En lo relativo al fomento del\nsector forestal y específicamente en cuanto al Pago por Servicios Ambientales\nen cualquiera de sus modalidades ambas instituciones podrán realizar acciones\nconjuntas con el fin de cumplir los objetivos emanados de la legislación\nforestal.\n\n2º-Que el Estado Costarricense\nse ha comprometido a fomentar la internalización de los costos ambientales y el\nuso de instrumentos económicos que puedan garantizar la protección del\nambiente, mediante el pago de servicios ambientales, de conformidad con los\nprincipios establecidos en la Conferencia de las Naciones Unidas sobre el Medio\nAmbiente y Desarrollo (Cumbre de la Tierra), la Convención Marco de Cambio\nClimático, ratificada mediante Ley Nº 7414 de 13 de junio de 1994, el Convenio\nCentroamericano sobre Cambios Climáticos, ratificado mediante Ley Nº 7513 de 9\nde junio de 1995 y el Convenio sobre Diversidad Biológica, ratificado por Ley\nNº 7416 de 30 de junio de 1994.\n\n3º-Que mediante Decreto\nEjecutivo Nº 32750-MINAE, publicado en La Gaceta Nº 218 del 11 de\nnoviembre del 2005, se realizó una modificación al artículo 64 del Reglamento a\nla Ley Forestal, Decreto Ejecutivo Nº 25721-MINAE, estableciéndose que\nFONAFIFO, de los recursos que percibiese por cualquier fuente para el pago por\nservicios ambientales, podría disponer de un porcentaje no mayor al 7% del\nmonto anual otorgado, para hacer frente a los gastos administrativos en que\nincurra en la ejecución del programa de pagos por servicios ambientales,\ndebiendo financiar con un 2% de ese porcentaje, la ejecución de la Estrategia\nde Seguimiento al Pago por Servicios Ambientales elaborada por el Sistema Nacional\nde Áreas de Conservación (SINAC).\n\n4º-Que el Sistema Nacional de\nÁreas de Conservación le corresponde parte del control, seguimiento y fomento\ndel Programa de Pagos por Servicios Ambientales.\n\n5º-Que FONAFIFO tiene como\nfunción el trámite y pago de servicios ambientales que brindan los bosques y\nplantaciones forestales y otras actividades necesarias para fortalecer el\ndesarrollo del sector de recursos naturales del país.\n\n6º-Que el Plan Nacional de\nDesarrollo Forestal, propone como una de sus principales metas, el\nestablecimiento de 95.000 hectáreas de plantaciones forestales, la recuperación\nde 283.961 hectáreas en la modalidad de protección de bosques y al menos 24.000\nhectáreas de sistemas agroforestales contenidos en el Plan de Acción 2004-2013.\n\n7º-Que es necesario para la\nactividad forestal, el desarrollo de una estrategia clara principalmente en\nreforestación, en cuanto al planteamiento en la disponibilidad y uso de los\nrecursos financieros, buscando mecanismos que permitan la sostenibilidad de ese\nfinanciamiento, así como asegurar la producción de materia prima que disminuya\nla presión sobre el bosque natural, protegiendo la biodiversidad y asegurando\nla provisión de los servicios ambientales establecidos en la Ley Forestal, Nº\n7575.\n\n8º-Que el artículo 10 de la\nLey Forestal y sus reformas, Nº 7575, estableció como funciones de la Oficina\nNacional Forestal, impulsar programas para el fomento de las inversiones en el\nsector forestal, la constitución y el fortalecimiento de grupos organizados y\nefectuar campañas de divulgación y capacitación, sobre los beneficios del\nmanejo y la conservación e incremento de las plantaciones forestales.\n\n9º-Que la Oficina Nacional\nForestal ha contribuido en el desarrollo y consolidación del sistema integral\nde servicios ambientales y su función es importante para lograr una adecuada\nvinculación y participación de las organizaciones de productores forestales en\nla prestación de los servicios ambientales.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 33205\n\n                        Reform of the Regulation to the Forestry Law\n\nComplete Text record: 9D93B\nN° 33205\n\nN° 33205\n\n \n\nTHE FIRST VICE PRESIDENT\n\nEXERCISING THE PRESIDENCY\nOF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND\nENERGY\n\n \n\nIn exercise of the powers\nconferred upon them by subsections 3) and 18) of articles 140 and 146, of the\nPolitical Constitution, articles 3, 46, 47, subsection d) of the Forestry Law and\nits amendments, No. 7575, published in La Gaceta No. 72 of April 16,\n1996, article 27 of the General Law of Public Administration,\nNo. 6227 of May 2, 1978, and,\n\n \n\nWhereas:\n\n \n\n1º-That article 3 of\nExecutive Decree No. 25721-MINAE, Regulation to the Forestry Law and its amendments,\npublished in La Gaceta No. 16 of January 23, 1997, established that the State Forest Administration shall be the responsibility of the Ministry of Environment and\nEnergy, and shall perform its functions, through the National System of Conservation\nAreas (SINAC) and the National Forest Financing Fund (FONAFIFO). Regarding the promotion of\nthe forest sector and specifically regarding Payment for Environmental Services\nin any of its modalities, both institutions may carry out joint actions\nin order to fulfill the objectives emanating from forest\nlegislation.\n\n2º-That the Costa Rican State\nhas committed to promoting the internalization of environmental costs and the\nuse of economic instruments that can guarantee the protection of the\nenvironment, through the payment of environmental services, in accordance with\nthe principles established at the United Nations Conference on Environment and\nDevelopment (Earth Summit), the Framework Convention on Climate\nChange, ratified by Law No. 7414 of June 13, 1994, the\nCentral American Convention on Climate Change, ratified by Law No. 7513 of June 9,\n1995, and the Convention on Biological Diversity, ratified by Law\nNo. 7416 of June 30, 1994.\n\n3º-That by Executive\nDecree No. 32750-MINAE, published in La Gaceta No. 218 of November 11,\n2005, a modification was made to article 64 of the Regulation to\nthe Forestry Law, Executive Decree No. 25721-MINAE, establishing that\nFONAFIFO, from the resources it received from any source for the payment of\nenvironmental services, could dispose of a percentage not exceeding 7% of the\nannual amount granted, to cover the administrative expenses incurred\nin the execution of the environmental services payment program,\nhaving to finance with 2% of that percentage, the execution of the Strategy\nfor Monitoring Environmental Services Payment prepared by the National System\nof Conservation Areas (SINAC).\n\n4º-That the National System of\nConservation Areas is responsible for part of the control, monitoring, and promotion\nof the Environmental Services Payment Program.\n\n5º-That FONAFIFO's function is\nthe processing and payment of environmental services provided by forests and\nforest plantations and other activities necessary to strengthen the\ndevelopment of the country's natural resources sector.\n\n6º-That the National Forest\nDevelopment Plan proposes as one of its main goals, the\nestablishment of 95,000 hectares of forest plantations, the recovery\nof 283,961 hectares under the forest protection (protección de bosques) modality, and at least 24,000\nhectares of agroforestry systems contained in the 2004-2013 Action Plan.\n\n7º-That it is necessary for the\nforest activity, the development of a clear strategy, mainly in\nreforestation, regarding the approach to the availability and use of\nfinancial resources, seeking mechanisms that allow the sustainability of that\nfinancing, as well as ensuring the production of raw material that reduces\nthe pressure on the natural forest, protecting biodiversity and ensuring\nthe provision of the environmental services established in the Forestry Law, No.\n7575.\n\n8º-That article 10 of the\nForestry Law and its amendments, No. 7575, established as functions of the National\nForestry Office, to promote programs for the promotion of investments in the\nforest sector, the constitution and strengthening of organized groups, and\nto carry out dissemination and training campaigns, on the benefits of\nmanagement and conservation and increase of forest plantations.\n\n9º-That the National Forestry\nOffice has contributed to the development and consolidation of the comprehensive system\nof environmental services and its function is important to achieve an adequate\nlinkage and participation of forest producer organizations in\nthe provision of environmental services. Therefore:\n\n \n\nHEREBY DECREE:\n\n \n\nArticle 1º-Article\n64 of Executive Decree No. 25721-MINAE, Regulation to the Forestry\nLaw, published in La Gaceta No. 16 of January 23, 1997,\namended by article 1 of Executive Decree No. 30762-MINAE, published\nin La Gaceta No. 194 of October 9, 2002, and article 3 of\nExecutive Decree No. 32750-MINAE, published in La Gaceta No. 218 of November 11,\n2005, is hereby amended to read as follows:\n\n \n\n\"Article 64.-The National Forest Financing Fund, from the\nresources it receives from any source for the payment of environmental\nservices, may dispose of a percentage that shall not exceed 10% of the\nannual amount granted, to finance the administrative expenses incurred\nfor the execution of environmental services payment.\n\n \n\nFrom the resources obtained by\nvirtue of this article, FONAFIFO shall transfer 2% to the National System of\nConservation Areas (SINAC) of the Ministry of Environment and Energy for the\nexecution and operation of the Strategy for Monitoring and Promotion of the Environmental Services\nPayment Program, prepared by SINAC, and shall transfer 1% to the National\nForestry Office, to execute actions contained in the work plan\nprepared by it, in order to contribute to the promotion of the environmental services program.\"\n\nArticle 2º-It shall take effect as of\nits publication.\n\n \n\nGiven at the Presidency of the\nRepublic, San José, on the fifth day of June, two thousand six."
