saneamiento ambiental en los términos del artículo 297 de la Ley\nGeneral de Salud, por lo que resulta imperativo que la Municipalidad coadyuve\nen especial en lo relativo a los reglamentos de zonificación, desarrollo\nurbanístico, con la organización administradora de los sistemas comunales, como\ninstrumento de desarrollo sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\n3º-Que\nde conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la\nLey Constitutiva del A y A, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La Gaceta Nº\n150 del 5 de agosto de 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nNacional, y se encuentra facultado en delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en las comunidades\nla administración de aquellos sistemas en las que las ventajas comparativas de\ninmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad Colonia San José de Puerto Viejo de Sarapiquí, con aporte de la\ncomunidad, de AyA y del Estado, se ha construido un sistema de acueductos\ncomunales, para el abastecimiento de una población de habitantes.\n\nIII.-Que\nen Asamblea general de vecinos celebrada, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\nIV.-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación\nAdministrativa del Acueducto y Alcantarillado Sanitario de Colonia San José,\ndistrito Puerto Viejo, cantón Sarapiquí, provincia Heredia, cédula jurídica\ntres- cero cero dos - trescientos cincuenta mil cuarenta y dos, que se\nencuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional bajo el expediente número quince mil cuatrocientos cincuenta.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nHuetar Norte mediante el memorando Nº RHN- 06-0221 del día 20 de junio de 2006,\nasí como la Dirección Jurídica en el memorando Nº DJ-2006-5730 del día 13 de\nnoviembre de 2006, recomiendan a la Subgerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0024-2006 del día13 del mes noviembre de\n2006, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió criterio,\nestableciendo que cumplidos los trámites técnicos, es jurídicamente procedente\ndelegar la administración de dicho sistema. Therefore, it is imperative that the Municipality\ncooperate, especially regarding zoning regulations and urban development, with\nthe administrative organization of the communal systems, as an instrument of\nsocial, economic, industrial, business, agrarian, tourist, and human settlement\nsustainable development provided by the aqueduct and sewerage systems.\n\n3º—That\nin accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the\nConstitutive Law of AyA, Article 264 of the General Public Health Law (Ley General de Salud Pública),\nArticles 17, 32, 33, 148 et seq. of the Water Law (Ley de Aguas) No. 276 of August\n24, 1942, the General Potable Water Law (Ley General de Agua Potable), and the Regulations for the Administrative Associations\nof Communal Aqueduct and Sewerage Systems (Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales) No.\n39529-S-MINAE, published in La Gaceta No.\n150 of August 5, 2005, it is established that AyA is the Governing Body in all\nmatters relating to Aqueduct and Sewerage Systems throughout the National\nterritory, and is empowered to delegate the administration of such systems to\norganizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.—That\nthe participation of the community or civil society constitutes one of the\neffective instruments for achieving sustainable development in Costa Rica.\nTherefore, since 1976, AyA has been delegating to communities the\nadministration of those systems where the comparative advantages of immediacy,\neffectiveness, and efficiency, and cost and benefit to the populations, make it\nmore appropriate to assign their administration to the communities.\n\nII.—That\nthe community of Colonia San José in Puerto Viejo de Sarapiquí, with\ncontributions from the community, AyA, and the State, has built a communal\naqueduct system to supply a population of inhabitants.\n\nIII.—That\nin a general Assembly of neighbors held, they resolved to constitute the\norganization and request that AyA delegate the administration of the systems to\nsaid organization.\n\nIV.—That\ndue to the characteristics of the system, it is appropriate to delegate the\nadministration to the communal organization constituted for that purpose,\nnamed the Administrative Association of the Aqueduct and Sanitary Sewerage\nof Colonia San José (Asociación\nAdministrativa del Acueducto y Alcantarillado Sanitario de Colonia San José),\nPuerto Viejo district, Sarapiquí canton, Heredia province, legal identification\nnumber three- zero zero two - three hundred fifty thousand forty-two, which is\nduly registered in the Association Registry of the National Registry under file\nnumber fifteen thousand four hundred fifty.\n\nV.—That\nfor the purposes of the provisions of the Regulations, the Directorate of the\nHuetar Norte Region, via memorandum No. RHN- 06-0221 of June 20, 2006, as\nwell as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13,\n2006, recommend that the Sub-Management proceed with the Delegation of the\nAdministration of the system to the respective organization.\n\nVI.—That\nthrough legal opinion No. DJ-SC-0024-2006 of November 13, 2006, the Legal\nAdvisory Office for Communal Systems of the Legal Directorate issued its\ncriterion, establishing that, the technical procedures having been completed,\nit is legally appropriate to delegate the administration of said system.
