de la Administración del Sistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con los artículos 50, 129\nde la Constitución Política, el Estado debe procurar el mayor bienestar a los\nciudadanos, planificando la producción hacia un ambiente sano ecológicamente equilibrado.\n\n2º-Que de conformidad con los artículos 11, 21,\n129 y 169 de la Constitución inviolabilidad de la\nvida cuando se suministra agua potable y saneamiento ambiental en los términos\ndel artículo 297 de la Ley General de Salud, por lo que resulta imperativo que\nla Municipalidad coadyuve en especial en lo relativo a los reglamentos de\nzonificación, desarrollo urbanístico, con la organización administradora de los\nsistemas comunales, como instrumento de desarrollo sostenible social,\neconómico, industrial, empresariales, agrario, turístico y de asentamientos\nhumanos que proporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los artículos 1, 2,\n3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva del A y A, artículo 264\nde la Ley General de Salud Pública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas N° 276 del 24 de agosto de 1942, Ley General de Agua Potable y\nReglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados\nComunales N° 39529-S-MINAE, publicado en La Gaceta N° 150 del 5 de\nagosto de 2005, se establece que A y A es el ente Rector en todo lo relativo a\nlos Sistemas de Acueductos y Alcantarillados en todo el territorio Nacional, y\nse encuentra facultado en delegar la administración de tales sistemas en\norganizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la participación de la comunidad o\nsociedad civil, constituye uno de los instrumentos eficaces para lograr la\nconsecución del desarrollo sostenible en Costa Rica, por lo que A y A, desde\n1976 ha venido delegando en las comunidades la administración de aquellos\nsistemas en las que las ventajas comparativas de inmediatez, eficacia y\neficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar\nen las comunidades su administración.\n\nII.-Que la comunidad Falconia de Bagaces, con\naporte de la comunidad, de A y A y del Estado, se ha construido un sistema de\nacueductos comunales, para el abastecimiento de una población de habitantes. \n\nIII.-Que en asamblea general de vecinos\ncelebrada, dispusieron constituir la organización y solicitar al A y A, que\ndelegue la administración de los sistemas en dicha organización.\n\nIV.-Que por las características del sistema, es\nprocedente delegar la administración en la organización comunal constituida al\nefecto, denominada Asociación Administradora del Acueducto y Alcantarillado del\nAsentamiento Falconia, Bagaces, Guanacaste, cédula jurídica tres- cero cero dos\n- trescientos setenta y siete mil quinientos cinco, que se encuentra debidamente\ninscrita en el Registro de Asociaciones del Registro Nacional bajo el tomo\nnúmero quinientos treinta y cinco asiento número cuatro mil doscientos\ncincuenta y siete.\n\nV.-Que para los efectos de lo dispuesto en el\nReglamento, la Dirección de la Región Chorotega mediante el memorando N°\nRCH-513-2006 del día 3 de octubre de 2006, así como la Dirección Jurídica en el\nmemorando N° DJ-2006-5730 del día 13 de noviembre de 2006, recomiendan a la\nSubgerencia proceder a la Delegación de la Administración del sistema en la\nrespectiva organización.\n\nVI.-Que mediante el dictamen legal N°\nDJ-SC-0033-2006 del día 13 del mes noviembre de 2006, la Asesoría Legal de\nSistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo que\ncumplidos los trámites técnicos, es jurídicamente procedente delegar la\nadministración de dicho sistema. cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the Falconia community of Bagaces, with contributions from the community, A y A, and the State, has built a community aqueduct system to supply a population of inhabitants. \n\nIII.-That in a general assembly of neighbors held, they resolved to constitute the organization and request A y A to delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the community organization constituted for this purpose, named Administrative Association of the Aqueduct and Sewer System of the Falconia Settlement, Bagaces, Guanacaste, legal ID number three-zero zero two - three hundred seventy-seven thousand five hundred five, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred thirty-five, entry number four thousand two hundred fifty-seven.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Chorotega Region, by memorandum No. RCH-513-2006 of October 3, 2006, as well as the Legal Directorate, in memorandum No. DJ-2006-5730 of November 13, 2006, recommend to the Deputy Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That by legal opinion No. DJ-SC-0033-2006 of November 13, 2006, the Legal Advisory Office for Community Systems of the Legal Directorate issued its criterion, establishing that, having completed the technical procedures, it is legally appropriate to delegate the administration of said system.
