Este acuerdo fue derogado posteriormente por el Acuerdo 318 del 28 de julio de 2006.",

  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 183\n\n                        Permite la Importación de Embarcaciones para las actividades de pesca\ncomercial\n\nTexto Completo acta: 9F006\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\n(Este Acuerdo fue derogado,\n    por el acuerdo N° 318 del 28 de julio del 2006)\n\nINSTITUTO COSTARRICENSE DE\n    PESCA Y ACUICULTURA\n\n    A.J.D.I.P./183-2002.-Puntarenas, a los\n  veintiocho días del mes de junio del dos mil dos.\n\n \n\nConsiderando:\n\n          1º-Que de conformidad con lo dispuesto en la Ley\n        Nº 7384 del 16 de marzo de 1994, publicado en el Diario Oficial La Gaceta Nº\n        62 del 29 de marzo del mismo año, es competencia del Instituto\n        Costarricense de la Pesca y Acuicultura, normar el aprovechamiento de\n        los recursos pesqueros, así como regular los aspectos pertinentes en\n        cuanto al otorgamiento de permiso y licencia de pesca, características\n        de las embarcaciones, capturas y demás aspectos pertinentes en cuanto\n        al ejercicio de la actividad pesquera.\n\n          2º-Que en el transcurso del tiempo, se han\n        establecido diversas regulaciones y acuerdos, en los cuales se ha\n        determinado el tamaño de las embarcaciones para la realización de las\n        diversas pesquerías y normado en cuanto a la posibilidad de\n        sustitución de las mismas, por el tamaño de éstas y la potencia de\n        los motores.\n\n          3º-Que es importante a los efectos del\n        desarrollo y fomento de la actividad pesquera, establecer regulaciones y\n        disposiciones que permitan en forma adecuada, el crecimiento y\n        reconversión de la flota pesquera nacional, respetando las\n        disposiciones normativas existentes en la materia.\n\n          4º-Que la Ley Nº 4582 de 4 de mayo de 1970, que\n        declara el fomento y desarrollo de la industria pesquera, establece\n        regulaciones en cuanto a la importación de embarcaciones, la cual se\n        encuentra vigente.\n\nPor tanto,\n\nACUERDAN:\n\nArtículo 1º-Se permitirá la importación de\nembarcaciones para las actividades de pesca comercial, con el fin de sustituir\nembarcaciones que cuenten con permisos o licencias de pesca vigentes, en el\ntanto se cumpla con las disposiciones legales aplicables en la materia y bajo\nlas siguientes condiciones y parámetros:\n\n- No se podrán importar embarcaciones de pesca construidas de madera,\nde cualquier tamaño que sean.\n\n- Solo se podrán importar embarcaciones construidas de cualquier otro\nmaterial, si las mismas tienen una medida igual o mayor a 65 pies de eslora\n\n- Las embarcaciones importadas para efecto de sustitución de\nlas embarcaciones de pesca comercial, podrán tener una medida máxima de\ntreinta metros de eslora (. pies).\n\n- Para efectos de importación y sustitución de embarcaciones, deberá\nrespetarse el aumento máximo de eslora permitido por embarcación, según lo dispuesto en\nel acuerdo AJDIP 308-97 de 26 de noviembre de 1997 y sus reformas, definido en un\ncincuenta por ciento más de la eslora de la embarcación a sustituir. Queda sin efecto la\neslora máxima permitida que se encontraba fijada en 24 metros.\n\n- Las limitaciones o regulaciones en cuanto al tamaño de las\nembarcaciones que existieren por zonas específicas y tipo de embarcaciones, se mantienen\nvigentes según se hubieren emitido.\n\nArtículo 2º-Los permisionarios o interesados en acogerse a lo dispuesto en el presente Acuerdo,\ndeberán realizar solicitud formal al Instituto y obtener la autorización correspondiente, mediante\nla cual se definirán los trámites y documentos pertinentes que se deberán presentar, dentro de los\nplazos correspondientes. De igual manera deberán los permisionarios realizar manifestaciones\nexpresas bajo fe de juramento, respecto del destino que se dará a la embarcación a sustituir, cuya\nprueba podrá serle requerida por el Instituto y verificada en su oportunidad, bajo pena de\naplicación en caso de incumplimiento de las sanciones respectivas.",
  "body_en_text": "en la totalidad del texto\n\n-\n\nFull Text of Regulation 183\n\nAllows the Importation of Vessels for commercial fishing activities\n\nFull Text of record: 9F006\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\n(This Agreement was repealed,\nby agreement No. 318 of July 28, 2006)\n\nCOSTA RICAN INSTITUTE OF\nFISHERIES AND AQUACULTURE\n\nA.J.D.I.P./183-2002.-Puntarenas, on the\ntwenty-eighth day of the month of June, two thousand two.\n\nConsidering:\n\n1º-That in accordance with the provisions of Law No. 7384 of March 16, 1994, published in the Official Gazette La Gaceta No. 62 of March 29 of the same year, it is the competence of the Costa Rican Institute of Fisheries and Aquaculture to regulate the exploitation of fishery resources, as well as to regulate the relevant aspects regarding the granting of fishing permits and licenses, characteristics of vessels, catches, and other pertinent aspects regarding the exercise of fishing activity.\n\n2º-That over time, various regulations and agreements have been established, in which the size of vessels for carrying out various fisheries has been determined and regulated regarding the possibility of their replacement, based on their size and engine power.\n\n3º-That it is important for the purposes of the development and promotion of fishing activity to establish regulations and provisions that adequately allow the growth and reconversion of the national fishing fleet, respecting the existing regulatory provisions on the matter.\n\n4º-That Law No. 4582 of May 4, 1970, which declares the promotion and development of the fishing industry, establishes regulations regarding the importation of vessels, which remains in force.\n\nTherefore,\n\nTHEY AGREE:\n\nArticle 1-The importation of vessels for commercial fishing activities shall be permitted, for the purpose of replacing vessels that have valid fishing permits or licenses, as long as the applicable legal provisions on the matter are complied with and under the following conditions and parameters:\n\n- Fishing vessels built of wood may not be imported, regardless of their size.\n\n- Vessels built of any other material may only be imported if they measure equal to or greater than 65 feet in length (eslora).\n\n- Imported vessels for the purpose of replacing commercial fishing vessels may have a maximum measurement of thirty meters in length (eslora) (. feet).\n\n- For purposes of importation and replacement of vessels, the maximum increase in length (eslora) permitted per vessel must be respected, according to the provisions of agreement AJDIP 308-97 of November 26, 1997 and its amendments, defined as fifty percent more than the length (eslora) of the vessel to be replaced. The maximum permitted length (eslora) that was previously set at 24 meters is hereby rendered without effect.\n\n- The limitations or regulations regarding the size of vessels that exist for specific zones and type of vessels remain in force as they were issued.\n\nArticle 2-Permit holders or interested parties wishing to avail themselves of the provisions of this Agreement must submit a formal request to the Institute and obtain the corresponding authorization, through which the pertinent procedures and documents to be submitted shall be defined, within the corresponding deadlines. Likewise, permit holders must make express statements under oath, regarding the destination to be given to the vessel to be replaced, proof of which may be required by the Institute and verified in due course, under penalty of application of the respective sanctions in case of non-compliance."
