Dicha red deberá tener una luz de malla de ¾\nde pulgada, una longitud máxima de 20 metros y una altura máxima de 2 metros y\nno deberá de tener bolsa. Corresponderá al INCOPESCA el otorgamiento de\npermisos provisionales para este efecto durante la veda de conformidad con los\nrequerimientos de carnada en cada una de las comunidades pesqueras.\n\n \n\nB.\nPesca con red bolichera: durante el\nperíodo comprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de\noctubre del 2006, se permitirá la captura de carnada (sardina y anchoveta) con\nred bolichera. Dicha red deberá tener una luz de malla máxima de ½ pulgada, una\nlongitud máxima de 40 metros, una altura máxima de 8 metros, con o sin bolsa.\nCorresponderá al INCOPESCA el otorgamiento de permisos provisionales para este\nefecto durante la veda, de conformidad con los requerimientos de carnada en\ncada una de las comunidades pesqueras.\n\n \n\nC.\nDe la pesca de atún para carnada:\ndurante el período comprendido entre el 1º de junio y el 31 de julio y del 1º\nal 31 de octubre del 2006, se permitirá la captura de atún para carnada con\nredes agalleras o trasmallos a flote. Se permitirá una red agallera o trasmallo\na flote por embarcación durante los días lunes, martes y miércoles de cada semana\nen el horario de las 16:00 horas a las 6:00 horas (por tal razón la faena de\npesca deberá iniciar a partir de las 16:00 horas del día lunes y finalizar a\nlas 6:00 horas del día jueves de cada semana). Corresponderá\nal INCOPESCA el otorgamiento a solicitud de parte de los permisionarios, paralos\npermisos provisionales para este efecto durante la veda, de conformidad con los\nrequerimientos de carnada en cada una de las comunidades pesqueras.\n\n \n\n(Así\nreformado el inciso anterior mediante acuerdo AJDIP/260 del 02 de junio del\n2006).\n\n \n\nDicha\nred deberá tener una luz de malla mínima de 31/2 pulgadas, una longitud máxima\nde 500 metros y una altura máxima de 150 mallas y deberá estar provista de\nboyas, galones o cualquier otro dispositivo que permita a las autoridades\ncompetentes su identificación.  \n\n \n\n(Así\nreformado el párrafo anterior mediante acuerdo AJDIP/260 del 02 de junio del\n2006).\n\n \n\nSe\nestablece como zona autorizada para el uso de este tipo de pesca el área\ncomprendida entre la línea recta imaginaria que va desde el Muelle de Cruceros\nde Puntarenas (84º49'51\" Longitud Oeste, 9º58'26\" Latitud Norte) hasta la parte\nmás Oriental de la Isla de Cedros (84º51'59\" Longitud Oeste, 9º51'00\" Latitud\nNorte) y de esas dos líneas imaginarias aguas hacia afuera del Golfo de Nicoya.\n\nAquellos\npermisionarios que se dediquen a este tipo de pesca facilitarán sus\nembarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de\nestas, información de sus capturas y de las características del arte de pesca\nutilizada.\n\nAsimismo\nestarán obligados a informar el lugar, hora y fecha de cada uno de sus\ndesembarques ante el Departamento de Protección y Registro, para que\nfuncionarios del Departamento de Investigación y Desarrollo o de esa misma\nDependencia fiscalicen in situ dichos desembarques.\n\nArtículo\n5º-De la pesca de sardina por parte de\nla Flota Semi- Industrial sardinera con red de cerco: durante el periodo\ncomprendido entre el 1º de junio y el 31 de julio y del 1º al 31 de octubre del\n2006, se permitirá la pesca de la sardina con red de cerco, durante los días\nlunes, martes y miércoles de cada semana en la zona comprendida entre una línea\nrecta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52\"\nLongitud Oeste, 09º53'31\" Latitud Norte) hasta el Faro de las Islas Negritos\nAfuera (84º49'35\" Longitud Oeste, 09º49'14\" Latitud Norte) y de ahí aguas\nadentro hasta la línea recta imaginaria que va hasta el Muelle de Cruceros en\nla Ciudad de Puntarenas (84º49'51\" Longitud Oeste, 09º58'26\" Latitud Norte).\n\nAquellos\npermisionarios que se dediquen a este tipo de pesca facilitarán sus\nembarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de\nestas información de sus capturas. \n\nAsimismo\nestarán obligados a informar el lugar, hora y fecha de cada uno de sus desembarques\nante el Departamento de Protección y Registro, para que funcionarios del\nDepartamento de Investigación y Desarrollo o de esa misma Dependencia\nfiscalicen in situ dichos desembarques. \n\nDurante\nlos 4 días restantes de la semana de esta veda, esta flota podrá pescar aguas\nafuera de la línea recta imaginaria comprendida desde Punta Torres, conocida\ncomo Peñón (84º43'52\" Longitud Oeste, 09º53'31\" Latitud Norte) hasta el Faro de\nlas Islas Negritos Afuera (84º49'35\" Longitud Oeste, 09º49'14\" Latitud Norte).\n\nArtículo\n6º-De la pesca de la jaiva con nasas:\ndurante el período comprendido entre el 1º de junio y el 31 de julio y del 1º\nal 31 de octubre del 2006, se permitirá la pesca del cangrejo jaiva con nasas,\núnicamente a todo aquel permisionario con Licencia de Pesca Comercial vigente\npara este tipo de pesca y en la (s) zona (s) autorizada (s).\n\nArtículo\n7º-De la presentación del Listado de\npescadores afectos al subsidio. Therefore,\n\nIT IS AGREED:\n\nArticle 1.-Regarding fishing by the Semi-Industrial shrimp trawler fleet: the Semi-Industrial shrimp trawler fleet is prohibited from operating from June 1 to July 31 and from October 1 to 31, 2006, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from that line, inshore to the mouth of the Tempisque River.\n\nArticle 2.-The Semi-Industrial shrimp trawler fleet may not carry out its activity at any time of the year in the area between an imaginary straight line running from the Puntarenas Cruise Ship Pier (84º49'51\" West Longitude, 9º58'26\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from this line inshore to the mouth of the Tempisque River.\n\nArticle 3.-Regarding fishing by the Small-Scale Artisanal Fleet.\n\nA. Fishing with gillnets or trammel nets (redes agalleras o trasmallos): during the period from June 1 to July 31 and from October 1 to 31, 2006, the use of gillnets or trammel nets of any mesh size is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from that line, inshore to the mouth of the Tempisque River.\n\nB. Fishing with Taiwanese longline (línea taiwanesa): during the period from June 1 to July 31 and from October 1 to 31, 2006, the use of the Taiwanese longline is prohibited in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from that line, inshore to the mouth of the Tempisque River.\n\nC. Fishing with handlines (cuerdas de mano): during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use handlines with number 6 hooks at any time of day, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from that line inshore to the mouth of the Tempisque River. Those who choose this alternative must notify the Protection and Registration Department.\n\n(Thus amended the previous paragraph by agreement AJDIP/260 of June 2, 2006).\n\nD. Fishing with bottom-set longline (línea planera) in the inshore zone of the Gulf of Nicoya: during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use, at any time of day, one bottom-set longline per vessel with a maximum length of 500 meters and a maximum of 300 number 6 hooks, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to Punta Cuchillo (84º52'23\" West Longitude, 09º49'39\" North Latitude) and from that line inshore to the mouth of the Tempisque River. Those who choose this alternative must notify the Protection and Registration Department.\n\n(Thus amended the previous paragraph by agreement AJDIP/260 of June 2, 2006).\n\nE. Fishing with bottom-set longline (línea planera) in the offshore zone of the Gulf of Nicoya: during the period from June 1 to July 31 and from October 1 to 31, 2006, any permit holder with a Commercial Fishing License for the zone may use one bottom-set longline per vessel with a maximum length of 5000 meters and a maximum of 3000 number 6 hooks, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to Punta Cuchillo (84º52'23\" West Longitude, 09º49'39\" North Latitude) and from that line seaward, outside the Gulf of Nicoya. Those who choose this alternative must notify the Protection and Registration Department.\n\n(Thus amended the previous paragraph by agreement AJDIP/260 of June 2, 2006).\n\nArticle 4.-Regarding fishing for bait.\n\nA. Fishing with beach seine net (chinchorro de barrer playa): during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of bait (sardine and anchovy) with beach seine net on the beach is permitted. Said net must have a mesh size of ¾ of an inch, a maximum length of 20 meters, and a maximum height of 2 meters, and must not have a bag. It shall be the responsibility of INCOPESCA to grant provisional permits for this purpose during the closed season in accordance with the bait requirements in each of the fishing communities.\n\nB. Fishing with lampara net (red bolichera): during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of bait (sardine and anchovy) with lampara net is permitted. Said net must have a maximum mesh size of ½ inch, a maximum length of 40 meters, a maximum height of 8 meters, with or without a bag. It shall be the responsibility of INCOPESCA to grant provisional permits for this purpose during the closed season, in accordance with the bait requirements in each of the fishing communities.\n\nC. Fishing for tuna for bait: during the period from June 1 to July 31 and from October 1 to 31, 2006, the capture of tuna for bait with floating gillnets or trammel nets (redes agalleras o trasmallos a flote) is permitted. One floating gillnet or trammel net per vessel is permitted on Mondays, Tuesdays, and Wednesdays of each week from 4:00 p.m. to 6:00 a.m. (for this reason, the fishing operation must begin at 4:00 p.m. on Monday and end at 6:00 a.m. on Thursday of each week). It shall be the responsibility of INCOPESCA to grant, at the request of the permit holders, provisional permits for this purpose during the closed season, in accordance with the bait requirements in each of the fishing communities.\n\n(Thus amended the previous paragraph by agreement AJDIP/260 of June 2, 2006).\n\nSaid net must have a minimum mesh size of 3 1/2 inches, a maximum length of 500 meters, and a maximum height of 150 meshes, and must be equipped with buoys, gallon containers, or any other device that allows the competent authorities to identify it.\n\n(Thus amended the previous paragraph by agreement AJDIP/260 of June 2, 2006).\n\nThe area authorized for the use of this type of fishing is established as the area between the imaginary straight line running from the Puntarenas Cruise Ship Pier (84º49'51\" West Longitude, 9º58'26\" North Latitude) to the easternmost part of Isla de Cedros (84º51'59\" West Longitude, 9º51'00\" North Latitude) and from those two imaginary lines seaward, outside the Gulf of Nicoya.\n\nThose permit holders who engage in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain, on board these vessels, information on their catches and the characteristics of the fishing gear used.\n\nThey shall also be obliged to report the place, time, and date of each of their landings to the Protection and Registration Department, so that officials from the Research and Development Department or that same Unit may inspect said landings in situ.\n\nArticle 5.-Regarding sardine fishing by the Semi-Industrial sardine fleet with purse seine (red de cerco): during the period from June 1 to July 31 and from October 1 to 31, 2006, sardine fishing with purse seine is permitted, on Mondays, Tuesdays, and Wednesdays of each week, in the area between an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude) and from there inshore to the imaginary straight line running to the Cruise Ship Pier in the City of Puntarenas (84º49'51\" West Longitude, 09º58'26\" North Latitude).\n\nThose permit holders who engage in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain, on board these vessels, information on their catches.\n\nThey shall also be obliged to report the place, time, and date of each of their landings to the Protection and Registration Department, so that officials from the Research and Development Department or that same Unit may inspect said landings in situ.\n\nDuring the remaining 4 days of the week of this closed season, this fleet may fish seaward of the imaginary straight line from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84º49'35\" West Longitude, 09º49'14\" North Latitude).\n\nArticle 6.-Regarding the fishing of swimming crab (jaiva) with traps (nasas): during the period from June 1 to July 31 and from October 1 to 31, 2006, the fishing of swimming crab with traps is permitted, solely for any permit holder with a valid Commercial Fishing License for this type of fishing and in the authorized zone(s).\n\nArticle 7.-Regarding the submission of the List of fishers eligible for the subsidy. The General Technical Directorate must take the pertinent actions so that, within a period not exceeding 30 calendar days from the effective date of this regulation, it submits to the pertinent administrative authorities of IMAS the list of fishers subject to the restrictions and conditions of the closed season for the Gulf of Nicoya, so that they are granted the corresponding economic subsidy.\n\n(The second paragraph of this article was repealed by agreement AJDIP/260 of June 2, 2006).\n\nArticle 8.-Regarding sanctions: in addition to the application of those sanctions established in the Fisheries and Aquaculture Law, Law No. 8436, for all those permit holders whom the competent authorities find violating the provisions established in this agreement during the present closed season, INCOPESCA, through each of its competent offices, shall immediately suspend, from the time the infraction is committed through the remaining period(s) of the closed season, the provision of fuel at the preferential price, and both the permit holders and their helpers shall be automatically excluded from the lists sent to the Joint Institute for Social Aid (Instituto Mixto de Ayuda Social, IMAS) as potential beneficiaries of the economic assistance that that Institution grants during the closed seasons established in the Gulf of Nicoya.\n\nArticle 9.-Effective Date: effective as of June 1, 2006." }
