  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 686\n\n                        Convenio de Delegación de la Asociación Administradora del Acueducto y\nAlcantarillado Rural de Salitral, Bagaces, Guanacaste\n\nTexto Completo acta: A408E\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO\nCOSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNº 2006-686\n\n \n\nASUNTO: Convenio de Delegación de la Asociación\nAdministradora del Acueducto y Alcantarillado Rural de Salitral, Bagaces, Guanacaste.\n\n           \n\nConoce esta Junta Directiva de la Solicitud de\nDelegación de la Administración del Sistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con los artículos 50, 129\nde la Constitución Política, el Estado debe procurar el mayor bienestar a los\nciudadanos, planificando la producción hacia un ambiente sano ecológicamente equilibrado.\n\n2º-Que de conformidad con los artículos 11, 21,\n129 y 169 de la Constitución Política, corresponde a las Municipalidades velar\npor los intereses locales, y la Sala Constitucional en reiterados\npronunciamientos se ha manifestado en el sentido de que se garantiza la\ninviolabilidad de la vida cuando se suministra agua potable y saneamiento\nambiental en los términos del artículo 297 de la Ley General de Salud, por lo\nque resulta imperativo que la Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización administradora\nde los sistemas comunales, como instrumento de desarrollo sostenible social,\neconómico, industrial, empresariales, agrario, turístico y de asentamientos\nhumanos que proporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los artículos 1, 2,\n3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva del A y A, artículo 264\nde la Ley General de Salud Pública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas N° 276 del 24 de agosto de 1942, Ley General de Agua Potable y\nReglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados\nComunales N° 39529-S-MINAE, publicado en La Gaceta N° 150 del 5 de\nagosto de 2005, se establece que A y A es el ente Rector en todo lo relativo a\nlos Sistemas de Acueductos y Alcantarillados en todo el territorio Nacional, y\nse encuentra facultado en delegar la administración de tales sistemas en\norganizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la participación de la comunidad o\nsociedad civil, constituye uno de los instrumentos eficaces para lograr la\nconsecución del desarrollo sostenible en Costa Rica, por lo que A y A, desde\n1976 ha venido delegando en las comunidades la administración de aquellos\nsistemas en las que las ventajas comparativas de inmediatez, eficacia y\neficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar\nen las comunidades su administración.\n\nII.-Que la comunidad Salitral de Bagaces, con\naporte de la comunidad, de A y A y del Estado, se ha construido un sistema de\nacueductos comunales, para el abastecimiento de una población de habitantes. \n\nIII.-Que en asamblea general de vecinos celebrada,\ndispusieron constituir la organización y solicitar al A y A, que delegue la\nadministración de los sistemas en dicha organización.\n\nIV.-Que por las características del sistema, es procedente delegar la administración en la\norganización comunal constituida al efecto, denominada Asociación Administradora de Acueducto y\nAlcantarillado Rural de Salitral de Bagaces, cédula jurídica tres-cero cero dos- cuatrocientos seis\nmil ciento veintiséis, que se encuentra debidamente inscrita en el Registro de Asociaciones del\nRegistro Nacional bajo el tomo número quinientos cuarenta y cuatro asiento dieciséis mil ciento\ncuarenta y cinco.  V.-Que para los efectos de lo dispuesto en el Reglamento, la Dirección de la\nRegión Chorotega mediante el memorando N° RGH-485-2006 del día 13 de setiembre de 2006, así como la\nDirección Jurídica en el memorando N° DJ-2006-5730 del día 13 de noviembre de 2006, recomiendan a la\nSubgerencia proceder a la Delegación de la Administración del sistema en la respectiva organización.\n\nVI.-Que mediante el dictamen legal N°\nDJ-SC-0035-2006 del día 13 del mes noviembre de 2006, la Asesoría Legal de\nSistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo que\ncumplidos los trámites técnicos, es jurídicamente procedente delegar la\nadministración de dicho sistema. Por tanto:\n\n \n\nCon fundamento en lo dispuesto en los artículos 11, 21, 18, 50, 129, 169 y 188 de la Constitución\nPolítica; artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva de A y A, artículo\n264 de la Ley General de Salud Pública N° 5395 de 30 de octubre de 1973, artículo 17, 32, 33, 148 y\nsiguientes de la Ley de Aguas N° 276 del 27 de agosto de 1942, Ley General de Agua Potable N° 1634\ndel 18 de setiembre de 1953, artículos 1, 4, 11, 16, 113.12, ,114 de la Ley General de la\nAdministración Pública, Ley del Ambiente N° 7554 del 4 de octubre de 1995, artículo 4 y 33 de la Ley\nForestal N° 7575 del 13 de febrero de 1996 y sus reformas, Ley de Conservación de Vida Silvestre N°\n7317 de 30 de octubre de 1992, artículo 7 de la Ley de Caminos Públicos N° 5060 del 22 de agosto de\n1972, Reglamento del Laboratorio Nacional de Aguas de A y A Decreto N° 26066-S, publicado en La\nGaceta N° 109 del 9 de junio de 1997; Reglamento para la Calidad de Agua Decreto Ejecutivo N° 32327\ndel 10 de febrero de 2005; Reglamento de Uso y Vertido del la Aguas Residuales Decreto Ejecutivo N°\n26042-S-MINAE del 19 de junio de 1997, Reglamento de Aprobación y Operación de Sistemas de\nTratamiento de Aguas Residuales Decreto Ejecutivo N° 31545 del 9 de octubre de 2003 y Reglamento de\nLodos de Tanques Sépticos Decreto Ejecutivo N° 21279-S del 15 de mayo de 1992.  Reglamento Sectorial\npara la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario N° 30413-MP-MINAE-S-MEIC\ndel 25 de marzo de 2002.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norma 686\n\n                        Delegation Agreement of the Administrative Association of the Rural Aqueduct and Sewer System of Salitral, Bagaces, Guanacaste\n\nComplete Text of act: A408E\nCOSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS\n\nINSTITUTO\nCOSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNo. 2006-686\n\n \n\nSUBJECT: Delegation Agreement of the Administrative Association of the Rural Aqueduct and Sewer System of Salitral, Bagaces, Guanacaste.\n\n            \n\nThis Board of Directors has received the Request for Delegation of the Administration of the Aqueduct and Sewer Systems.\n\n \n\nWhereas:\n\n \n\n1.-That in accordance with articles 50, 129 of the Political Constitution, the State must procure the greatest well-being for its citizens, planning production towards an ecologically balanced healthy environment.\n\n2.-That in accordance with articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to ensure local interests, and the Constitutional Chamber in reiterated pronouncements has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied in the terms of article 297 of the General Health Law, for which reason it is imperative that the Municipality cooperate, especially in matters related to zoning regulations, urban development, with the administrative organization of the communal systems, as an instrument of social, economic, industrial, business, agricultural, tourism, and human settlement sustainable development provided by the aqueduct and sewer systems.\n\n3.-That in accordance with articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of A y A, article 264 of the General Public Health Law, articles 17, 32, 33, 148 et seq. of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation of the Administrative Associations of the Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that A y A is the Governing Body in all matters relating to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments to achieve the attainment of sustainable development in Costa Rica, for which reason A y A, since 1976, has been delegating to the communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, makes it more appropriate to assign their administration to the communities.\n\nII.-That the Salitral de Bagaces community, with contribution from the community, from A y A, and from the State, has built a communal aqueduct system, for the supply of a population of inhabitants. \n\nIII.-That in a general assembly of residents held, they decided to constitute the organization and request that A y A delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, called Asociación Administradora de Acueducto y Alcantarillado Rural de Salitral de Bagaces, legal ID number three-zero zero two-four hundred six thousand one hundred twenty-six, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred forty-four, entry sixteen thousand one hundred forty-five. V.-That for the purposes of the provisions of the Regulation, the Directorate of the Chorotega Region via memorandum No. RGH-485-2006 of September 13, 2006, as well as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13, 2006, recommend to the Sub-management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0035-2006 of November 13, 2006, the Legal Advisory for Communal Systems of the Legal Directorate, issued an opinion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system. Therefore:\n\n \n\nBased on the provisions of articles 11, 21, 18, 50, 129, 169, and 188 of the Political Constitution; articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of A y A, article 264 of the General Public Health Law No. 5395 of October 30, 1973, article 17, 32, 33, 148 et seq. of the Water Law No. 276 of August 27, 1942, General Potable Water Law No. 1634 of September 18, 1953, articles 1, 4, 11, 16, 113.12, 114 of the General Law of Public Administration, Environmental Law No. 7554 of October 4, 1995, article 4 and 33 of the Forestry Law No. 7575 of February 13, 1996, and its amendments, Wildlife Conservation Law No. 7317 of October 30, 1992, article 7 of the Public Roads Law No. 5060 of August 22, 1972, Regulation of the National Water Laboratory of A y A Decree No. 26066-S, published in La Gaceta No. 109 of June 9, 1997; Regulation for Water Quality Executive Decree No. 32327 of February 10, 2005; Regulation for the Use and Discharge of Wastewater Executive Decree No. 26042-S-MINAE of June 19, 1997, Regulation for the Approval and Operation of Wastewater Treatment Systems Executive Decree No. 31545 of October 9, 2003, and Regulation of Septic Tank Sludge Executive Decree No. 21279-S of May 15, 1992.
