33103\n\nNº 33103\n\n \n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DE\nAGRICULTURA Y GANADERÍA\n\n \n\nEn ejercicio de\nlas atribuciones establecidas en los artículos 140, incisos 3), 8), 18) y 20) y\n146 de la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley Nº 6227\ndel 2 de mayo de 1978, Ley General de la Administración Pública y la Ley Nº\n7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria.\n\n \n\nConsiderando:\n\n \n\n1º-Que de\nconformidad con la Ley de Protección Fitosanitaria Nº7664, al Ministerio de\nAgricultura y Ganadería, le corresponde regular aquellas actividades cuya\nejecución incida directamente sobre la Sanidad Vegetal o productos\nfitosanitarios utilizados en el país.\n\n2º-Que la\nutilización de controladores biológicos, en particular artrópodos y nemátodos\nconstituye una importante herramienta en el Manejo Integrado de Plagas.\n\n3º-Que en\nconsecuencia tiene que estar regulada la importación, exportación,\nreexportación, investigación, producción, envasado, comercialización, calidad,\nuso y manejo, de organismos invertebrados de uso agrícola para el control de\nplagas agrícolas a fin de que no causen perjuicios a la agricultura y al\nambiente.\n\n4º-Que corresponde\nal Estado fomentar la participación de los sectores público y privado en las\nactividades relacionadas con la utilización de organismos benéficos de uso\nagrícola por lo que es necesario establecer requisitos y procedimientos para el\nregistro y control de los mismos al igual que para su calidad y eficacia.\n\n5º-Que corresponde\nal Ministerio de Agricultura y Ganadería coordinar con el sector privado y\notras entidades competentes nacionales e internacionales programas integrales\nde capacitación en Manejo Integrado de Plagas (MIP), transferir información al\nagricultor y fomentar el desarrollo de buenas prácticas agrícolas así como la\ninocuidad de alimentos y el uso eficiente y comercialización de organismos\nbenéficos de uso agrícola. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nEl siguiente,\n\n \n\nReglamento\nTécnico para el Registro de Organismos\n\nInvertebrados\n(Artrópodos y Nematodos)\n\nde\nUso Agrícola\n\n \n\nArtículo 1º-Objetivo\ny Ámbito de Aplicación. El presente Reglamento establece las regulaciones\npara la importación, investigación, comercialización, uso y calidad, de\norganismos invertebrados de uso agrícola para el control de plagas agrícolas a\nfin de que no causen perjuicios a la agricultura y al ambiente.\n\nEste Reglamento no\nincluye los organismos benéficos genéticamente modificados.\n\nArtículo 2º-Definiciones.\nPara efectos de la aplicación del presente Reglamento, se establecen las\nsiguientes definiciones:\n\n1. Agente de\nControl Biológico: Enemigo natural, antagonista, o competidor u otro\norganismo, utilizado para el control de plagas.\n\n2. Ambiente:\nEs el entorno, incluyendo el agua, el aire, el suelo y su interrelación, así\ncomo las relaciones entre estos elementos y los organismos vivos.\n\n3. Análisis de\nRiesgo: Proceso de evaluación y análisis, de las evidencias biológicas,\ncientíficas y económicas para determinar las medidas fitosanitarias que han de\nadoptarse.\n\n4. Artrópodo:\nTérmino que se aplica a animales invertebrados dotados de un esqueleto externo\ny apéndices articulados.\n\n5. Clase de\nProducto: Acaricida, insecticida, nematicida, herbicida, fungicida,\npolinizador biológico a base de organismos invertebrados de uso agrícola.\n\n6. Comercialización:\nEl proceso de la distribución y venta de organismos invertebrados de uso\nagrícola.\n\n7. Control\nBiológico: Estrategia de control contra plagas en que se utilizan enemigos\nnaturales, antagonistas, o competidores vivos, u otras entidades bióticas\ncapaces de reproducirse.\n\n8. Control de\nCalidad: Aplicación de procedimientos para verificar que el organismo\ninvertebrado de uso agrícola, cumple con lo establecido en las normas\nrespectivas.\n\n9. Envase:\nEl recipiente que contiene organismos invertebrados de uso agrícola.\n\n10. Especificidad:\nMedida del rango de hospederos de un agente de control biológico bajo una\nescala que va desde el especializado extraordinariamente, que sólo puede\ncompletar el desarrollo en una especie o cepa única de su huésped (monófago)\nhasta el general, con muchos hospederos que comprenden varios grupos de\norganismos (polífago).\n\n11. Etiqueta:\nMaterial impreso o gráfico que acompaña al envase, con la información del\nproducto registrado.\n\n12. Hospedero:\nCualquier sustrato orgánico que sirva de alimento a un organismo vivo.\n\n13. Importador:\nPersona física o jurídica registrado en el SFE(*), que introduce al país\norganismos invertebrados de uso agrícola.\n\n(Nota de Sinalevi: Mediante\n el artículo 48 del Reglamento de la\n Estructura Organizativa del Servicio Fitosanitario del Estado,\n aprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\n indica que las\n funciones asignadas al SFE  serán realizadas por el Departamento de\n Biotecnología.\")\n\n14. Introducción:\nLiberación de un agente de control biológico en un ecosistema donde no existía\nanteriormente.\n\n15. Legislación:\nConjunto de leyes que integran el derecho positivo de\n\nun Estado.\n\n16. Nombre\nComercial: Nombre con el cual la empresa registrante identifica, registra y\ncomercializa un organismo invertebrado de uso agrícola.\n\n17. Organismo\nInvertebrado: Artrópodos y nemátodos de uso agrícola utilizados por el\nhombre en el combate de plagas.\n\n18. Organismos\nInvertebrados Ausentes: Artrópodos y nemátodos de uso agrícola no presentes\nen un país.\n\n19. Organismo\nInvertebrados Presentes: Artrópodos y nemátodos de uso agrícola presentes\nen un país.\n\n20. Origen:\nTerritorio geográfico nativo del invertebrado\n\n21. Permiso de\nImportación: Documento oficial que autoriza la importación de organismos\ninvertebrados de uso agrícola de conformidad con requisitos fitosanitarios\nespecíficos.\n\n22. Plaga:\nCualquier especie, raza o biotipo vegetal o animal o agente patógeno dañino\npara las plantas o productos vegetales.\n\n23. Productor:\nPersona física o jurídica encargada de reproducir organismos invertebrados de\nuso agrícola con fines de comercialización.\n\n24. Registrante:\nPersona física o jurídica que solicite el servicio de registro de un producto\nfitosanitario u organismo invertebrado ante el SFE(*).\n\n(Nota de Sinalevi: Mediante el\nartículo 48 del Reglamento de la Estructura\nOrganizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n25. Registro:\nProcedimiento legal mediante el cual todos los organismos invertebrados de uso\nagrícola son autorizados por el Ministerio para su venta y uso, de acuerdo a lo\nestablecido en el presente Reglamento.\n\n26. Tipo de\nacción: Modo de acción del organismo invertebrado de uso agrícola\n(parasitoide, depredador, polinizador y mutualista) sobre las distintas plagas.\n\n27. Titular del\nRegistro: Persona física o jurídica propietaria del registro de un\norganismo invertebrado de uso agrícola en el SFE(*).\n\n(Nota de Sinalevi: Mediante el\nartículo 48 del Reglamento de la Estructura\nOrganizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 3º-Abreviaturas.\nEn el presente Reglamento se utilizarán las siguientes abreviaturas:\n\nSFE(*): Servicio Fitosanitario del Estado.\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nMAG: Ministerio de Agricultura y Ganadería.\n\nMIP: Manejo Integrado de Plagas.\n\nArtículo 4º-Sobre el Registro.\n\n \n\n4.1. Sobre el registro de persona física o\njurídica:\n\n4.1.1. Toda persona física o\njurídica que desee importar, exportar, reexportar, producir, reempacar, reenvasar y\ncomercializar, organismos invertebrados de uso agrícola, o realizar\n\ninvestigaciones con fines de\nregistro de productos, deberá estar inscrita ante el SFE(*)\nsegún las disposiciones de este Reglamento.\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n4.1.2. Para el proceso de registro\nel interesado debe llenar el formulario de inscripción (anexo 1) y presentarlo\nante el Programa de Registro del SFE(*)\ncon la siguiente información y/o documentación:\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\na) Certificación de la personería\njurídica vigente.\n\nb) Original para ser confrontada o\ncopia certificada de la cédula jurídica vigente.\n\nc) Indicación expresa y calidades\ndel regente autorizado y su inscripción en el Colegio de Ingenieros, indicando\nel número de colegiado y fotocopia de la cédula de identidad del regente.\n\nd) Información o datos de la\ninscripción de la empresa en el Colegio de Ingenieros Agrónomos.\n\ne) Firmas autorizadas para trámites\nen el Registro.\n\n \n\n4.1.3. El SFE(*)\ntendrá un plazo máximo de diez días hábiles para aprobar o rechazar la\nsolicitud.\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.2. Sobre el registro del producto comercial:\n\n \n\n4.2.1. Todo producto comercial de\nun organismo invertebrado de uso agrícola que se comercialice y/o produzca en\nel país, debe estar registrado ante el SFE(*).\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.2.2. Para el proceso de registro\nde organismos invertebrados de uso agrícola, la persona física o jurídica\ndeberá presentar una solicitud escrita al SFE(*)\ny la siguiente información:\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n4.2.2.1. Datos del registrante\n\na) Nombre de la persona física o\njurídica que solicita el registro.\n\nb) Calidades y generalidades del\nrepresentante de la compañía.\n\nc) Calidades y generalidades del\nregente agrícola indicando el número de colegiado.\n\nd) Lugar para oír notificaciones.\n\ne) Firmas del representante legal y\nregente agrícola avalando la información.\n\n \n\n4.2.2.2.\nDatos del producto comercial\n\n \n\na) Nombre comercial del producto.\n\nb) Nombre científico del Organismo\nInvertebrado de Uso Agrícola.\n\nc) Nombre del fabricante y país de\norigen.\n\nd) Tipo de acción y clase\n(parasitoide, depredador, polinizador, mutualista/ nematicida,\nacaricida, insecticida, fungicida, herbicida).\n\ne) Fase del ciclo biológico en la\ncual se comercializa el producto (huevo, larva, pupa, ninfa o adulto).\n\nf) Fase del ciclo biológico en el\nque actúa el producto (huevo, larva, pupa, ninfa o adulto).\n\ng) Tipo y características de los\ningredientes inertes.\n\nh) Certificado de calidad emitido\npor una institución reconocida por el SFE(*).\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\ni) Metodología para el análisis de\ncontrol de calidad por parte del productor o fabricante.\n\n \n\n4.2.2.3.\nInformación para la identificación del Organismo Invertebrado\n\n \n\na) Clasificación taxonómica del\norganismo invertebrado de uso agrícola.\n\nb) Información y datos para su\nidentificación e instituciones especializadas en el tema.\n\nc) Ciclo de vida y descripción general\nde todos los estadíos de desarrollo del organismo\ninvertebrado.\n\n \n\n4.2.2.4.\nInformación Sobre el Uso del Organismo Invertebrado\n\n \n\na) Nombre común y clasificación\ntaxonómica de la o las plagas a controlar.\n\nb) Rango de hospederos de la(s)\nplaga(s).\n\nc) Especificidad del organismo\ninvertebrado de uso agrícola.\n\nd) Información sobre enemigos\nnaturales.\n\ne) Indicaciones sobre su uso en\ncampo, intervalo entre aplicaciones y dosis recomendadas.\n\nf) Compatibilidad con productos\nquímicos, y otros organismos benéficos.\n\ng) Condiciones fitosanitarias y\nambientales para su uso.\n\n \n\n4.2.2.5.\nProyecto de Etiqueta\n\n \n\na) Nombre comercial.\n\nb) Nombre científico.\n\nc) Presentación (cantidad).\n\nd) Productor.\n\ne) Registrante.\n\nf) País de origen.\n\ng) Número y fecha de Registro.\n\nh) Uso agronómico.\n\ni) Condiciones de almacenamiento.\n\n \n\n4.2.3. Cuando se trate de\norganismos invertebrados de uso agrícola presentes en el país y que no se\nconsideren plaga, el SFE(*) deberá\npronunciarse en un plazo de treinta días hábiles siguientes a la fecha de\npresentación de la solicitud y demás requisitos completos, aprobando o\nrechazando el registro.\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n4.2.4. Cuando se trate de organismos invertebrados de uso agrícola ausentes en el país, el SFE(*)\nrealizará el análisis de riesgo correspondiente y supervisará el Ensayo de Adaptabilidad y\nEfectividad de Organismos Invertebrados Ausentes en el país si corresponde.\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n4.2.5. En caso de solicitudes de registro de organismos invertebrados de uso agrícola ausentes en el\npaís, el SFE(*) deberá pronunciarse aprobando o rechazando el registro en un plazo de sesenta días\nhábiles siguientes a la fecha de presentación de la información requerida para el análisis de riesgo\ny/o de los resultados del Ensayo de Adaptabilidad y Efectividad de Organismos Invertebrados Ausentes\nen el país según corresponda.\n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n4.2.6. El interesado deberá\npresentar solicitud por escrito al SFE(*)\npara que realice el análisis de riesgo correspondiente aportando la siguiente\ninformación (emitida por una autoridad reconocida por el SFE(*) en\nidioma español):\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\na) Efectos al ambiente, animales no\nobjetivos y efectos secundarios del organismo invertebrado.\n\nb) Experiencias en países donde se\nhaya liberado el organismo invertebrado.\n\nc) Medios de dispersión.\n\nd) Documentación aportada por la\nempresa que indique los beneficios relacionados a la efectividad y especificidad\nbiológica con la introducción del organismo invertebrado.\n\n \n\n4.2.7 Cuando el SFE(*)\ndetermine que el nivel de riesgo es aceptable y que se puede continuar con el\nproceso de registro, la persona física o jurídica deberá presentar solicitud\npor escrito al SFE(*) para realizar una prueba de eficacia biológica y\naportar el Protocolo para el Ensayo de Adaptabilidad Y Efectividad de\nOrganismos Invertebrados Ausentes en el país.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.2.8. El protocolo de Ensayo de\nAdaptabilidad y Efectividad de Organismos Invertebrados de Uso Agrícola deberá\nser elaborado y publicado por el SFE(*)\nen su página Web en un plazo de treinta días posteriores a la entrada en\nvigencia del presente reglamento.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el Departamento\nde Biotecnología.\")\n\n \n\n4.2.9. A las resoluciones emitidas\npor el SFE(*) les caben recursos de\nrevocatoria ante el Jefe del Departamento de Insumos Agrícolas, apelación ante\nel Director del SFE(*) y revisión ante el Ministro de Agricultura y Ganadería\nsegún lo establecido en la Ley General de la Administración Pública.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.2.10. Toda solicitud de\ninscripción deberá publicarse en el diario oficial por tres días consecutivos,\nhaciendo una breve descripción de la misma y confiriendo a terceros un plazo de\ndiez días hábiles a partir de la tercera publicación, para presentar\noposiciones.\n\n4.2.11. De presentarse una\noposición se notificará al registrante, quien deberá ofrecer sus pruebas de\ndescargo dentro del término de 3 días hábiles contando a partir del momento en\nque fue notificado. Transcurrido este plazo, el SFE(*)\ndebe resolver en el período de 8 días hábiles.\n\n4.2.12.\nPresentar el comprobante de pago de la tarifa 3.a establecida en el Decreto Ejecutivo\nN° 27763 Fijación de tarifas de los servicios del Ministerio de Agricultura y\nGanadería, del 10 de marzo de 1999.\n\n \n\n(Así\nadicionado el inciso anterior por el artículo 1° del decreto ejecutivo N° 44720\ndel 6 de agosto del 2024)\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el Departamento\nde Biotecnología.\")\n\n \n\n4.3. De la vigencia, modificación, suspensión y\ncancelación del registro\n\n \n\n4.3.1. El Registro de organismos\ninvertebrados de uso agrícola tendrá una vigencia de diez años, sin perjuicio\nde la potestad que tiene el SFE(*) para realizar\nestudios sobre la base de los programas de seguimiento y vigilancia post\nregistro, adoptando las disposiciones pertinentes conforme a la ley.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.3.2. El Registro de Organismos\nInvertebrados de Uso Agrícola podrá ser modificado por el registrante,\npresentando solicitud por escrito con carácter de declaración jurada en los\nsiguientes casos:\n\n \n\na) Cuando cambie el titular del\nregistro, adjuntando los datos y credenciales del nuevo titular.\n\nb) Cuando se amplíe o cambie el\npaís de origen, adjuntando certificación del laboratorio productor, demostrando\nque el proceso de producción es igual al registrado originalmente.\n\nc) Cuando cambie el nombre\ncomercial, adjuntando certificación del Registro de Marcas y nombre comercial a\ndesignar.\n\nd) Cuando se modifique la\npresentación, adjuntando presentaciones, sellos de seguridad y clase de\nempaque.\n\ne) Cuando se adicionen nuevas\nplagas para los cuales se registró el producto aportando la documentación\ncorrespondiente.\n\nf) Cuando cambie el formato o el\ncontenido de la etiqueta, para lo cual el interesado suministrará el nuevo\nproyecto de etiqueta con los cambios propuestos.\n\n \n\n4.3.3. Las modificaciones al\nregistro de un determinado organismo invertebrado, se realizarán mediante\nresolución técnica administrativa del SFE(*).\nDicha modificación conservará el número y fecha de registro correspondiente.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.3.4. La suspensión, restricción\nde uso y/o cancelación del registro de organismos invertebrados de uso agrícola\nprocede, según sea el caso:\n\n \n\na) Cuando lo solicite el titular\ndel registro.\n\nb) Cuando el SFE(*)\nlo determine bajo justificación técnica científica o legal.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.3.5. La cancelación del registro\nde organismos invertebrados de uso agrícola no es obstáculo para la aplicación\nde las demás sanciones o reparaciones civiles, penales o administrativas que\ncorrespondan, de conformidad con la legislación nacional aplicable.\n\n \n\n4.4. De los derechos y obligaciones del titular de\nregistro\n\n \n\n4.4.1. El titular del registro de\nun producto comercial a base de organismos invertebrados de uso agrícola debe\nsolicitar por escrito la reinscripción del registro ante el SFE(*)\ncon seis meses de antelación al vencimiento. Si no se renueva el registro,\nautomáticamente es cancelado.\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.4.2. El titular de un registro,\nmediante una notificación de autorización, podrá facultar a una o varias\npersonas a ejercer las actividades de importación, exportación, reexportación,\nproducción, reempaque, reenvasado\no comercialización, según la inscripción realizada ante el SFE(*).\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\n \n\n4.4.3. El titular del registro de\norganismos invertebrados de uso agrícola debe facilitar la labor de supervisión\ndel SFE(*).\n\n \n\n(Nota\nde Sinalevi: Mediante el artículo 48 del Reglamento\nde la Estructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las funciones\nasignadas al SFE  serán realizadas por el\nDepartamento de Biotecnología.\")\n\nArtículo 5º-De\nlas importaciones.\n\n \n\n5.1. Importación\nde Organismos Invertebrados de Uso Agrícola para la investigación con fines de\nregistro.\n\n \n\n5.1.1. El SFE(*) será\nel responsable de regular y supervisar la introducción e investigación con\nfines de registro y de establecer los procedimientos de cuarentena post entrada\nde organismos invertebrados de uso agrícola.\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n5.1.2. Todo\norganismo invertebrado de uso agrícola que se quiera importar debe estar\nregistrado ante el Programa de Registro del SFE(*), excepto cuando el SFE(*) lo\nautorice en caso de investigación con fines de registro o emergencia y\nsiguiendo las disposiciones descritas en este reglamento.\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n5.1.3. El\ninteresado en importar un organismo invertebrado de uso agrícola con fines de\ninvestigación para registro, deberá solicitarlo por escrito ante el SFE(*) y\naportar la siguiente información:\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n \n\na) Calidades y\ndatos del solicitante.\n\nb) Nombre del\nproducto comercial.\n\nc) Nombre\ncientífico y común de la especie.\n\nd) Nombre\ncientífico y común de las plagas que controla.\n\ne) Aportar\ninformación técnica de la procedencia del organismo.\n\nf) Análisis del\nriesgo aprobado por el SFE(*).\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\ng) Presentación\ndel producto.\n\nh) Cantidad de\nproducto requerido a importarse.\n\ni) Propuesta de\ninvestigación para organismos invertebrados de uso agrícola presentes en el\npaís sin estar registrados.\n\nj) Protocolo para\nEnsayo de Adaptabilidad Y Efectividad de Organismos Invertebrados Ausentes\naprobado por el SFE(*).\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n \n\n5.1.4. El SFE(*)\n\ncontará con diez días naturales a partir del recibo de la solicitud y de la\ninformación completa para otorgar o denegar el permiso de importación para\ninvestigación con fines de registro. En caso de rechazo de la solicitud el SFE(*)\ndeberá documentar y explicar su decisión.\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\n5.1.5. El permiso\nde importación para la investigación con fines de registro tendrá la vigencia\naprobada según lo propuesto en los protocolos de investigación y podrá ser\nampliado, debiendo presentar\nsolicitud justificada treinta días hábiles antes de su vencimiento y adjuntando\nun informe de los datos obtenidos durante la primera investigación.\n\n5.1.6. Toda\nimportación de organismos invertebrados de uso agrícola, no autorizada por el\nSFE(*), debe ser devuelta a su lugar de origen o destruida. El costo correrá por\nparte del importador.\n\n \n\n(Nota de Sinalevi:\nMediante el artículo 48 del Reglamento de la\nEstructura Organizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 6º-Del\nControl de Calidad.\n\n \n\n6.1. Le\ncorresponderá al SFE(*) ejercer el Control de Calidad sobre los Organismos\nInvertebrados de Uso Agrícola estableciendo las normas que correspondan.\n\n \n\n(Nota de Sinalevi: Mediante\nel artículo 48 del Reglamento de la Estructura\nOrganizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 7º-De\nlas Emergencias Fitosanitarias.\n\n \n\n7.1. En los casos\nde emergencia fitosanitaria declarada oficialmente, el SFE(*) podrá autorizar la\nimportación y utilización de organismos invertebrados de uso agrícola presentes\nen el país y no registrados, mientras prevalezca dicha situación.\n\n \n\n(Nota de Sinalevi: Mediante\nel artículo 48 del Reglamento de la Estructura\nOrganizativa del Servicio Fitosanitario del Estado,\naprobado mediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 8º-Del\nEtiquetado.\n\n \n\n8.1. Toda etiqueta\ncontendrá la información estipulada en el punto 4.2.2.5.\n\nArtículo 9º-Del\nmanejo de la información.\n\n \n\n9.1. El SFE(*) creará\ny administrará una base de datos con información de organismos invertebrados de\nuso agrícola para darle soporte informático a la gestión del registro.\n\n9.2. El\nregistrante de organismos invertebrados de uso agrícola podrá indicar cuáles\ndatos corresponden a secretos industriales o comerciales. El SFE(*) mediante\nresolución declarará como información confidencial toda aquella que considere\nsegún lo establecido por la legislación vigente.\n\n9.3. Los datos\ntécnicos y los resultados de los ensayos de eficacia empleados para el registro\nde organismos invertebrados de uso agrícola, no pueden ser utilizados para el\nregistro de otro producto, salvo que se trate del mismo titular del registro o\nun tercero autorizado por el titular del registro.\n\n(Nota de Sinalevi: Mediante el artículo 48\ndel Reglamento de la Estructura Organizativa\ndel Servicio Fitosanitario del Estado, aprobado\nmediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 10.-Especificaciones.\n\n \n\n10.1. Los\ndocumentos legales, así como las certificaciones emitidas fuera del país con\nfines de registro no deben de tener más de un año de consularizadas y las\ncertificaciones nacionales más de tres meses.\n\n10.2. El SFE(*) debe\ncapacitar al personal involucrado en la importación de organismos invertebrados\nde uso agrícola a fin de agilizar el proceso, considerando su naturaleza\naltamente perecedera.\n\n10.3. El SFE(*) podrá\nsolicitar mayor información al registrante en caso de ser requerida, lo cual\ndeberá justificarse debidamente.\n\n10.4. El SFE(*) podrá\nautorizar la producción y liberación de organismos invertebrados de uso\nagrícola de instituciones del Estado para la investigación y desarrollo de sus\nacciones sin fines de lucro. Estas deberán informar al SFE(*) de sus actividades a\nfin de ejercer los controles de calidad correspondientes.\n\n(Nota de Sinalevi: Mediante el artículo 48\ndel Reglamento de la Estructura Organizativa\ndel Servicio Fitosanitario del Estado, aprobado\nmediante decreto ejecutivo N° 36801 del 20 de setiembre del 2011, se\nindica que las\nfunciones asignadas al SFE  serán realizadas por el Departamento de\nBiotecnología.\")\n\nArtículo 11.-Rige\na partir de su publicación.\n\nDISPOSICIONES\nTRANSITORIAS\n\n \n\nI.-El Titular de\nun Registro de Organismos Invertebrados de Uso Agrícola que se haya registrado\namparado al Decreto Ejecutivo Nº 24337-MAG-S, tendrá un plazo de un año\ncalendario, contado a partir de la publicación del presente Decreto, para\nactualizar la información suministrada en el registro anterior, conforme a lo\ndispuesto en este Reglamento.\n\nII.-Todo productor\nnacional de Organismos Invertebrados de Uso Agrícola contará con un plazo de un\naño para powers established in Articles 140, subsections 3), 8), 18) and 20) and\n146 of the Political Constitution, Articles 25, 27.1, 28.2b of Law Nº 6227\nof May 2, 1978, General Law of Public Administration and Law Nº\n7664 of April 8, 1997, Plant Protection Law.\n\n \n\nConsidering:\n\n \n\n1º-That in\naccordance with the Plant Protection Law Nº7664, the Ministry of\nAgriculture and Livestock is responsible for regulating those activities whose\nexecution directly affects Plant Health or phytosanitary products used in the country.\n\n2º-That the\nuse of biological control agents, particularly arthropods and nematodes,\nconstitutes an important tool in Integrated Pest Management.\n\n3º-That consequently,\nthe import, export, re-export, research, production, packaging, marketing, quality,\nuse and handling of invertebrate organisms for agricultural use for the control of\nagricultural pests must be regulated so that they do not cause damage to agriculture and the\nenvironment.\n\n4º-That it is the State's\nresponsibility to promote the participation of the public and private sectors in\nactivities related to the use of beneficial organisms for agricultural use, therefore it is necessary to establish requirements and procedures for the\nregistration and control of the same, as well as for their quality and efficacy.\n\n5º-That it is the responsibility\nof the Ministry of Agriculture and Livestock to coordinate with the private sector and\nother competent national and international entities comprehensive\ntraining programs in Integrated Pest Management (IPM), to transfer information to the\nfarmer and to promote the development of good agricultural practices as well as\nfood safety and the efficient use and marketing of beneficial\norganisms for agricultural use. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nThe following,\n\n \n\nTechnical\nRegulation for the Registration of Invertebrate\n\nOrganisms (Arthropods and Nematodes)\n\nfor\nAgricultural Use\n\n \n\nArticle 1º-Objective\nand Scope of Application. This Regulation establishes the rules\nfor the import, research, marketing, use and quality, of\ninvertebrate organisms for agricultural use for the control of agricultural pests\nso that they do not cause damage to agriculture and the environment.\n\nThis Regulation does not\ninclude genetically modified beneficial organisms.\n\nArticle 2º-Definitions.\nFor the purposes of applying this Regulation, the\nfollowing definitions are established:\n\n1. Biological Control\nAgent: Natural enemy, antagonist, or competitor or other\norganism, used for pest control.\n\n2. Environment:\nIt is the surroundings, including water, air, soil and their interrelation, as well\nas the relationships between these elements and living organisms.\n\n3. Risk\nAnalysis: Process of evaluation and analysis of biological,\nscientific and economic evidence to determine the phytosanitary measures to be\nadopted.\n\n4. Arthropod:\nTerm applied to invertebrate animals equipped with an external skeleton\nand jointed appendages.\n\n5. Product\nClass: Acaricide, insecticide, nematicide, herbicide, fungicide,\nbiological pollinator based on invertebrate organisms for agricultural use.\n\n6. Marketing:\nThe process of distribution and sale of invertebrate organisms for agricultural\nuse.\n\n7. Biological\nControl: Control strategy against pests in which\nnatural enemies, antagonists, or competitors, or other biotic\nentities capable of reproducing are used.\n\n8. Quality\nControl: Application of procedures to verify that the invertebrate\norganism for agricultural use complies with the provisions of the respective\nstandards.\n\n9. Container:\nThe recipient that contains invertebrate organisms for agricultural use.\n\n10. Specificity:\nMeasure of the host range of a biological control agent on a\nscale ranging from the extraordinarily specialized, which can only\ncomplete development on a single species or strain of its host (monophagous)\nto the generalist, with many hosts comprising several groups of\norganisms (polyphagous).\n\n11. Label:\nPrinted or graphic material that accompanies the container, with the information of the\nregistered product.\n\n12. Host:\nAny organic substrate that serves as food for a living organism.\n\n13. Importer:\nNatural or legal person registered with the SFE(*), who introduces\ninvertebrate organisms for agricultural use into the country.\n\n(Note from Sinalevi: Through\n Article 48 of the Regulation of the\n Organizational Structure of the State Phytosanitary Service,\n approved by Executive Decree N° 36801 of September 20, 2011, it is\n indicated that the\n functions assigned to the SFE will be carried out by the Department of\n Biotechnology.\")\n\n14. Introduction:\nRelease of a biological control agent into an ecosystem where it did not\nexist previously.\n\n15. Legislation:\nSet of laws that make up the positive law of\n\na State.\n\n16. Trade\nName: Name with which the registrant company identifies, registers and\nmarkets an invertebrate organism for agricultural use.\n\n17. Invertebrate\nOrganism: Arthropods and nematodes for agricultural use used by\nman in the fight against pests.\n\n18. Absent\nInvertebrate Organisms: Arthropods and nematodes for agricultural use not present\nin a country.\n\n19. Present\nInvertebrate Organisms: Arthropods and nematodes for agricultural use present\nin a country.\n\n20. Origin:\nNative geographic territory of the invertebrate\n\n21. Import\nPermit: Official document that authorizes the import of\ninvertebrate organisms for agricultural use in accordance with specific\nphytosanitary requirements.\n\n22. Pest:\nAny species, race or biotype of plant or animal or pathogenic agent harmful\nto plants or plant products.\n\n23. Producer:\nNatural or legal person responsible for reproducing invertebrate organisms for\nagricultural use for marketing purposes.\n\n24. Registrant:\nNatural or legal person who requests the registration service for a phytosanitary\nproduct or invertebrate organism before the SFE(*).\n\n(Note from Sinalevi: Through\nArticle 48 of the Regulation of the Organizational\nStructure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n25. Registration:\nLegal procedure by which all invertebrate organisms for agricultural\nuse are authorized by the Ministry for their sale and use, in accordance with\nthe provisions of this Regulation.\n\n26. Type of\naction: Mode of action of the invertebrate organism for agricultural use\n(parasitoid, predator, pollinator and mutualist) on the different pests.\n\n27. Registration\nHolder: Natural or legal person who owns the registration of an\ninvertebrate organism for agricultural use at the SFE(*).\n\n(Note from Sinalevi: Through\nArticle 48 of the Regulation of the Organizational\nStructure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\nArticle 3º-Abbreviations.\nThe following abbreviations shall be used in this Regulation:\n\nSFE(*): State Phytosanitary Service.\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\nMAG: Ministry of Agriculture and Livestock.\n\nIPM: Integrated Pest Management.\n\nArticle 4º-On Registration.\n\n \n\n4.1. On the registration of a natural or\nlegal person:\n\n4.1.1. Any natural or\nlegal person who wishes to import, export, re-export, produce, repack, refill and\nmarket, invertebrate organisms for agricultural use, or to carry out\n\nresearch for product\nregistration purposes, must be registered with the SFE(*)\naccording to the provisions of this Regulation.\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n4.1.2. For the registration process,\nthe interested party must fill out the registration form (Annex 1) and submit it\nto the Registration Program of the SFE(*)\nwith the following information and/or documentation:\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\na) Certification of the current legal\nstatus.\n\nb) Original for comparison or\ncertified copy of the current legal identification card.\n\nc) Express indication and qualifications\nof the authorized technical manager and his/her registration with the College of Engineers, indicating\nthe membership number and a photocopy of the technical manager's identity card.\n\nd) Information or data on the\ncompany's registration with the College of Agronomic Engineers.\n\ne) Authorized signatures for procedures\nin the Registry.\n\n \n\n4.1.3. The SFE(*)\nshall have a maximum period of ten business days to approve or reject the\napplication.\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.2. On the registration of the commercial product:\n\n \n\n4.2.1. Every commercial product of\nan invertebrate organism for agricultural use that is marketed and/or produced in\nthe country must be registered with the SFE(*).\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.2.2. For the registration process\nof invertebrate organisms for agricultural use, the natural or legal person\nmust submit a written application to the SFE(*)\nand the following information:\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n4.2.2.1. Registrant data\n\na) Name of the natural or legal\nperson requesting the registration.\n\nb) Qualifications and generalities\nof the company representative.\n\nc) Qualifications and generalities of the\nagricultural technical manager, indicating the membership number.\n\nd) Place to hear notifications.\n\ne) Signatures of the legal representative and\nagricultural technical manager endorsing the information.\n\n \n\n4.2.2.2.\nCommercial product data\n\n \n\na) Trade name of the product.\n\nb) Scientific name of the Invertebrate\nOrganism for Agricultural Use.\n\nc) Name of the manufacturer and country of\norigin.\n\nd) Type of action and class\n(parasitoid, predator, pollinator, mutualist/ nematicide,\nacaricide, insecticide, fungicide, herbicide).\n\ne) Phase of the life cycle in\nwhich the product is marketed (egg, larva, pupa, nymph or adult).\n\nf) Phase of the life cycle in\nwhich the product acts (egg, larva, pupa, nymph or adult).\n\ng) Type and characteristics of the\ninert ingredients.\n\nh) Quality certificate issued by\nan institution recognized by the SFE(*).\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\ni) Methodology for the quality\ncontrol analysis by the producer or manufacturer.\n\n \n\n4.2.2.3.\nInformation for the Identification of the Invertebrate Organism\n\n \n\na) Taxonomic classification of the\ninvertebrate organism for agricultural use.\n\nb) Information and data for its\nidentification and institutions specialized in the subject.\n\nc) Life cycle and general description\nof all the developmental stages of the invertebrate\norganism.\n\n \n\n4.2.2.4.\nInformation on the Use of the Invertebrate Organism\n\n \n\na) Common name and taxonomic\nclassification of the pest or pests to be controlled.\n\nb) Host range of the pest(s).\n\nc) Specificity of the invertebrate\norganism for agricultural use.\n\nd) Information on natural\nenemies.\n\ne) Indications for its use in the\nfield, interval between applications and recommended doses.\n\nf) Compatibility with chemical\nproducts, and other beneficial organisms.\n\ng) Phytosanitary and environmental\nconditions for its use.\n\n \n\n4.2.2.5.\nLabel Draft\n\n \n\na) Trade name.\n\nb) Scientific name.\n\nc) Presentation (quantity).\n\nd) Producer.\n\ne) Registrant.\n\nf) Country of origin.\n\ng) Registration number and date.\n\nh) Agronomic use.\n\ni) Storage conditions.\n\n \n\n4.2.3. When dealing with\ninvertebrate organisms for agricultural use present in the country and that are not\nconsidered a pest, the SFE(*) must\nissue a decision within a period of thirty business days following the date of\nsubmission of the application and other complete requirements, approving or\nrejecting the registration.\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n4.2.4. When dealing with invertebrate organisms for agricultural use absent from the country, the SFE(*)\nshall carry out the corresponding risk analysis and supervise the Adaptability and Effectiveness Trial of\nAbsent Invertebrate Organisms in the country if applicable.\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n4.2.5. In the case of registration applications for invertebrate organisms for agricultural use absent from the\ncountry, the SFE(*) must issue a decision approving or rejecting the registration within a period of sixty business\ndays following the date of submission of the information required for the risk analysis\nand/or the results of the Adaptability and Effectiveness Trial of Absent Invertebrate Organisms\nin the country, as applicable.\n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n4.2.6. The interested party must\nsubmit a written application to the SFE(*)\nfor it to carry out the corresponding risk analysis, providing the following\ninformation (issued by an authority recognized by the SFE(*) in\nthe Spanish language):\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\na) Effects on the environment, non-target\nanimals and side effects of the invertebrate organism.\n\nb) Experiences in countries where\nthe invertebrate organism has been released.\n\nc) Means of dispersal.\n\nd) Documentation provided by the\ncompany indicating the benefits related to the effectiveness and biological specificity\nwith the introduction (introducción) of the invertebrate organism.\n\n \n\n4.2.7 When the SFE(*)\ndetermines that the risk level is acceptable and that the\nregistration process can continue, the natural or legal person must submit a written\napplication to the SFE(*) to carry out a biological efficacy test and\nprovide the Protocol for the Adaptability and Effectiveness Trial of\nAbsent Invertebrate Organisms in the country.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.2.8. The protocol for the Adaptability and Effectiveness Trial of\nInvertebrate Organisms for Agricultural Use must\nbe prepared and published by the SFE(*)\non its Web page within a period of thirty days after the entry into\nforce of this regulation.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the Department\nof Biotechnology.\")\n\n \n\n4.2.9. Resolutions issued\nby the SFE(*) are subject to appeals for\nreconsideration before the Head of the Department of Agricultural Inputs, appeal before\nthe Director of the SFE(*) and review before the Minister of Agriculture and Livestock\nas established in the General Law of Public Administration.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.2.10. Any registration\napplication must be published in the official gazette for three consecutive days,\nproviding a brief description of the same and granting third parties a period of\nten business days from the third publication, to present\noppositions.\n\n4.2.11. If an opposition is presented,\nthe registrant shall be notified, who must offer their exculpatory evidence\nwithin a term of 3 business days counting from the moment\nin which they were notified. Once this period has elapsed, the SFE(*)\nmust resolve within a period of 8 business days.\n\n4.2.12.\nSubmit proof of payment of fee 3.a established in Executive Decree\nN° 27763 Fixing of tariffs for the services of the Ministry of Agriculture and\nLivestock, of March 10, 1999.\n\n \n\n(Thus added the previous subsection by Article 1 of Executive Decree N° 44720\nof August 6, 2024)\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the Department\nof Biotechnology.\")\n\n \n\n4.3. On the validity, modification, suspension and\ncancellation of the registration\n\n \n\n4.3.1. The Registration of invertebrate\norganisms for agricultural use shall have a validity of ten years, without prejudice\nto the power that the SFE(*) has to carry out\nstudies based on post-registration monitoring and surveillance\nprograms, adopting the pertinent provisions in accordance with the law.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.3.2. The Registration of Invertebrate\nOrganisms for Agricultural Use may be modified by the registrant,\nby submitting a written application in the form of a sworn statement in the\nfollowing cases:\n\n \n\na) When the registration holder\nchanges, attaching the data and credentials of the new holder.\n\nb) When the country of origin is expanded or changed, attaching certification from the producing laboratory, demonstrating\nthat the production process is the same as the one originally registered.\n\nc) When the trade\nname changes, attaching certification from the Trademark and Trade Name Registry\nto be designated.\n\nd) When the presentation is modified, attaching presentations, security seals and type of\npackaging.\n\ne) When new\npests are added for which the product was registered, providing the corresponding\ndocumentation.\n\nf) When the format or\ncontent of the label changes, for which the interested party shall supply the new\nlabel draft with the proposed changes.\n\n \n\n4.3.3. Modifications to the\nregistration of a specific invertebrate organism shall be made by\ntechnical administrative resolution of the SFE(*).\nSaid modification shall retain the corresponding registration number and date.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.3.4. The suspension, restriction\nof use and/or cancellation of the registration of invertebrate organisms for agricultural use\nis applicable, as the case may be:\n\n \n\na) When requested by the registration\nholder.\n\nb) When the SFE(*)\ndetermines it under technical scientific or legal justification.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.3.5. The cancellation of the registration\nof invertebrate organisms for agricultural use is not an obstacle to the application\nof other applicable civil, criminal or administrative sanctions or reparations\nthat may apply, in accordance with applicable national legislation.\n\n \n\n4.4. On the rights and obligations of the registration\nholder\n\n \n\n4.4.1. The holder of the registration of\na commercial product based on invertebrate organisms for agricultural use must\nrequest in writing the renewal of the registration before the SFE(*)\nsix months before expiry. If the registration is not renewed, it\nis automatically cancelled.\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.4.2. The holder of a registration,\nby means of an authorization notification, may empower one or several\npersons to carry out the activities of import, export, re-export,\nproduction, repacking, refilling\nor marketing, according to the registration made before the SFE(*).\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\n \n\n4.4.3. The registration holder of\ninvertebrate organisms for agricultural use must facilitate the supervision work\nof the SFE(*).\n\n \n\n(Note\nfrom Sinalevi: Through Article 48 of the Regulation\nof the Organizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the functions\nassigned to the SFE will be carried out by the\nDepartment of Biotechnology.\")\n\nArticle 5º-On\nImports.\n\n \n\n5.1. Import\nof Invertebrate Organisms for Agricultural Use for research for registration\npurposes.\n\n \n\n5.1.1. The SFE(*) shall be\nresponsible for regulating and supervising the introduction (introducción) and research for\nregistration purposes and for establishing post-entry quarantine procedures\nfor invertebrate organisms for agricultural use.\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n5.1.2. Any\ninvertebrate organism for agricultural use that is to be imported must be\nregistered with the Registration Program of the SFE(*), except when the SFE(*)\nauthorizes it in the case of research for registration purposes or emergency and\nfollowing the provisions described in this regulation.\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n5.1.3. The\ninterested party in importing an invertebrate organism for agricultural use for\nresearch for registration purposes, must request it in writing before the SFE(*) and\nprovide the following information:\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n \n\na) Qualifications and\ndata of the applicant.\n\nb) Name of the\ncommercial product.\n\nc) Scientific\nand common name of the species.\n\nd) Scientific\nand common name of the pests it controls.\n\ne) Provide\ntechnical information on the origin of the organism.\n\nf) Risk\nanalysis approved by the SFE(*).\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\ng) Product\npresentation.\n\nh) Quantity of\nproduct required to be imported.\n\ni) Research\nproposal for invertebrate organisms for agricultural use present in the\ncountry without being registered.\n\nj) Protocol for\nthe Adaptability and Effectiveness Trial of Absent Invertebrate Organisms\napproved by the SFE(*).\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n \n\n5.1.4. The SFE(*)\n\nshall have ten calendar days from receipt of the application and the\ncomplete information to grant or deny the import permit for\nresearch for registration purposes. In case of rejection of the application, the SFE(*)\nmust document and explain its decision.\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\n5.1.5. The import\npermit for research for registration purposes shall have the validity\napproved according to what is proposed in the research protocols and may\nbe extended, with a justified application\nsubmitted thirty business days before its expiry and attaching\na report of the data obtained during the first investigation.\n\n5.1.6. Any\nimport of invertebrate organisms for agricultural use, not authorized by the\nSFE(*), must be returned to its place of origin or destroyed. The cost shall be borne\nby the importer.\n\n \n\n(Note from Sinalevi:\nThrough Article 48 of the Regulation of the\nOrganizational Structure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\nArticle 6º-On\nQuality Control.\n\n \n\n6.1. It shall\nbe the responsibility of the SFE(*) to exercise Quality Control over Invertebrate\nOrganisms for Agricultural Use, establishing the corresponding standards.\n\n \n\n(Note from Sinalevi: Through\nArticle 48 of the Regulation of the Organizational\nStructure of the State Phytosanitary Service,\napproved by Executive Decree N° 36801 of September 20, 2011, it is\nindicated that the\nfunctions assigned to the SFE will be carried out by the Department of\nBiotechnology.\")\n\nArticle 7º-On\nPhytosanitary Emergencies.\n\n \n\n7.1. In cases\nof officially declared phytosanitary emergency, the SFE(*) may authorize the\nimport and use of invertebrate organisms for agricultural use present\nin the country and not registered, for as long as this situation prevails.\n\n(Note from Sinalevi: By means of\nArticle 48 of the Organizational Structure Regulation of the State Phytosanitary Service, approved by Decreto Ejecutivo N° 36801 of September 20, 2011, it is stated that the\nfunctions assigned to the SFE will be carried out by the Department of Biotechnology.)\n\nArticle 8—Labeling.\n\n8.1. Every label shall contain the information stipulated in section 4.2.2.5.\n\nArticle 9—Information Management.\n\n9.1. The SFE(*) shall create and administer a database containing information on invertebrate organisms of agricultural use to provide informatics support for the management of the registry (registro).\n\n9.2. The registrant (registrante) of invertebrate organisms of agricultural use may indicate which data correspond to industrial or commercial secrets. The SFE(*), by resolution (resolución), shall declare as confidential information all that which it considers in accordance with the provisions of current legislation.\n\n9.3. The technical data and results of efficacy trials (ensayos de eficacia) used for the registration (registro) of invertebrate organisms of agricultural use may not be used for the registration of another product, except when involving the same registration holder (titular del registro) or a third party authorized by the registration holder.\n\n(Note from Sinalevi: By means of Article 48 of the Organizational Structure Regulation of the State Phytosanitary Service, approved by Decreto Ejecutivo N° 36801 of September 20, 2011, it is stated that the functions assigned to the SFE will be carried out by the Department of Biotechnology.)\n\nArticle 10.—Specifications.\n\n10.1. Legal documents, as well as certifications issued outside the country for registration purposes, must not be more than one year past consularization (consularizadas), and national certifications not more than three months.\n\n10.2. The SFE(*) must train personnel involved in the importation of invertebrate organisms of agricultural use in order to streamline the process, considering their highly perishable nature.\n\n10.3. The SFE(*) may request further information from the registrant should it be required, which must be duly justified.\n\n10.4. The SFE(*) may authorize the production and release of invertebrate organisms of agricultural use by State institutions for research and development of their non-profit activities.
