Crea la Comisión Nacional de Biocombustibles.\n\nTexto Completo acta: C4407\nNº 33357\n\n(Este decreto fue derogado por el artículo 26° del Reglamento de Biocombustibles, decreto ejecutivo\nN° 35091 del 09 de enero del 2009)\n\nNº 33357\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nEL MINISTRO DE AGRICULTURA Y\nGANADERÍA,\n\nY EL MINISTRO DEL AMBIENTE Y\nENERGÍA\n\n \n\nDe conformidad con las\natribuciones que les conceden los artículos 140, incisos 3), 8), 18) y 20), y\n146 de la Constitución Política, los artículos 25, 27.1, 28.2.b de la Ley Nº\n6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº\n7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que\nincorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería y la Ley Nº\n7554 del 13 de noviembre de 1995, Ley Orgánica del Ambiente, Ley Nº 7152 Ley de\nConversión MINAE, y Ley Nº 7356 del Monopolio de Hidrocarburos en favor del\nEstado.\n\n \n\nConsiderando:\n\n \n\nI.-Que es imperativo asegurar\nel abastecimiento energético nacional, reduciendo la dependencia de la\nimportación de petróleo, diversificar las fuentes de energía y aumentar la\nproducción de fuentes renovables autóctonas, logrando la satisfacción de las\nnecesidades energéticas del país de forma sostenible desde el punto de vista\nambiental, social y económico.\n\nII.-Que es necesario integrar\nlos esfuerzos de los sectores energía y agropecuario, procurando disminuir la\ncontaminación ambiental, estimulando la reactivación económica, la generación\nde valor agregado, la incorporación de nuevas zonas productoras que contribuyan\nal desarrollo socioeconómico del país, aprovechando las capacidades y recursos nacionales.\n\nIII.-Que en el uso y\naprovechamiento racional de los recursos naturales y energéticos debe\ngarantizarse un balance entre el desarrollo socioeconómico y la protección del\nambiente.\n\nIV.-Que existe la posibilidad\nde sustituir parcialmente los combustibles fósiles por biocombustibles\nobtenidos a partir de materia prima de producción agrícola.\n\nV.-Que el país cuenta con\ncapacidad instalada, experiencia, áreas de cultivo sembradas, con potencial de\ncrecimiento para la producción de biocombustibles.\n\nVI.-Que las Comisiones\nNacionales de Etanol y Biodiesel creadas por el Poder Ejecutivo mediante los\nDecretos Ejecutivos Nos. DE.31.087 MAG-MINAE y DE 31.818-MAG-MINAE,\nrespectivamente rindieron informes de gran utilidad, sobre aspectos a\nconsiderar para la definición de una política energética que comprenda el uso\nde biocombustibles.\n\nVII.-Que se requiere un\ntratamiento integral en materia de biocombustibles y por ende reorientar, los\nesfuerzos anteriormente desarrollados individualmente por las comisiones en\netanol y biodiesel. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Derogar los\nDecretos Ejecutivos, DE.31.087 MAGMINAE publicado en el Alcance Nº 24 a La\nGaceta Nº 85 del 6 de mayo del 2003 y DE 31.818-MAG-MINAE publicado en La\nGaceta Nº 112 del 9 de junio del 2004.\n\nArtículo 2º-Crear la Comisión\nNacional de Biocombustibles, la cual estará integrada por:\n\n \n\n. Un representante del Ministerio\nde Ambiente y Energía designado por el Ministro del ramo.\n\n. Un representante del\nMinisterio de Agricultura y Ganadería designado por el Ministro del ramo.\n\n. Un representante de la\nOficina Costarricense de Implementación Conjunta.\n\n. Un representante de la\nRefinadora Costarricense de Petróleo S. A., designado por su presidente.\n\n. Un representante de la\nAutoridad Reguladora de los Servicios Públicos.\n\n \n\nCada una de las instituciones\nque participa tendrá un miembro propietario y uno suplente, tanto el\npropietario como el suplente será convocado a las sesiones de esta comisión y\npodrán asistir a las reuniones pero habrá un solo voto por institución.\n\nLos representantes deberán ser\nnombrados dentro de los ocho días hábiles posteriores de la entrada en vigencia\ndel presente Decreto, y su designación debe ser comunicada formalmente al\nDespacho del Ministro de Ambiente y Energía.\n\nArtículo 3º-El Coordinador de\nla Comisión Nacional de Biocombustibles, será designado por el Ministro de\nAmbiente y Energía y la misma contará con el apoyo logístico y técnico de la\nSecretaría de Planificación Sector Agropecuario y la Dirección Sectorial de\nEnergía, así como con el apoyo de RECOPE.\n\nArtículo 4º-La Comisión\nNacional de Biocombustibles, debe:\n\n \n\n. Creates the National Biofuels Committee.\n\nFull Text of record: C4407\nNo. 33357\n\n(This decree was repealed by Article 26 of the Biofuels Regulation, Executive Decree No. 35091 of January 9, 2009)\n\nNo. 33357\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF AGRICULTURE AND LIVESTOCK,\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn accordance with the powers granted to them by Articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, Articles 25, 27.1, 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law No. 7554 of November 13, 1995, Organic Law of the Environment, Law No. 7152, MINAE Conversion Law, and Law No. 7356 on the State Monopoly of Hydrocarbons.\n\nConsidering:\n\nI.-That it is imperative to ensure national energy supply, reducing dependence on petroleum imports, diversifying energy sources, and increasing the production of indigenous renewable sources, achieving the satisfaction of the country's energy needs in an environmentally, socially, and economically sustainable manner.\n\nII.-That it is necessary to integrate the efforts of the energy and agricultural sectors, seeking to reduce environmental pollution, stimulating economic reactivation, the generation of added value, and the incorporation of new producing areas that contribute to the country's socioeconomic development, taking advantage of national capacities and resources.\n\nIII.-That in the rational use and harnessing of natural and energy resources, a balance between socioeconomic development and environmental protection must be guaranteed.\n\nIV.-That there is the possibility of partially substituting fossil fuels with biofuels obtained from agricultural raw materials.\n\nV.-That the country has installed capacity, experience, planted crop areas, and growth potential for the production of biofuels.\n\nVI.-That the National Ethanol and Biodiesel Committees created by the Executive Branch through Executive Decrees Nos. DE.31.087 MAG-MINAE and DE 31.818-MAG-MINAE, respectively, produced highly useful reports on aspects to consider for defining an energy policy that includes the use of biofuels.\n\nVII.-That a comprehensive approach to biofuels is required and, therefore, the efforts previously developed individually by the ethanol and biodiesel committees must be redirected. Therefore,\n\nDECREE:\n\nArticle 1.-To repeal Executive Decrees DE.31.087 MAG-MINAE, published in Supplement No. 24 to La Gaceta No. 85 of May 6, 2003, and DE 31.818-MAG-MINAE, published in La Gaceta No. 112 of June 9, 2004.\n\nArticle 2.-To create the National Biofuels Committee, which shall be composed of:\n\n. A representative of the Ministry of Environment and Energy appointed by the Minister of that branch.\n\n. A representative of the Ministry of Agriculture and Livestock appointed by the Minister of that branch.\n\n. A representative of the Costa Rican Office for Joint Implementation (Oficina Costarricense de Implementación Conjunta).\n\n. A representative of the Costa Rican Petroleum Refinery, S. A. (Refinadora Costarricense de Petróleo S. A., RECOPE), appointed by its president.\n\n. A representative of the College of Chemical Engineers and Related Professionals.\n\n. A representative of the College of Chemists.\n\n. A representative of the National Chamber of Palm Growers (Cámara Nacional de Palmeros).\n\n. A representative of the National Chamber of Agriculture and Agroindustry (Cámara Nacional de Agricultura y Agroindustria), who shall be chosen by the Minister of Agriculture and Livestock from a shortlist of three candidates sent by the Chamber.\n\n. A representative of the Industrial Agricultural League of Sugarcane (Liga Agrícola Industrial de la Caña de Azúcar, LAICA).\n\n. A representative of the Costa Rican Electricity Institute (Instituto Costarricense de Electricidad, ICE).\n\n. A representative of the Regulatory Authority for Public Services (Autoridad Reguladora de los Servicios Públicos).\n\nEach participating institution shall have one full member and one alternate member; both the full member and the alternate member shall be summoned to the sessions of this committee and may attend the meetings, but there shall be only one vote per institution.\n\nThe representatives must be appointed within the eight working days following the entry into force of this Decree, and their appointment must be formally communicated to the Office of the Minister of Environment and Energy.\n\nArticle 3.-The Coordinator of the National Biofuels Committee shall be appointed by the Minister of Environment and Energy, and it shall have the logistical and technical support of the Agricultural Sector Planning Secretariat and the Energy Sector Directorate, as well as the support of RECOPE.\n\nArticle 4.-The National Biofuels Committee must:\n\n. Propose to the Ministers of Environment and Energy and of Agriculture and Livestock an action plan containing short-, medium-, and long-term strategies for the implementation of biofuel use in Costa Rica, as well as follow-up and control actions, responsible parties, and deadlines.\n\n. Identify and substantiate the legal reforms or legal instruments required to implement the production and use of biofuels.\n\n. Propose mechanisms for the valuation of products of plant or animal origin that can be used for the production of biofuels.\n\n.
