  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 91\n\n                        Regula Traspaso de Embarcaciones con Permiso Pesca Vigente del Instituto\nCostarricense de Pesca y Acuacultura\n\nTexto Completo acta: A1F9C\nINSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA\n\n \n\n(Se deja sin\nefecto mediante el acuerdo Nº 442 del 6 de octubre del 2006)\n\n \n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUACULTURA\n\n \n\nAJDIP/091.-Puntarenas,\na los trece días del mes de marzo del año dos mil uno.\n\n \n\nConsiderando:\n\n \n\n1°-Que es deber\ndel Estado Costarricense, procurar el mayor bienestar de todos los habitantes\ndel país. buscando el más adecuado reparto de la riqueza.\n\n2°-Que corresponde\nal INCOPESCA de conformidad con sus competencias y facultades otorgadas en la\nLey No 7384, regular, extender, suspender y cancelar los permisos de pesca,\ncaza marina y construcción de embarcaciones.\n\n3°-Que el permiso\nde pesca que otorga el INCOPESCA, es patrimonio de Estado y no constituye un\ntítulo negociable por parte de persona alguna, no pudiendo enajenarse,\npermitiéndose su transmisión únicamente con el traspaso de la embarcación\ndestinada a la realización de las labores o faenas de pesca.\n\n4°-Que es\nimportante y necesario mejorar el tramite de las solicitudes de traspasos de\nembarcaciones presentadas al Instituto, reguladas actualmente mediante acuerdo\nAJDIP/160-98, del 4 de junio de 1998 y sus reformas, publicado en La Gaceta N°\n130 del 7 de julio del mismo año. Por\ntanto,\n\n \n\nSE ACUERDA:\n\n \n\nArticulo\n1º-Si un permisionario que cuenta con una embarcación con permiso de pesca\nvigente o inactivo, tiene interés en vender y traspasar la embarcación, deberá\nde previo a la formalización de la venta, contar con la autorización del\nINCOPESCA, caso contrario se podrá cancelar administrativamente el permiso o\nlicencia de pesca.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/292 del 30 de junio del 2006)\n\nArtículo 2°-El\npermisionario para cumplir con lo anterior deberá presentar solicitud por\nescrito ante el Departamento de Protección y Registro del Instituto, en el cual\nse expongan las razones de su decisión, acompañando a su vez documento original\nen el que consigne las calidades del permisionario, de la embarcación a\ntraspasar, de la persona física o jurídica a la que se pretende traspasar la\nembarcación, debidamente firmado por el permisionario y el interesado en la\nadquisición de la embarcación, adjuntando fotocopia de las cédulas de\nidentidad.\n\nTratándose de\npersonas jurídicas a la que se pretende traspasar la embarcación, se deberá\nadjuntar certificación original y copia certificada vigente, de la personería\njurídica de la misma.\n\nArtículo 3°-En\ncaso de que un permisionario con permiso de pesca vigente, falleciere, el\nheredero legítimo declarado judicialmente, de la embarcación o el albacea de la\nsucesión o mortual, debidamente acreditado por documento idóneo, estarán\nfacultados para solicitar ante el INCOPESCA el traspaso de la embarcación de\npesca y el permiso o licencia correspondiente para lo cual deberán de adjuntar:\n\n \n\n- Copia del\ncertificado de defunción del permisionario\n\n- Certificado de\nnacimiento en donde conste el grado de filiación con el permisionario.\n\n- Certificado de\nestado civil del causante o fallecido.\n\n- Certificado\njudicial o notarial de la declaratoria de heredero legitimo de la embarcación\ncorrespondiente o de la condición de albacea.\n\n \n\nEn los traspasos\nrealizados bajo esta condición, el heredero o legatario, deberá reunir los\nrequisitos respectivos para poder ser titular de una licencia o permiso de\npesca.\n\nArtículo\n4°-Tratándose del traspaso de embarcaciones, que puedan ser producto de\ndonaciones, se deberá cumplir en igual forma con lo dispuesto en el artículo\nsegundo del presente acuerdo.\n\n         Artículo\n5°-Las solicitudes de traspasos deberán ser tramitadas, valoradas y\notorgadas por los funcionarios del Instituto, responsables de las Direcciones u\nOficinas Regionales y el Departamento de Protección y Registro, cumpliéndose\ncon los requisitos pertinentes y debiendo contarse de previo, con el visto bueno\nde la Asesoría Legal Interna, para lo cual deberá existir un estudio de cada\ncaso en particular y cuyo informe sustentara la recomendación en base a\ncriterio técnicos, de oportunidad, conveniencia y legalidad, todo lo cual\nconstará en el expediente administrativo de las embarcaciones.\n\n(Así reformado mediante el artículo 1° del acuerdo AJDIP/259 del 12 de\nsetiembre del 2002)\n\nArtículo 6°-Se\nderoga el acuerdo AJDIP/160-98 y sus reformas, publicado en La Gaceta No 130\ndel 7 de julio de 1998.\n\nArtículo 7°-Rige a\npartir de su publicación.\n\n \n\nPuntarenas, 23 de\nmarzo del 2001.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 91\n\n                        Regulates the Transfer of Vessels with a Valid Fishing Permit from the Costa\nRican Institute of Fisheries and Aquaculture\n\nComplete Text of record: A1F9C\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\n \n\n(Rendered without effect by means of agreement No. 442 of October 6, 2006)\n\n \n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\n \n\nAJDIP/091.-Puntarenas, on the thirteenth day of the month of March of the year two thousand one.\n\n \n\nConsidering:\n\n \n\n1°-That it is the duty of the Costa Rican State to seek the greatest well-being of all the inhabitants of the country, pursuing the most adequate distribution of wealth.\n\n2°-That it is the responsibility of INCOPESCA, in accordance with its powers and faculties granted in Law No. 7384, to regulate, issue, suspend, and cancel permits for fishing, marine hunting, and vessel construction.\n\n3°-That the fishing permit granted by INCOPESCA is State patrimony and does not constitute a negotiable title by any person, and may not be alienated, its transmission being permitted only with the transfer of the vessel destined for carrying out fishing work or tasks.\n\n4°-That it is important and necessary to improve the processing of vessel transfer applications submitted to the Institute, currently regulated by agreement AJDIP/160-98, of June 4, 1998, and its amendments, published in La Gaceta No. 130 of July 7 of the same year. Therefore,\n\n \n\nIT IS AGREED:\n\n \n\nArticle 1°-If a permit holder who has a vessel with a valid or inactive fishing permit is interested in selling and transferring the vessel, they must, prior to the formalization of the sale, have the authorization of INCOPESCA; otherwise, the fishing permit or license may be administratively cancelled.\n\n \n\n(Thus amended by agreement AJDIP/292 of June 30, 2006)\n\nArticle 2°-To comply with the above, the permit holder must submit a written application to the Department of Protection and Registry of the Institute, setting forth the reasons for their decision, attaching in turn an original document stating the qualifications of the permit holder, of the vessel to be transferred, and of the natural or legal person to whom the vessel is intended to be transferred, duly signed by the permit holder and the person interested in acquiring the vessel, attaching a photocopy of the identity cards.\n\nIn the case of legal persons to whom the vessel is intended to be transferred, an original certification and a current certified copy of the legal status of said legal person must be attached.\n\nArticle 3°-In the event that a permit holder with a valid fishing permit dies, the judicially declared legitimate heir of the vessel or the executor of the estate or succession, duly accredited by suitable document, shall be authorized to request from INCOPESCA the transfer of the fishing vessel and the corresponding permit or license, for which purpose they must attach:\n\n \n\n- Copy of the death certificate of the permit holder\n- Birth certificate stating the degree of filiation with the permit holder.\n- Certificate of marital status of the deceased.\n- Judicial or notarial certificate of the declaration of legitimate heir of the corresponding vessel or of the condition of executor.\n\n \n\nIn transfers carried out under this condition, the heir or legatee must meet the respective requirements to be able to hold a fishing license or permit.\n\nArticle 4°-In the case of the transfer of vessels that may be the result of donations, the provisions of article two of this agreement must be complied with in the same manner.\n\n     Article 5°-Transfer applications must be processed, evaluated, and granted by the officials of the Institute responsible for the Regional Directorates or Offices and the Department of Protection and Registry, fulfilling the pertinent requirements and having to obtain, beforehand, the approval of the Internal Legal Advisory Office, for which purpose there must be a study of each particular case, the report of which shall support the recommendation based on technical criteria of opportunity, convenience, and legality, all of which shall be recorded in the administrative file of the vessels.\n\n(Thus amended by article 1 of agreement AJDIP/259 of September 12, 2002)\n\nArticle 6°-Agreement AJDIP/160-98 and its amendments, published in La Gaceta No. 130 of July 7, 1998, are repealed.\n\nArticle 7°-It becomes effective upon its publication.\n\n \n\nPuntarenas, March 23, 2001."
