sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\n3º-Que de\nconformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley\nConstitutiva del A y A, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La\nGaceta Nº 150 del 5 de agosto de 2005, se\nestablece que A y A es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio Nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la\nparticipación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que A y A, desde 1976 ha venido delegando en las comunidades\nla administración de aquellos sistemas en las que las ventajas comparativas de\ninmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que la\ncomunidad San Martín de Pejibaye de Pérez Zeledón, con aporte de la comunidad,\nde A y A y del Estado, se ha construido un sistema de acueductos comunales,\npara el abastecimiento de una población de habitantes.\n\nIII.-Que en\nasamblea general de vecinos celebrada, dispusieron constituir la organización y\nsolicitar al A y A, que delegue la administración de los sistemas en dicha\norganización.\n\nIV.-Que por las\ncaracterísticas del sistema, es procedente delegar la administración en la\norganización comunal constituida al efecto, denominada Asociación\nAdministradora del Acueducto de San Martín de Pejibaye de Pérez Zeledón, cédula\njurídica tres-cero cero dos-trescientos sesenta y ocho mil doscientos cuarenta\ny ocho, que se encuentra debidamente inscrita en el Registro de Asociaciones\ndel Registro Nacional bajo el tomo número quinientos veintiocho Asiento número\ndiez mil doscientos quince.\n\nV.-Que para los\nefectos de lo dispuesto en el Reglamento, la Dirección de la Región Brunca\nmediante el memorando Nº DIRB-2006- 0746 del día 13 de setiembre de 2006, así\ncomo la Dirección Jurídica en el memorando Nº DJ- 2006-5730 del día 13 de\nnoviembre de 2006, recomiendan a la Subgerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0030-2006 del día 13 del mes noviembre de\n2006, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió\ncriterio, estableciendo que cumplidos los trámites técnicos, es jurídicamente\nprocedente delegar la administración de dicho sistema. Therefore, it is imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of communal systems, as an instrument of social, economic, industrial, business, agricultural, tourist, and human settlement sustainable development provided by aqueduct and sewerage systems.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation of Administrative Associations of Communal Aqueduct and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, and for this reason, since 1976, AyA has been delegating to the communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of San Martín de Pejibaye de Pérez Zeledón, with contributions from the community, from AyA, and from the State, has built a communal aqueduct system, for the supply of a population of inhabitants.\n\nIII.-That in a general assembly of residents held, they decided to constitute the organization and request that AyA delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto de San Martín de Pejibaye de Pérez Zeledón, legal identification number three-zero zero two-three hundred sixty-eight thousand two hundred forty-eight, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred twenty-eight, Entry number ten thousand two hundred fifteen.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Brunca Region, through memorandum No. DIRB-2006-0746 of September 13, 2006, as well as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13, 2006, recommend that the Deputy Management proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0030-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate issued a criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
