PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DEL\nAMBIENTE Y ENERGÍA\n\n \n\nEn ejercicio de\nlas facultades que les confieren los incisos 3) y 18) del artículos 140 y 146\nde la Constitución Política, los artículos 3, 46, 47, inciso d) de la Ley\nForestal y sus reformas, Ley Nº 7575, publicada en La Gaceta Nº 72 del\n16 de abril de 1996, el artículo 5º de la Ley de Simplificación y Eficiencia\nTributaria, Ley Nº 8114, publicada en La Gaceta Nº 131 del 9 de julio de\n2001, el artículo 6°7 de la Ley General de la Administración Pública, Ley Nº\n6227 del 2 de mayo de 1978, y\n\n \n\nConsiderando:\n\n \n\n1º-Que la\nAdministración Forestal del Estado es competencia del Ministerio del Ambiente y\nEnergía, por medio del Sistema Nacional de Áreas de Conservación (SINAC) y el\nFondo Nacional de Financiamiento Forestal (FONAFIFO), instituciones que tienen\nla competencia de fomentar el sector forestal, específicamente a través del\nPrograma de Pago por Servicios Ambientales (PPSA).\n\n2º-Que FONAFIFO\ntiene como función el trámite y pago de servicios ambientales que brindan los\nbosques y plantaciones forestales y otras actividades necesarias para\nfortalecer el desarrollo del sector de recursos naturales del país.\n\n3º-Que al SINAC le\ncorresponde parte del control, seguimiento y fomento del Programa de Pagos por\nServicios Ambientales.\n\n4º-Que a través de\nConvenios Internacionales nuestro país se ha comprometido a llevar a cabo\nprogramas de conservación, manejo de bosques y reforestación.\n\n5º-Que es\nimportante la consolidación de las áreas silvestres protegidas y el\nfortalecimiento de las reservas privadas y núcleos de producción forestal\nsostenible, mediante el reconocimiento de los servicios ambientales que brindan\nestas áreas.\n\n6º-Que es\nimportante para la actividad forestal el desarrollo de una estrategia clara\nprincipalmente en reforestación, en cuanto al planteamiento en la\ndisponibilidad y uso de los recursos financieros, buscando mecanismos que\npermitan la sostenibilidad de ese financiamiento. Así mismo asegurar la\nproducción de materia prima que disminuya la presión sobre el bosque natural,\nprotegiendo la biodiversidad y asegurando la provisión de los servicios\nambientales establecidos en la Ley Forestal.\n\n7º-Que mediante la\nnegociación de proyectos de cooperación internacional y nacional, el MINAE ha\nsolicitado el apoyo financiero para fortalecer y dar continuidad al Programa de\nPago de Servicios Ambientales, así como permitir que se desarrollen e\ninstitucionalicen otros mecanismos de financiamiento como la venta de servicios\nambientales de mitigación de gases con efecto invernadero y el mecanismo de\ncobro del servicio ambiental de conservación del recurso hídrico en Costa Rica.\n\n8º-Que mediante la\nLey Nº 8355, publicada en La Gaceta Nº 118 del 20 de junio del 2003, se\naprobó el Convenio entre el Gobierno de la República Federal de Alemania y el\nGobierno de la República de Costa Rica sobre Cooperación Financiera-Proyecto\nForestal Huetar Norte.\n\n9º-Que en la\nselección de proyectos en la modalidad de protección de bosques, las Oficinas\nRegionales del FONAFIFO, deben dar prioridad a las presolicitudes de áreas\nubicadas dentro del Programa Nacional de Corredores Biológicos-Costa Rica, con\nel fin de contribuir al fortalecimiento y consolidación de áreas prioritarias\npara la conservación de la biodiversidad.\n\n10.-Que de\nconformidad con los artículos 38 y 62 del Reglamento a la Ley Forestal y sus\nreformas, Decreto Ejecutivo Nº 25721-MINAE, publicado en La Gaceta Nº 16\ndel 23 de enero de 1997, el Poder Ejecutivo establecerá mediante decreto, las\náreas prioritarias en las que se debe pagar servicios ambientales, la cantidad\nde hectáreas disponibles y el monto por hectárea.\n\n11.-Que mediante\nDecreto Ejecutivo Nº 32750-MINAE, publicado en La Gaceta Nº 218 del 11\nde noviembre del 2005, se realizó una modificación a los montos otorgados para\nlas diferentes modalidades para el Pago de Servicios Ambientales.\n\n12º-Que FONAFIFO\ncomo órgano adscrito al MINAE procurará mejorar el Índice de Desarrollo Social\nespecialmente en las áreas rurales. Por lo tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Para\nel año dos mil seis, el Presupuesto asignado al Programa de Servicios\nAmbientales es de siete mil seiscientos diez millones seiscientos noventa y un\nmil ochocientos cuatro colones exactos (¢7.610.691.804).\n\n \n\nEste monto se\ndistribuirá de la siguiente manera:\n\n \n\na) Quinientos\nsesenta millones de colones exactos (¢560.000.000), de conformidad con lo\nestablecido en el artículo 64 del Reglamento a la Ley Forestal Nº 7575, Decreto\nEjecutivo Nº 25721-MINAE y sus reformas, lo cual corresponde al 10% de los recursos\nprovenientes del presupuesto ordinario de la República, para financiar los\ngastos administrativos en que se incurra para la ejecución del programa de pago\npor servicios ambientales.\n\nb) Cinco mil\nsetecientos noventa y tres millones novecientos cincuenta y dos mil seiscientos\ncuarenta y dos colones exactos (¢ 5.793.952.642) para atender las obligaciones\nfinancieras por contratos de pago de servicios ambientales formalizados en los\naños 2002 al 2005.\n\nc) Setecientos\ncinco millones seiscientos setenta y tres mil cuarenta y seis colones exactos\n(¢705.673.046) para el pago de servicios ambientales en la modalidad de\nreforestación sobre 3.500 hectáreas ubicadas en las áreas prioritarias, con el\nfin de establecer plantaciones para la producción de materia prima con fines\nindustriales. Estas 3.500 hectáreas incluyen 600 hectáreas con especies\nnativas, contenidas en los Decretos de vedas y especies amenazadas o en peligro\nde extinción (Decreto Nº 25663 MINAE y Decreto Nº 25700 MINAE y sus reformas)\npara reforestación de áreas en pastos y potreros o mediante regeneración\nnatural.\n\nd) Cuatrocientos\ncatorce millones novecientos mil seiscientos cuarenta y dos colones exactos\n(¢414.900.642) para el pago de servicios ambientales en la modalidad de\nprotección de bosques sobre 12.069 hectáreas ubicadas en las áreas\nprioritarias.\n\ne) Ciento treinta\ny seis millones ciento sesenta y cinco mil cuatrocientos setenta y cuatro\ncolones exactos (¢136.165.474) para el pago de servicios ambientales en la\nmodalidad de reforestación integrada a sistemas agroforestales sobre 300.000\nárboles.\n\n \n\nFONAFIFO podrá\nvariar la distribución establecida en los incisos anteriores de acuerdo con la\noferta de tierras que pretendan ingresar a las modalidades, siempre y cuando no\nsobrepasen el monto total de los recursos autorizados en este artículo.\n\nLos contratos que\nal efecto emita FONAFIFO, establecerán las condiciones, plazos, forma de pago y\notros requisitos para cumplir con lo estipulado en este artículo.\n\nEn caso de\ndisponer con una mayor asignación de recursos según lo establece el artículo 5\nde la Ley de Simplificación y Eficiencia Tributaria, N° 8114 y otros recursos\nfinancieros provenientes de proyectos en negociación o por otros ingresos que\ncapte FONAFIFO, para el pago de servicios ambientales, se distribuirán según\ncriterio de los donantes y del FONAFIFO.\n\nArtículo 2º-El\nmonto máximo a pagar por hectárea y por árboles según sea el caso y según lo\nestablecido en los incisos c), d), e) del artículo 1º del presente Decreto,\nserá de:\n\n \n\na) Sesenta y cuatro\ndólares exactos ($64) por hectárea por año, para el pago de servicios\nambientales por protección de bosque, desembolsados en un período de cinco\naños, prorrogable por otro periodo de cinco años.\n\nb) Ochocientos\ndieciséis dólares exactos ($816) por hectárea, para el pago de servicios\nambientales en reforestación, desembolsados en un plazo de diez años.\n\nc) Cuarenta y un\ndólares exactos ($41) por hectárea por año, para pago de servicios ambientales\nde recuperación de áreas mediante regeneración natural en pastos y potreros, en\ncontratos de cinco años, prorrogables por otro periodo de cinco años.\n\nd) Un dólar con\ntreinta centavos ($1,30) por árbol, para el pago de servicios ambientales en\nreforestación integrados a sistemas agroforestales, desembolsados en un plazo\nde tres años.\n\n \n\nLos montos\nestablecidos en los incisos a, b y c se aplicarán según lo establecido en el\nDecreto Ejecutivo Nº 32750-MINAE, publicado en La Gaceta Nº 218\ndel 11 de noviembre del 2005.\n\nLos montos\npendientes de desembolsar de años anteriores, se regirán según lo establecido\nen los Decretos Ejecutivos respectivos para cada año.\n\nArtículo 3º-Las\náreas prioritarias para el trámite de las presolicitudes del año 2006 en las\ndiferentes modalidades serán las siguientes:\n\n \n\n1. Proyectos de\nReforestación: Se establecen como prioritarias para la ejecución de proyectos\nde reforestación las áreas sin bosque con los siguientes criterios:\n\n \n\na) Se dará\nprioridad a los sitios que presenten un alto potencial productivo para el\ndesarrollo de plantaciones forestales (clases de capacidad de uso III, IV, V y\nVI de la metodología oficial establecida en el Manual para la determinación de\nla capacidad de uso de las tierras de Costa Rica, Decreto Ejecutivo N° 23214- MAG-MIRENEM).\n\nb) Sitios donde\nhaya un alto potencial de bloques de plantación, dando especial prioridad a los\nproyectos que utilicen material genético mejorado.\n\nc) Se podrán\nincluir áreas en donde se ejecutaron proyectos de reforestación financiados por\nmedio de incentivos y que hayan cumplido con los planes de manejo aprobados.\n\nd) Para los\nproyectos de reforestación con especies nativas, establecidos como prioritarios\ny contenidos en los decretos de vedas y especies amenazadas o en peligro de\nextinción, (Decreto N° 25663-MINAE y Decreto N° 25700-MINAE y sus reformas), se\nestablece como prioritario todo el país. Se podrán acoger a esta modalidad de\nPago por servicios ambientales, las estrategias de conservación para especies\npropuestas en los citados decretos o sus modificaciones que presenten entes de\ninvestigación, y que cumplan con los requisitos establecidos en el manual de procedimientos\nvigente al momento de presentar los proyectos.\n\ne) Dentro de las\náreas indicadas en los puntos a), b), c), y d) anteriores, se dará prioridad a\nlas ubicadas en los cantones con Índice de Desarrollo Social (IDS) menor al 40%\nsegún la determinación realizada por MIDEPLAN en el 2001.\n\n \n\n2. Proyectos de\nreforestación en pastos y potreros mediante regeneración natural.\n\n \n\na) Los proyectos\nde reforestación mediante regeneración natural en pastos y potreros se podrán\nrealizar solo en áreas definidas como tierras Kyoto, que no tenían cobertura\nforestal antes del 31 de diciembre de 1989, que se ubiquen en las Regiones\nChorotega, Pacífico Central y Brunca del país según la regionalización administrativa\nde MIDEPLAN.\n\n \n\n3. Proyectos de\nProtección de Bosques. Se establecen como prioritarias para la ejecución de\nproyectos de protección de bosque las áreas con los siguientes criterios:\n\n \n\na) Para el trámite\nde proyectos de protección, se dará prioridad aquellos ubicados en corredores\nbiológicos reconocidos oficialmente hasta el año 2003 por el SINAC.\n\nb) Proyectos de\nprotección que cumplan con lo establecido en el punto anterior que tengan\ncontratos vencidos de años anteriores.\n\nc) Áreas de bosque\nque tengan como función la protección del recurso hídrico.\n\nd) Áreas privadas\ndentro de las áreas silvestres protegidas cualquiera que sea su categoría de\nmanejo.\n\ne) Dentro de las\náreas indicadas en los puntos a), b), c), y d) anteriores, se dará prioridad a\nlas ubicadas en los cantones con Índice de Desarrollo Social (IDS) menor al 40%\nsegún la determinación realizada por MIDEPLAN en el 2001.\n\n \n\n4. Proyectos de\nSistemas Agroforestales. Se dará prioridad a proyectos tramitados por\norganizaciones que cumplan con los requisitos establecidos en el Manual de\nProcedimientos del 2006.\n\n \n\nEn cada una de las\nOficinas Subregionales del SINAC y Regionales del FONAFIFO, se mantendrá un\nmapa con las áreas prioritarias para ubicar las fincas que apliquen al Programa\nPago de Servicios Ambientales.\n\nArtículo 4º-Se\nfaculta a FONAFIFO a emitir el pago de los servicios ambientales en sus\ndiferentes modalidades por las cantidades máximas autorizadas por este Decreto.\n\nArtículo 5º-El\npago de servicios ambientales se hará diferido de acuerdo con las siguientes\ncondiciones:\n\n \n\na) Los Proyectos\nde reforestación con áreas menores o iguales a cincuenta hectáreas, podrán\nrecibir el pago por adelantado. Para estos proyectos, el primer desembolso del\n46% se hará una vez formalizado el contrato con el Estado siempre y cuando el\nmonto a desembolsar este garantizado según se establezca en el Manual de Procedimientos\ndel año 2006. En los restantes nueve años se pagará un porcentaje anual del 6%\ndel monto total del contrato. Los pagos se realizan a partir de la fecha\npromedio de plantación.\n\na) Los Proyectos\nde reforestación que no reciben pago por adelantado, recibirán el primer pago\ndel 46% una vez formalizado el contrato con el Estado y que se cumpla con los\nrequisitos establecidos en el Manual de Procedimiento del año 2006. En los\nrestantes nueve años se pagará un porcentaje anual del 6% del monto total del\ncontrato. Igualmente los pagos se realizarán a partir de la fecha promedio de plantación.\n\nb) El pago de\nservicios ambientales para los proyectos en los que se desarrollen Sistemas\nAgroforestales, el primer desembolso se hará una vez firmado el respectivo\ncontrato y sea recibida por FONAFIFO la garantía que se establezca en el Manual\nde Procedimientos del año 2006 o se certifique por parte del regente forestal\nel establecimiento de los árboles y su fecha promedio de plantación. Este\nprimer desembolso será de un 65% del monto establecido, para el segundo año\nserá de un 20% y un 15% para el tercer año y podrán solicitarse a los doce y\nveinticuatro meses después de la fecha de establecimiento de los árboles\ncertificada por el regente forestal.\n\nArtículo 6º-El\nplazo para la presentación de presolicitudes para el pago de servicios\nambientales en el año dos mil seis vence 30 días a partir de la publicación de\neste decreto.\n\nArtículo 7º-Podrán\npagarse Servicios Ambientales en la modalidad de protección en fincas amparadas\nal derecho de posesión, según lo establecido en el Decreto Ejecutivo\n31633-MINAE del 26 de enero del 2004.\n\nArtículo 8º-Los\ncontratos de servicios ambientales que se financien con los recursos\nautorizados en este decreto, deben firmarse a más tardar el 30 de Noviembre del\naño dos mil seis.\n\nArtículo\n9º-FONAFIFO realizará el pago de servicios ambientales con fondos captados por\ninstituciones públicas y privadas, por la utilización de servicios ambientales\ngenerados por los bosques y plantaciones forestales, que contribuyan a la\nprotección del recurso hídrico para uso urbano, rural o hidroeléctrico, las\ncondiciones de los mismos serán establecidos por los Convenios y contratos\nformalizados para tal efecto.\n\nArtículo 10.-Los\nrecursos no utilizados por FONAFIFO, las devoluciones realizadas o los recursos\nrecuperados en virtud de incumplimientos contractuales, serán depositados en\nuna cuenta que al efecto establezca el citado Fondo y serán presupuestados para\nla ejecución de nuevos proyectos de pago de servicios ambientales.\n\nArtículo 11.-Para\ncumplir con su cometido FONAFIFO podrá suscribir convenios de cooperación con\notros órganos y entes públicos.\n\nArtículo 12.-De\nacuerdo con lo que dispone la Ley Forestal del Patrimonio del FONAFIFO la Junta\nDirectiva establecerá una cuenta patrimonio la cual se conformará con recursos\nociosos o sin destino, a fin de que al cabo de un plazo de 10 años procure su\npropia sostenibilidad financiera. Un monto no mayor al 40% podrá ser destinado\nal crédito para pequeños y medianos productores forestales y el resto serán\ninvertidos en títulos valores con  espaldo\ndel Sector Público.\n\nArtículo 13.-Rige\na partir de su publicación.\n\n \n\nDado en la\nPresidencia de la República.-San José, el once del mes de mayo del dos mil\nseis.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 33226\n\n Designates Budget to the Environmental Services Program, for the year 2006\n\nComplete Text record: 9DCA1\nN° 33226\n\nN° 33226\n\n \n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT AND ENERGY\n\n \n\nIn exercise of\nthe powers conferred by subsections 3) and 18) of articles 140 and 146\nof the Political Constitution, articles 3, 46, 47, subsection d) of the Ley Forestal\nand its amendments, Law Nº 7575, published in La Gaceta Nº 72 of\nApril 16, 1996, article 5 of the Law on Tax Simplification and Efficiency,\nLaw Nº 8114, published in La Gaceta Nº 131 of July 9, 2001,\narticle 6°7 of the General Law on Public Administration, Law Nº\n6227 of May 2, 1978, and\n\n \n\nWhereas:\n\n \n\n1st-That the State\nForest Administration is the responsibility of the Ministry of Environment and\nEnergy, through the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and the\nNational Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), institutions that have\nthe responsibility of promoting the forestry sector, specifically through the\nEnvironmental Services Payment Program (Programa de Pago por Servicios Ambientales, PPSA).\n\n2nd-That FONAFIFO\nhas the function of processing and paying for environmental services (servicios ambientales) provided by\nforests and forest plantations and other necessary activities to\nstrengthen the development of the country's natural resources sector.\n\n3rd-That SINAC is\nresponsible for part of the control, monitoring and promotion of the Program of Payments for Environmental Services.\n\n4th-That through\nInternational Agreements our country has committed to carrying out\nprograms for conservation, forest management and reforestation.\n\n5th-That the\nconsolidation of protected wild areas and the strengthening of private reserves and sustainable forest production\nnuclei is important, through the recognition of the environmental services that\nthese areas provide.\n\n6th-That the\ndevelopment of a clear strategy, mainly in reforestation, regarding the planning of\navailability and use of financial resources, seeking mechanisms that\nallow the sustainability of that financing, is important for forestry activity. Likewise, to ensure the\nproduction of raw material that reduces the pressure on the natural forest,\nprotecting biodiversity and ensuring the provision of the\nenvironmental services established in the Ley Forestal.\n\n7th-That through the\nnegotiation of international and national cooperation projects, MINAE has\nrequested financial support to strengthen and give continuity to the Payment for Environmental Services Program, as well as to allow other financing mechanisms to be developed and\ninstitutionalized, such as the sale of environmental\nservices for the mitigation of greenhouse gases and the mechanism for\ncharging for the environmental service of water resource conservation in Costa Rica.\n\n8th-That through\nLaw Nº 8355, published in La Gaceta Nº 118 of June 20, 2003, the\nAgreement between the Government of the Federal Republic of Germany and the\nGovernment of the Republic of Costa Rica on Financial Cooperation-Huetar Norte Forest\nProject was approved.\n\n9th-That in the\nselection of projects under the forest protection modality, the Regional\nOffices of FONAFIFO must give priority to pre-applications for areas\nlocated within the National Biological Corridors Program-Costa Rica, in\norder to contribute to the strengthening and consolidation of priority areas\nfor biodiversity conservation.\n\n10.-That in\naccordance with articles 38 and 62 of the Regulation to the Ley Forestal and its\namendments, Executive Decree Nº 25721-MINAE, published in La Gaceta Nº 16\nof January 23, 1997, the Executive Branch shall establish by decree, the\npriority areas in which environmental services must be paid, the quantity\nof hectares available and the amount per hectare.\n\n11.-That by means of\nExecutive Decree Nº 32750-MINAE, published in La Gaceta Nº 218 of November\n11, 2005, a modification was made to the amounts granted for\nthe different modalities for the Payment of Environmental Services.\n\n12th-That FONAFIFO\nas a body attached to MINAE will seek to improve the Social Development Index\nespecially in rural areas. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1st-For\nthe year two thousand six, the Budget assigned to the Environmental Services Program is seven thousand six hundred ten million six hundred ninety-one\nthousand eight hundred four exact colones (¢7,610,691,804).\n\n \n\nThis amount will\nbe distributed as follows:\n\n \n\na) Five hundred\nsixty million exact colones (¢560,000,000), in accordance with what is\nestablished in article 64 of the Regulation to the Ley Forestal Nº 7575, Executive\nDecree Nº 25721-MINAE and its amendments, which corresponds to 10% of the resources\ncoming from the ordinary budget of the Republic, to finance the\nadministrative expenses incurred for the execution of the payment\nfor environmental services program.\n\nb) Five thousand\nseven hundred ninety-three million nine hundred fifty-two thousand six hundred\nforty-two exact colones (¢5,793,952,642) to meet the financial\nobligations from environmental services payment contracts formalized in the\nyears 2002 to 2005.\n\nc) Seven hundred\nfive million six hundred seventy-three thousand forty-six exact colones\n(¢705,673,046) for the payment of environmental services under the\nreforestation modality on 3,500 hectares located in the priority areas, with the\npurpose of establishing plantations for the production of raw material for industrial\npurposes. These 3,500 hectares include 600 hectares with native\nspecies, contained in the Decrees on logging bans and threatened or endangered\nspecies (Decreto Nº 25663 MINAE and Decreto Nº 25700 MINAE and their amendments)\nfor reforestation of areas in pastures and paddocks or through natural\nregeneration.\n\nd) Four hundred\nfourteen million nine hundred thousand six hundred forty-two exact colones\n(¢414,900,642) for the payment of environmental services under the\nforest protection modality on 12,069 hectares located in the priority\nareas.\n\ne) One hundred\nthirty-six million one hundred sixty-five thousand four hundred seventy-four\nexact colones (¢136,165,474) for the payment of environmental services under the\nmodality of reforestation integrated into agroforestry systems on 300,000\ntrees.\n\n \n\nFONAFIFO may\nvary the distribution established in the preceding subsections in accordance with the\nsupply of land intending to enter the modalities, as long as they do not\nexceed the total amount of resources authorized in this article.\n\nThe contracts that\nFONAFIFO issues for this purpose shall establish the conditions, terms, form of payment and\nother requirements to comply with what is stipulated in this article.\n\nIn the event of a\ngreater allocation of resources as established in article 5\nof the Law on Tax Simplification and Efficiency, N° 8114 and other financial\nresources coming from projects under negotiation or from other income that\nFONAFIFO captures, for the payment of environmental services, they shall be distributed according\nto the criteria of the donors and FONAFIFO.\n\nArticle 2nd-The\nmaximum amount to pay per hectare and per tree as applicable and as\nestablished in subsections c), d), e) of article 1 of this Decree,\nshall be:\n\n \n\na) Sixty-four\nexact dollars ($64) per hectare per year, for the payment of environmental\nservices for forest protection, disbursed over a period of five\nyears, extendable for another period of five years.\n\nb) Eight hundred\nsixteen exact dollars ($816) per hectare, for the payment of environmental\nservices in reforestation, disbursed over a period of ten years.\n\nc) Forty-one\nexact dollars ($41) per hectare per year, for payment of environmental services\nfor the recovery of areas through natural regeneration in pastures and paddocks, in\ncontracts of five years, extendable for another period of five years.\n\nd) One dollar\nand thirty cents ($1.30) per tree, for the payment of environmental services in\nreforestation integrated into agroforestry systems, disbursed over a period\nof three years.\n\n \n\nThe amounts\nestablished in subsections a, b and c shall apply as established in the\nExecutive Decree Nº 32750-MINAE, published in La Gaceta Nº 218\nof November 11, 2005.\n\nThe amounts\npending disbursement from previous years shall be governed by what is established\nin the respective Executive Decrees for each year.\n\nArticle 3rd-The\npriority areas for processing pre-applications for the year 2006 in the\ndifferent modalities shall be the following:\n\n \n\n1. Reforestation\nProjects: Areas without forest cover (cobertura boscosa) are established as priorities for the execution of projects\nof reforestation with the following criteria:\n\n \n\na) Priority shall be given\nto sites that present a high productive potential for the\ndevelopment of forest plantations (land-use capacity classes III, IV, V and\nVI of the official methodology established in the Manual for the determination of\nthe land-use capacity of Costa Rica, Executive Decree N° 23214- MAG-MIRENEM).\n\nb) Sites where\nthere is a high potential for plantation blocks, giving special priority to the\nprojects that use improved genetic material.\n\nc) Areas may be\nincluded where reforestation projects financed through\nincentives were executed and that have complied with the approved management plans.\n\nd) For\nreforestation projects with native species, established as priorities\nand contained in the decrees on logging bans and threatened or endangered\nspecies, (Decreto N° 25663-MINAE and Decreto N° 25700-MINAE and their amendments), the\nentire country is established as priority. Conservation strategies for\nspecies proposed in the cited decrees or their modifications that are presented by\nresearch entities, and that comply with the requirements established in the procedures\nmanual in force at the time of presenting the projects, may benefit under this Payment for Environmental Services\nmodality.\n\ne) Within the\nareas indicated in points a), b), c), and d) above, priority shall be given to\nthose located in the cantons with a Social Development Index (IDS) of less than 40%\naccording to the determination made by MIDEPLAN in 2001.\n\n \n\n2. Reforestation\nprojects in pastures and paddocks through natural regeneration.\n\n \n\na) Reforestation projects\nthrough natural regeneration in pastures and paddocks may be carried\nout only in areas defined as Kyoto lands, that did not have forest\ncover before December 31, 1989, which are located in the Chorotega,\nPacífico Central and Brunca Regions of the country according to the administrative regionalization\nof MIDEPLAN.\n\n \n\n3. Forest\nProtection Projects. Areas with the following criteria are established as priorities for the execution of\nforest protection projects:\n\n \n\na) For processing\nprotection projects, priority shall be given to those located in biological\ncorridors officially recognized up to the year 2003 by SINAC.\n\nb) Protection projects\nthat comply with the provisions of the previous point and that have\nexpired contracts from previous years.\n\nc) Forest areas\nthat have the function of protecting the water resource.\n\nd) Private areas\nwithin protected wild areas whatever their management category.\n\ne) Within the\nareas indicated in points a), b), c), and d) above, priority shall be given to\nthose located in the cantons with a Social Development Index (IDS) of less than 40%\naccording to the determination made by MIDEPLAN in 2001.\n\n \n\n4. Agroforestry\nSystems Projects. Priority shall be given to projects processed by\norganizations that meet the requirements established in the Procedures\nManual for 2006.\n\n \n\nIn each of the\nSubregional Offices of SINAC and Regional Offices of FONAFIFO, a\nmap with the priority areas shall be kept to locate the farms that apply to the Environmental Services Payment\nProgram.\n\nArticle 4th-FONAFIFO\nis authorized to issue the payment of environmental services in its\ndifferent modalities for the maximum amounts authorized by this Decree.\n\nArticle 5th-The\npayment of environmental services shall be deferred according to the following\nconditions:\n\n \n\na) Reforestation\nProjects with areas less than or equal to fifty hectares may\nreceive the payment in advance. For these projects, the first disbursement of\n46% shall be made once the contract with the State is formalized, provided that the\namount to be disbursed is guaranteed as established in the Procedures\nManual for the year 2006. In the remaining nine years, an annual percentage of 6%\nof the total contract amount shall be paid. The payments are made from the average\nplanting date.\n\na) Reforestation\nProjects that do not receive advance payment shall receive the first payment\nof 46% once the contract with the State is formalized and the\nrequirements established in the Procedure Manual for the year 2006 are met. In the\nremaining nine years, an annual percentage of 6% of the total contract amount shall be paid.\nLikewise, the payments shall be made from the average planting date.\n\nb) For the payment of\nenvironmental services for projects in which Agroforestry\nSystems are developed, the first disbursement shall be made once the respective\ncontract is signed and the guarantee established in the Procedures\nManual for the year 2006 is received by FONAFIFO, or the establishment of the trees and their average planting\ndate is certified by the forestry manager (regente forestal). This\nfirst disbursement shall be 65% of the established amount, for the second year\nit shall be 20% and 15% for the third year and may be requested at twelve and\ntwenty-four months after the date of establishment of the trees\ncertified by the forestry manager (regente forestal).\n\nArticle 6th-The\ndeadline for the submission of pre-applications for the payment of environmental\nservices in the year two thousand six expires 30 days from the publication of\nthis decree.\n\nArticle 7th-Environmental\nServices may be paid under the protection modality on farms covered\nby the right of possession, as established in Executive Decree\n31633-MINAE of January 26, 2004.\n\nArticle 8th-The\nenvironmental services contracts that are financed with the resources\nauthorized in this decree must be signed no later than November 30 of the\nyear two thousand six.\n\nArticle\n9th-FONAFIFO shall make the payment of environmental services with funds captured from\npublic and private institutions, for the use of environmental services\ngenerated by forests and forest plantations, that contribute to the\nprotection of the water resource for urban, rural or hydroelectric use, the\nconditions thereof shall be established by the Agreements and contracts\nformalized for that purpose.\n\nArticle 10.-The\nresources not used by FONAFIFO, the refunds made, or the resources\nrecovered by virtue of contractual breaches, shall be deposited in\nan account established for that purpose by the cited Fund and shall be budgeted for\nthe execution of new environmental services payment projects.\n\nArticle 11.-To\nfulfill its mission, FONAFIFO may enter into cooperation agreements with\nother public bodies and entities.\n\nArticle 12.-In\naccordance with what is provided in the Ley Forestal regarding the Assets of FONAFIFO, the Board\nof Directors shall establish a asset account which shall be made up of idle\nor unallocated resources, so that after a period of 10 years it ensures\nits own financial sustainability. An amount not exceeding 40% may be allocated\nto credit for small and medium forest producers and the remainder shall be\ninvested in securities backed\nby the Public Sector.\n\nArticle 13.-It takes effect\nfrom its publication.\n\n \n\nIssued at the\nPresidency of the Republic.-San José, the eleventh of May, two thousand\nsix." }
