  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 265\n\n                        Prohíbe el trasbordo de sardina en todo el litoral pacífico costarricense de\nuna embarcación a otra\n\nTexto Completo acta: C909E\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\n(Derogadopor\nel artículo 10 del acuerdo N°  \n\nA.J.D.I./270 del 21 de agosto de 2009 \"Establece destino de porcentaje igual o mayor a 90% de\ndesembarques de sardina como materia prima para elaboración productos destinados a consumo humano y\nporcentaje igual o menor a un 10% como carnada para flota pesquera nacional\")\n\n \n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\n \n\nA.J.D.I.P./265-2006.-Puntarenas, a los ocho días\ndel mes de junio del dos mil seis.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con la Ley Nº 7384, Ley de\nCreación del INCOPESCA y la Ley Nº 8436, Ley de Pesca y Acuicultura, es\natribución y competencia del INCOPESCA controlar la pesca y la caza de especies\nmarinas, en las aguas jurisdiccionales, conforme a lo dispuesto en el artículo 6º\nde la Constitución Política y normar el aprovechamiento racional de los recursos\npesqueros con el afán de proteger y mantener su sostenibilidad.\n\n2º-Que de acuerdo con estudios realizados por\ninvestigadores de la Universidad Nacional de Costa Rica (UNA) la pesquería de\nla sardina alcanzó su máximo rendimiento en el año 1976 en el que se capturaron\n7590 Tm cuando en aquel entonces operaban 9 embarcaciones, período después del\ncual las capturas disminuyeron abruptamente hasta alcanzar cerca de las 1.000\nTm en el año 1983.\n\n3º-Que a pesar de que en los últimos 8 años han\nvenido operando únicamente dos embarcaciones sardineras con red de cerco,\nigualmente se ha venido observando que las capturas de dicho recurso continúan disminuyendo\nsignificativamente en todo el litoral pacífico costarricense y muy\nespecialmente dentro del Golfo de Nicoya, por lo que se hace necesario tomar\nlas medidas pertinentes que permitan su recuperación.\n\n4º-Que como resultado de la disminución de las\ncapturas de ese recurso, las empresas propietarias de las embarcaciones con\nlicencia de pesca comercial vigente para la extracción de sardina con red de\ncerco, a su vez han experimentado un aumento en sus costos de operación y ante\ntal situación, han venido implementando la práctica del trasbordo de producto permitiéndole\nde esta manera a la embarcación pesquera una mayor permanencia en los caladeros\nde pesca.\n\n5º-Que por los aspectos indicados anteriormente\nen cuanto a esta pesquería, no es conveniente permitir ese tipo de práctica,\ncaso contrario de no restringirse se estaría propiciando un aumento del\nesfuerzo pesquero sobre un recurso que se encuentra en un estado bastante\ndelicado y que podría resultar en un perjuicio mayor sobre la biología y la\ndinámica poblacional de dicha pesquera. Por tanto,\n\n \n\nSE ACUERDA:\n\n \n\nProhibir el trasbordo de sardina en todo el\nlitoral pacífico costarricense de una embarcación a otra, salvo en aquellos\ncasos excepcionales debidamente justificados ante la Junta Directiva y para lo\ncual deberá contarse de previo con una recomendación técnica que lo autorice.",
  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Regulation 265\n\n                        Prohibits the transshipment (trasbordo) of sardine along the entire Costa Rican Pacific coastline from\none vessel to another\n\nFull Text of Record: C909E\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\nINCOPESCA\n\n(Repealed by\narticle 10 of agreement No. A.J.D.I./270 of August 21, 2009 \"Establishes a destination for a percentage equal to or greater than 90% of\nsardine landings as raw material for the production of products intended for human consumption and\na percentage equal to or less than 10% as bait for the national fishing fleet\")\n\n \n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\nINCOPESCA\n\n \n\nA.J.D.I.P./265-2006.-Puntarenas, on the eighth day\nof the month of June, two thousand six.\n\n \n\nConsidering:\n\n \n\n1º-That in accordance with Law No. 7384, Law for the\nCreation of INCOPESCA and Law No. 8436, Fisheries and Aquaculture Law, it is\nthe responsibility and competence of INCOPESCA to control fishing and the hunting of marine\nspecies in jurisdictional waters, as provided in Article 6\nof the Political Constitution, and to regulate the rational use of fishery\nresources with the aim of protecting and maintaining their sustainability.\n\n2º-That according to studies conducted by\nresearchers from the Universidad Nacional de Costa Rica (UNA), the sardine\nfishery reached its maximum yield in 1976, when 7590 metric tons (Tm) were caught\nwhile 9 vessels were operating at that time, a period after\nwhich catches decreased abruptly, reaching approximately 1,000\nmetric tons (Tm) in 1983.\n\n3º-That despite the fact that only two purse-seine (red de cerco) sardine vessels have been\noperating in the last 8 years,\nit has also been observed that catches of this resource continue to decrease\nsignificantly along the entire Costa Rican Pacific coastline and very\nespecially within the Gulf of Nicoya, making it necessary to take\nthe pertinent measures to allow its recovery.\n\n4º-That as a result of the decrease in\ncatches of this resource, the companies owning the vessels with\na current commercial fishing license for the extraction of sardine with purse seine (red de cerco), in turn have experienced an increase in their operating costs, and in\nview of this situation, they have been implementing the practice of product transshipment, thereby\nallowing the fishing vessel a longer stay on the fishing\ngrounds (caladeros de pesca).\n\n5º-That due to the aspects indicated above\nregarding this fishery, it is not advisable to allow this type of practice;\notherwise, by not restricting it, an increase in\nfishing effort would be encouraged on a resource that is in a rather\ndelicate state and that could result in greater harm to the biology and\npopulation dynamics of said fishery. Therefore,\n\n \n\nIT IS AGREED:\n\n \n\nTo prohibit the transshipment of sardine along the entire\nCosta Rican Pacific coastline from one vessel to another, except in those\nexceptional cases duly justified before the Board of Directors and for\nwhich a prior technical recommendation authorizing it must be obtained."
