DE RECURSOS NATURALES, ENERGIA Y MINAS,\n\n \n\nEn uso de las facultades que les\nconfieren el artículo 140, incisos 3) y 18) de la Constitución Política y los\nartículo 82 y 84 de la Ley de Conservación de la Vida Silvestre N° 7317 del 30\nde octubre de 1992.\n\n \n\nConsiderando:\n\n \n\n1°-Que es obligación del Estado\nvelar por la protección de los recursos naturales del país.\n\n2°-Que mediante la Ley N° 13, Ley\nGeneral sobre Terrenos Baldíos, emitida el 6 de enero de 1939, artículo 10 y la\nley N° 2825 Y sus reformas, artículo 7, inciso f) se creó una zona pública\ninalienable de 2 000 metros de ancho a lo largo de la frontera con Nicaragua;\nesta área en virtud de lo dispuesto en los pronunciamientos emitidos por la\nProcuraduría General de la República N° C107-85 y N° C272-85 del 20 de mayo de\n1985 y 29 de octubre de 1985 respectivamente, se concede que la administración\nde la zona en tanto los terrenos sean de aptitud agrícola al Instituto de\nDesarrollo Rural(*) y en tanto lo sean de aptitud forestal al Ministerio\nde Recursos Naturales, Energía y Minas.\n\n(*)\n(Modificada su denominación por el artículo 14° de la Ley N° 9036 del 11 de\nmayo de 2012, \"Transforma el Instituto de Desarrollo Agrario (IDA) en el\nInstituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo\nRural\")\n\n3°-Que la zona en mención se\nconstituye en un importantísimo corredor biológico entre el Area\nde Conservación Tortuguero, los Humedales de Tamborcito y Maquenque,\nel Refugio Nacional de Vida Silvestre Caño Negro y la Reserva Forestal El\nJardín.\n\n4°-Que de conformidad con el\nacuerdo sobre Áreas Fronterizas suscrito por los Gobiernos de las Repúblicas de\nCosta Rica y Nicaragua en Puntarenas a los quince días del mes de diciembre de\n1990, se declara el Sistema Internacional de Áreas Protegidas para la Paz\n(SI-A-PAZ) como el proyecto de conservación de más alta prioridad en ambos\npaíses.\n\n5°-Que el SI-A-PAZ pretende\nproteger la muestra más grande y representativa de bosque húmedo tropical que\nse encuentra en la Vertiente Caribe de Centroamérica.\n\n6°-Que el avance de los\nmonocultivos comerciales y la tala ilegal han reducido el área boscosa de la\nvertiente norte a niveles críticos, con el consecuente detrimento del hábitat\npara la vida silvestre, la pérdida de la biodiversidad, la sedimentación de los\ncauces pluviales y el avance del proceso de erosión. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1°-Declárase Refugio\nNacional de Vida Silvestre al corredor fronterizo conformado por los terrenos\ncomprendidos en una zona de 2 000 m de ancho a lo largo de la frontera con\nNicaragua desde Punta Castilla en el Mar Caribe hasta Bahía Salinas en el\nOcéano Pacífico, según se dispone en el Tratado Cañas-Jerez del 15 de abril de\n1858.\n\n(Nota de Sinalevi: Mediante el artículo 1° de\nla ley N° 10127 del 9 de febrero de 2022, se segregó del\nRefugio Nacional de Vida Silvestre Corredor Fronterizo, creado mediante Decreto\nEjecutivo 22962-MIRENEM, de 15 de febrero de 1994, modificado por Decreto\nEjecutivo 23248-MIRENEM de 20 de abril del mismo año y ubicado en la línea\ndivisoria entre las Repúblicas de Costa Rica y Nicaragua, un área total de\nnoventa y cuatro mil treinta y dos metros cuadrados (94 032 m2), según el\nlevantamiento topográfico mencionado más adelante.\n\nEl área total por segregar se divide en\ndos subáreas que se ubican entre los puntos uno y\ndiez y uno y veintiocho, respectivamente, de los cuadros que se detallan a\ncontinuación:\n\nLote 1, inmueble situado en el distrito uno,\nLos Chiles, cantón catorce, Los Chiles, de la provincia de Alajuela; Para el cumplimiento de estos fines el\nMinisterio de Comercio Exterior dispondrá:\n\na) de los recursos humanos\nrequeridos, para lo cual se garantizará que disponga de las plazas que sean\nnecesarias, incluyendo la creación de nuevas plazas y pudiendo utilizar también\nlas plazas creadas para tales efectos y que queden vacantes; y\n\nb) de los recursos percibidos\npor el Ministerio de Hacienda en el artículo 4 de la Ley 9154, según como se\nestablece en la ley, y de transferencias provenientes de otras instituciones o\nentidades públicas y de aquellos recursos producto de la colaboración\nfinanciera nacional o internacional.\n\nAsimismo, la institución\ntitular del terreno se encuentra facultada para ceder los derechos de uso y\nusufructo a fideicomisos de titularización, fondos de inversión o figuras\nsimilares; Therefore,\n\nDECREES:\n\nArticle 1—The border corridor comprised of the lands\nwithin a zone of 2,000 m in width along the border with\nNicaragua from Punta Castilla on the Caribbean Sea to Bahía Salinas in the\nPacific Ocean, as provided in the Cañas-Jerez Treaty of April 15,\n1858, is declared a National Wildlife Refuge (Refugio Nacional de Vida Silvestre).\n\n(Note from Sinalevi: By Article 1 of\nLaw N° 10127 of February 9, 2022, a total area of\nninety-four thousand thirty-two square meters (94,032 m2) was segregated from the\nCorredor Fronterizo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Corredor Fronterizo), created by Executive\nDecree 22962-MIRENEM of February 15, 1994, amended by Executive\nDecree 23248-MIRENEM of April 20 of the same year, and located on the\ndividing line between the Republics of Costa Rica and Nicaragua, according to the\ntopographic survey mentioned below.\n\nThe total area to be segregated is divided into\ntwo sub-areas located between points one and\nten and one and twenty-eight, respectively, of the tables detailed\nbelow:\n\nLot 1, property located in district one,\nLos Chiles, canton fourteen, Los Chiles, Alajuela province; To fulfill these purposes, the\nMinistry of Foreign Trade (Ministerio de Comercio Exterior) shall have:\n\na) the human resources\nrequired, for which it is guaranteed that it will have the necessary positions,\nincluding the creation of new positions and the ability to also use\npositions created for such purposes that become vacant; and\n\nb) the resources received\nby the Ministry of Finance (Ministerio de Hacienda) under Article 4 of Law 9154, as\nestablished in the law, and transfers from other institutions or\npublic entities and those resources resulting from national or international financial\ncollaboration.\n\nFurthermore, the institution\nholding title to the land is empowered to cede the rights of use and\nusufruct to securitization trusts (fideicomisos de titularización), investment funds (fondos de inversión), or similar\nfigures; the foregoing, should it be deemed necessary or convenient for the\nconstruction, remodeling, expansion, maintenance, and/or operation of the\ninfrastructure works required for the functioning of the border\npost.)\n\nArticle 2—Lands whose\nproperty title is legitimately registered with the Public Property\nRegistry (Registro Público de la Propiedad) within the area comprised by the National Wildlife Refuge (Refugio Nacional de Vida Silvestre), shall only be considered part thereof once the State purchases\nor expropriates their property right.\n\n(Thus amended by\nArticle 1 of Executive Decree N° 23248 of April 20, 1994).\n\nArticle 3—The administration of the\nRefuge corresponds to the Dirección General de Vida Silvestre of the Ministry of\nNatural Resources, Energy and Mines.\n\nArticle 4—It takes effect upon its\npublication.\n\nIssued at the Presidency of the\nRepublic.--San José, on the fifteenth day of February, nineteen hundred\nand ninety-four.\n\nDate of generation: 5/5/2026 05:39:02\n\n Go to the beginning of the document" }
