Estero Puntarenas\n\nTexto Completo acta: B651D\nNº 33327\n\nNº 33327\n\n \n\nEL\nPRESIDENTE DE LA REPÚBLICA\n\nY EL\nMINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nEn\nel ejercicio de las facultades conferidas por los artículos 140 incisos 3) y\n18) y 146 de la\n Constitución Política, los artículos 7º y 82 de\nla Ley de Conservación de\nla Vida Silvestre Nº\n7317, publicada en La\n Gaceta Nº 235 del 7 de diciembre de 1992, los artículos\n32 y 42 de la Ley\n Orgánica del Ambiente Nº 7554, publicada en\nLa Gaceta Nº 215 del\n13 de noviembre de 1995, Ley Forestal Nº 7575, publicada en\nLa Gaceta Nº 72 del\n16 de abril de 1996 y los artículos 6º, 11 y 27 de\nla Ley General de\nla Administración Pública\nde 2 de mayo de 1978.\n\n \n\nConsiderando:\n\n \n\n1º-Que\nes obligación del Estado velar por la conservación de los recursos naturales\ndel país, la administración de la vida silvestre y la recomendación de medidas\nque aseguren la perpetuidad de las especies, en la figura del Ministerio del\nAmbiente y Energía. \n\n2º-Que\nes interés del Gobierno fortalecer las estructuras administrativas en el campo\nde los recursos naturales, a fin de contar con políticas definidas que\ngaranticen el uso racional de dichos recursos. \n\n3º-Que el manejo racional integrado de los recursos naturales, contribuye a satisfacer las\nnecesidades regionales para la investigación científica, educación ambiental, ecoturismo, desarrollo\ncultural, socioeconómico y socioambiental y otras formas de aprovechamiento racional de la\nbiodiversidad, fundamentales para asegurar el desarrollo sostenible en los ámbitos local y nacional,\ntales como el ecoturismo o el turismo rural.\n\n4º-Que\nla protección de especies amenazadas y en peligro de extinción es tarea\nprioritaria del Estado costarricense y muy especialmente para las Áreas\nSilvestres Protegidas.\n\n5º-Que\ncomo consecuencia directa del aumento de la población humana, la agricultura\nintensiva, la urbanización, la contaminación, la sobreexplotación de los\nrecursos marinos y otras formas de intervención en el sistema ecológico e\nhidrológico, los ecosistemas de humedales, principalmente en el Golfo de\nNicoya, se están perdiendo en forma acelerada, lo que podría traer serias\nconsecuencias para la biodiversidad, las actividades de pesca y la economía del\npaís a mediano y largo plazo. \n\n6º-Que\nla Isla San\nLucas, ubicada en el Golfo de Nicoya, contiene rasgos culturales importantes,\nasí como recursos biológicos asociados tanto al área insular como la zona\ncostera que son importantes para su protección por representar uno de los pocos\nsitios de bosque seco que existe en el país y principalmente en un área\ninsular.\n\n7º-Que\nel Golfo de Nicoya constituye un criadero natural de muchas especies marinas\nque son aprovechadas por las comunidades aledañas. \n\n8º-Que\nlos humedales constituyen un importante sitio de alimentación, refugio y\nreproducción para una gran variedad de especies silvestres, por lo que reviste\nespecial importancia su protección y conservación.\n\n9º-Que\nel manejo racional integrado de los recursos marinos y costeros, incluidos los\nmanglares, contribuye a satisfacer las necesidades regionales para la\ninvestigación, recreación, educación ambiental, belleza escénica, así como el\naprovechamiento de los recursos naturales renovables, explotados racionalmente,\nen concordancia con lo que establece\nla Resolución VIII de\nla Convención\nsobre Humedales de Importancia Internacional, ratificada por Costa Rica según\nLey Nº 7224 del 9 de abril de 1991.\n\n10.-Que\nlas Resoluciones VII.5 y VII.28 de la sétima conferencia de las partes,\nrealizada del 9 al 20 de febrero del 2004, de\nla Convención sobre\nDiversidad Biológica, de la cual Costa Rica es signataria, establece:\n\n \n\na.\n\"Integrar las Áreas Protegidas en paisajes terrestres y marinos más amplios de\nmanera de mantener la estructura y función ecológicas.\"\n\n \n\nb.\n\"Regenerar y rehabilitar los hábitat y los ecosistemas degradados, según\nproceda, como contribución a la creación de redes ecológicas, corredores\necológicos y/o zonas intermedias.\"\n\n \n\nc.\n\"Establecer políticas y mecanismos institucionales con la plena participación\nde las comunidades indígenas y locales, para facilitar el reconocimiento legal\ny la administración eficaz de las áreas conservadas por las comunidades\nindígenas y locales, de manera consecuente con los objetivos de conservar tanto\nla diversidad biológica como los conocimientos, innovaciones y prácticas de las\ncomunidades indígenas y locales.\"\n\n \n\nd.\n\"Utilizar los beneficios sociales y económicos generados por las áreas\nprotegidas para aliviar la pobreza, en concordancia con los objetivos de la\nadministración de áreas protegidas.\"\n\n \n\ne.\n\"Intensificar y afianzar la participación de las comunidades indígenas y\nlocales y de todos los sectores interesados.\"\n\n \n\nf.\n\"Prevenir y mitigar los impactos negativos de amenazas graves a áreas\nprotegidas aplicando evaluaciones de impacto ambiental a todo plan o proyecto\ncon el potencial de producir efectos sobre las áreas protegidas.\"\n\n \n\n11.-Que\nla Ley de\nConservación de Vida Silvestre Nº 7317 y\nla Ley Orgánica del\nAmbiente Nº 7554 facultan al Poder Ejecutivo a crear Áreas Silvestres\nProtegidas en aquellas áreas con características ecológicas importantes o\nespeciales.\n\n12.-Que el Estero Puntarenas ha sido durante muchas décadas y\nseguirá siendo una vía de transporte y navegación para la comunidad\nPuntarenense, para los comerciantes y transportistas. \n\n13.-Que el desarrollo de las actividades de pesca, turismo,\ncabotaje, navegación, transporte, comerciales e industriales en\nla Ciudad de Puntarenas\ndepende del desarrollo de la zona limítrofe de la ciudad con la porción sur del\nEstero Puntarenas.\n\n14.-Que\nlos humedales y su conservación están declarados de interés público por\nla Ley Orgánica del\nAmbiente Nº 7554, estén o no estén protegidos por las leyes que rijan esta\nmateria; por consiguiente, cualquier actividad a realizar dentro de estos\necosistemas debe cumplir con todos los requisitos que dicta la normativa\njurídica vigente. \n\n15.-Que se hace necesario aclarar y definir acertadamente las\ncoordenadas que definen los límites del Estero Puntarenas y Manglares Asociados\ncomo Área Silvestre Protegida Categoría Humedal.\n\n16.-Que\nel Decreto de creación del Refugio Nacional de Vida Silvestre Isla San Lucas\nDecreto Ejecutivo Nº 29277-MINAE, publicado en\nLa Gaceta Nº 30 de\nlunes 12 de febrero del 2001 y su modificación, Decreto Ejecutivo Nº\n32349-MINAE, publicado en La\n Gaceta Nº 92 de viernes 13 de mayo del 2005, son confusos\nrespecto a la verdadera ubicación de\nla Isla San Lucas y otros territorios, por lo cual,\nse justifica la corrección de sus límites y su ratificación como Refugio\nNacional de Vida Silvestre. Por tanto,\n\n \n\nEL\nPRESIDENTE DE LA REPÚBLICA\n\nY EL\nMINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nDECRETAN:\n\n \n\nArtículo\n1º-Rectifíquese, delimítese y amplíese los límites del Refugio Nacional de Vida\nSilvestre Isla San Lucas, propiedad Estatal, declarado según Decreto Ejecutivo\nNº 29277-MINAE publicado en La\n Gaceta Nº 30 de lunes 12 de febrero del 2001 y su\nmodificación Decreto Ejecutivo Nº 32349-MINAE publicado en\nLa Gaceta Nº 92 de viernes\n13 de mayo del 2005 para que en adelante se lean como sigue:\n\n \n\nA. La porción\nterrestre conformada por la\n Isla San Lucas, ubicada en el Golfo de Nicoya, hoja\nCartográfica del IGN denominada Golfo, edición 3-IGNCR, situada entre las coordenadas\ngeográficas de latitud norte 9° 55'\n55\" - 9 57' 20\" y longitud Oeste 84° 53' 23\", con una extensión de 462 ha. De este punto sigue una línea de dirección Oeste-Este, pasando\npor los siguientes puntos:\n\n \n\n218500\nN-443000 E (1)\n\n218500\nN-446000 E (2)\n\n218670\nN-447000 E (3)\n\n218330\nN-450000 E (4)\n\n218390\nN-450480 E (5)\n\n \n\nPunto\n(5) que coincide con la parte externa o intersección del Estero Chacarita con\nel borde sur del Estero Puntarenas. articles 140, subsections 3) and 18), and 146 of the Political Constitution, articles 7 and 82 of the Wildlife Conservation Law No. 7317, published in La Gaceta No. 235 of December 7, 1992, articles 32 and 42 of the Organic Law of the Environment No. 7554, published in La Gaceta No. 215 of November 13, 1995, Forest Law No. 7575, published in La Gaceta No. 72 of April 16, 1996, and articles 6, 11, and 27 of the General Law of Public Administration of May 2, 1978.\n\nConsidering:\n\n1º-That it is the obligation of the State to ensure the conservation of the country's natural resources, the administration of wildlife, and the recommendation of measures that ensure the perpetuity of species, through the Ministry of Environment and Energy.\n\n2º-That it is in the Government's interest to strengthen administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.\n\n3º-That the integrated rational management of natural resources contributes to satisfying regional needs for scientific research, environmental education, ecotourism, cultural, socioeconomic and socio-environmental development, and other forms of rational use of biodiversity, which are fundamental for ensuring sustainable development at local and national levels, such as ecotourism or rural tourism.\n\n4º-That the protection of threatened and endangered species is a priority task for the Costa Rican State, and very especially for Protected Wild Areas.\n\n5º-That as a direct consequence of the increase in human population, intensive agriculture, urbanization, pollution, overexploitation of marine resources, and other forms of intervention in the ecological and hydrological system, wetland ecosystems, mainly in the Gulf of Nicoya, are being lost at an accelerated rate, which could have serious consequences for biodiversity, fishing activities, and the country's economy in the medium and long term.\n\n6º-That Isla San Lucas, located in the Gulf of Nicoya, contains important cultural features, as well as biological resources associated with both the island area and the coastal zone that are important for their protection, as they represent one of the few dry forest (bosque seco) sites that exist in the country, and mainly in an island area.\n\n7º-That the Gulf of Nicoya constitutes a natural nursery for many marine species that are utilized by the surrounding communities.\n\n8º-That wetlands constitute an important feeding, refuge, and reproduction site for a great variety of wild species, making their protection and conservation particularly important.\n\n9º-That the integrated rational management of marine and coastal resources, including mangroves, contributes to satisfying regional needs for research, recreation, environmental education, scenic beauty, as well as the use of renewable natural resources, exploited rationally, in accordance with the provisions of Resolution VIII of the Convention on Wetlands of International Importance, ratified by Costa Rica pursuant to Law No. 7224 of April 9, 1991.\n\n10.-That Resolutions VII.5 and VII.28 of the seventh Conference of the Parties, held February 9-20, 2004, of the Convention on Biological Diversity, to which Costa Rica is a signatory, establishes:\n\na. \"Integrate Protected Areas into broader land- and seascapes so as to maintain ecological structure and function.\"\n\nb. \"Regenerate and rehabilitate degraded habitats and ecosystems, as appropriate, as a contribution to the creation of ecological networks, ecological corridors, and/or buffer zones.\"\n\nc. \"Establish policies and institutional mechanisms with full participation of indigenous and local communities, to facilitate the legal recognition and effective administration of areas conserved by indigenous and local communities, consistent with the objectives of conserving both biological diversity and the knowledge, innovations, and practices of indigenous and local communities.\"\n\nd. \"Use the social and economic benefits generated by protected areas to alleviate poverty, in accordance with protected area management objectives.\"\n\ne. \"Intensify and strengthen the participation of indigenous and local communities and all interested sectors.\"\n\nf. \"Prevent and mitigate the negative impacts of serious threats to protected areas by applying environmental impact assessments (evaluaciones de impacto ambiental) to any plan or project with the potential to produce effects on protected areas.\"\n\n11.-That the Wildlife Conservation Law No. 7317 and the Organic Law of the Environment No. 7554 empower the Executive Branch to create Protected Wild Areas in those areas with important or special ecological characteristics.\n\n12.-That the Estero Puntarenas has been for many decades and will continue to be a transportation and navigation route for the Puntarenas community, for merchants, and for transporters.\n\n13.-That the development of fishing, tourism, cabotage, navigation, transportation, commercial, and industrial activities in the City of Puntarenas depends on the development of the zone bordering the city with the southern portion of the Estero Puntarenas.\n\n14.-That wetlands and their conservation are declared of public interest by the Organic Law of the Environment No. 7554, whether or not they are protected by the laws governing this matter; consequently, any activity to be carried out within these ecosystems must comply with all the requirements dictated by the current legal regulations.\n\n15.-That it is necessary to clarify and accurately define the coordinates that define the boundaries of the Estero Puntarenas and Associated Mangroves as a Protected Wild Area in the Wetland Category.\n\n16.-That the Decree creating the Isla San Lucas National Wildlife Refuge, Executive Decree No. 29277-MINAE, published in La Gaceta No. 30 of Monday, February 12, 2001, and its amendment, Executive Decree No. 32349-MINAE, published in La Gaceta No. 92 of Friday, May 13, 2005, are confusing regarding the true location of Isla San Lucas and other territories; therefore, the correction of its boundaries and its ratification as a National Wildlife Refuge is justified. Therefore,\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nDECREE:\n\nArticle 1º-Rectify, define, and extend the boundaries of the Isla San Lucas National Wildlife Refuge, State property, declared by Executive Decree No. 29277-MINAE published in La Gaceta No. 30 of Monday, February 12, 2001, and its amendment Executive Decree No. 32349-MINAE published in La Gaceta No. 92 of Friday, May 13, 2005, so that henceforth they shall read as follows:\n\nA. The terrestrial portion consisting of Isla San Lucas, located in the Gulf of Nicoya, on the IGN cartographic sheet named Golfo, edition 3-IGNCR, situated between the geographical coordinates of north latitude 9° 55' 55\" - 9 57' 20\" and West longitude 84° 53' 23\", with an extension of 462 ha. the initial point of this description of the Estero de Puntarenas and Associated Mangroves Wetland at coordinates 218500 N-443000 E (1).\n\nArticle 3º-Any infrastructure work to be built, whether docks (atracaderos), piers (muelles), fish collection centers, or any other related to fishing, tourism, or other activities, within the buffer zone (zona de amortiguamiento), which corresponds to the strip between the southern boundary of the Protected Wild Area Estero Puntarenas and Associated Mangroves Wetland and the coastline of the city of Puntarenas, running from point 1 at coordinates 218500 N-443000 E to point 5 at coordinates 218390 N-450480 E, must be built on pilings (pilotes) or floating docks (muelles flotantes), depending on their purpose, size, or load capacity. To build said infrastructure, interested parties must request approval from the Maritime Port Division of the Ministry of Public Works and Transport (MOPT); once such approval is obtained, the Municipality of Puntarenas shall proceed to grant the corresponding permit.\n\nArticle 4º-The Administration of the protected areas declared herein shall be the responsibility of the Ministry of Environment and Energy and the institutions established by current regulations. The management categories established in this decree shall be governed in accordance with the provisions established in this regard by the legal regulations in force on the matter. The extraction of marine species shall be permitted based on the regulations established by the Management Plan of these Protected Wild Areas, their Use Regulation, and the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA).\n\nArticle 5º-This decree does not limit or modify the condition of the Estero Puntarenas as a means of transportation or navigation. Free navigation through it is maintained, and the tasks deemed necessary to provide adequate maintenance so that it does not lose its navigability condition are authorized. Any other activity required to be carried out within the portion of the Estero de Puntarenas that forms part of the Protected Wild Area must have the respective permit from the Subregional Office of SINAC-MINAE located in Esparza de Puntarenas, and at its discretion.\n\nArticle 6º-Declare of public interest any activity or project aimed at recovering and conserving the quality of the waters and the natural resources of the Estero de Puntarenas, as well as their rational use.\n\nArticle 7º-Repeal articles 3, 4, and 5 of Executive Decree No. 32349-MINAE, published in La Gaceta No. 92 of Friday, May 13, 2005.\n\nArticle 8º-Effective as of its publication.\n\nGiven at the Presidency of the Republic.-San José, on the thirtieth day of the month of August of the year two thousand six."
