Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos\ny Alcantarillados Comunales N° 32529-S-MINAE, publicado en La Gaceta 150 del 5 de agosto de 2005 y\nReglamento de Prestación de Servicios a los Clientes, publicado en el Diario Oficial La Gaceta N°\n159 del 20 de agosto de 1997.\n\n \n\nACUERDA:\n\n \n\n1º-Acordar la\ndelegación de la administración de los sistemas de acueducto y alcantarillado\nsanitario de la comunidad, en la Asociación Administradora Acueducto Buenos\nAires de Juan Viñas, Jiménez.   "body_en_text": "of the entire text\n\n                    -\n\n                        Full Text of Norm 694\n\n                        Delegation Agreement for the Aqueduct and Sewer System of the Asociación\nAdministradora del Acueducto Rural Coopevega, Cutris, San Carlos, Alajuela\n\nFull Text of record: A409B\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNo. 2006-694\n\n \n\nSUBJECT: Delegation Agreement for the Aqueduct and Sewer System of the Asociación Administradora del Acueducto Rural Coopevega,\nCutris, San Carlos, Alajuela.\n\n \n\nThis Board of Directors hears the Request for Delegation of the Administration of the Aqueduct and Sewer Systems.\n\n \n\nResultando:\n\n \n\n1º-That in accordance with Articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being for its citizens, planning production toward a healthy, ecologically balanced environment.\n\n2º-That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber (Sala Constitucional) in reiterated pronouncements has stated that the inviolability of life is guaranteed when drinking water and environmental sanitation are supplied under the terms of Article 297 of the General Health Law (Ley General de Salud); therefore, it is imperative that the Municipality cooperate, especially regarding zoning regulations and urban development, with the administrative organization of the communal systems, as an instrument for the sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development provided by aqueduct and sewer systems.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and subsequent of the Water Law (Ley de Aguas) No. 276 of August 24, 1942, the General Drinking Water Law, and the Regulation for the Administrative Associations of Communal Aqueduct and Sewer Systems (Reglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales) No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Entity for everything related to Aqueduct and Sewer Systems throughout the national territory and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica; therefore, AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, makes it more suitable to assign their administration to the communities.\n\n2º-That the community of Coopevega, with contributions from the community, AyA, and the State, has built a communal aqueduct system for the supply of a population of inhabitants.\n\n3º-That in a general assembly of residents held, they decided to constitute the organization and request that AyA delegate the administration of the systems to said organization.\n\n4º-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora de Acueducto Rural Coopevega, legal ID three-zero zero two-two hundred seventy-three thousand two hundred ninety-two, which is duly registered in the Associations Registry of the National Registry under volume number four hundred seventy-three, entry number nine thousand seven hundred nine.\n\n5º-That for the purposes of the provisions in the Regulation, the Directorate of the Huetar Norte Region, via memorandum No. RHN-06-0363 of October 3, 2006, as well as the Legal Directorate in memorandum No. DJ- 2006-5730 of November 13, 2006, recommend that the Deputy Management proceed with the Delegation of the System Administration to the respective organization.\n\n6º-That through legal opinion No. DJ-SC-0043-2006 of November 13, 2006, the Legal Advisory for Communal Systems of the Legal Directorate issued a criterion, establishing that the technical procedures having been completed, it is legally appropriate to delegate the administration of said system. Legal ID three-zero zero two-two hundred seventy-three thousand two hundred ninety-two; register it in our internal records.\n\n2º-To authorize the Administration to sign the Delegation Agreement with the legal representative of the Association, in which, in addition to compliance with current legislation, specific obligations and reciprocal considerations assumed by the parties will be specified and which will repeal previously signed agreements.\n\n3º-To provide that the Directorate of Communal Systems and the Regional Directorate corresponding to the geographic location of the systems carry out all advisory, control, and training activities—technical, environmental, financial, legal, organizational, and communal—as established by the laws and Regulations.\n\n4º-Once the Delegation Agreement is signed, submit it for the approval of the Comptroller General of the Republic.\n\n5º-Once the Agreement is approved, Notify all users of the system and residents of the respective community by means of publication in the official newspaper La Gaceta, so that they may exercise all their rights, duties, and obligations regarding the system in accordance with the laws and Regulations.\n\n \n\nCommunicate and publish.\n\n \n\nFinal Agreement.\n\n \n\nSan José, November 28, 2006"
