Reglamento a la Ley de\nConservación de la Vida Silvestre, Decreto Ejecutivo Nº 32633-MINAE, publicado\nen La Gaceta N° 180 del 20 de setiembre del 2005, y\n\n \n\nConsiderando:\n\n \n\nI.-Que es interés del Estado fortalecer las\nestructuras administrativas en el campo de los recursos naturales, con la\nfinalidad de contar con políticas definidas que garanticen el uso racional de\ndichos recursos existentes, así como la adopción de las medidas necesarias para\nla conservación y el desarrollo sostenible de los recursos naturales. \n\nII.-Que la sociedad Empresa Diecisiete Setenta\ny Seis Sociedad Anónima, inscrita ante el Registro Público, al tomo:\nochocientos treinta y dos, folio: doscientos ochenta y ocho, asiento: trescientos\nochenta y cuatro, cédula de persona jurídica Nº 3-101-155762, representada por\nla señora Marynell Baker Benson,\nmayor de edad, divorciada, abogada, vecina de San Ramón de Tres Ríos, y cédula\nde identidad número ocho-cero treinta y cinco-ciento setenta y dos, tiene\ndentro de su objeto social, la conservación ambiental y desarrollo sostenible\nde los recursos naturales. \n\nIII.-Que con el fin de coadyuvar con los\nesfuerzos públicos y privados de conservación ambiental que se suscitan en el\npaís, la sociedad Empresa Diecisiete Setenta y Seis S. A., ha manifestado su\ndeseo de someter voluntariamente tres fincas de su propiedad al régimen de\nprotección de Refugio Nacional de Vida Silvestre en la categoría de\nPrivado. \n\nIV.-Que la Ley de Conservación de Vida\nSilvestre N° 7317 y la Ley Orgánica del Ambiente N° 7554, facultan al Poder\nEjecutivo para crear Áreas Silvestres Protegidas en aquellas áreas que\npresenten características ecológicas importantes o especiales para su\nprotección y conservación. \n\nV.-Que los artículos 82 y 87 de la Ley de\nConservación de la Vida Silvestre, Nº 7317, establecen como refugios nacionales\nde vida silvestre los que el Poder Ejecutivo declare como tales, con el fin de\nllevar a cabo la protección e investigación de la flora y la fauna\nsilvestre. \n\nVI.-Que las fincas propiedad de Empresa\nDiecisiete Setenta y Seis S. A., a someter al régimen de protección de Refugio\nde Vida Silvestre Categoría Privada, ubicadas en Bahía Junquillal,\ndistrito La Cruz, cantón La Cruz, provincia de Guanacaste, son las siguientes:\nMatrícula Nº 5-088755-000, plano catastrado Nº G-0218641-1994; matrícula Nº\n5-097940-000, plano catastrado Nº G-0342724-1996, y matrícula Nº 5-109535-000,\nplano catastrado Nº G-0411759-1997.\n\nVII.-Que las fincas descritas presentan una\ncobertura de bosque en diferentes etapas de madurez, dos pequeños humedales con\nvegetación de manglar, una gran diversidad de especies del bosque seco y\nrecursos marinos y costeros que constituyen el hábitat de una gran variedad de\nfauna silvestre.\n\nVIII.-Que las zonas costeras de la provincia de\nGuanacaste presentan importantes ecosistemas de bosque seco, cuya riqueza\nbiológica se ha visto amenazada ante un acelerado desarrollo urbano y\nturístico, razón por la cual se hace necesario la conservación y protección\nambiental de dichas zonas.\n\nIX.-Que las fincas propiedad de la sociedad\nEmpresa Diecisiete Setenta y Seis S. A., colindan con el Refugio de Vida\nSilvestre Bahía Junquillal, lo cual hace que se esté\nconformando un corredor biológico costero de gran belleza escénica y valor\nambiental. \n\nX.-Que la constitución de este Refugio Privado fortalecerá el área de amortiguamiento del Refugio de\nVida Silvestre de Bahía Junquillal y la Zona Marítimo Terrestre de la Región Norte del país,\npermitiendo de esa manera la consolidación del Corredor Biológico Marino-Costero Bahía Junquillal.\n\nXI.-Que estudios efectuados en las mencionadas\npropiedades han recomendado la creación de un área silvestre protegida privada,\nque sirva para la protección de la biodiversidad y para brindar oportunidades\nde educación ambiental, reforestación, investigación y divulgación en la zona. Por\ntanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Declárase como \"Refugio de Vida\nSilvestre Chenailles Categoría de Privado\", los\ninmuebles inscritos ante el Registro Nacional, que se describen a continuación:\nMatrícula Nº 5-088755-000, ubicado en el distrito La Cruz, cantón La Cruz, de\nla provincia de Guanacaste, que mide: setecientos treinta y nueve mil\nquinientos noventa y nueve metros con ochenta y cinco decímetros cuadrados, y\ncon plano catastrado Nº G-0218641-1994; matrícula Nº 5-097940-000, ubicado en\nel distrito La Cruz, cantón La Cruz, de la provincia de Guanacaste, que mide:\ntrescientos noventa y dos mil doscientos noventa y ocho metros con noventa y\ncuatro decímetros cuadrados, y con plano catastrado Nº G-0342724-1996, y\nmatrícula Nº 5-109535-000, ubicado en el distrito La Cruz, cantón La Cruz, de\nla provincia de Guanacaste, que mide: tres millones trescientos cincuenta y dos\nmil cuatrocientos nueve metros con cincuenta y seis decímetros cuadrados, y con\nplano catastrado Nº G-0411759-1997, pertenecientes a Empresa Diecisiete Setenta\ny Seis S. A., cédula de persona jurídica Nº 3-101-155762, las que se ubican en\nlas Hojas Cartográficas Murciélago Nº 3048 I y Bahía Salinas Nº 3049 II, escala\n1:50,000 del Instituto Geográfico Nacional.\n\nLas siguientes coordenadas geográficas en Lambert Norte son los puntos de referencia de los vértices\ndel Refugio Chenailles: partiendo del lindero más al sureste del Refugio Chenailles: 329581 N y\n352079 E frente al camino que conduce de la comunidad de Soley al Refugio de Vida Silvestre\nJunquillal, 329165 N y 351837 E frente a una quebrada sin nombre que drena al Estero Quebrada Verde\ndel Refugio de Vida Silvestre Junquillal, 329097 N y 351653 E que colinda con la propiedad de Fulvio\nPaniagua, 330332 N y 349503 E en el sector oeste en el acantilado contiguo a Playa Mostrencal,\n332084 N y 350212 E en el sector al norte en la margen izquierda de una quebrada sin nombre pero\nllamada Buenaventura, 331361 N y 351804 E en el sector noreste frente al camino que conduce a la\ncomunidad de Soley y en la margen derecha de la Quebrada Saltomojosa.\n\nArtículo 2º-La administración y manejo del\nRefugio Privado de Vida Silvestre Chenailles será responsabilidad de la Empresa\nDiecisiete Setenta y Seis S. A., to be submitted to the protection regime of a Private Category Wildlife Refuge, located in Bahía Junquillal, La Cruz district, La Cruz canton, Guanacaste province, are the following: Registration No. 5-088755-000, cadastral plan No. G-0218641-1994; Registration No. 5-097940-000, cadastral plan No. G-0342724-1996; and Registration No. 5-109535-000, cadastral plan No. G-0411759-1997.\n\nVII.-That the described properties present forest cover (cobertura boscosa) in different stages of maturity, two small wetlands with mangrove vegetation, a great diversity of dry forest species, and marine and coastal resources that constitute the habitat of a great variety of wildlife.\n\nVIII.-That the coastal zones of Guanacaste province present important dry forest ecosystems, whose biological richness has been threatened by accelerated urban and tourism development, which is why the conservation and environmental protection of said zones is necessary.\n\nIX.-That the properties owned by the corporation Empresa Diecisiete Setenta y Seis S. A., border the Bahía Junquillal Wildlife Refuge, which means a coastal biological corridor of great scenic beauty and environmental value is being formed.\n\nX.-That the establishment of this Private Refuge will strengthen the buffer zone (área de amortiguamiento) of the Bahía Junquillal Wildlife Refuge and the Maritime Terrestrial Zone (Zona Marítimo Terrestre) of the Northern Region of the country, thereby allowing the consolidation of the Bahía Junquillal Marine-Coastal Biological Corridor.\n\nXI.-That studies carried out on the mentioned properties have recommended the creation of a private protected wild area, which would serve for the protection of biodiversity and to provide opportunities for environmental education, reforestation, research, and outreach in the zone. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1.-The real estate inscribed before the National Registry, described below, is hereby declared as \"Chenailles Wildlife Refuge Private Category\" (Refugio de Vida Silvestre Chenailles Categoría de Privado): Registration No. 5-088755-000, located in La Cruz district, La Cruz canton, Guanacaste province, measuring: seven hundred thirty-nine thousand five hundred ninety-nine square meters and eighty-five square decimeters, with cadastral plan No. G-0218641-1994; Registration No. 5-097940-000, located in La Cruz district, La Cruz canton, Guanacaste province, measuring: three hundred ninety-two thousand two hundred ninety-eight square meters and ninety-four square decimeters, with cadastral plan No. G-0342724-1996; and Registration No. 5-109535-000, located in La Cruz district, La Cruz canton, Guanacaste province, measuring: three million three hundred fifty-two thousand four hundred nine square meters and fifty-six square decimeters, with cadastral plan No. G-0411759-1997, belonging to Empresa Diecisiete Setenta y Seis S. A., legal identification number No. 3-101-155762, which are located on the Cartographic Sheets Murciélago No. 3048 I and Bahía Salinas No. 3049 II, scale 1:50,000 of the Instituto Geográfico Nacional.\n\nThe following geographic coordinates in Lambert North are the reference points for the vertices of the Chenailles Refuge: starting from the southeasternmost boundary marker of the Chenailles Refuge: 329581 N and 352079 E in front of the road leading from the community of Soley to the Junquillal Wildlife Refuge, 329165 N and 351837 E in front of an unnamed stream (quebrada) that drains into the Estero Quebrada Verde of the Junquillal Wildlife Refuge, 329097 N and 351653 E which borders the property of Fulvio Paniagua, 330332 N and 349503 E in the western sector on the cliff adjacent to Playa Mostrencal, 332084 N and 350212 E in the northern sector on the left bank of an unnamed stream but called Buenaventura, 331361 N and 351804 E in the northeastern sector in front of the road leading to the community of Soley and on the right bank of the Quebrada Saltomojosa.\n\nArticle 2.-The administration and management of the Chenailles Private Wildlife Refuge will be the responsibility of Empresa Diecisiete Setenta y Seis S. A., strictly following the Management Plan (Plan de Manejo) approved by the Área de Conservación Guanacaste (ACG), for which said area will supervise the execution thereof and may request progress reports or issue technical and scientific standards that the owning corporation must follow.\n\nArticle 3.-The owning corporation of the real estate mentioned in article 1 of this Executive Decree undertakes not to develop any activity that endangers the existence of the flora and fauna existing in the zone, to provide the necessary collaboration to researchers and officials of MINAE who visit the area in the performance of their official duties, and to comply with the provisions that the Wildlife Conservation Law, No. 7317, and the Forestry Law (Ley Forestal) and its amendments, No. 7575, their respective regulations, the Management Plan approved for the Refuge, and other provisions in force regarding environmental legal regulations, may specify to that effect.\n\nArticle 4.-The administration of wildlife and the recommendation of measures that ensure the conservation of species will be the function of the Área de Conservación Guanacaste (ACG).\n\nArticle 5.-The real estate referred to in article 1 of this Decree will be subject to the Private Wildlife Refuge Regime for a period of ten years, extendable for equal periods, for which the owning corporation must request the extension from the Área de Conservación Guanacaste (ACG) at least 6 months prior to the end of said period, otherwise it must express its desire to release the properties from the regime by means of a written submission presented before the aforementioned area, 6 months prior to the expiration of the period.\n\nArticle 6.-It shall enter into force upon its publication.\n\n \n\nGiven at the Presidency of the Republic.-San José, on the ninth day of November, two thousand six." }
