  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 33168\n\n                        Deroga Reforma Reglamento para el Control de Contaminación por Ruido\n\nTexto Completo acta: 9C2E1\nNº 33168\n\nNº 33168\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LA MINISTRA DE SALUD\n\n \n\nEn ejercicio de las facultades\nque les confiere el artículo 140, incisos 3) y 18), de la Constitución\nPolítica, 28 de la Ley N° 6227 de 2 de mayo de 1978, Ley General de la\nAdministración Pública y 2) y 7), de la Ley N° 5395 del 23 de octubre de 1997\nLey General de Salud.\n\n \n\nConsiderando:\n\n \n\nI.-Que mediante Decreto N°\n28718-S del 15 de junio del 2000, publicado en La Gaceta N° 155 del 14\nde agosto del 2000, el Poder Ejecutivo emitió el Reglamento para el Control de\nContaminación por Ruido.\n\nII.-Que la Defensoría de los\nHabitantes de la República, interpuso ante la Sala Constitucional de la Corte\nSuprema de Justicia, Acción de Inconstitucionalidad contra el supracitado\nDecreto Nº 28718-S.\n\nIII.-Que el Decreto Nº 28718-S\nseñalado supra, mediante su numeral 30, derogó los artículos 6º y 50 del\nDecreto Ejecutivo N° 11492-S de 22 de abril de 1980 y sus reformas.\n\nIV.-Que al no existir norma\nlegal vigente que permitiera a las autoridades de salud ejercer el control de\nla contaminación por ruido, se hizo necesario derogar el artículo 30 del\nDecreto Ejecutivo N° 28718-S, con el objeto de poner de nuevo en vigencia los\nartículos 6º y 50 del Decreto Ejecutivo N° 11492-S y sus reformas.   "body_en_text": "**Full Text of Regulation 33168**\n\n**Repeals Reform Regulation for Noise Pollution Control**\n\nFull Text record: 9C2E1\nNo. 33168\n\nNo. 33168\n\nTHE PRESIDENT OF THE REPUBLIC\nAND THE MINISTER OF HEALTH\n\nIn exercise of the powers conferred upon them by Article 140, subsections 3) and 18), of the Political Constitution, 28 of Law No. 6227 of May 2, 1978, General Law of Public Administration, and 2) and 7) of Law No. 5395 of October 23, 1997, General Health Law.\n\nConsidering:\n\nI.—That through Decree No. 28718-S of June 15, 2000, published in La Gaceta No. 155 of August 14, 2000, the Executive Branch issued the Regulation for Noise Pollution Control.\n\nII.—That the Office of the Ombudsman (Defensoría de los Habitantes de la República) filed before the Constitutional Chamber of the Supreme Court of Justice an Unconstitutionality Action against the aforementioned Decree No. 28718-S.\n\nIII.—That Decree No. 28718-S indicated above, through its section 30, repealed Articles 6 and 50 of Executive Decree No. 11492-S of April 22, 1980, and its amendments.\n\nIV.—That in the absence of a valid legal provision allowing health authorities to exercise noise pollution control, it became necessary to repeal Article 30 of Executive Decree No. 28718-S, in order to bring Articles 6 and 50 of Executive Decree No. 11492-S and its amendments back into force. Said reinstatement was achieved through Executive Decree No. 29190-S of December 4, 2000, promulgated in La Gaceta No. 248 of December 27, 2000.\n\nV.—That through Decision (Voto) No. 05-016777 at 16:54 hours on November 30, 2005, the Constitutional Chamber of the Supreme Court of Justice declared the Unconstitutionality Action brought by the Office of the Ombudsman against the Noise Pollution Control Regulation to be without merit.\n\nVI.—That based on the foregoing, the existence of Decree No. 29190-S of December 4, 2000, cited above, is rendered unnecessary. Therefore,\n\nDECREE:\n\nArticle 1.—Repeal Executive Decree No. 29190-S, published in La Gaceta No. 248 of December 27, 2000.\n\nArticle 2.—This Decree shall take effect upon its publication.\n\nGiven at the Office of the President.—San José, on the seventeenth day of May, two thousand six."
