  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29449\n\n                        Reforma Reserva Indígena Guaymí de Coto Brus\n\nTexto Completo acta: 9F5E4\nN° 29449-G\n\nN° 29449\n\nEL\nPRESIDENTE DE LA REPÚBLICA\n\nY\nEL MINISTRO DE GOBERNACION Y POLICÍA,\n\nY\nSEGURIDAD PÚBLICA\n\nCon\nfundamento en los inciso 3) y 18) del artículo 140, de la Constitución Política\ny las leyes Nº 5251 de fecha 11 de julio de 1973 y sus reformas, la Ley\nIndígena Nº 6172 de fecha 29 de noviembre de 1977 y Ley 7316 de fecha 12 de\noctubre doce 1992, Convenio 169 OIT.\n\nConsiderando:\n\n1º-Que los límites actuales de la reserva indígena Guaymí de Coto Brus, establecido por Decreto\nEjecutivo Nº 12232-G, La Gaceta Nº 25 de fecha 5 de febrero de 1981 con correcciones dadas por el\nDecreto Nº 12751-G- La Gaceta, 130 de fecha 10 de julio de 1981, presenta imperfecciones de detalle\nen la Fila Cruces, la cual, según artículo 6 de este decreto le brinda un estatuto especial de\n\"Bosque Protector\", como zona de reserva de flora y fauna, así como para la protección de cuencas\nhidrográficas, que son elementales en el abastecimiento de agua potable para las poblaciones de\nLimoncito, Brusmalís, Alto Unión, Paraíso, La Guaria, Km 19 y Río Claro. Dejándose por fuera el\nsector sur de dicha fila.\n\n2º-Que por\nla riqueza ecológica y fuente hidrográfica que presenta el sector sur de Fila\nCruces, debe ser incluida dentro de la demarcación de la reserva a fin de\nbrindarle el estatuto de bosque protector a dicho sector sur, tal y como lo\nindica el artículo 6 del decreto antes citada.\n\n3º-Que en la\nzona de Paraíso, existen terrenos considerados tradicionalmente de ocupación\nindígena, que se deben incluir dentro de la reserva indígena,.\nGuaymí de Coto Brus, a fin\nde cumplir con el mandato del artículo Nº 14 de la Ley Nº 7316, Convenio 169,\nOIT, de fecha 12 de octubre de 1992.\n\n4º-Que es\nnecesario definir una delimitación conforme a la realidad, para evitar\nconflictos por tierra a la población indígena y no indígena del lugar.\n\n5º-Que es requisito fundamental, salvaguardar la riqueza natural de la reserva indígena Guaymí de\nCoto Brus, para la población indígena Guaymí que la habita. Por tanto,\n\nDecretan:\n\nArtículo\n1º-Modifíquese los linderos de la reserva indígena Guaymí\nde Coto Brus, a fin de incluir en ella, el sector Sur\nde la Fila Cruces y terrenos tradicionalmente indígenas en el sector de\nParaíso, de manera que los límites definitivos de esta reserva sean\nestablecidos acorde a la realidad y definidos en el artículo 2: del presente\ndecreto.\n\nArtículo 2º-Modifíquese el artículo *1º del Decreto Nº 12232-G, La\nGaceta Nº 25 de fecha 5 de febrero de 1981 y el artículo Nº 1º del Decreto\nEjecutivo Nº 12751-G de La Gaceta Nº 130 de fecha 10 de julio de 1981,\npara que de ahora en adelante se lea así: \"La Reserva Indígena Guaymí de Coto Brus, se encuentra\nen las hojas cartográficas del Instituto Geográfico Nacional, escala l:50 000,\nCoto Brus 3542 I y Piedras Blancas 3542II.\n\nLa Reserva Indígena Guaymí de Coto Brus, se localiza por los puntos, cuyas coordenadas son:\npartiendo del vértice Anguciana N 307, 230, E 556 662\n(Cerro de 1707 metros).\n\n| N 307 800 | E 557 100 |\n| --- | --- |\n| N 308 800 | E 556 700 |\n| N 309 500 | E 557 550 |\n| N 310 000 | E 557 500 |\n\n \n\nDe este punto se continúa por una trocha dibujada en el mapa, pasando\npor los puntos de coordenadas siguientes:\n\n| N 310 150 | E 557 625 |\n| --- | --- |\n| N 310 600 | E 557 450 |\n| N 310 700 | E 557 475 |\n| N 310 775 | E 557 600 |\n| N 310 750 | E 557 680 |\n| N 310 775 | E 557 850 |\n| N 310 765 | E 557 960 |\n| N 310 825 | E 558 120 |\n| N 310 900 | E 558 250 |\n| N 310 975 | E 558 400 |\n| N 311 060 | E 558 500 |\n| N 311 195 | E 558 600 |\n| N 311 350 | E 558 650 |\n| N 311 425 | E 558 750 |\n\nA partir de este punto, el lindero de la reserva sale de la trocha\npara continuar con rumbo sur este, hacia el punto de coordenadas N 310 700 E\n560 200. De este punto se continúa con rumbo este franco a las coordenadas N\n310 450 E 561 275 punto que interseca un camino dibujado en el mapa. De ahí se\nsigue con rumbo sur este por una recta al punto de coordenadas N 310 125 E 561\n500. De este punto el límite se desvía tomando rumbo Noreste al punto de\ncoordenadas N 310 550 E 562 500. Punto de confluencia entre la quebrada\ndenominada, quebrada Caballo (Modori) en el terreno (\nsin nombre en el mapa) y el Río Limón. De este punto, el lindero de la reserva,\ncontinúa aguas arriba por el río Limón, hasta el punto de coordenadas N 3l0\n150, E 564 150. De ahí, se continúa aguas arriba por\nel Río Limón, hasta la unión de éste con Río Chico, en coordenadas N 309 150 E 568 800). |\n\nEl límite de la reserva indígena, sigue aguas arriba por el Río Chico,\nhasta la unión de dos de sus principales brazos en el punto de coordenadas N\n307 300 E 568 600. De este punto, se sigue por el brazo izquierdo aguas arriba,\nhasta el punto de coordenadas N 305 250 E 569 450. De ahí se continúa con rumbo\nEste franco, a la coordenada N 305 250 E 570 150, punto que interseca una\nquebrada dibujada por curvas de nivel que confluye al Río Salto.\n\nDe este punto se toma rumbo Sur franco hasta el punto de coordenadas N\n304 750 E 570 150. Punto que interseca la Fila Cruces. Anteriormente se indicaba: \" N 303\n875 E 568 450\")\n\nDe ahí se sigue una recta rumbo Oeste Franco, al punto de coordenadas N\n302 700 E 567 975. Punto que se localiza en la naciente de una quebrada\ndibujada en el mapa por curvas de nivel, la cual constituye una de las\nnacientes principales de Río Lagarto. De este punto, se sigue aguas abajo por\nesta naciente, hasta las coordenadas N 302 325 E 566 295 punto de confluencia\ncon otra naciente del río Lagarto. A partir de ahí, se sigue por el Río Lagarto\naguas abajo, hasta las coordenadas N 301 925 E 566 025. De ahí una recta al\npunto de coordenadas N 301 700 E 565 550. A partir de este punto se continúa\npor las coordenadas siguientes:\n\n| N 302 170 | E 564 650 |  | | --- | --- | --- | | N 302 000 | E 562 000 |  | | N 303 000 | E 559\n650 |  | | N 303 000 | E 558 675 |  | | N 303 950 | E 557 250 |  | | N 303 995 | E 556 685 | punto\nque interseca uno de los brazos del río Esquinas. De este punto se continúa al punto de coordenadas N 304\n300, E 555 550 Punto ubicado sobre otro brazo este del Río Esquinas. Se continúa aguas arriba por\neste brazo, hasta el punto de coordenada N 304 800 E 555 550. De ahí continúa por una recta rumbo\nNoroeste, hasta la coordenada N. 305 475 E 554 450. Punto que interseca sobre el río Esquinas. De\naquí, el límite de la reserva continúa por este río aguas arriba, siguiendo su naciente principal,\nhasta el punto de coordenadas N 307 350 E 555 100. |\n\nA partir de ahí se sigue por una recta hasta el punto de\ncoordenada, N 307 405 E 555 350, y de este punto, se sigue hasta el punto de\ncoordenadas N 307 230, E 556 662, vértice Anguciana,\npunto de origen de la presente descripción.\n\n*(NOTA DE SINALEVI: Mediante\nel presente artículo, se modifica el artículo 1° del decreto ejecutivo N° 12232\ndel 26 de enero de 1981, no obstante, en razón de la materia reformada y la\ninformación suministrada por el Ministerio de Gobernación y Policía, la reforma\ncorresponde al artículo 2°).\n\nArtículo\n3º-Que los límites establecidos en el artículo 2 del presente decreto, son los\nlímites vigentes y definitivos de la Reserva Indígena Guaymí de Coto Brus.\n\nArtículo\n4º-Para efectos de la División Política Administrativa y el Registro Civil. La\nReserva Indígena Guaymí de Coto Brus, se compone de las siguientes localidades:\n\n1-\nBrusmalís: De Río Chico a Quebrada Pita incluyendo Villa Palacios (Kebidini).\n\n2- Kigari (o\nPita): Quebrada Pita a Caño Bravo.\n\n3- La Unión,\nentre los tres brazos principales del río Caño Bravo, dibujados en la hoja\ncartográfica Piedras Blancas 3542 II escala l:50,000 I:G:N:\n\n4- La Casona\n\n5- Modori\n(Quebrada Caballo) al norte de esta quebrada\n\n6- Anguciana\n\n7- Cerro\nParaguas o quebrada Pita\n\nArtículo\n5º-La zona forestal de la Fila Cruces tendrá un Estatuto especial de zona\nprotectora, tanto en sentido norte como sur y será únicamente utilizada como\nzona de Flora y Fauna y protección de Cuencas Hidrográfica, quedando prohibida\nla deforestación y caza en la mismo y no se dará lugar a ningún tipo de\naprovechamiento forestal o cualquier otra forma de explotación del bosque, en\nesta zona.\n\nArtículo\n6º-Los Artículos 7 y 8 del decreto N° 12232-G de fecha 26-1-81 La Gaceta\nNº 25, de fecha 5 de febrero de 1981, quedan vigentes.\n\nArtículo\n7º-Modifíquese el Artículo 5° del Decreto N° 12232-G, de La Gaceta N° 25 de\nfecha 5 de febrero de 1981, para que de hora en adelante se lea así: Los\nsectores de La Casona, Brusmalís, Limoncito, Cerro Paraguas, Villa Palacios. Leaving out the\nsouthern sector of said ridge.\n\n2º-That due to\nthe ecological richness and hydrographic source that the southern sector of Fila\nCruces presents, it must be included within the demarcation of the reserve in order to\nprovide the protective forest status to said southern sector, just as\narticle 6 of the aforementioned decree indicates.\n\n3º-That in the\nzone of Paraíso, there exist lands traditionally considered of indigenous\noccupation, which must be included within the indigenous reserve,.\nGuaymí de Coto Brus, in order\nto comply with the mandate of article Nº 14 of Law Nº 7316, Convention 169,\nILO, of October 12, 1992.\n\n4º-That it is\nnecessary to define a delimitation in accordance with reality, to avoid\nland conflicts for the indigenous and non-indigenous population of the place.\n\n5º-That it is a fundamental requirement, to safeguard the natural wealth of the Guaymí de\nCoto Brus indigenous reserve, for the Guaymí indigenous population that inhabits it. Therefore,\n\nThey Decree:\n\nArticle\n1º-The boundaries of the Guaymí Indigenous Reserve\nde Coto Brus are modified, in order to include in it, the Southern sector\nof the Fila Cruces and traditionally indigenous lands in the sector of\nParaíso, so that the definitive limits of this reserve are\nestablished according to reality and defined in article 2: of the present\ndecree.\n\nArticle 2º-Article *1º of Decree Nº 12232-G, La\nGaceta Nº 25 of February 5, 1981 and article Nº 1º of Executive\nDecree Nº 12751-G of La Gaceta Nº 130 of July 10, 1981 are modified,\nso that from now on it reads as follows: \"The Guaymí de Coto Brus Indigenous Reserve, is located\non the cartographic sheets of the National Geographic Institute, scale l:50 000,\nCoto Brus 3542 I and Piedras Blancas 3542II.\n\nThe Guaymí de Coto Brus Indigenous Reserve, is located by the points, whose coordinates are:\nstarting from the Anguciana vertex N 307, 230, E 556 662\n(Cerro of 1707 meters).\n\n| N 307 800 | E 557 100 |\n| --- | --- |\n| N 308 800 | E 556 700 |\n| N 309 500 | E 557 550 |\n| N 310 000 | E 557 500 |\n\nFrom this point it continues along a trail drawn on the map, passing\nthrough the following coordinate points:\n\n| N 310 150 | E 557 625 |\n| --- | --- |\n| N 310 600 | E 557 450 |\n| N 310 700 | E 557 475 |\n| N 310 775 | E 557 600 |\n| N 310 750 | E 557 680 |\n| N 310 775 | E 557 850 |\n| N 310 765 | E 557 960 |\n| N 310 825 | E 558 120 |\n| N 310 900 | E 558 250 |\n| N 310 975 | E 558 400 |\n| N 311 060 | E 558 500 |\n| N 311 195 | E 558 600 |\n| N 311 350 | E 558 650 |\n| N 311 425 | E 558 750 |\n\nStarting from this point, the boundary of the reserve leaves the trail\nto continue with a southeast course, toward the coordinate point N 310 700 E\n560 200. From there it\nfollows with a southeast course along a straight line to coordinate point N 310 125 E 561\n500. From this point the limit deviates taking a Northeast course to coordinate\npoint N 310 550 E 562 500. Confluence point between the stream\nnamed, quebrada Caballo (Modori) on the ground (\nwithout a name on the map) and the Río Limón. From this point, the boundary of the reserve\ncontinues upstream along the Río Limón, to coordinate point N 3l0\n150, E 564 150. From there it continues with a due\nEast course, to coordinate N 305 250 E 570 150, a point that intersects a\nstream drawn by contour lines that flows into the Río Salto.\n\nFrom this point, a due South course is taken to coordinate point N\n304 750 E 570 150. Point that intersects the Fila Cruces. From this point, it follows downstream along\nthis spring (naciente), to coordinates N 302 325 E 566 295, confluence point\nwith another spring (naciente) of the Río Lagarto. Starting from there, it follows along the Río Lagarto\ndownstream, to coordinates N 301 925 E 566 025. From there a straight line to\ncoordinate point N 301 700 E 565 550. From\nhere, the boundary of the reserve continues along this river upstream, following its principal spring (naciente),\nto coordinate point N 307 350 E 555 100. |\n\nStarting from there, it follows a straight line to the\ncoordinate point, N 307 405 E 555 350, and from this point, it follows to coordinate\npoint N 307 230, E 556 662, Anguciana vertex,\npoint of origin of the present description.\n\n*(NOTE FROM SINALEVI: By means of\nthe present article, article 1° of executive decree N° 12232\nof January 26, 1981 is modified, nonetheless, by reason of the amended matter and the\ninformation supplied by the Ministry of Governance and Police, the amendment\ncorresponds to article 2°).\n\nArticle\n3º-That the limits established in article 2 of the present decree, are the\ncurrent and definitive limits of the Guaymí de Coto Brus Indigenous Reserve.\n\nArticle\n4º-For purposes of the Political Administrative Division and the Civil Registry. The\nGuaymí de Coto Brus Indigenous Reserve, is composed of the following localities:\n\n1-\nBrusmalís: From Río Chico to Quebrada Pita including Villa Palacios (Kebidini).\n\n2- Kigari (or\nPita): Quebrada Pita to Caño Bravo.\n\n3- La Unión,\nbetween the three principal branches of the Caño Bravo river, drawn on the\ncartographic sheet Piedras Blancas 3542 II scale l:50,000 I:G:N:\n\n4- La Casona\n\n5- Modori\n(Quebrada Caballo) to the north of this stream\n\n6- Anguciana\n\n7- Cerro\nParaguas or Quebrada Pita\n\nArticle\n5º-The forest zone of the Fila Cruces shall have a special Status of protective zone, in both the northern and southern senses, and shall be used solely as a zone of Flora and Fauna and protection of Hydrographic Basins, deforestation and hunting being prohibited therein, and no type of forest use (aprovechamiento forestal) or any other form of exploitation of the forest shall take place in this zone.\n\nArticle\n6º-Articles 7 and 8 of decree N° 12232-G of 1-26-81 La Gaceta\nNº 25, of February 5, 1981, remain in force.\n\nArticle\n7º-Article 5° of Decree N° 12232-G, of La Gaceta N° 25 of\nFebruary 5, 1981, is modified, so that from now on it reads as follows: The\nsectors of La Casona, Brusmalís, Limoncito, Cerro Paraguas, Villa Palacios. Together,\nthey shall have the category of neighborhood of the Cantón of Coto Brus and shall\nbe denominated: Barrio Guaymí de Coto Brus.\n\nArticle\n8º-Takes effect upon its publication.\n\nGiven at the\nPresidency of the Republic.- San José, at eight o'clock in the morning on the twenty-second day of\nMarch, two thousand one."
