Por tanto,\n\n \n\nSE ACUERDA:\n\n \n\nArtículo 1º-De la pesca por\nparte de la Flota\n Semiindustrial camaronera de arrastre: Se prohíbe a\nla Flota Semiindustrial\ncamaronera de arrastre faenar durante los meses de mayo, junio y julio de cada\naño, en el área comprendida entre una línea recta imaginaria que va desdé Punta\nTorres, conocida como Peñón (84º43'52\" Longitud Oeste, 09º53'31\" Latitud norte)\nhasta el Faro de las Islas Negritos Afuera (84º49'35\" Longitud oeste, 09º49'14\"\nLatitud norte) y de aquí hasta Punta Cuchillo (84º52'23\" Longitud oeste,\n09º49'39\" Latitud norte), de esa línea imaginaria, aguas adentro hasta la\ndesembocadura del Río Tempisque.\n\nArtículo 2º-No se permitirá\nfaenar utilizando arte de pesca de arrastre de ningún tipo, en ninguna época\ndel año en la zona comprendida entre una línea recta imaginaria que va desde el\nMuelle de Cruceros de Puntarenas (84º49'51\" Longitud oeste, 9º58'26\" Latitud\nnorte) hasta el Faro de las Islas Negritos Afuera (84º49'35\" Longitud oeste,\n09º49'14\" Latitud norte) y de aquí hasta Punta Cuchillo (84º52'23\" Longitud\noeste, 09º49'39\" Latitud norte), de esta línea imaginaria, aguas adentro hasta\nla desembocadura del Río Tempisque.\n\nArtículo 3º-De la pesca por parte de la flota artesanal en pequeña escala.\n\n \n\nA- Pesca con redes agalleras o red de enmalle: Durante los meses de\nmayo, junio y julio de cada año, se prohíbe la utilización de redes agalleras o\ntrasmallos de cualquier luz de malla, en el área comprendida entre una línea\nrecta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52\"\nLongitud oeste, 09º53'31\" Latitud norte) hasta el Faro de las Islas Negritos\nAfuera (84º49'35\" Longitud oeste, 09º49'14\" Latitud norte) y de aquí hasta\nPunta Cuchillo (84º52'23\" Latitud oeste, 09º49'39\" Latitud norte), de esa línea\nimaginaria, aguas adentro hasta la desembocadura del Río Tempisque.\n\nB- Pesca con línea taiwanesa: Durante\nel período comprendido entre los meses de mayo, junio y julio de cada año, se\nprohíbe la utilización de la línea taiwanesa, en el área comprendida entre una\nlínea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52\"\nLongitud oeste, 09º53'31\" Latitud norte) hasta el Faro de las Islas Negritos\nAfuera (84º49'35\" Longitud oeste, 09º49'14\" Latitud norte) y de aquí hasta\nPunta Cuchillo (84º52'23\" Longitud oeste, 09º49'39\" Latitud norte) de esa línea\nimaginaria, aguas adentro hasta la desembocadura del Río Tempisque.\n\nC- Pesca con cuerdas de mano: Durante\nel período comprendido entre mayo, junio y julio de cada año, todo aquel\npermisionario con Licencia de Pesca Comercial para la parte interna del Golfo\nde Nicoya, podrá utilizar a cualquier hora del día las cuerdas de mano con\nanzuelo Nº 6, en el área comprendida entre una línea recta imaginaria que va\ndesde Punta Torres, conocida como Peñón (84º43'52\" Longitud oeste, 09º53'31\"\nLatitud norte) hasta el Faro de las Islas Negritos Afuera (84º49'35\" Longitud\noeste, 09º49'14\" Latitud norte) y de aquí hasta Punta Cuchillo (84º52'23\"\nLongitud oeste, 09º49'39\" Latitud norte) de esa línea imaginaria, aguas adentro\nhasta la desembocadura del Río Tempisque.\n\nD- Pesca con línea planera en\nla zona aguas adentro del Golfo de Nicoya: Durante el período comprendido\nentre los meses de mayo, junio y julio de cada año, todo aquel permisionario\ncon Licencia de Pesca Comercial para la parte interna del Golfo de Nicoya,\npodrá utilizar a cualquier hora del día una línea planera por embarcación con\nun máximo de 500 metros\nde largo y también un máximo de 300 anzuelos Nº 6, en el área comprendida entre\nuna línea recta imaginaria que va desde Punta Torres, conocida como Peñón (84º43'52\"\nLongitud oeste, 09º53'31\" '4Catitud norte) hasta el Faro de las Islas Negritos\nAfuera (84º49'35\" Longitud oeste, 09º49'14\" Latitud Norte) y de aquí hasta\nPunta Cuchillo (84º52'23\" Longitud oeste, 09º49'39\" Latitud norte), de esa\nlínea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque.\n\nE- Pesca con línea planera en\nla zona aguas afuera del Golfo de Nicoya: Quienes opten por lo dispuesto en\nlos puntos C y D, podrán capturar su propia carnada utilizando chinchorro de\nbarrer playa y/o red bolichera. Quienes opten por esta alternativa deben\ncomunicarlo al Departamento de Protección y Registro.\n\nF,  De\n\nla Pesca\n de Atún y Macarelas (pequeñas pelágicas) con red agallera a la deriva.\n\n \nSe establece como zona autorizada para el uso de este tipo de pesca el área\ncomprendida entre la línea recta imaginaria que va desde el Muelle de Cruceros\nde Puntarenas (84°49551\"\nLongitud Oeste, 9°58'26\" Latitud Norte) hasta la parte más Oriental de\n\nla Isla\n de Cedros (84°51'59\" Longitud Oeste, 9°51'00\" Latitud Norte) y de\nesas dos líneas imaginarias aguas hacia afuera del Golfo de Nicoya.  \n\nDicha\nred deberá tener una luz de malla mínima de 3½ pulgadas, una longitud máxima\nde\n500 metros\n y una altura máxima de 100 mallas y deberá estar provista de boyas, galones o\ncualquier otro dispositivo que permita a las autoridades competentes su\nidentificación.\n\nAquellos\npermisionarios que se dediquen a este tipo de pesca facilitarán sus\nembarcaciones para que funcionarios del INCOPESCA, puedan obtener a bordo de éstas\ninformación de sus capturas y de las características del arte de pesca\nutilizada, cuando así lo designe\n\nla Institución\n\".\n\nEl\nincumplimiento a esta normativa será sancionada, según lo estipulado en el\narticulo de\n\nla Ley N\n° 8436.\n\n \n\n(Así\nadicionado el inciso anterior  mediante acuerdo AJDIP/126 del 27 de abril de\n2007)\n\nArtículo\n4º-De la pesca de sardina por parte de\nla Flota  Semiindustrial\n sardinera con red de cerco:  Durante el periodo comprendido entre los\nmeses de mayo, jumo y julio de cada año, se permitirá la pesca de la sardina\ncon red de cerco, durante los días lunes, martes y miércoles de cada semana en\nla zona interna comprendida, entre una línea recta imaginaria que va desde\nPunta Torres, conocida como Peñón (84°43'52\" Longitud Oeste, 09°53'31\"\nLatitud Norte) hasta el Faro de las Islas Negritos Afuera (84°49'35\"\nLongitud Oeste, 09°49'14\" Latitud Norte) y de aquí, en línea recta\nimaginaria que va hasta el Muelle de Cruceros en\n\nla Ciudad\n de Puntarenas (84°49'51\" Longitud Oeste, 09°58'26\" Latitud Norte).\n\nAquellos\npermisionarios que se dediquen a este tipo de pesca facilitarán sus\nembarcaciones para que funcionarios del ESTCOPESCA, puedan permanecer y obtener\na bordo de éstas, la información de sus capturas, de acuerdo a las\nposibilidades cíe\n\nla Institución.\n\nPrevio\na la llegada del barco sardinero a puerto, el permisionario deberá de notificar\nal Departamento de Protección y Registro para efecto .de inspeccionar todas las\ndescargas.\n\nSi el\npermisionario no cumpliera lo estipulado en este artículo, se dará por\nterminada la autorización acordada.\n\n \n\n(Así\nreformado mediante acuerdo AJDIP/126 del 27 de abril de 2007)\n\nArtículo 5º-De la pesca de la\njaiva con nasas: Durante el período comprendido entre los meses de mayo,\njunio y julio de cada año, se permitirá la pesca del cangrejo jaiva con nasas,\núnicamente a todo aquel permisionario con Licencia de Pesca Comercial vigente\npara este tipo de pesca y en la(s) zona(s) autorizada(s).\n\nArtículo 6º-De la presentación\ndel listado de pescadores afectos al subsidio.\nLa Dirección General\nTécnica deberá realizar las acciones pertinentes a fin de que en un plazo no\nmayor a 30 días naturales contados a partir de la publicación de esta\nregulación, presente ante las instancias administrativas y competentes del\nIMAS, el listado preliminar de pescadores sujeto a las restricciones y\ncondiciones de veda para el Golfo de Nicoya, a fin de que se les otorgue el\nsubsidio económico correspondiente, una vez que haya cumplido con la obligación\ndel servicio de trabajo comunal. \n\nCon sustento en lo establecido en\nla Ley 8436,\núnicamente gozarán de ese beneficio aquellos pescadores debidamente legalizados\nque se vean afectados por la veda.\n\nArtículo 7º-De las sanciones: Además\nde la aplicación de aquellas sanciones establecidas en\nla Ley de Pesca y Acuicultura,\nLey Nº 8436, a\ntodos aquellos permisionarios que durante la presente veda las autoridades competentes\nlos encuentren infringiendo las disposiciones establecidas en este acuerdo, el\nINCOPESCA a través de cada una de sus oficinas competentes procederá a\nsuspender como medida precautoria a partir de que se cometa la infracción y\nhasta que se concluya el proceso administrativo sancionatorio, el otorgamiento\ndel combustible a precio preferencial y solicitará al Instituto Mixto de Ayuda\nSocial (IMAS) que tanto los permisionarios como sus ayudantes sean excluidos\nautomáticamente de los listados remitidos como potenciales beneficiarios de la\nayuda económica que esa Institución otorga durante las vedas establecidas en el\nGolfo de Nicoya.\n\nArtículo 8º-Para dar fiel\ncumplimiento a lo dispuesto en este acuerdo, referente a las artes de pesca\npermitidas en la pesquería artesanal, se autoriza únicamente mantener a bordo\nlas cuerdas de mano y la línea planera autorizada.\n\nArtículo 9º-Publíquese.",
  "body_en_text": "A.J.D.I.P./074-2007.—Puntarenas,\non the sixteenth day of the month of March, 2007.\n\nConsidering:\n\n1º—That in accordance with Law No. 7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the authority and competence of INCOPESCA to protect and conserve hydrobiological resources, in order to guarantee the living resources of the sea for future generations.\n\n2º—That it is technically considered that one of the ways to conserve hydrobiological resources and guarantee a sustainable exploitation of the resources is the establishment of closed seasons (vedas) and areas, which it is advisable to define and apply in the current year.\n\n3º—That after analyzing the technical criteria and recommendations issued by the Closed Season Commission (Comisión de Veda), as well as the criterion of the General Technical Directorate of INCOPESCA, it agrees to decree a closed season (veda) in the Gulf of Nicoya. Those who opt for this alternative must notify the Department of Protection and Registry.\n\nF, Of Tuna and Mackerel (small pelagics) Fishing (Pesca de Atún y Macarelas (pequeñas pelágicas)) with drifting gillnet (red agallera a la deriva).\n\nThe area authorized for the use of this type of fishing is established as the area between the imaginary straight line running from the Puntarenas Cruise Ship Pier (84°49'51\" West Longitude, 9°58'26\" North Latitude) to the easternmost part of Isla de Cedros (84°51'59\" West Longitude, 9°51'00\" North Latitude) and from those two imaginary lines towards the offshore waters of the Gulf of Nicoya.\n\nSaid net must have a minimum mesh size (luz de malla) of 3½ inches, a maximum length of 500 meters, and a maximum height of 100 meshes, and must be equipped with buoys, floats, or any other device that allows the competent authorities to identify it.\n\nThose permit holders (permisionarios) engaged in this type of fishing shall make their vessels available so that INCOPESCA officials may obtain information on board about their catches and the characteristics of the fishing gear used, when so designated by the Institution.\n\nNon-compliance with this regulation shall be sanctioned, as stipulated in the article of Law No. 8436.\n\n(Thus added the preceding subsection through agreement AJDIP/126 of April 27, 2007)\n\nArticle 4º—Of sardine fishing by the Semi-industrial Sardine Fleet (Flota Semiindustrial sardinera) with purse seine net (red de cerco): During the period comprised of the months of May, June, and July of each year, sardine fishing with a purse seine net shall be permitted on Mondays, Tuesdays, and Wednesdays of each week in the inner zone comprised between an imaginary straight line running from Punta Torres, known as Peñón (84°43'52\" West Longitude, 09°53'31\" North Latitude) to the Faro de las Islas Negritos Afuera Lighthouse (84°49'35\" West Longitude, 09°49'14\" North Latitude) and from there, in an imaginary straight line running to the Cruise Ship Pier in the City of Puntarenas (84°49'51\" West Longitude, 09°58'26\" North Latitude).\n\nThose permit holders (permisionarios) engaged in this type of fishing shall make their vessels available so that INCOPESCA officials may remain on board and obtain information about their catches, according to the Institution's capabilities.\n\nPrior to the sardine boat's arrival at port, the permit holder must notify the Department of Protection and Registry for the purpose of inspecting all landings.\n\nIf the permit holder fails to comply with the stipulations of this article, the agreed-upon authorization shall be terminated.\n\n(Thus reformed through agreement AJDIP/126 of April 27, 2007)\n\nArticle 5º—Of fishing for swimming crab (jaiva) with pots (nasas): During the period comprised of the months of May, June, and July of each year, fishing for swimming crab (cangrejo jaiva) with pots shall be permitted only to any permit holder (permisionario) with a current Commercial Fishing License for this type of fishing and in the authorized zone(s).\n\nArticle 6º—Of the submission of the list of fishermen eligible for the subsidy.\nThe General Technical Directorate must take the pertinent actions so that, within a period not exceeding 30 calendar days counted from the publication of this regulation, it submits to the administrative and competent bodies of IMAS the preliminary list of fishermen subject to the restrictions and conditions of the closed season (veda) for the Gulf of Nicoya, so that they may be granted the corresponding economic subsidy, once they have fulfilled the obligation of communal work service.\n\nBased on the provisions of Law 8436, only those duly legalized fishermen who are affected by the closed season (veda) shall enjoy this benefit.\n\nArticle 7º—Of the sanctions: In addition to the application of those sanctions established in the Fisheries and Aquaculture Law, Law No. 8436, to all those permit holders (permisionarios) who, during the present closed season (veda), are found by the competent authorities to be infringing the provisions established in this agreement, INCOPESCA, through each of its competent offices, shall proceed to suspend, as a precautionary measure from the moment the infraction is committed until the conclusion of the sanctioning administrative process, the granting of fuel at a preferential price and shall request the Joint Institute of Social Assistance (Instituto Mixto de Ayuda Social, IMAS) that both the permit holders and their assistants be automatically excluded from the lists submitted as potential beneficiaries of the economic aid that this Institution grants during the closed seasons (vedas) established in the Gulf of Nicoya.\n\nArticle 8º—In order to faithfully comply with the provisions of this agreement regarding the fishing gears permitted in the artisanal fishery, it is authorized to only keep on board the authorized handlines (cuerdas de mano) and the authorized longline (línea planera).\n\nArticle 9º—Let it be published."
