recursos naturales, a fin de contar con políticas definidas\nque garanticen el uso racional de dichos recursos.\n\n2º-Que\nel Refugio Nacional de Vida Silvestre Bosque Diriá, se estableció como área\nsilvestre protegida, mediante los decretos ejecutivos Nº 20517-MIRENEM del 5 de\njunio de 1991 y 21221-MIRENEM del 3 de marzo de 1992.\n\n3º-Que\nterritorialmente es el área silvestre protegida continental de mayor extensión\ndel Área de Conservación Tempisque y sitio de gran importancia estratégica en\nla conformación del Corredor Biológico Chorotega.\n\n4º-Que\nestudios técnicos (Merayo, 1999) han determinado que es de suma importancia\nproteger las cuencas altas de los ríos Diriá, Enmedio, Tigre y Verde, ubicadas\ndentro de los terrenos de esta área protegida, a fin de garantizar a largo\nplazo el suministro de recursos hídricos para la provincia de Guanacaste,\nprincipalmente para el cantón de Santa Cruz. \n\n5º-Que\ndicha área constituye un núcleo muy importante para la conservación de los\nrecursos naturales de la península de Nicoya, tal como lo refleja la evaluación\necológica rápida realizada por Villarreal (2003) con recursos del Convenio\nINBio-SINAC.\n\n6º-Que\nexiste un potencial valor arqueológico poco estudiado, acerca de los\nasentamientos indígenas que fueron parte de los dominios del Cacique Diriá.\n\n7º-Que\nademás de lo anterior, el Bosque Diriá resguarda recursos de gran valor\nescénico y sitios aptos para el disfrute sano de sus bellezas, como\ntradicionalmente ha ocurrido desde antes de su creación como área silvestre\nprotegida.\n\n8º-Que\nel área comprendida dentro de sus límites, así como los terrenos que mediante\neste decreto se piensan agregar, constituyen áreas de vital importancia para la\nprotección de los mantos acuíferos existentes en la región y conforman una gran\ncuenta hidrográfica, con lo cual se pretende unificar el área de los sectores\nde La Casona y el de San Juan. \n\n9º-Que\nel 90% de las fincas que conforman el área silvestre son en la actualidad\nPatrimonio Natural del Estado y solo resta comprar un 10% para consolidar el\nárea considerada prioritaria. \n\n10.-Que\ndesde su creación como área silvestre y principalmente en los últimos años, la\ncomunidad de Santa Cruz a través de diferentes instancias como la\nMunicipalidad, la Universidad Estatal a Distancia, la Guardia Rural, la\nComisión de Corredor Biológico Diriá, ACOBIGUA, los grupos de brigadas contra\nincendios y otras han realizado un trabajo conjunto en pro de la consolidación\ny conservación del Diriá.\n\n \n\nDECRETAN:\n\n \n\nArtículo\n1º-Modifíquese el Decreto Ejecutivo Nº 23126-MIRENEM publicado en La Gaceta Nº\n79 del 26 de abril de 1994 para que se Se\ncontinúa luego por una serie de puntos con las siguientes coordenadas:\n\n \n\n238800\nN 358285 E\n\n238965\nN 358145 E\n\n \n\nA\npartir de este último punto, el límite sigue por el camino público entre Cola\nde Gallo y San Juan, hasta llegar al punto de inicio; es decir, 242690 N y\n366585 E.\n\nArtículo\n2º-Con el fin de consolidar biológica y geográficamente el Parque Nacional\nDiriá, de acuerdo con este derrotero el área total será de 5 426 ha.\n\nArtículo\n3º-La administración y protección del Parque Nacional Diriá le corresponderá al\nMinisterio del Ambiente y Energía, a través del Sistema Nacional de Áreas de\nConservación y más concretamente al Área de Conservación Tempisque.\n\nArtículo\n4º-Con fundamento en el artículo 29 de la Ley de Biodiversidad Nº 7788 del 30\nde abril de 1998, crease el Consejo Local del Parque Nacional Diriá, el cual\nestará conformado por:\n\n \n\ni.\nEl Director del Área de Conservación Tempisque o la persona que éste designe,\n\n \n\nii.\nEl Alcalde Municipal de Santa Cruz o su representante,\n\n \n\niii.\nEl Alcalde Municipal de Nicoya p su representante,\n\n \n\niv.\nEl Alcalde Municipal de Carrillo o su representante,\n\n \n\nv.\nEl Administrador Regional del IDA en Santa Cruz,\n\n \n\nvi.\nEl Jefe de la Agencia de Servicios Agropecuarios del MAG en Santa Cruz,\n\n \n\nvii.\nEl o la Administradora del Centro Universitario de la UNED en Santa Cruz o su\nrepresentante,\n\n \n\nviii.\nUn representante de las organizaciones ambientalistas de Santa Cruz,\n\n \n\nix.\nUn representante del sector empresarial.\n\nArtículo\n5º-El Área de Conservación Tempisque, a fin de cumplir con lo estipulado en los\nartículos 38 y 39 de la Ley de Biodiversidad Nº 7788 del 30 de abril de 1998,\nfomentará la participación de organizaciones no gubernamentales locales en la\nadministración de servicios no esenciales de esta área protegida, así como para\nla gestión conjunta y la cooperación en la búsqueda de recursos para su\nfortalecimiento.\n\nArtículo\n6º-El Área de Conservación Tempisque coordinará con las instituciones públicas\ny privadas de la zona, organizaciones no gubernamentales de la región, la Asociación\nCorredor Biológico Diriá, los productores y productoras y el sector\nempresarial, para garantizar las conectividades y la viabilidad ecológica de\nlas poblaciones y ecosistemas objeto de protección del Parque Nacional Diriá.\n\nArtículo\n7º-Las fincas particulares afectadas, según lo dispuesto en el artículo 37 de\nla Ley Orgánica del Ambiente Nº 7554, quedarán comprendidas dentro del Parque\nNacional Diriá, sólo a partir del momento en que se haya efectuado legalmente\nel pago o la expropiación, salvo cuando en forma voluntaria se sometan al\nrégimen forestal. El Poder Ejecutivo queda facultado para realizar las\nexpropiaciones contempladas en este artículo, de conformidad con lo establecido\nen la Ley de Expropiaciones Nº 7495 del 3 de mayo de 1995.\n\nArtículo\n8º-Deróguense los Decretos Nº 20517-MIRENEM del 5 de junio de 1991, Nº\n21221-MIRENEM del 3 de marzo de 1992, Nº 22731-MIRENEM del 19 de noviembre de\n1993, Nº 22821-MIRENEM del 6 de enero de 1994, Nº 23126MIRENEM del 7 de abril\nde 1994, y Nº 24311-MIRENEM del 8 de mayo de 1995.\n\nArtículo\n9º-Rige a partir de su publicación.\n\n \n\nDado\nen la Presidencia de la República.-San José, a los veinticinco días del mes de\njulio del dos mil cuatro.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 32003\n\n Changes the category of the Bosque Diriá National Wildlife Refuge to\n\"Diriá National Park\"\n\nComplete Text file: 9A813\nNo. 32003\n\nNo. 32003\n\n \n\nTHE\nPRESIDENT OF THE REPUBLIC\n\nAND THE\nMINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nIn\nexercise of the powers conferred upon them by Article 140, subsections 3) and\n18) of the Political Constitution and in accordance with the provisions of\nArticle 32 of the Organic Law of the Environment No. 7554 of October 4, 1995,\nas well as the provisions of Article 13 of the National Parks Law No. 6084\nof August 24, 1977,\n\n \n\nConsidering:\n\n \n\n1º-That\nit is in the interest of the Government to strengthen and consolidate administrative structures\nin the field of natural resources, in order to have defined policies\nthat guarantee the rational use of said resources.\n\n2º-That\nthe Bosque Diriá National Wildlife Refuge was established as a protected wilderness area\nthrough Executive Decrees No. 20517-MIRENEM of June 5,\n1991 and 21221-MIRENEM of March 3, 1992.\n\n3º-That\nterritorially, it is the largest continental protected wilderness area\nin the Tempisque Conservation Area and a site of great strategic importance in\nthe formation of the Chorotega Biological Corridor.\n\n4º-That\ntechnical studies (Merayo, 1999) have determined that it is of utmost importance\nto protect the upper basins of the Diriá, Enmedio, Tigre, and Verde rivers, located\nwithin the lands of this protected area, in order to guarantee the long-term supply of water resources for the province of Guanacaste,\nmainly for the canton of Santa Cruz. \n\n5º-That\nthis area constitutes a very important nucleus for the conservation of the\nnatural resources of the Nicoya Peninsula, as reflected in the rapid\necological assessment carried out by Villarreal (2003) with resources from the INBio-SINAC Agreement.\n\n6º-That\nthere is a little-studied potential archaeological value concerning the\nindigenous settlements that were part of the dominions of Chief Diriá.\n\n7º-That\nin addition to the above, the Bosque Diriá safeguards resources of great scenic\nvalue and sites suitable for the healthy enjoyment of its beauties, as\nhas traditionally occurred since before its creation as a protected wilderness area.\n\n8º-That\nthe area comprised within its boundaries, as well as the lands that are intended to be added through\nthis decree, constitute areas of vital importance for the\nprotection of the existing aquifer mantles in the region and form a large\nhydrographic basin, with which it is intended to unify the area of the\nLa Casona and San Juan sectors. \n\n9º-That\n90% of the properties that make up the wilderness area are currently\nNatural Heritage of the State and only 10% remains to be purchased to consolidate the\narea considered a priority. \n\n10.-That\nsince its creation as a wilderness area and mainly in recent years, the\ncommunity of Santa Cruz through different instances such as the\nMunicipality, the State Distance University, the Rural Guard, the\nDiriá Biological Corridor Commission, ACOBIGUA, the fire brigade groups,\nand others have carried out joint work in favor of the consolidation\nand conservation of Diriá.\n\n \n\nTHEY DECREE:\n\n \n\nArticle\n1º-Amend Executive Decree No. 23126-MIRENEM published in La Gaceta No.\n79 of April 26, 1994, so that the management category of the\nBosque Diriá National Wildlife Refuge is changed to that of the Diriá National Park,\ndemarcated on the cartographic sheets of the National Geographic Institute, scale\n1:50,000 Diriá and Cerro Brujo. The boundaries of the Diriá National Park shall be:\n\n \n\nStarting\nfrom a point located on the public road between the communities of San Juan and\nCola de Gallo, with coordinates 242375 North and 367010 East, of the\nLambert Costa Rica Norte coordinate system. From this point, it continues, in\nfirst instance towards the east, through a series of points with the following\ncoordinates:\n\n \n\nIt\nstarts from a point located on the public road between the communities of San\nJuan and Cola de Gallo, with coordinates 242690 North and 366585 East, of the\nLambert Costa Rica Norte coordinate system. It\nthen continues through a series of points with the following coordinates:\n\n \n\n| --- | --- |\n| 238800 N 358285 E | |\n| 238965 N 358145 E | |\n\n \n\nFrom\nthis last point, the boundary continues along the public road between Cola\nde Gallo and San Juan, until reaching the starting point; that is, 242690 N and\n366585 E.\n\nArticle\n2º-In order to biologically and geographically consolidate the Diriá National\nPark, according to this route, the total area shall be 5,426 ha.\n\nArticle\n3º-The administration and protection of the Diriá National Park shall correspond to the\nMinistry of Environment and Energy, through the National System of Conservation Areas and more specifically to the Tempisque Conservation Area.\n\nArticle\n4º-Based on Article 29 of the Biodiversity Law No. 7788 of April 30,\n1998, the Local Council of the Diriá National Park is created, which\nshall be composed of:\n\n \n\ni.\nThe Director of the Tempisque Conservation Area or the person he/she designates,\n\n \n\nii.\nThe Municipal Mayor of Santa Cruz or his/her representative,\n\n \n\niii.\nThe Municipal Mayor of Nicoya or his/her representative,\n\n \n\niv.\nThe Municipal Mayor of Carrillo or his/her representative,\n\n \n\nv.\nThe Regional Administrator of the IDA in Santa Cruz,\n\n \n\nvi.\nThe Head of the Agricultural Services Agency of the MAG in Santa Cruz,\n\n \n\nvii.\nThe Administrator of the UNED University Center in Santa Cruz or his/her\nrepresentative,\n\n \n\nviii.\nA representative of the environmentalist organizations of Santa Cruz,\n\n \n\nix.\nA representative of the business sector.\n\nArticle\n5º-The Tempisque Conservation Area, in order to comply with the stipulations of\nArticles 38 and 39 of the Biodiversity Law No. 7788 of April 30, 1998,\nshall promote the participation of local non-governmental organizations in the\nadministration of non-essential services of this protected area, as well as for\njoint management and cooperation in the search for resources for its\nstrengthening.\n\nArticle\n6º-The Tempisque Conservation Area shall coordinate with public and private\ninstitutions in the zone, non-governmental organizations in the region, the Diriá Biological Corridor Association, producers and the business\nsector, to guarantee connectivity and the ecological viability of\nthe populations and ecosystems that are the objects of protection of the Diriá National Park.\n\nArticle\n7º-The privately owned properties affected, according to the provisions of Article 37 of\nthe Organic Law of the Environment No. 7554, shall be included within the Diriá National\nPark only from the moment payment or expropriation has been legally carried out, except when they voluntarily submit to the\nforest regime. The Executive Branch is empowered to carry out the\nexpropriations contemplated in this Article, in accordance with the provisions\nof the Expropriations Law No. 7495 of May 3, 1995.\n\nArticle\n8º-Decrees No. 20517-MIRENEM of June 5, 1991, No.\n21221-MIRENEM of March 3, 1992, No. 22731-MIRENEM of November 19,\n1993, No. 22821-MIRENEM of January 6, 1994, No. 23126-MIRENEM of April 7,\n1994, and No. 24311-MIRENEM of May 8, 1995, are hereby repealed.\n\nArticle\n9º-It shall become effective upon its publication.\n\n \n\nGiven\nat the Presidency of the Republic.—San José, on the twenty-fifth day of\nJuly, two thousand four." }
