las facultades\nconferidas en los artículos 140, incisos 3) y 18), y 146 de\nla Constitución Política;\nlos artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2), acápite b de\nla Ley Nº 6227, Ley General de\nla Administración Pública\ndel 2 de mayo de 1978, los artículos 21, 23, 24 y 25 de\nla Ley Nº 8131, Ley de\nla Administración Financiera\nde la República\ny Presupuestos Públicos del 18 de setiembre del 2001 y sus reformas y su\nReglamento.\n\n \n\n \n\nConsiderando:\n\n \n\n \n\nI.-Que\ncon el fin de lograr una mayor eficiencia en la asignación de los recursos\npúblicos, es de especial relevancia racionalizar su uso, sin menoscabo de la\natención en el sector social.\n\n II.-Que en aras de una política fiscal\nresponsable y financieramente sostenible, en concordancia con las prioridades,\nobjetivos y estrategias fijadas en el Plan Nacional de Desarrollo elaborado por\nel Ministerio de Planificación Nacional y Política Económica (MIDEPLAN), y de\nacuerdo con las proyecciones macroeconómicas realizadas por el Ministerio de\nHacienda (MH) y el Banco Central de Costa Rica (BCCR), es necesario establecer\ndirectrices que regulen el crecimiento del gasto público. \n\nIII.-Que\nla Autoridad\n Presupuestaria (AP) de conformidad con los artículos 1º, 9º,\n21, 23, 24 y 25 de la Ley Nº\n8131, Ley de la\n Administración Financiera de\nla República y Presupuestos Públicos\npublicada en La Gaceta Nº\n198 del 16 de octubre del 2001, sus reformas y su Reglamento, está facultada\npara formular las directrices de política presupuestaria para las entidades\ncubiertas por su ámbito.\n\nIV.-Que\nla Autoridad Presupuestaria\nformuló las directrices y demás regulaciones mediante el acuerdo Nº 8025,\ntomado en la sesión ordinaria Nº 3-2007, celebrada el 20 de febrero del 2007.\n\nV.-Que los Decretos Ejecutivos Nº\n33401-MP-MINAE-HMIDEPLAN, publicado en\nLa Gaceta Nº 204 del 25 de\noctubre del 2006 y Nº 33555-MP-H-MIDEPLAN, publicado en\nLa Gaceta Nº 24 del 2 de\nfebrero del 2007, se promulgaron en el marco de un proceso de reestructuración,\nfortalecimiento y modernización del Instituto Costarricense de Electricidad y\nsus empresas -definidas como Radiográfica Costarricense Sociedad Anónima,\nCompañía Nacional de Fuerza y Luz Sociedad Anónima y Compañía Radiográfica\nInternacional de Costa Rica Sociedad Anónima- y del Instituto Nacional de\nSeguros.\n\nVI.-Que\nel Consejo de Gobierno conoció las directrices y regulaciones en el artículo\nsétimo en la sesión número treinta y seis, celebrada el siete de marzo del dos\nmil siete. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nDirectrices de\nPolítica Presupuestaria para las Entidades\n\nPúblicas, Ministerios\ny demás Órganos según\n\ncorresponda,\ncubiertos por el Ámbito\n\nde\nla Autoridad Presupuestaria,\n\npara\nel Año 2008\n\n \n\n \n\nCAPÍTULO I\n\n \n\nDel gasto\npresupuestario\n\n \n\n \n\nArtículo 1º-El gasto\npresupuestario de las entidades públicas, para el año 2008, podrá incrementarse\nhasta un máximo de 6% con respecto al gasto presupuestario máximo autorizado\npara el 2007, según artículo 1º del Decreto Ejecutivo Nº 32973-H y sus\nreformas, publicado en La\n Gaceta Nº 64 del 30 de marzo del 2006; del cual se\ndeducirán las ampliaciones a dicho gasto que corresponden a gastos no\nrecurrentes.\n\nPara aquellas entidades que ingresen\nal ámbito de la AP,\nla Secretaría Técnica\nde la Autoridad\n Presupuestaria (STAP) comunicará el gasto presupuestario\nmáximo, considerando el porcentaje de crecimiento antes indicado.\n\nLos montos autorizados\nresultantes serán comunicados por la\n STAP a más tardar el 30 de abril del 2007.\n\nLas entidades públicas,\nministerios y demás órganos, deberán dar prioridad al financiamiento para\natender las acciones estratégicas consideradas en el Plan Nacional de\nDesarrollo (PND). \n\nEn caso de que el gasto presupuestario\nmáximo establecido, no permita a alguna entidad financiar en su totalidad las\nacciones estratégicas, y ésta cuente con recursos propios, la misma podrá\nsobrepasar el 6% para dar contenido presupuestario a dichas acciones,\nsolicitando el trámite respectivo a\nla Autoridad Presupuestaria.\n\nEn el caso de los ministerios,\ncorresponderá al Ministerio de Hacienda asignar los recursos adicionales a\ndicho porcentaje, según las posibilidades fiscales, considerando las\nprioridades establecidas en el PND. \n\n    (Modificado por el artículo 1° del decreto\nejecutivo N° 33816 del 30 de mayo del 2007, de la siguiente forma: \"Modificase\na la\n Autoridad Reguladora de los Servicios Públicos,\nel gasto presupuestario máximo para el  2008, quedando el límite de gasto\npresupuestario en la suma de ¢4.007.840,00 (cuatro mil siete millones\nochocientos cuarenta mil colones sin céntimos).\n\n  (Modificado por el artículo 1° del decreto ejecutivo N° 33939\ndel 21 de junio del 2007, de la siguiente forma: \"Modificase\npara\nel Consejo de Salud Ocupacional, el gasto presupuestario máximo para el \n2008,\nquedando el límite de gasto presupuestario en la suma de ¢168.860.000,00\n(ciento sesenta y ocho millones ochoscientos sesenta\nmil colones con cero céntimos)\").\n\n(Modificado\npor el artículo 1° del decreto ejecutivo N° 33976 del 22 de agosto del 2007, de\nla siguiente forma: \"Modificase para\nel Instituto Costarricense de Turismo, el gasto presupuestario máximo para\nel  2008, quedando el límite de gasto presupuestario en la suma de ¢10.461.375.000,00 (diez mil\ncuatrocientos sesenta y un millones trescientos setenta y cinco mil colones\nexactos) para ese período).\n\n(Modificado por el\nartículo 1° del decreto ejecutivo N° 33977 del 03 de setiembre del 2007, de la\nsiguiente forma: \"Modificase para el Consejo de Seguridad Vial (COSEVI), el gasto\npresupuestario máximo para el  2008, quedando el límite de gasto presupuestario en la suma de\n¢9.577.237.517,00 (nueve mil quinientos setenta y siete millones doscientos\ntreinta y siete mil quinientos diecisiete colones exactos), para ese\nperíodo.\"). *(Mediante el artículo 1º del decreto ejecutivo\nN° 34556\ndel 06 de mayo del\n2008, se modifica el gasto período.\n\n(Modificado\npor el artículo 1° del decreto ejecutivo N° 34022*del 05 de setiembre del 2007,\nde la siguiente forma: \"Modificase al\nInstituto Costarricense del Deporte y\nla Recreación, N° 34722 del 18 de agosto de 2008, de la siguiente manera:\n\"Modifícase para\nla Junta Administrativa\nde la Imprenta Nacional, el gasto presupuestario máximo para el 2008,\nquedando el límite de gasto presupuestario en la suma de ¢3.071.537.000,00\n(tres mil setenta y un millones quinientos treinta y siete mil colones exactos)\npara ese período.\n\n(Modificado por el artículo 1° del decreto ejecutivo N° 34809 del 10 de octubre de 2008, de la\nsiguiente manera: \"Modificase para el Consejo Nacional para Investigaciones Cientificas y\nTecnológicas, el gasto presupuestario máximo para el cinco mil seiscientos veinte colones sin céntimos ) para ese período).\n\n (Mediante el artículo 1° del decreto ejecutivo N° 34856 del 22 de octubre de 2008, se modifica para\nel Patronato Nacional de Rehabilitación, el gasto presupuestario máximo para el 2008, quedando el\nlímite en la suma de ¢254.000.000,00 (doscientos cincuenta y cuatro millones de colones exactos),\npara ese período)\n\n (Mediante el artículo 1° del decreto ejecutivo N° 34874 del 23 de octubre de 2008, se modifica para\nla Comisión Nacional de Asuntos Indígenas, el gasto presupuestario máximo para el 2008, quedando el\nlímite en la suma de ¢271.440.000,00 (doscientos setenta y un millones cuatrocientos cuarenta mil\ncolones exactos), para este período)\n\n(Mediante el artículo 1° del\ndecreto ejecutivo N° 34854 del 23 de octubre de 2008, se modifica para el Museo\nde Arte y Diseño Contemporáneo, el gasto presupuestario máximo para el 2008,\nquedando el límite  en la suma de ¢107.281.600,82 (ciento siete millones\ndoscientos ochenta y un mil seiscientos colones con ochenta y dos céntimos),\npara ese período)\n\nArtículo\n2º-Para la aplicación del artículo anterior, se excluyen del gasto\npresupuestario los siguientes conceptos:\n\n \n\na) \nPara todas las entidades y demás órganos, según corresponda:\n\n1. \nRecursos asignados a proyectos de inversión, entendidos éstos como un conjunto\nde obras de infraestructura que incluyen las acciones del sector público,\ntendientes a la creación, ampliación y/o conservación de los bienes de\ncapital del país, según su programación y recursos financieros disponibles.\n\n \n\n2. \nSumas sin asignación presupuestaria.\n\n \n\n3. \nAmortización.\n\n \n\n4. \nIntereses y comisiones sobre deuda interna y externa.\n\n \n\n5. \nAdquisición de valores.\n\n \n\n6. \nMontos ordenados en resoluciones administrativas firmes y en resoluciones\njudiciales con carácter de cosa juzgada material en firme.\n\n \n\n7. \nImpuestos por transferir.\n\n \n\n8. \nOtros recursos que se transfieren al Fondo General de Gobierno (incluye\ndonaciones de títulos valores).\n\n \n\n9. \nImpuestos sobre ingresos y utilidades.\n\n \n\n10. Contribuciones\nPatronales al Desarrollo y la Seguridad Social, Contribuciones Patronales a\nFondos de Pensiones obligatorios y complementarios y Otros Fondos de\nCapitalización.\n\n \n\n11. Reintegros\no devoluciones al Fondo de Desarrollo Social de Asignaciones Familiares\n(FODESAF).\n\n \n\n12. Recursos\nprovenientes del FODESAF que reciben las instituciones para su uso en diversos\nprogramas sociales.\n\n \n\n13. Montos\nasignados para la atención de lo dispuesto en Ley Nº 7972, Creación de Cargas\nTributarias sobre Licores, Cervezas y Cigarrillos para Financiar un Plan\nIntegral de Protección y Amparo de la Población Adulta Mayor, Niñas y Niños\nen Riesgo Social, Personas Discapacitadas Abandonadas, Rehabilitación de Alcohólicos\ny Farmacodependientes, Apoyo a las Labores de la Cruz Roja y Derogación de\nImpuestos Menores sobre las Actividades Agrícolas y su Consecuente Sustitución.\n\n \n\n14. Recursos\nque transfieran las entidades públicas a la Comisión Nacional de Prevención\nde Riesgos y Atención de Emergencias, de conformidad con lo que establece la\nLey Nº 8488, Ley Nacional de Emergencias y Prevención del Riesgo.\n\n \n\n15. Recursos\norientados a proyectos y programas en apoyo a la Ley Nº 7600 Ley de Igualdad de\nOportunidades para las Personas con Discapacidad.\n\n \n\n16.\nCanon Autoridad Reguladora de los Servicios Públicos (ARESEP).\n\n \n\n17. Recursos\nque transfieran las entidades públicas y demás órganos al Instituto\nCostarricense del Deporte y la Recreación (ICODER) Ley Nº 7800, Ley de (RECOPE)\n- Impuesto único a los combustibles; compra de materia prima; compra de\nproducto terminado; transporte y fletes internacionales; seguros por importación\nde hidrocarburos; canon aviación civil; comisión sobre tarjetas de crédito; póliza\ntodo riesgo, daño físico y póliza responsabilidad civil por venta de\ncombustible de aviación-aeropuertos.\n\n \n\nServicio\nNacional de Aguas Subterráneas, Riego y Avenamiento (SENARA)\n- Transferencia al Instituto Nacional de Innovación y Transferencia en Tecnología\nAgropecuaria (INTA), Ley Nº 8149, Ley del Instituto Nacional de Innovación y\nTransferencia en Tecnología Agropecuaria y sus reformas.\n\n \n\nTeatro\nNacional\n- Transferencias a: Museo de Arte Costarricense, Teatro Popular Melico Salazar\npara la Compañía Nacional de Teatro y Centro Nacional de la Música, según\nLey Nº 3632, Declara Monumento al Teatro Nacional e Impuesto Espectáculos Públicos\ny Ley Nº 5780, Distribuye Impuesto a favor del Teatro Nacional y el Decreto Nº\n27762-H-C, Reglamento para la Aplicación del Impuesto sobre Espectáculos Públicos\ncreados por Leyes Nº 3 del 14/12/1918 y Nº 37 del 23/12/1943 y reformas.\n\n \n\n(Así reformado por el artículo 1° del\ndecreto ejecutivo N° 34471 del 7 de abril de 2008)\n\nCAPÍTULO II\n\n \n\nDe las inversiones financieras\n\n \n\nArtículo 3º-Las inversiones\nfinancieras se regirán por las siguientes disposiciones:\n\n \n\na)                 \nLas nuevas adquisiciones de activos financieros\na plazo en moneda nacional o extranjera, o la renovación de este tipo de\noperaciones, con excepción de lo que establecen los incisos e), g) y h) de este\nmismo artículo, se harán únicamente en títulos de deuda interna del Gobierno,\nque ofrecerá el Ministerio de Hacienda (MH), según el siguiente detalle:\n\n \n\n| Plazo en moneda nacional | Tipo de título |\n| --- | --- |\n| Menor o igual a 30 días - | Cero cupón del MH o bien pagaré del Tesoro |\n| Mayor a 30 a menos de 365 días - | Cero cupón del MH, TUDES o pagaré del Tesoro. |\n| Igual o mayor a un año plazo - | TUDES del MH o bonos de Renta Fija |\n\n \n\n \n\nLo anterior, según las\ncondiciones de rendimiento que defina el MH. \nEn caso de que la programación financiera de\nla Dirección de\nTesorería Nacional o la\n Política de Endeudamiento Público indique que no se requiere\nla captación de recursos de las instituciones públicas,\nla Dirección de\nTesorería Nacional podrá autorizar a las instituciones de forma temporal, para\nque puedan invertir en los instrumentos de corto plazo del Banco Central de Costa\nRica (BCCR). Las entidades invertirán en colones y unidades de desarrollo según\nsea la política del MH. Las inversiones en dólares únicamente se aceptarán de manera\nexcepcional y la\n Dirección de Tesorería Nacional podrá en caso de que por\nalguna razón el plazo y monto de la inversión no sea de interés del MH\nautorizar a la entidad a colocar los recursos de manera temporal en los bancos\ndel Estado.\n\nb)         Las inversiones de las entidades públicas, en valores emitidos por el Estado, deberán\nrealizarse mediante compra directa en el MH o por medio de los mecanismos que éste autorice en su\noportunidad.  También podrán realizarse en el BCCR de forma excepcional según lo indicado en el\ninciso a).\n\nc)         Las entidades públicas financieras podrán invertir recursos\npropios según lo dispuesto en el Decreto Nº 32546-H, Reforma al Reglamento a\nla Ley de Reestructuración de\nla Deuda Pública,\npublicado en La Gaceta Nº\n157 del 17 de agosto del 2005.\n\nd)         Para lograr una mejor distribución de la cartera de\nvencimientos y apoyar las acciones del MH, las entidades públicas ajustarán la programación\nfinanciera a efecto de que las inversiones se realicen al mayor plazo posible,\nmanteniendo sólo en sus cuentas corrientes el saldo mínimo para la operatividad\nde cada entidad.\n\ne)         Las entidades públicas renovarán las inversiones en títulos\nvalores en las mutuales de ahorro y préstamo para la vivienda (Mutuales de Alajuela,\nCartago, La Vivienda).\nEste monto no podrá sobrepasar el saldo que se mantenía en cada una de ellas al\n31 de diciembre de 1993.\n\nf)          Las entidades públicas, no podrán invertir recursos en\ncolones o en dólares en ningún tipo de Fondo de Inversión, cuentas corrientes y\ncuentas de ahorro que se manejen como inversiones a la vista, cuentas con\nfondos pactados ni en ninguna otra figura de depósito excepto lo indicado en el\ninciso d) anterior.\n\ng)         Las inversiones en activos financieros para respaldar\ngarantías judiciales y otras cauciones ordenadas por el Poder Judicial, podrán realizarse\nen la entidad bancaria que éste indique.\n\nh)         Las entidades públicas, podrán orientar recursos hacia\ncartas de crédito y garantías para realizar transacciones con proveedores en el\nexterior y reservas para obligaciones financieras también en el exterior, en\naquellos casos en que así se amerite por razones de carácter contractual.\n\nCAPÍTULO III\n\n \n\nDe la deuda pública\n\n \n\nArtículo 4º-El Sector Público no\nFinanciero, podrá mantener hasta un 35% del saldo total de su deuda interna en\nel Sistema Bancario Nacional.\n\nArtículo 5º-Las entidades públicas, ministerios y demás órganos según\ncorresponda, podrán solicitar autorización para contratar créditos internos y\nexternos para el financiamiento de proyectos, siempre y cuando:\n\na)         Se trate de proyectos\ndefinidos como prioritarios por parte del Gobierno de\nla República de conformidad\ncon el PND o el Plan Nacional de Inversión Pública, o en caso de emergencia\nnacional sea necesario destinar recursos a la compra de bienes y servicios o la\nrealización de obras.\n\nb)         La ejecución, pago de\nintereses y comisiones, estén contemplados dentro de los montos del gasto\npresupuestario máximo, establecidos para cada entidad y ministerio.\n\nc)         Cumplan con lo estipulado\nen el Procedimiento para el endeudamiento público que emita la Dirección\nGeneral de Gestión de Deuda Pública (*) como órgano rector del Subsistema de Crédito Público.\n\n \n\n(*)(Así modificada su denominación por el artículo 4 de la\nLey de Fortalecimiento de la gestión de la deuda pública, N° 10524 del 18 de\nsetiembre del 2024. Anteriormente indicaba \"Dirección de\nCrédito Público\")\n\nArtículo 6° -Las entidades públicas que utilicen líneas de crédito, deberán\nseguir el procedimiento que estipule la Dirección General de Gestión de Deuda\nPública (*).\n\n(*)(Así modificada su denominación por el artículo 4 de la\nLey de Fortalecimiento de la gestión de la deuda pública, N° 10524 del 18 de\nsetiembre del 2024. Anteriormente indicaba \"Dirección de\nCrédito Público\")\n\nCAPÍTULO IV\n\n \n\nDe la programación y evaluación\n\n \n\n    Artículo\n7º-Las entidades públicas, ministerios y demás órganos según corresponda,\naplicarán los lineamientos técnicos y metodológicos para la elaboración,\nseguimiento y evaluación del Plan Operativo institucional (POI), elaborados por\nel MH y MIDEPLAN, en coordinación con la Contraloría General de la República\ny emitidos por el Poder Ejecutivo.\n\n \n\n(Así reformado por el artículo 1° del\ndecreto ejecutivo N° 34471 del 7 de abril de 2008)\n\nArtículo 8º-Las entidades\npúblicas, ministerios y demás órganos según corresponda deberán ordenar sus\nprioridades, de manera que sus presupuestos incluyan los recursos para\nfinanciar las Authority,\n\nfor\nthe Year 2008\n\nCHAPTER I\n\nOf budgetary\nexpenditure\n\nArticle 1.-The budgetary\nexpenditure of public entities, for the year 2008, may increase\nup to a maximum of 6% with respect to the maximum authorized budgetary expenditure\nfor 2007, according to article 1 of Executive Decree Nº 32973-H and its\namendments, published in La Gaceta\nNº 64 of March 30, 2006; from which the\nextensions to said expenditure corresponding to non-recurring expenditures will be deducted.\n\nFor those entities that enter\nthe scope of the AP,\nthe Technical Secretariat\nof the Budgetary Authority (STAP) will communicate the maximum budgetary\nexpenditure, considering the growth percentage indicated above.\n\nThe resulting authorized\namounts will be communicated by the\n STAP no later than April 30, 2007.\n\nPublic entities,\nministries and other bodies, must prioritize financing to\naddress the strategic actions considered in the National Development Plan Resources that public entities transfer to the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, in accordance with the provisions of Law No. 8488, Ley Nacional de Emergencias y Prevención del Riesgo.\n\n15. Resources directed to projects and programs in support of Law No. 7600, Ley de Igualdad de Oportunidades para las Personas con Discapacidad.\n\n16. Levy for the Autoridad Reguladora de los Servicios Públicos (ARESEP).\n\n17. In case the financial programming of the Dirección de Tesorería Nacional or the Política de Endeudamiento Público indicates that the raising of resources from public institutions is not required, the Dirección de Tesorería Nacional may temporarily authorize institutions to invest in short-term instruments of the Banco Central de Costa Rica (BCCR). The entities shall invest in colones and development units according to the policy of the MH. Investments in dollars will only be accepted on an exceptional basis, and the Dirección de Tesorería Nacional may, if for any reason the term and amount of the investment is not of interest to the MH, authorize the entity to temporarily place the resources in state banks.\n\nb) Investments by public entities in securities issued by the State must be carried out through direct purchase at the MH or through the mechanisms it authorizes in due course. They may also be carried out at the BCCR on an exceptional basis, as indicated in subsection a).\n\nc) Public financial entities may invest their own resources according to Decree No. 32546-H, Reforma al Reglamento a la Ley de Reestructuración de la Deuda Pública, published in La Gaceta No. 157 of August 17, 2005.\n\nd) To achieve a better distribution of the maturity portfolio and support the actions of the MH, public entities shall adjust their financial programming so that investments are made for the longest possible term, maintaining only the minimum balance in their current accounts for the operational needs of each entity.\n\ne) Public entities shall renew investments in securities at mutual savings and loan associations for housing (Mutuales de Alajuela, Cartago, La Vivienda). This amount may not exceed the balance held in each one as of December 31, 1993.\n\nf) Public entities may not invest resources in colones or dollars in any type of Investment Fund, current accounts and savings accounts managed as sight investments, accounts with agreed-upon funds, or any other deposit modality, except as indicated in subsection d) above.\n\ng) Investments in financial assets to back judicial guarantees and other sureties ordered by the Judicial Branch may be made at the banking institution it indicates.\n\nh) Public entities may direct resources toward letters of credit and guarantees to conduct transactions with foreign suppliers, and reserves for financial obligations also abroad, in cases merited for contractual reasons.\n\nCHAPTER III\n\nOn public debt\n\nArticle 4.-The Non-Financial Public Sector may maintain up to 35% of the total balance of its domestic debt in the Sistema Bancario Nacional.\n\nArticle 5.-Public entities, ministries, and other bodies, as applicable, may request authorization to contract internal and external loans for project financing, provided that:\n\na) The projects are defined as priorities by the Government of the Republic in conformity with the PND or the Plan Nacional de Inversión Pública, or in case of a national emergency it is necessary to allocate resources to the purchase of goods and services or the execution of works.\n\nb) The execution, payment of interest, and commissions are contemplated within the maximum budgetary expenditure amounts established for each entity and ministry.\n\nc) They comply with the stipulations of the Procedure for public indebtedness issued by the Dirección General de Gestión de Deuda Pública (*) as the governing body of the Subsistema de Crédito Público.\n\n(*)(Thus modified in its name by Article 4 of the Ley de Fortalecimiento de la gestión de la deuda pública, No. 10524 of September 18, 2024. Previously it stated \"Dirección de Crédito Público\")\n\nCHAPTER IV\n\nOn programming and evaluation\n\nArticle 7º.-Public entities, ministries, and other bodies, according to what is applicable, shall apply the technical and methodological guidelines for the preparation, monitoring, and evaluation of the Institutional Operational Plan (Plan Operativo institucional, POI), prepared by the MH and MIDEPLAN, in coordination with the Contraloría General de la República and issued by the Executive Branch.\n\n(Thus amended by Article 1 of Executive Decree No. 34471 of April 7, 2008)\n\nArticle 8º.-Public entities, ministries, and other bodies, according to what is applicable, must organize their priorities so that their budgets include the resources to finance the strategic actions of the PND that are their exclusive competence or to which they must contribute for their execution.\n\nCHAPTER V\n\nOn final provisions\n\nArticle 9º.-For the purpose of follow-up and information, the public entities, ministries, and other bodies referred to in Article 1 of the Ley de la Administración Financiera de la República y Presupuestos Públicos shall observe the Procedures issued for the application and monitoring of these directives, as applicable.\n\nArticle 10.-When the supreme head of a public entity, ministry, or some body approves an administrative restructuring, with the respective authorization of the Minister Rector of the Sector to which it belongs, and if any cost associated with it is generated, this shall be included in the authorized maximum budgetary expenditure.\n\n(Thus amended by Article 1 of Executive Decree No. 34471 of April 7, 2008)\n\nArticle 11.-Non-compliance with the provisions of these directives may result in the application of the liability regime of Law No. 8131, established in Title X, Articles 107 and following.\n\nArticle 12.-The Executive Branch shall establish the procedures to be followed for the application of these directives through an Executive Decree.\n\nArticle 13.-These directives shall not apply to the Instituto Nacional de Seguros and the Instituto Costarricense de Electricidad and its companies, considering the framework of their restructuring, strengthening, and modernization process.\n\nArticle 14.-For the formulation of budgets, it takes effect upon its publication, and for the execution thereof, from January 1, 2008.\n\nGiven at the Presidency of the Republic.—San José, on the ninth day of the month of March of two thousand seven." }
