sostenible social, económico, industrial, empresariales,\nagrario, turístico y de asentamientos humanos que proporcionan los sistemas de\nacueductos y alcantarillados.\n\n3º-Que de\nconformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley\nConstitutiva del A y A, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas N° 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales N°\n39529-S-MINAE, publicado en La\nGaceta N° 150 del 5 de agosto de 2005, se\nestablece que A y A es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio Nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la\nparticipación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que A y A, desde 1976 ha venido delegando en las comunidades\nla administración de aquellos sistemas en las que las ventajas comparativas de\ninmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que la\ncomunidad Buenos Aires de Juan Viñas, con aporte de la comunidad, de A y A y\ndel Estado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes.\n\nIII.-Que en\nasamblea general de vecinos celebrada, dispusieron constituir la organización y\nsolicitar al A y A, que delegue la administración de los sistemas en dicha\norganización.\n\nIV.-Que por las\ncaracterísticas del sistema, es procedente delegarla administración en la organización\ncomunal constituida al efecto, denominada Asociación Administradora Acueducto\nBuenos Aires de Juan Viñas, Jiménez, cédula jurídica tres-cero cero\ndos-doscientos veintiocho mil dieciocho, que se encuentra debidamente inscrita\nen el Registro de Asociaciones del Registro Nacional bajo el tomo número\ncuatrocientos cincuenta, asiento número ocho mil ciento cincuenta y cinco.\n\nV.-Que para los\nefectos de lo dispuesto en el Reglamento, la Dirección de la Región Central\nEste mediante el memorando N° ORC-124-06 del día 12 de setiembre de 2006, así\ncomo la Dirección Jurídica en el memorando N° DJ-2006-5730 del día 13 de\nnoviembre de 2006, recomiendan a la Subgerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal N° DJ-SC-0042-2006 del día 13 del mes noviembre de\n2006, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió\ncriterio, estableciendo que cumplidos los trámites técnicos, es jurídicamente\nprocedente delegar la administración de dicho sistema. therefore, it is imperative that the Municipality collaborates, especially regarding zoning regulations and urban development, with the administrating organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development provided by the aqueduct and sewerage systems.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of A y A, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation for Administrating Associations of Communal Aqueduct and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that A y A is the Governing Body in all matters relating to Aqueduct and Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, which is why A y A, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; and cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the Buenos Aires de Juan Viñas community, with contributions from the community, from A y A, and from the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general assembly of residents held, they decided to constitute the organization and request that A y A delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for that purpose, called Asociación Administradora Acueducto Buenos Aires de Juan Viñas, Jiménez, legal identification number three-zero zero two-two hundred twenty-eight thousand eighteen, which is duly registered in the Associations Registry of the National Registry under volume number four hundred fifty, entry number eight thousand one hundred fifty-five.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Central East Region, through memorandum No. ORC-124-06 of September 12, 2006, as well as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13, 2006, recommend that the Sub-Management proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0042-2006 of November 13, 2006, the Communal Systems Legal Advisory Office of the Legal Directorate issued a criterion, establishing that the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
