DFOE-AM- 2/2003 y\nDFOE-AM-38/2005, la Contraloría General de la República señala la importancia de la\ncitada Oficina Ejecutora como instancia de apoyo al Despacho Ministerial para la toma de\nmedidas de control interno en materia de desarrollo de infraestructura física del MINAE.\n\nV.—Que desde el 15 de enero del 2003, la citada Oficina Ejecutora\nse vio obligada a suspender los trabajos de dibujo de ingeniería y arquitectura, con\nmotivo de que se retiró el Dibujante Arquitectónico y, a la fecha, no obstante los\nesfuerzos efectuados por el MINAE, no se ha logrado la consecución de la plaza\ncorrespondiente o bien el traslado a esa Oficina Ejecutora de algún funcionario idóneo\npara cubrir esas funciones.\n\nVI.—Que el Decreto Ejecutivo N° 29735-MINAE le define a la citada\nOficina Ejecutora una serie de funciones que implican la elaboración de planos o dibujo\nde Ingeniería o Arquitectura y que ante la falta de Dibujante Arquitectónico resulta\nmaterialmente imposible su cumplimiento, situación que a su vez afecta el adecuado\ncumplimiento de otras funciones conexas.\n\nVII.—Que ante la realidad apuntada y en atención al sentido de\nresponsabilidad que debe caracterizar a la Administración, resulta obligante una\nmodificación del citado Decreto Ejecutivo N° 29735-MINAE, de manera que las funciones\nque éste estipula al MINAE sean concordantes con su capacidad de cumplirlas. Por\ntanto:\n\nDECRETAN:\n\nArtículo 1º—Modifícase el texto del artículo 1° del Decreto\nNº 29735- MINAE, así: \n\n Artículo 1º—Créase la Oficina Asesora en Infraestructura Física del Ministerio del Ambiente y\nEnergía, como una oficina de asesoría y de apoyo técnico y normativo, responsable de la\nfiscalización de todos los proyectos de obras mayores, referentes al desarrollo, ampliación y\nacondicionamiento general de la planta física del MINAE, de acuerdo con el Plan Anual Operativo del\nMinisterio y las respectivas partidas presupuestarias. DFOE-AM- 2/2003 and\nDFOE-AM-38/2005, the Contraloría General de la República points out the importance of the\ncited Executing Office as a support body for the Ministerial Office for taking\ninternal control measures regarding the development of MINAE's physical infrastructure.\n\nV.—That since January 15, 2003, the cited Executing Office\nwas forced to suspend engineering and architecture drawing work, due\nto the fact that the Architectural Draftsperson was withdrawn and, to date, despite the\nefforts made by MINAE, the corresponding position has not been filled or the transfer to that Executing Office of a suitable official\nto cover those functions has not been achieved.\n\nVI.—That Decreto Ejecutivo N° 29735-MINAE defines for the cited\nExecuting Office a series of functions that involve the preparation of plans or Engineering\nor Architecture drawing and that given the lack of an Architectural Draftsperson, their fulfillment is\nmaterially impossible, a situation that in turn affects the adequate\nfulfillment of other related functions.\n\nVII.—That given the noted reality and in attention to the sense of\nresponsibility that should characterize the Administration, a\nmodification of the cited Decreto Ejecutivo N° 29735-MINAE is binding, so that the functions\nthat it stipulates for MINAE are consistent with its capacity to fulfill them. Therefore:\n\nTHEY DECREE:\n\nArticle 1.—The text of article 1 of Decreto\nNº 29735- MINAE is modified as follows:\n\nArticle 1.—The Advisory Office on Physical Infrastructure of the Ministry of Environment and\nEnergy is created, as an advisory and technical and normative support office, responsible for the\noversight (fiscalización) of all major works projects, relating to the development, expansion and\ngeneral conditioning of MINAE's physical plant, in accordance with the Ministry's Annual Operating Plan\nand the respective budget allocations.
