. \n\n6º-That\nto achieve the effectiveness and efficiency of Human Resource Management,\nit is advisable to review the Autonomous Service Regulations of the institution.\n\n7º-That\nthe present modification was authorized by the Legal Advisory Office of the\nCivil Service General Directorate, pursuant to article 13 subsection\ni) of the Civil Service Statute, through official communication AJ-099-2006 dated March\n13, 2006. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nArticle\n1º-Amend as appropriate Chapter II, on the Department of Human Resources\n(Departamento de Recursos Humanos), article 4º of Executive Decree number 28409-MINAE, which shall hereafter read as follows:\n\n \n\n\"Article\n4º-There shall be a Department of Human Resources within the Organization of the\nMinistry, to duly attend to all matters concerning personnel.\n\nThis\nDepartment shall have the collaboration of Auxiliary Offices, which shall report to\neach General Directorate. Likewise, the National System of Conservation Areas (SINAC) shall independently have a Human Resources office, which shall report administratively to the Senior Director and\ntechnically to the Civil Service General Directorate, in accordance with article\n8 of the Regulations to the Civil Service Statute; and this office shall have the support and\ncooperation of auxiliary offices in the different Conservation Areas\nnationwide; which shall report technically to the Human Resources Office of SINAC and administratively to the Directorate of the Conservation\nArea. \n\nThe\nDepartment of Human Resources and its auxiliary offices, the Human Resources Office of\nSINAC and its respective auxiliary offices shall have the\nfunctions assigned to them by these Regulations and other applicable regulations.\n\nThe\ncontent of these Regulations and other regulations related to the matter,\nwhere it involves the Department of Human Resources, must be understood\nintrinsically to refer to the Human Resources Office of SINAC for the same purposes.\"\n\nArticle\n2º-Amend as appropriate Chapter XVII, on the Personnel File (Expediente Personal),\narticles Nos. 67, 69 and 70 of Executive Decree number 28409-MINAE, which shall\nhereafter read as follows:\n\n \n\n\"Article\n67.-The Department of Human Resources of the Ministry and the Human Resources Office\nof SINAC shall be responsible for the creation and custody of the\npersonnel file of each official according to their respective\ndependency, and for keeping up to date the archives of pertinent documents,\nas well as for guaranteeing their confidentiality.\"\n\n \n\n\"Article\n69.-The Department of Human Resources and the Human Resources Office of\nSINAC, as appropriate for the official under their competence, shall prepare a prontuario (summary record)\nfor each employee, in order to have a practical summary of all the\ninformation derived from the service relationship on matters such as: date of\nentry, attendance, performance evaluation, disciplinary aspects,\nqualifications and suitability of the official, vacations, and other key\ninformation.\"\n\n \n\n\"Article\n70.-It is the duty of the administrative units of both the Ministry and\nthe National System of Conservation Areas and their dependencies to send a copy to the\npersonnel file of the officials, of those actions that, within\ntheir scope of competence, may generate legal-administrative acts. \n\nThe\ninformation and continuity in the prontuario, as well as in the personnel file,\nis of a confidential nature and only the officials\nof the Ministry and the National System of Conservation Areas, as\nappropriate, who require it for duties inherent to their position, the employee,\nand their authorized representative shall have access to it.\"\n\nArticle\n3º-Amend as appropriate Chapter XXII, on the Disciplinary Regime and\nthe Application Procedure, article 113 subsection b) of Executive Decree\nnumber 28409-MINAE, which shall hereafter read as follows:\n\n \n\n\"Article\n113:\n\n \n\nb)\nFor officials with a non-statutory relationship, with regard to the\ninstruction of dismissal, it shall be carried out by the Legal Unit of the Department of\nHuman Resources of the Ministry and, for officials of SINAC, by the\ncorresponding Human Resources Office; with the knowledge and\napproval of the Vice Minister or Senior Director respectively, following the\nsame procedure indicated in the preceding articles.\"\n\nArticle\n4º-It shall take effect from its publication.\n\n \n\nGiven\nat the Presidency of the Republic.-San José, on the twenty-seventh day of the month of\nFebruary of the year two thousand six." }
