de la Ley General de la Administración\nPública.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con lo\ndispuesto en el artículo 3, del Decreto Ejecutivo Nº 33151-MP, la rectoría del\nSector Social y Lucha contra la Pobreza está a cargo del Ministro de Vivienda y\nAsentamientos Humanos.\n\n2º-Que de conformidad con la\nLey Nº 8436, publicada en el Diario Oficial La Gaceta Nº 78 de fecha 25\nde abril de 2005 es atribución del Instituto Costarricense de Pesca y\nAcuicultura (INCOPESCA) proteger y conservar los recursos hidrobiológicos, en\naras de garantizar a las generaciones venideras, los recursos vivos del mar,\npromoviendo, una explotación sostenible de los recursos mediante el\nestablecimiento de periodos y áreas de veda, para lo cual se emite el acuerdo\nNº AJDIP/225- 2006, publicado en el Diario Oficial La Gaceta del 26 de\nmayo del año 2006.\n\n3º-Que el acuerdo citado y con\nbase en el artículo 34 de la Ley 8436, INCOPESCA prohíbe faenar a los\npescadores artesanales de la provincia de Puntarenas y en las comunidades del\nGolfo de Nicoya en Guanacaste, en los periodos que van del 1º de junio al 31 de\njulio y entre el 1º al 31 de octubre del 2006.\n\n4º-Que este acuerdo citado\nimpide a los pescadores que utilizan \"trasmallo\", desempeñar su actividad\nremunerada y por ende percibir ingresos por este concepto, afectando la\nsatisfacción de sus necesidades básicas.\n\n5º-Que en el artículo 36 de la\nLey 8436, se expresa: \"...El Poder Ejecutivo podrá autorizar el destino de\nfondos del Presupuesto Nacional a favor de INCOPESCA para la realización de los\nestudios sobre vedas, y a favor del Instituto Mixto de Ayuda Social (IMAS), con\nel propósito de desarrollar programas de asistencia socioeconómica diseñados especialmente\ncon tal propósito, a favor de los pescadores que se vean afectados en los\nperíodos de veda, siempre que se compruebe que no tienen otras fuentes de\ningresos y se encuentran en condición de pobreza. Estos programas implicarán\nnecesariamente servicios de trabajo comunal por parte de los beneficiarios, conforme\nal reglamento correspondiente o para la realización de estudios sobre la\nmateria.\n\n6º-Que la Ley de Creación del\nInstituto Mixto de Ayuda Social, Nº 4760 del 4 de mayo de 1971, establece en su\nartículo 2º la finalidad de resolver el problema de la pobreza extrema en el\npaís y en su artículo 4° dentro de sus fines de creación, se señala \"atender\nlas necesidades de los grupos sociales o de las personas que deban ser\nprovistas de medios de subsistencia cuando carezcan de ellos\".\n\n7º-Que el artículo 4º del Reglamento\npara la Prestación de Servicios y el Otorgamiento de Beneficios del Instituto\nMixto de Ayuda Social, publicado en La Gaceta Nº 102 del 29 de mayo del\n2000, define el concepto de pobreza como: \"Fenómeno o situación compleja de\níndole coyuntural o estructural multifacético y heterogéneo, que afecta a las personas\ny que se caracteriza por sus precarias condiciones de vivienda y sanitarias,\nbajos niveles educacionales, inserción inestable en el sistema productivo,\ncondiciones de riesgo social, con poca o ninguna incorporación en mecanismos de\nparticipación social, recursos insuficientes para satisfacer necesidades\nbásicas (nutricionales, salud, educación y vivienda) y en algunos casos\nausencia o insuficiencia de destrezas, aptitudes, herramientas y oportunidades\npara generar y acumular ingresos\".\n\n8º-Que en el artículo 21\ninciso h) del citado Reglamento, se señala en cuanto a los sujetos de los\nservicios institucionales, lo siguiente: \"En casos de excepción debidamente\ndocumentados y con el correspondiente informe técnico social autorizados por\nquien ejerza la Gerencia Regional respectiva, se podrá otorgar beneficios a\npersonas o familias que presenten una situación de pobreza coyuntural no\nnecesariamente registrada como tal en el SIPO, o que mediante algún decreto o\nley específica, se considere beneficiarios de la acción institucional\".\n\n9º-Que no se cuenta con un\nfondo compensatorio para brindar un subsidio económico a los pescadores\nafectados por la veda.\n\n10.-Que el período de veda,\nprovoca una situación de pobreza coyuntural en los pescadores por la carencia\nde ingresos por este concepto.\n\nPor tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Declárese en\nsituación de pobreza coyuntural la condición de los pescadores sujetos a las\nrestricciones y condiciones de veda para el Golfo de Nicoya, según el acuerdo\nNº AJDIP/225-2006, publicado enel diario oficial La Gaceta de 26 de mayo\ndel año 2006 de la Junta Directiva de INCOPESCA; y que carezcan de otros\ningresos complementarios. Por consiguiente, se autoriza al Instituto Mixto de\nAyuda Social a otorgar beneficios económicos en calidad de subsidio a estas\npersonas, en apego a las condiciones que se establecen en el presente decreto.\n\nArtículo 2º-Que INCOPESCA\ndeberá presentar en un plazo no mayor a 30 días naturales contados a partir de\nla vigencia de esta regulación, ante las instancias administrativas y\ncompetentes del IMAS, el listado de pescadores sujeto a las restricciones y\ncondiciones de veda para el Golfo de Nicoya, a fin de que se les otorgue el\nsubsidio económico correspondiente.\n\nArtículo 3º-El IMAS, procederá\na la atención de estas personas conbase en la resolución debidamente\nfundamentada y aprobada por la Gerente Regional que determine el cumplimiento\nde los requisitos establecidos en este decreto, de conformidad con el listado\ndepurado que deberá presentarle INCOPESCA, el cual contendrá los siguientes\nrequisitos:\n\n \n\na) Nombre completo del\nbeneficiario.\n\nb) Número de cédula de\nidentidad.\n\nc) Domicilio exacto de los\nbeneficiarios.\n\nd) Fotocopia de la licencia de\npesca vigente, extendida pro INCOPESCA.\n\ne) Declaración jurada de que\nno cuenta con más fuentes de ingresos en su núcleo familiar que la actividad de\npesca, antes y durante la veda.\n\nf) El IMAS a través de sus\noficinas regionales de Guanacaste y Puntarenas, en el plazo de seis meses a\npartir de este decreto verificará la condición socioeconómica de estos\nbeneficiarios de acuerdo con el SIPO y emitirá criterio sobre la pertinencia de\ncontinuar aplicando el criterio de pobreza coyuntural a la población objetivo\nde este decreto.\n\ng) En el plazo de seis meses a\npartir de la publicación del presente decreto, INCOPESCA, MINAE e IMAS deberán\nformular ante el Rector del Sector Social una propuesta de solución sostenible\nal problema objeto de este Reglamento.\n\nArtículo 4º-El IMAS otorgará\nun subsidio a los beneficiarios que cumplan con las condiciones estipuladas en\nel artículo anterior, emitido en dos eventos o tractos de la siguiente manera:\nEn el primer período de veda el monto a subsidiar será de noventa mil colones\n(¢ 90.000,00) por beneficiario, la entrega del beneficio se hará efectiva a más\ntardar en el mes de agosto del año 2006, y para el segundo período de veda el\nmonto a subsidiar será de cincuenta mil colones (¢ 50.000,00), que se entregará\na más tardar en el mes de octubre del mismo año, que conformará el segundo evento\no tracto.\n\nArtículo 5º-Los subsidios\nserán tramitados por las Gerencias Regionales del IMAS de las zonas de\nPuntarenas y Guanacaste. Los profesionales del IMAS estarán facultados para\nsolicitar a los potenciales beneficiarios los requisitos establecidos en el\nartículo 3º del presente decreto y no requerirán que los mismos se encuentren\nregistrados en el Sistema de Información de la Población Objetivo (SIPO). Para\nhacer efectiva la entrega del monto económico correspondiente al segundo\nperíodo de veda el IMAS podrá solicitar al INCOPESCA y/o a los beneficiarios la\nverificación y actualización de la información suministrada con base en este\ndecreto.\n\nArtículo 6º-Corresponde a\nINCOPESCA, la supervisión y control del trabajo comunal que realizarán los\npescadores en el período de veda, de conformidad con el respectivo reglamento\nque regule dicha actividad. En estos casos se procederá a la revocatoria del beneficio\nautorizado, previo cumplimiento del debido proceso.\n\nArtículo 7º-Rige a partir de\nsu publicación.\n\n \n\nDado en la Presidencia de la\nRepública.-San José, a los trece días del mes de junio del dos mil seis.", "body_en_text": "STANDARD 33192 – COMPLETE TEXT\n\nDeclares the Condition of Fishers Subject to the Restrictions and Conditions of the Closed Season for the Gulf of Nicoya to be in a Situation of Conjunctural Poverty\n\nComplete Text record: 9D467\nNº 33192\n\nNº 33192\n\nTHE FIRST VICE PRESIDENT\nIN EXERCISE OF THE PRESIDENCY\nOF THE REPUBLIC\n\nAND THE MINISTERS OF THE\nPRESIDENCY\n\nAND OF HOUSING AND HUMAN\nSETTLEMENTS\n\nIn exercise of the powers conferred by articles 140, subsections 3), 8) and 18) of the Political Constitution and 25, 26 and 27 of the General Public Administration Act.\n\nConsidering:\n\n1º—That in accordance with the provisions of article 3 of Executive Decree No. 33151-MP, the stewardship of the Social Sector and Fight against Poverty is the responsibility of the Minister of Housing and Human Settlements.\n\n2º—That in accordance with Law No. 8436, published in the Official Gazette La Gaceta No. 78 of April 25, 2005, it is the authority of the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura, INCOPESCA) to protect and conserve hydrobiological resources, in order to guarantee the living resources of the sea to future generations, promoting sustainable exploitation of resources through the establishment of closed-season periods and areas, for which purpose agreement No. AJDIP/225-2006 was issued, published in the Official Gazette La Gaceta of May 26, 2006.\n\n3º—That the cited agreement, based on article 34 of Law 8436, prohibits INCOPESCA artisanal fishers from the province of Puntarenas and in the communities of the Gulf of Nicoya in Guanacaste from working during the periods from June 1 to July 31 and from October 1 to 31, 2006.\n\n4º—That this cited agreement prevents fishers who use \"trasmallo\" nets from carrying out their remunerated activity and therefore from receiving income from this source, affecting the satisfaction of their basic needs.\n\n5º—That article 36 of Law 8436 states: \"...The Executive Branch may authorize the allocation of funds from the National Budget in favor of INCOPESCA to carry out studies on closed seasons, and in favor of the Joint Institute of Social Assistance (Instituto Mixto de Ayuda Social, IMAS), for the purpose of developing socioeconomic assistance programs specially designed for this purpose, in favor of fishers who are affected during closed-season periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs shall necessarily entail communal work services by the beneficiaries, in accordance with the corresponding regulations or for conducting studies on the matter.\"\n\n6º—That the Law Creating the Joint Institute of Social Assistance, No. 4760 of May 4, 1971, establishes in its article 2 the purpose of solving the problem of extreme poverty in the country, and in its article 4, among its founding purposes, states \"to attend to the needs of social groups or persons who must be provided with means of subsistence when they lack them.\"\n\n7º—That article 4 of the Regulation for the Provision of Services and the Granting of Benefits of the Joint Institute of Social Assistance, published in La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as: \"A complex phenomenon or situation of a conjunctural or structural, multifaceted, and heterogeneous nature that affects persons and is characterized by precarious housing and sanitary conditions, low educational levels, unstable insertion in the productive system, conditions of social risk, with little or no incorporation into mechanisms of social participation, insufficient resources to satisfy basic needs (nutritional, health, education, and housing), and in some cases absence or insufficiency of skills, aptitudes, tools, and opportunities to generate and accumulate income.\"\n\n8º—That in article 21, subsection h) of the cited Regulation, regarding the subjects of institutional services, the following is stated: \"In duly documented exceptional cases and with the corresponding technical social report authorized by whoever holds the respective Regional Management, benefits may be granted to persons or families that present a situation of conjunctural poverty not necessarily registered as such in the SIPO, or who, through a specific decree or law, are considered beneficiaries of institutional action.\"\n\n9º—That there is no compensatory fund to provide an economic subsidy to fishers affected by the closed season.\n\n10—That the closed season period causes a situation of conjunctural poverty among fishers due to the lack of income from this source.\n\nTherefore,\n\nTHEY DECREE:\n\nArticle 1—Declare the condition of fishers subject to the restrictions and conditions of the closed season for the Gulf of Nicoya, according to agreement No. AJDIP/225-2006, published in the official gazette La Gaceta of May 26, 2006, of the Board of Directors of INCOPESCA, and who lack other complementary income, to be in a situation of conjunctural poverty. Consequently, the Joint Institute of Social Assistance is authorized to grant economic benefits as a subsidy to these persons, in accordance with the conditions established in this decree.\n\nArticle 2—INCOPESCA must submit, within a period not exceeding 30 calendar days from the entry into force of this regulation, to the competent administrative bodies of IMAS, the list of fishers subject to the restrictions and conditions of the closed season for the Gulf of Nicoya, in order for the corresponding economic subsidy to be granted to them.\n\nArticle 3—IMAS shall proceed to attend to these persons based on a duly reasoned resolution approved by the Regional Manager that determines compliance with the requirements established in this decree, in accordance with the refined list that INCOPESCA must present, which shall contain the following requirements:\n\na) Full name of the beneficiary.\nb) Identity card number.\nc) Exact address of the beneficiaries.\nd) Photocopy of the valid fishing license, issued by INCOPESCA.\ne) Sworn declaration that their family unit has no sources of income other than the fishing activity, before and during the closed season.\nf) IMAS, through its regional offices of Guanacaste and Puntarenas, within six months from this decree, shall verify the socioeconomic condition of these beneficiaries in accordance with the SIPO and shall issue an opinion on the pertinence of continuing to apply the conjunctural poverty criterion to the target population of this decree.\ng) Within six months from the publication of this decree, INCOPESCA, MINAE, and IMAS must formulate before the Steward of the Social Sector a proposal for a sustainable solution to the problem addressed by this Regulation.\n\nArticle 4—IMAS shall grant a subsidy to beneficiaries who meet the conditions stipulated in the previous article, issued in two installments or tranches in the following manner: In the first closed-season period, the amount to be subsidized shall be ninety thousand colones (¢ 90,000.00) per beneficiary; the delivery of the benefit shall be made effective no later than the month of August 2006; and for the second closed-season period, the amount to be subsidized shall be fifty thousand colones (¢ 50,000.00), which shall be delivered no later than the month of October of the same year, constituting the second installment or tranche.\n\nArticle 5—The subsidies shall be processed by the Regional Managements of IMAS in the areas of Puntarenas and Guanacaste. IMAS professionals shall be empowered to request from potential beneficiaries the requirements established in article 3 of this decree and shall not require that they be registered in the Target Population Information System (Sistema de Información de la Población Objetivo, SIPO). To make the delivery of the corresponding economic amount for the second closed-season period effective, IMAS may request from INCOPESCA and/or the beneficiaries the verification and updating of the information provided based on this decree.\n\nArticle 6—It is the responsibility of INCOPESCA to supervise and control the communal work that the fishers shall carry out during the closed-season period, in accordance with the respective regulation governing said activity. INCOPESCA shall notify the respective Regional Management of IMAS, within a period not exceeding three days, of the name of those persons who fail to comply with this condition, as well as those who carry out actions that contravene the closed-season declaration or who have complementary income within their family group.
