Y,\n\nConsiderando:\n\n1º-Que la Reserva\nIndígena de China Kicha, establecida por Decreto\nEjecutivo N° 34 de La Gaceta N° 3 de 5 de enero de 1957, fue derogada por\nDecreto Ejecutivo N° 13570 - G de 30 de abril de 1982, omitiendo aspectos\nlegales de fondo, de la legislación indigenista, como la misma Ley Indígena y\nel Convenio 107 de la OIT, 1957. Lesionando derechos de la comunidad indígena.\n\n2º-Que el decreto de\nderogatoria de la Reserva Indígena de China Kicha, no\nconsideró los intereses de un núcleo importante de población indígena de la\netnia Cabécar, que se mantenía dentro de los límites\nde la reserva citada, dejándolos fuera del estatuto de reserva, desprotegido de\nlos beneficios que la legislación indígena les brindaba como comunidad y en\ndesigualdad de condiciones con respecto a las demás comunidades indígenas.\n\n3º-Que la comunidad\nindígena Cabécar de China Kicha,\napela a los derechos que le fueron lesionados y a sus intereses, amparados a la\nley 7316, del convenio 169 de la OIT. Solicitando, se le reivindique la tierra\nde la Reserva de China Kicha.\n\n4º-Que la comunidad\nindígena de China Kicha, ha solicitado a la Comisión\nNacional de Asuntos Indígenas, CONAI. La realización de estudios técnicos para\nque se considere su solicitud, vía administrativa. Teniéndose que la misma\ncomunidad ha practicado la consulta comunal, tal y como lo establece el\nConvenio 169 de la OIT, en su artículo N°6, inciso a.\n\n5º-Que la Comisión\nNacional de Asuntos Indígenas, CONAI. Ya realizó los estudios técnicos en China\nKicha, recomendando el reestablecimiento\nde la reserva de China Kicha, con una nueva\ndelimitación, sobre la cual existe pleno acuerdo de la comunidad indígena de\nese lugar.\n\n6º-Que a ese efecto,\nel Estado Costarricense habiendo ratificado el Convenio Internacional N° 169 de\nla OIT, y establecido la Ley indígena 6172, y su Reglamento y decretos\nconcordantes. Debe salvaguardar los derechos e intereses de la población\nindígena solicitante. Por tanto,\n\nDecretan:\n\nArtículo 1º-Se\nreestablece la reserva indígena de China Kicha con la\ndefinición de nuevos límites.\n\nArtículo 2º-La Reserva Indígena de China Kicha,\nse localiza en las hojas cartográficas del Instituto Geográfico Nacional,\nescala 1:50.000. Repunta 3443 I, Coronado 3443 II, Buenos Aires 3543 IV y\nGeneral 3543 III.\n\nLa Reserva Indígena de China Kicha, tendrá por\nlímites, las siguientes coordenadas:\n\nPartiendo de la unión de los ríos Pejibaye y General en el punto de\ncoordenadas N344 960 E 521 250. El lindero de la reserva, sigue aguas arriba\npor el Río General, hasta el punto de coordenadas N 348 800 E 520 090, lugar\ndonde confluye la Quebrada Pita sobre el Río General. De ahí, se continúa aguas\narriba por la Quebrada Pita, hasta un punto donde ésta interseca un camino que\nla atraviesa, en coordenadas N 348 850 E 519 250. A partir de\neste último punto, se deja el camino principal, para tomar por un camino tipo trocha, con rumbo\nSuroeste, pasando por los puntos de coordenadas N 346 900 E 516 925, N 346 860 E 516 950, N 346 825\nE 517000(**). De ahí, al punto de coordenadas N 346 725 e 516 440(***). Punto en donde confluye, una\npequeña quebrada (dibujada en el mapa por curvas de nivel) con la Quebrada Bonita. De este punto, se\nsigue aguas abajo por la Quebrada Bonita, hasta su desembocadura sobre el Río Pejibaye, en el punto\nde coordenadas N 344 780 E 518 650. Tomando en cuenta el artículo N° 14 del convenio N° 169\nde la OIT.\n\nArtículo\n4º-El plano catastrado de la Reserva Indígena de China Kicha, será elaborado\npor el Instituto de Desarrollo Agrario, IDA, mediante su Departamento de\nTopografía, a partir de las coordenadas que se definen en el artículo N° 2 del\npresente Decreto y será el encargado de realizar el tramite respectivo de\ncatastrado de dicho plano. Omitiendo el trabajo del levantamiento topográfico\nen el terreno, quedando obligado el Colegio Federado de Arquitectos e\nIngenieros y el Colegio de Ingenieros Topógrafos a cumplir con lo dispuesto en\neste artículo, el cual se inscribe dentro del marco del artículo 14, inciso 3\ndel Convenio N° 169. En razón de no obstaculizar, el tramite de catastro del\ncitado plano y de los planos de las reservas indígenas que faltasen por\ncatastrar o modificar, a partir de las coordenadas que se definen en los\ndecretos que las delimitan.\n\nArtículos 5º-Rige a partir de su publicación.\n\nDado en la Presidencia de la República.- San José, a los veintiún días\ndel mes de marzo del dos mil uno.",

It being understood that the\ncommunity itself has conducted the communal consultation, as established by\nILO Convention 169, Article 6, subsection a.\n\n5º-That the National\nCommission for Indigenous Affairs, CONAI, has already carried out the technical studies in China\nKicha, recommending the reestablishment\nof the China Kicha reserve, with a new\ndelimitation, on which there is full agreement from the indigenous community of\nthat place.\n\n6º-That to this end,\nthe Costa Rican State, having ratified International Convention No. 169 of\nthe ILO, and established Indigenous Law 6172, its Regulations, and concordant decrees,\nmust safeguard the rights and interests of the petitioning indigenous\npopulation. Therefore,\n\nThey decree:\n\nArticle 1-The\nindigenous reserve of China Kicha is reestablished with the\ndefinition of new boundaries.\n\nArticle 2-The Indigenous Reserve of China Kicha\nis located on the cartographic sheets of the National Geographic Institute,\nscale 1:50,000. Repunta 3443 I, Coronado 3443 II, Buenos Aires 3543 IV, and\nGeneral 3543 III.\n\nThe Indigenous Reserve of China Kicha shall have as its\nboundaries the following coordinates:\n\nStarting from the confluence of the Pejibaye and General rivers at the point with\ncoordinates N344 960 E 521 250. The boundary of the reserve continues upstream\nalong the Río General, to the point with coordinates N 348 800 E 520 090, the place\nwhere the Quebrada Pita flows into the Río General. From there, it continues upstream\nalong the Quebrada Pita, to a point where it intersects a road that\ncrosses it, at coordinates N 348 850 E 519 250. Previously,\nit read: \"N 346 725 E 517 440\")\n\nArticle\n3-Considering that the Indigenous Reserve of China Kicha was established\nby Executive Decree No. 34 of La Gaceta No. 3 of January 5,\n1957, with a surface area larger than that defined in the delimitation of the\npresent Decree, Article 2. The National Commission for Indigenous Affairs,\nCONAI, is empowered to indemnify lands adjacent to the reserve and\ninclude them within it, for its subdivision (parcelación) for the indigenous community, once\nthe lands located within the boundaries defined in Article 2 of\nthis Decree have been indemnified in accordance with the provisions of Indigenous Law No.\n6172, taking into account Article 14 of Convention No. 169\nof the ILO.\n\nArticle\n4-The cadastral plan of the Indigenous Reserve of China Kicha shall be prepared\nby the Institute of Agrarian Development, IDA, through its Department of\nTopography, based on the coordinates defined in Article 2 of this\nDecree, and it shall be responsible for carrying out the respective cadastral registration\nprocess for said plan, omitting the work of the topographical survey\non the ground. The Federated College of Architects and\nEngineers and the College of Topographical Engineers are obligated to comply with the provisions of\nthis article, which is inscribed within the framework of Article 14, subsection 3\nof Convention No. 169, so as not to obstruct the cadastral registration process for the\naforementioned plan and for the plans of the indigenous reserves that remain to be\nregistered or modified, based on the coordinates defined in the\ndecrees that delimit them.\n\nArticle 5-It shall take effect upon its publication.\n\nGiven at the Presidency of the Republic.—San José, on the twenty-first day\nof the month of March of two thousand one."
