Posteriormente mediante el artículo 16 del Reglamento para el\nestablecimiento de los costos de inscripción y evaluación en el marco del sistema de reconocimientos\nambientales, aprobado mediante decreto ejecutivo N° 37707 del 19 de abril del 2013 se\nderoga nuevamente la presente norma)\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n\n \n\nCon fundamento en el artículo 140, incisos 3 y\n18 y 146 de la Constitución Política y la Ley Orgánica del Ambiente Nº 7554 del\n4 de octubre de 1995 y los Decretos Ejecutivos números N° 27485-MINAE y 30077-MINAE.\n\n \n\nConsiderando:\n\n \n\n1º-Que los habitantes de la República tienen\nderecho a un ambiente sano y ecológicamente equilibrado, siendo deber del\nEstado garantizar ese derecho, defenderlo y preservarlo, según lo dispone el\nartículo 50 de la Constitución Política y la Ley Orgánica del Ambiente. \n\n2º-Que los consumidores y usuarios tienen\nderecho a un trato equitativo y a información adecuada y veraz, acerca de las\ncaracterísticas de los productos que consumen.\n\n3º-Que con la finalidad de dar contenido a las\nconsideraciones anteriores desde el año 1997 el Ministerio del Ambiente y\nEnergía ha puesto en operación la certificación Bandera Ecológica, como un\nmedio de reconocer el esfuerzo de personas jurídicas dedicadas a actividades manufactureras\no de servicio y de instituciones públicas, que desarrollan sus actividades\nproductivas atendiendo a la normativa ambiental y sanitaria y que con su\naccionar contribuyen al desarrollo humano sostenible. \n\n4º-Que la Dirección de la Sociedad Civil creada\nmediante Decreto Ejecutivo N° 27485-MINAE del 13 de octubre de 1998, tiene la responsabilidad\nde coordinar la ejecución del Programa Bandera Ecológica. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nReglamento para\notorgar el certificado\n\n\"Bandera Ecológica\"\n\n \n\nCAPÍTULO I\n\nObjetivos\n\n \n\nArtículo 1º-Bandera Ecológica, es la\ncertificación anual que emitirá el Ministerio del Ambiente y Energía, como ente\nRector en materia ambiental, a empresas privadas e instituciones o empresas\npúblicas, cuyas acciones beneficien al ambiente y que tiendan al\nestablecimiento de Sistemas de Gestión Ambiental.\n\nArtículo 2º-La certificación se entregará\nacompañada de un galardón denominado Bandera Ecológica, a quienes apliquen por\nel reconocimiento, se preocupan por el desarrollo de un ambiente sano y ecológicamente\nequilibrado, protejan la salud de los trabajadores en los procesos de producción\no prestación de servicios, fomenten el trato equitativo de los consumidores,\nsus derechos a la información y se encaminen hacia políticas de desarrollo\nhumano sostenible mediante la puesta en práctica de sistemas de gestión\nambiental.\n\nCAPÍTULO II\n\nGeneralidades\n\n \n\nArtículo 3º-Se crea la certificación Bandera\nEcológica, que se otorgará a empresas privadas e instituciones o empresas\npúblicas que cumplan con la legislación ambiental, de salud ocupacional y\nsanitaria vigente, así como con los requisitos establecidos en el presente\nReglamento.\n\nCAPÍTULO III\n\nRequisitos para obtener la Bandera Ecológica\n\n \n\nArtículo 4º-Para obtener la certificación\nBandera Ecológica la empresa deberá cumplir con las obligaciones establecidas\nen la legislación ambiental, de salud ocupacional y sanitaria vigente y\natinente, y sus actividades deberán encaminarse a establecer un Sistema de\nGestión Ambiental basado en los parámetros establecidos por la Comisión\nNacional de Bandera Ecológica.\n\nArtículo 5º-Podrán obtener la certificación\nempresas privadas e instituciones o empresas públicas, que en sus políticas,\ndirectrices, acuerdos y gestión, además de cumplir con su razón de ser, cumplan\ncon los siguientes requerimientos:\n\n \n\na) Garantizar la satisfacción del usuario con\nlos servicios que presta. \n\n \n\nb) Incorporar el concepto desarrollo sostenible\nen sus objetivos y procesos institucionales. \n\n \n\nc) Propiciar y reglamentar el manejo ambiental\nde los insumos y productos en los servicios que presta a lo largo del ciclo de conservación,\nproducción, distribución, consumo y desechos. \n\n \n\nd) Estimular el desarrollo equilibrado entre la\nsociedad y la naturaleza. \n\n \n\ne) Promover o participar en programas de\nextensión, educación o capacitación que involucren a la ciudadanía en sus\nactividades. \n\n \n\nf) Desarrollar un Sistema de Gestión Ambiental.\n\nArtículo 6º-La Comisión Nacional de Bandera\nEcológica podrá establecer otros requerimientos, de acuerdo a la naturaleza de\nla actividad que realice el solicitante, atendiendo a la normativa ambiental\nnacional e internacional reconocido por el país.\n\nCAPÍTULO IV\n\nCategorías de Bandera Ecológica\n\n \n\nArtículo 7º-Se establecen cuatro categorías de\nla certificación Bandera Ecológica. Los procesos de evaluación ambiental que\nanualmente se realicen permitirán a la Comisión Nacional de Bandera Ecológica\notorgar las certificaciones correspondientes:\n\n \n\na) Bandera Ecológica A. Se otorgará esta\ncertificación a aquellas empresas privadas e instituciones o empresas públicas,\nque cumplan con las regulaciones ambientales y laborales atinentes a su\nactividad productiva. \n\n \n\nb) Bandera Ecológica '41ª. Se otorgará\nesta certificación a aquellas empresas privadas e instituciones o empresas\npúblicas, que además de cumplir con el inciso anterior, hayan iniciado el\nproceso del establecimiento de su Sistema de Gestión Ambiental, definiendo al\nmenos su política ambiental, metas ambientales, objetivos ambientales, hayan\niniciado el proceso de construcción de sus procedimientos y registros y que el\nproceso de operacionalización del Sistema de Gestión Ambiental pueda ser\ndefinido como avanzado. \n\n \n\nc) Sello Verde. Se otorgará esta\ncertificación a aquellas empresas privadas e instituciones o empresas públicas,\nque además de cumplir con el inciso a) tengan en funcionamiento el 100% de su\nSistema de Gestión Ambiental el cual deberá cumplir con todos los parámetros establecidos\npor la Comisión Nacional de Bandera Ecológica. \nAdicionalmente los estándares de producción o de servicios que alcancen\nestas empresas o instituciones públicas podrán ser categorizados como de clase\nmundial. \n\n \n\nd) Amigos del Ambiente. Se otorgará esta\ncertificación a aquellas empresas privadas e instituciones o empresas públicas,\nque hayan mantenido al menos por cuatro períodos anuales consecutivos la certificación\nen la categoría Sello Verde. Adicionalmente deberá existir criterio unánime de\ntodos los que hayan participado en las evaluaciones de esos cuatro períodos de\nla existencia de un mejoramiento continuo de su desempeño ambiental.\n\nCAPÍTULO V\n\nPublicidad de la certificación\n\n \n\nArtículo 8º-Una vez al año, la Comisión\nNacional de Bandera Ecológica, hará un reconocimiento público a las empresas e\ninstituciones galardonadas, indicando la fecha en que les fue otorgada la\ncertificación Bandera Ecológica y la categoría que obtuvieron.\n\nArtículo 9º-Las empresas o instituciones que\nhan sido certificadas por Bandera Ecológica, adquieren el compromiso de\nmantener y mejorar las condiciones ambientales y sanitarias bajo las cuales\nobtuvieron la certificación.\n\nArtículo 10.-La certificación Bandera\nEcológica, tiene una vigencia de un año, no obstante la Comisión Nacional de\nBandera Ecológica, podrá retirar la certificación y el emblema, si la empresa o\ninstitución, inflinge las características ambientales y sanitarias que la\nhicieron acreedora de la certificación.\n\nArtículo 11.-La certificación obliga a los\nentes certificados comunicar a la Comisión Nacional, cualquier cambio o\nmodificación a los procesos o al Sistema de Gestión Ambiental evaluados y que\nle hicieran merecedor de tal distinción. Para ello contarán con un plazo máximo\nde diez días hábiles a la fecha en que se produjeron los cambios. El\nincumplimiento de esta obligación faculta a la Comisión Nacional a retirar la\ncertificación obtenida.\n\nCAPÍTULO VI\n\nSolicitudes\n\n \n\nArtículo 12.-Quienes pretendan ser certificados\npor Bandera Ecológica deberán:\n\n \n\na) Inscribirse en sede del Programa Bandera\nEcológica. \n\n \n\nb) Someterse anualmente al proceso de\nevaluación ambiental que dirigirá la Comisión Nacional de Bandera Ecológica y\ncubrir los costos correspondientes en el proceso de inscripción, confección, evaluación\ny otorgamiento de la certificación. \n\n \n\nc) Completar el Formulario de Aplicación que le\nserá entregado una vez inscrita la empresa o institución pública. La\ninformación proporcionada a través del Formulario Inicial tendrá el carácter de\nautoevaluación ambiental del desempeño ambiental y sanitario de la empresa y\ntendrá adicionalmente el carácter de Declaración Jurada, debiendo ser\nrefrendada por la más alta autoridad administrativa correspondiente de la\nempresa y por un profesional competente en la materia.\n\nArtículo 13.-Las empresas e instituciones, que\nen el Formulario de Aplicación o en alguna otra fase del proceso, brinden\ninformación falsa, inexacta o adulterada, a efecto de inducir a la Comisión\nNacional de Bandera Ecológica a conclusiones erróneas, perderá la\ncertificación. La Comisión trasladará el asunto a las autoridades\ncorrespondientes a fin de que se proceda conforme la ley lo estipule.\n\nCAPÍTULO VII\n\nDeberes del Programa Bandera Ecológica\n\n \n\nArtículo 14.-Una vez recibido el formulario de\naplicación completado, el cual constituye en sí mismo un criterio de\nautoevaluación de la empresa, el Ministerio del Ambiente y Energía por medio\ndel Programa Bandera Ecológica, realizará una inspección ocular de las\ninstalaciones y/ o procesos productivos de la empresa o institución pública\nsolicitante. El informe resultante de dicha inspección será remitido a la\nComisión Nacional de Bandera Ecológica para su estudio y constituye en sí mismo\nel segundo criterio del proceso de evaluación.\n\nArtículo 15.-El Programa Bandera Ecológica a\ntravés de la Comisión Nacional solicitará una vez conocido el Informe de\nInspección, una Auditoría Ambiental para la empresa privada, institución o\nempresa pública solicitante. La Comisión Nacional de Bandera Ecológica asignará\nuno o varios auditores responsables, según corresponda a la auditoría solicitada.\nEl Informe de Auditoría que emane del proceso respectivo constituirá el tercer\ncriterio de evaluación. Esta auditoría deberá realizarla única y exclusivamente\npor un(a) auditor(a) debidamente acreditado(a) ante la Comisión Nacional de\nBandera Ecológica.\n\nArtículo 16.-Una vez recabados los tres criterios\nnecesarios para la emisión de cualquier certificación y expresados a través del\nFormulario de Aplicación, el Informe de Inspección y el Informe de Auditoría,\nla Comisión Nacional de Bandera Ecológica resolverá la Aplicación emitiendo el\nDictamen correspondiente. Los acuerdos de la Comisión Nacional se establecerán\npor mayoría simple.\n\nArtículo 17.-La Comisión Nacional de Bandera\nEcológica será responsable de establecer cualquier mecanismo adicional para la\ntramitación, auditoría e inspección a las empresas e instituciones.\n\nCAPÍTULO VIII\n\nDe la Comisión Nacional de Bandera Ecológica\n\n \n\nArtículo 18.-Se crea la Comisión Nacional de\nBandera Ecológica, la cual se reunirá trimestralmente o en su defecto cuando el\nSecretario Técnico los convoque, en caso de un empate de votos en la toma de\ndecisiones, el Presidente de la Comisión Nacional podrá ejercer derecho a doble\nvoto. Se levantará un acta de los asuntos tratados en cada sesión y estará\nintegrada de la siguiente forma:\n\n \n\n1) El Ministro de Ambiente y Energía o su\nrepresentante; quien presidirá.\n\n \n\n2) El Director de la Oficina de Sociedad Civil\ndel MINAE; quien fungirá como Secretario Técnico.\n\n \n\n3) Un representante de Fundación Bandera\nEcológica para la Gestión Ambiental y la Conservación de los Recursos Naturales,\nque fungirá con carácter exclusivo como ente ejecutor del Programa Bandera Ecológica.\n\n \n\n4) Un representante de las empresas poseedoras\nde la certificación Bandera Ecológica.\n\n \n\n5) Un representante del grupo de auditores\nacreditados ante el Programa Bandera Ecológica.\n\nArtículo 19.-Son funciones de la Comisión\nNacional de Bandera Ecológica las siguientes:\n\n \n\na) Recomendar al Ministerio del Ambiente y\nEnergía, la política a seguir para la implementación del Programa Bandera\nEcológica. \n\n \n\nb) Aprobar y poner en funcionamiento bajo el\nmismo esquema de operación del Programa Bandera Ecológica (Aplicación,\nInspección, Auditoría y Dictamen) otros sistemas de certificación ambiental o\nde distinciones ambientales atinentes a sostenibilidad, sectores productivos\nparticulares u otros que compartan la filosofía y el espíritu del Programa\nBandera Ecológica. Estos nuevos sistemas de certificación ambiental deberán ser\nexpresamente autorizados por el Ministro del Ambiente y Energía. \n\n \n\nc) Supervisar y aprobar o improbar la construcción\nde herramientas técnicas que deban utilizarse en los procesos del Programa\nBandera Ecológica. \n\n \n\nd) Evaluar y fijar pautas a seguir en las\nevaluaciones ambientales a realizarse en la implementación de este Programa. \n\n \n\ne) Aprobar o denegar las certificaciones\nBandera Ecológica mediante resoluciones que deberán ser debidamente\nfundamentadas. \n\n \n\nf) Dar publicidad a la lista de certificaciones\nemitidas anualmente. \n\n \n\ng) Establecer los requisitos para la\nacreditación de los Auditores del Programa Bandera Ecológica. \n\n \n\nh) Asignar los (as) auditores (as) responsables\nde realizar Auditoría Ambiental en cada aplicación empresa o institución,\nmediante el procedimiento que se otorgará por medio de Resolución. \n\n \n\ni) Solicitar, colaboración o apoyo a las instituciones\nestatales cuando se considere necesario, con el fin de reforzar sus criterios técnicos\nantes de emitir sus dictámenes. \n\n \n\nj) Supervisar y aprobar la implantación de un\nsistema de calidad en el proceso de certificación que deberá establecer el Programa\nBandera Ecológica. \n\n \n\nk) Solicitar a la Fundación Bandera Ecológica\nla organización, realización y manejo de una reunión cada dos años con los\nauditores acreditados ante el Programa Bandera Ecológica a fin de que escojan a\nsus representantes ante la Comisión Nacional de Bandera Ecológica.\n\n \n\n1) Las empresas poseedoras de la certificación\ncada dos años entregarán el nombre de la persona que los representará ante la\nComisión Nacional. La Comisión Nacional le solicitará a la Fundación Bandera Ecológica\nla coordinación de una reunión cada dos años con las empresas poseedoras de la\ncertificación a fin de que las mismas escojan a sus representantes ante la\nComisión Nacional de Bandera Ecológica. \n\n \n\nm) Ampliar las certificaciones del Programa\nBandera Ecológica a través de la puesta en operación de propuestas y\nherramientas técnicas que hayan sido elaboradas por la Fundación Bandera\nEcológica para la gestión ambiental y la conservación de los recursos naturales\ny aprobados por el MINAE. \n\n \n\nn) Cualquier otra, que señale este Reglamento o\nque se desprenda de las funciones que se les asigna.\n\n    Artículo 20.-Dirección General de Gestión Calidad Ambiental. El\nDirector de la\nDirección General de Gestión Calidad Ambiental será el\nresponsable de ejecutar las directrices y decisiones de la\nComisión Nacional de Bandera Ecológica y actuará bajo su\nsupervisión. Será nombrado por el Ministerio del Ambiente y Energía, su\nresponsabilidad incluye además mantener informado al Consejo y al Ministerio\ndel Ambiente y Energía sobre la aplicación de esta legislación y de otras leyes\ncuya aplicación le corresponde al Programa Bandera Ecológica; asimismo deberá\nsupervisar y dar seguimiento al cumplimiento de los reglamentos, las políticas\ny las directrices en la materia.\n\n \n\n(La reforma practicada al presente artículo por el artículo 4° del decreto ejecutivo N° 34204 del 23\nde noviembre de 2007 posteriormente fue derogada por el artículo 20 del decreto ejecutivo N° 41594\ndel 15 de enero del 2019 \"Crea el Sistema de Reconocimientos Ambientales (SIREA)\". Subsequently, by Article 16 of the Regulation for the establishment of registration and evaluation costs within the framework of the environmental recognition system, approved by Decreto Ejecutivo N° 37707 of April 19, 2013, this regulation is repealed again)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AMBIENTE Y ENERGÍA\n\nBased on Article 140, subsections 3 and\n18, and 146 of the Constitución Política and Ley Orgánica del Ambiente Nº 7554 of\nOctober 4, 1995, and Decretos Ejecutivos N° 27485-MINAE and 30077-MINAE.\n\nConsidering:\n\n1º-That the inhabitants of the Republic have\nthe right to a healthy and ecologically balanced environment, and it is the duty of the\nState to guarantee that right, defend it, and preserve it, as provided in\nArticle 50 of the Constitución Política and the Ley Orgánica del Ambiente.\n\n2º-That consumers and users have\nthe right to equitable treatment and to adequate and truthful information about\nthe characteristics of the products they consume.\n\n3º-That with the purpose of giving substance to the\nforegoing considerations, since 1997 the Ministerio del Ambiente y\nEnergía has put into operation the Bandera Ecológica certification, as\na means of recognizing the efforts of legal entities engaged in manufacturing\nor service activities and of public institutions that carry out their productive\nactivities in compliance with environmental and sanitary regulations and whose\nactions contribute to sustainable human development.\n\n4º-That the Dirección de la Sociedad Civil created\nby Decreto Ejecutivo N° 27485-MINAE of October 13, 1998, is responsible\nfor coordinating the implementation of the Programa Bandera Ecológica. Therefore,\n\nDECREE:\n\nRegulation for\ngranting the \"Bandera Ecológica\"\ncertificate\n\nCHAPTER I\n\nObjectives\n\nArticle 1º-Bandera Ecológica is the\nannual certification that will be issued by the Ministerio del Ambiente y Energía, as the governing\nentity in environmental matters, to private companies and public institutions or\ncompanies whose actions benefit the environment and are aimed at the\nestablishment of Environmental Management Systems.\n\nArticle 2º-The certification will be delivered\nalong with an award called Bandera Ecológica, to those who apply for\nthe recognition, are concerned with developing a healthy and ecologically\nbalanced environment, protect the health of workers in their production\nor service provision processes, promote equitable treatment of consumers and\ntheir rights to information, and move towards sustainable human\ndevelopment policies through the implementation of environmental\nmanagement systems.\n\nCHAPTER II\n\nGeneral Provisions\n\nArticle 3º-The Bandera Ecológica certification is created, which will be granted to private companies and public institutions or\ncompanies that comply with current environmental, occupational health,\nand sanitary legislation, as well as with the requirements established in this\nRegulation.\n\nCHAPTER III\n\nRequirements for Obtaining the Bandera Ecológica\n\nArticle 4º-To obtain the Bandera Ecológica certification, the company must comply with the obligations established\nin current and relevant environmental, occupational health,\nand sanitary legislation, and its activities must be aimed at establishing an\nEnvironmental Management System based on the parameters established by the\nComisión Nacional de Bandera Ecológica.\n\nArticle 5º-Private companies and public institutions or\ncompanies that, in their policies, guidelines, agreements, and management,\nin addition to fulfilling their purpose, comply with the following requirements may obtain the certification:\n\na) Guarantee user satisfaction with the\nservices it provides.\n\nb) Incorporate the concept of sustainable development\ninto their institutional objectives and processes.\n\nc) Promote and regulate the environmental management\nof inputs and products in the services it provides throughout the cycle of conservation,\nproduction, distribution, consumption, and waste.\n\nd) Stimulate balanced development between\nsociety and nature.\n\ne) Promote or participate in outreach,\neducation, or training programs that involve citizens in its\nactivities.\n\nf) Develop an Environmental Management System.\n\nArticle 6º-The Comisión Nacional de Bandera\nEcológica may establish other requirements, according to the nature of\nthe activity carried out by the applicant, in compliance with national and\ninternational environmental standards recognized by the country.\n\nCHAPTER IV\n\nCategories of Bandera Ecológica\n\nArticle 7º-Four categories of the\nBandera Ecológica certification are established. The environmental evaluation processes carried out annually will allow the Comisión Nacional de Bandera Ecológica\nto grant the corresponding certifications:\n\na) Bandera Ecológica A. This\ncertification will be granted to those private companies and public institutions or\ncompanies that comply with the environmental and labor regulations relevant to\ntheir productive activity.\n\nb) Bandera Ecológica '41ª. This\ncertification will be granted to those private companies and public institutions or\ncompanies that, in addition to complying with the previous subsection, have begun the\nprocess of establishing their Environmental Management System, defining at\nleast their environmental policy, environmental goals, and environmental objectives; have\nbegun the process of building their procedures and records; and whose\nprocess of operationalizing the Environmental Management System can be\ndefined as advanced.\n\nc) Sello Verde. This\ncertification will be granted to those private companies and public institutions or\ncompanies that, in addition to complying with subsection a), have 100% of their\nEnvironmental Management System in operation, which must comply with all the parameters established\nby the Comisión Nacional de Bandera Ecológica.\nAdditionally, the production or service standards achieved\nby these private companies or public institutions may be categorized as world-class.\n\nd) Amigos del Ambiente. This\ncertification will be granted to those private companies and public institutions or\ncompanies that have maintained the\ncertification in the Sello Verde category for at least four consecutive annual periods. Additionally, there must be a unanimous criterion\namong all those who participated in the evaluations of those four periods\nthat a continuous improvement of their environmental performance exists.\n\nCHAPTER V\n\nPublicity of the Certification\n\nArticle 8º-Once a year, the Comisión\nNacional de Bandera Ecológica will give public recognition to the awarded companies and\ninstitutions, indicating the date on which they were granted the\nBandera Ecológica certification and the category they obtained.\n\nArticle 9º-The companies or institutions that\nhave been certified by Bandera Ecológica acquire the commitment to\nmaintain and improve the environmental and sanitary conditions under which\nthey obtained the certification.\n\nArticle 10.-The Bandera\nEcológica certification is valid for one year; however, the Comisión Nacional de\nBandera Ecológica may withdraw the certification and the emblem if the company or\ninstitution breaches the environmental and sanitary characteristics that\nmade it worthy of the certification.\n\nArticle 11.-The certification obligates the\ncertified entities to inform the Comisión Nacional of any\nchange or modification to the evaluated processes or the Environmental Management System that\nmade it deserving of such distinction. They will have a maximum period\nof ten business days from the date the changes occurred to do so. The\nfailure to comply with this obligation empowers the Comisión Nacional to withdraw the\nobtained certification.\n\nCHAPTER VI\n\nApplications\n\nArticle 12.-Those seeking to be certified\nby Bandera Ecológica must:\n\na) Register at the headquarters of the Programa Bandera\nEcológica.\n\nb) Undergo the annual environmental evaluation process directed by the Comisión Nacional de Bandera Ecológica and cover the corresponding costs of the registration, preparation, evaluation,\nand granting of the certification process.\n\nc) Complete the Application Form that will\nbe provided once the company or public institution is registered. The\ninformation provided through the Initial Form will have the character of an environmental self-assessment of the company's environmental and sanitary performance and\nwill additionally have the character of a Declaración Jurada, which must be\nendorsed by the corresponding highest administrative authority of the\ncompany and by a competent professional in the field.\n\nArticle 13.-Companies and institutions that,\nin the Application Form or at any other phase of the process, provide\nfalse, inaccurate, or adulterated information in order to induce the Comisión\nNacional de Bandera Ecológica to erroneous conclusions will lose the\ncertification. The Comisión will refer the matter to the corresponding\nauthorities so that they may proceed as stipulated by law.\n\nCHAPTER VII\n\nDuties of the Programa Bandera Ecológica\n\nArticle 14.-Once the completed application form is received, which in itself constitutes a\nself-assessment criterion of the company, the Ministerio del Ambiente y Energía, through\nthe Programa Bandera Ecológica, will conduct an ocular inspection of the\nfacilities and/or production processes of the applying company or public institution. The report resulting from said inspection will be sent to the\nComisión Nacional de Bandera Ecológica for its study and constitutes in itself\nthe second criterion of the evaluation process.\n\nArticle 15.-The Programa Bandera Ecológica, through the Comisión Nacional, will request,\nonce the Inspection Report is known, an Environmental Audit for the applying private company, institution, or public company. The Comisión Nacional de Bandera Ecológica will assign\none or more responsible auditors, as appropriate for the requested audit.\nThe Audit Report emanating from the respective process will constitute the third\nevaluation criterion. This audit must be conducted solely and exclusively\nby an auditor duly accredited before the Comisión Nacional de\nBandera Ecológica.\n\nArticle 16.-Once the three criteria\nnecessary for issuing any certification are gathered and expressed through the\nApplication Form, the Inspection Report, and the Audit Report,\nthe Comisión Nacional de Bandera Ecológica will resolve the Application by issuing the\ncorresponding Dictamen. The agreements of the Comisión Nacional will be established\nby simple majority.\n\nArticle 17.-The Comisión Nacional de Bandera\nEcológica will be responsible for establishing any additional mechanism for\nthe processing, audit, and inspection of companies and institutions.\n\nCHAPTER VIII\n\nThe Comisión Nacional de Bandera Ecológica\n\nArticle 18.-The Comisión Nacional de\nBandera Ecológica is created, which will meet quarterly, or failing that, when the\nSecretario Técnico convenes it. In case of a tie vote in decision-making, the President of the Comisión Nacional may exercise the right to a double\nvote. Minutes will be kept of the matters dealt with in each session, and it will be\ncomposed as follows:\n\n1) The Minister of Ambiente y Energía or their\nrepresentative, who will preside.\n\n2) The Director of the Oficina de Sociedad Civil\nof MINAE, who will act as Secretario Técnico.\n\n3) A representative of Fundación Bandera\nEcológica para la Gestión Ambiental y la Conservación de los Recursos Naturales,\nwho will act exclusively as the executing entity of the Programa Bandera Ecológica.\n\n4) A representative of the companies holding\nthe Bandera Ecológica certification.\n\n5) A representative of the group of auditors\naccredited before the Programa Bandera Ecológica.\n\nArticle 19.-The functions of the Comisión\nNacional de Bandera Ecológica are as follows:\n\na) Recommend to the Ministerio del Ambiente y\nEnergía the policy to follow for the implementation of the Programa Bandera\nEcológica.\n\nb) Approve and put into operation, under the\nsame operational scheme of the Programa Bandera Ecológica (Application,\nInspection, Audit, and Dictamen), other environmental certification or environmental distinction systems relevant to sustainability, particular\nproductive sectors, or others that share the philosophy and spirit of the Programa\nBandera Ecológica. These new environmental certification systems must be\nexpressly authorized by the Minister of Ambiente y Energía.\n\nc) Supervise and approve or disapprove the construction\nof technical tools to be used in the processes of the Programa\nBandera Ecológica.\n\nd) Evaluate and set guidelines to follow in the\nenvironmental evaluations to be carried out in the implementation of this Program.\n\ne) Approve or deny the Bandera Ecológica certifications through resolutions that must be duly\nsubstantiated.\n\nf) Publicize the list of certifications\nissued annually.\n\ng) Establish the requirements for the\naccreditation of the Auditors of the Programa Bandera Ecológica.\n\nh) Assign the auditors responsible for carrying out the Environmental Audit in each application from a company or institution,\nthrough the procedure that will be granted by Resolution.\n\ni) Request collaboration or support from state\ninstitutions when deemed necessary, in order to reinforce their technical criteria\nbefore issuing their dictámenes.\n\nj) Supervise and approve the implementation of a\nquality system in the certification process that the Programa\nBandera Ecológica must establish.\n\nk) Request the Fundación Bandera Ecológica to organize, hold, and manage a meeting every two years with the\nauditors accredited before the Programa Bandera Ecológica so that they may select\ntheir representatives to the Comisión Nacional de Bandera Ecológica.\n\n1) The companies holding the certification\nwill, every two years, provide the name of the person who will represent them before the\nComisión Nacional. The Comisión Nacional will request the Fundación Bandera Ecológica to coordinate a meeting every two years with the companies holding the\ncertification so that they may select their representatives to the\nComisión Nacional de Bandera Ecológica.\n\nm) Expand the certifications of the Programa\nBandera Ecológica through the implementation of proposals and\ntechnical tools that have been developed by the Fundación Bandera\nEcológica para la gestión ambiental y la conservación de los recursos naturales\nand approved by MINAE.\n\nn) Any other function indicated by this Regulation or\nthat stems from the assigned functions.\n\n Article 20.-Dirección General de Gestión Calidad Ambiental. The\nDirector of the\nDirección General de Gestión Calidad Ambiental will be the\nperson responsible for executing the guidelines and decisions of the\nComisión Nacional de Bandera Ecológica and will act under its\nsupervision. They will be appointed by the Ministerio del Ambiente y Energía; their\nresponsibility also includes keeping the Consejo and the Ministerio\ndel Ambiente y Energía informed about the application of this legislation and other laws\nwhose application corresponds to the Programa Bandera Ecológica; likewise, they must\nsupervise and monitor compliance with the regulations, policies,\nand guidelines on the matter.\n\n(The amendment made to this article by Article 4 of Decreto Ejecutivo N° 34204 of November 23, 2007, was subsequently repealed by Article 20 of Decreto Ejecutivo N° 41594\nof January 15, 2019, \"Crea el Sistema de Reconocimientos Ambientales (SIREA)\". However, since the legislator did not indicate that the amended text should revert to its previous state, the amendment remains\nin the present article)\n\nArticle 21.-Of the Fundación Bandera\nEcológica. The Fundación Bandera Ecológica will cooperate with the Programa\nBandera Ecológica, to the extent of its technical and legal possibilities, in the\nimplementation of its policies, objectives, and processes.\n\nCHAPTER IX\n\nUse of the Bandera Ecológica Emblem\n\nand the Logo by\nCertified Entities\n\nArticle 22.-Once the certified entity has\nbeen officially notified of the respective dictamen, it may make\nthe received certification known to the public through any means of\ncommunication.
