El texto es el siguiente:\n\n \n\n\"CONVENCIÓN SOBRE\nLA CONSERVACIÓN DE LAS ESPECIES MIGRATORIAS DE ANIMALES SILVESTRES\n\nLas Partes Contratantes,\n\nRECONOCIENDO que la fauna\nsilvestre, en sus numerosas formas, constituye un elemento irremplazable de los\nsistemas naturales de la tierra, que tiene que ser conservado para el bien de\nla humanidad;\n\nCONSCIENTES de que cada\ngeneración humana administra los recursos de la tierra para las generaciones\nfuturas y tiene el deber de que dicho legado se conserve y de que cuando esté\nsujeto a uso se haga con prudencia;\n\nCONSCIENTES del creciente valor\nque adquiere la fauna silvestre desde los puntos de vista medio-ambiental,\necológico, genético, científico, estético, recreativo, cultural, educativo,\nsocial y económico;\n\nPREOCUPADAS EN PARTICULAR por las\nespecies de animales silvestres que en sus migraciones franquean los límites de\njurisdicciones nacionales o cuyas migraciones se desarrollan fuera de dichos\nlímites;\n\nRECONOCIENDO que los Estados son\ny deben ser los protectores de las especies migratorias de animales silvestres\nque viven dentro de los límites de su jurisdicción nacional o que los\nfranquean;\n\nCONVENCIDAS de que la\nconservación así como el eficaz cuidado y aprovechamiento de las especies\nmigratorias de animales silvestres requieren una acción concertada de todos los\nEstados dentro de cuyos límites de jurisdicción nacional pasan dichas especies\nalguna parte de su ciclo biológico;\n\nRECORDANDO la Recomendación 32\ndel Plan de acción adoptado por la Conferencia de las Naciones Unidas sobre el\nmedio ambiente humano (Estocolmo, 1972), del que la Asamblea General de las\nNaciones Unidas tomó nota con satisfacción en su vigésima séptima sesión;\n\nHAN ACORDADO LO SIGUIENTE:\n\n \n\nArtículo I\n\n \n\nDefiniciones\n\n \n\n1.         Para\nlos fines de la presente Convención:\n\na)         \"especie migratoria\" significa el conjunto de la\npoblación, o toda parte de ella geográficamente aislada, de cualquier especie o\ngrupo taxonómico inferior de animales silvestres, de los que una parte\nimportante franquea cíclicamente y de manera previsible, uno o varios límites\nde jurisdicción nacional;\n\nb)         \"estado de conservación de una especie migratoria\"\nsignifica el conjunto de las influencias que actuando sobre dicha especie\nmigratoria pueden afectar a la larga a su distribución y a su cifra de\npoblación;\n\nc)         \"el estado de conservación\" será considerado como\n\"favorable\" cuando:\n\n \n\n(1)        los datos relativos a la dinámica de las poblaciones de\nla especie migratoria en cuestión indiquen que esta especie continuará por largo\ntiempo constituyendo un elemento viable de los ecosistemas a que pertenece;\n\n(2)        la extensión del área de distribución de esta especie\nmigratoria no disminuya ni corra el peligro de disminuir a largo plazo;\n\n(3)        exista y seguirá existiendo en un futuro previsible, un\nhábitat suficiente para que la población de esta especie migratoria se mantenga\na largo plazo; y\n\n(4)        la distribución y los efectivos de la población de esta\nespecie migratoria se acerquen por su extensión y su número a los niveles\nhistóricos en la medida en que existan ecosistemas potencialmente adecuados a\ndicha especie, y ello sea compatible con su prudente cuidado y aprovechamiento;\n\n \n\nd)         \"el estado de conservación\" será considerado como\n\"desfavorable\" cuando una cualquiera de las condiciones enunciadas en el\nsubpárrafo c) no se cumpla;\n\ne)         \"en peligro\" significa, para una determinada especie\nmigratoria, que ésta está amenazada de extinción en el total o en una parte\nimportante de su área de distribución;\n\nf)          \"área de distribución\" significa el conjunto de superficies\nterrestres o acuáticas que una especie migratoria habita, frecuenta\ntemporalmente, atraviesa o sobrevuela en un momento cualquiera a lo largo de su\nitinerario habitual de migración;\n\ng)         \"hábitat\" significa toda zona en el interior del área de\ndistribución de una especie migratoria que ofrece las condiciones de vida\nnecesarias a la especie en cuestión;\n\nh)         \"Estado del área de distribución\" significa, para una\ndeterminada especie migratoria, todo Estado (y, dado el caso, toda otra Parte\nmencionada en el sub-párrafo k)) que ejerza su\njurisdicción sobre una parte cualquiera del área de distribución de dicha\nespecie migratoria, o también, un Estado bajo cuyo pabellón naveguen buques\ncuya actividad consista en sacar de su ambiente natural, fuera de los límites\nde jurisdicción nacional, ejemplares de la especie migratoria en cuestión;\n\ni)          \"sacar de su ambiente natural\" significa tomar, cazar,\npescar, capturar, hostigar, matar con premeditación o cualquier otro intento\nanálogo;\n\n \n\nj)          \"ACUERDO\" significa un convenio internacional para la\nconservación de una o varias especies migratorias conforme a los\n\nArtículos IV y V de la presente\nConvención; y\n\nk)         \"Parte\" significa un Estado o cualquier organización\nregional de integración económica constituida por Estados soberanos, para el\ncual está vigente la presente Convención y que tenga competencia para negociar,\nconcluir y aplicar acuerdos internacionales en materias cubiertas por la\npresente Convención.\n\n \n\n2. Tratándose de cuestiones que caen bajo su competencia,\nlas organizaciones regionales de integración económica. Partes de la presente\nConvención, son en su propio nombre sujetos de todos los derechos y deberes que\nla presente Convención confiere a sus Estados miembros; en estos casos, los\nEstados miembros no pueden ejercer separadamente dichos derechos.\n\n \n\n3. Cuando la presente Convención prevé que una\ndecisión debe tomarse por mayoría de dos tercios o por unanimidad de las\n\"Partes presentes y votantes\", eso significa \"las Partes presentes y que se han\nmanifestado por un voto afirmativo o negativo\". Para determinar la mayoría, las\nPartes que se han abstenido no se cuentan entre las \"presentes y votantes\".\n\nArtículo II\n\n \n\nPrincipios\nfundamentales\n\n \n\n1.         Las\nPartes reconocen la importancia de la conservación de las especies migratorias\ny de las medidas a convenir para este fin por los Estados del área de\ndistribución, siempre que sea posible y apropiado, concediendo particular\natención a las especies migratorias cuyo estado de conservación sea\ndesfavorable; el mismo reconocimiento se extiende también a las medidas\napropiadas y necesarias, por ellas adoptadas separada o conjuntamente, para la\nconservación de tales especies y de su hábitat.\n\n2.         Las\nPartes reconocen la necesidad de adoptar medidas a fin de evitar que una\nespecie migratoria pase a ser una especie amenazada.\n\n3.         En\nparticular, las Partes:\n\n \n\na)         deberían promover, apoyar o cooperar a investigaciones\nsobre especies migratorias;\n\nb)         se esforzarán por conceder una protección inmediata a\nlas especies migratorias enumeradas en el Apéndice I; y\n\nc)         deberán procurar la conclusión de ACUERDOS sobre la conservación,\ncuidado y aprovechamiento de las especies migratorias enumeradas en el Apéndice\nII.\n\nArtículo III\n\n \n\nEspecies\nmigratorias en peligro: Apéndice I\n\n \n\n1.         El\nApéndice I enumera las especies migratorias en peligro.\n\n2.         Una\nespecie migratoria puede ser incluida en el Apéndice I si pruebas dignas de\nconfianza, que incluyen los mejores datos científicos disponibles, demuestran\nque dicha especie está en peligro.\n\n3.         Una\nespecie migratoria puede ser eliminada del Apéndice I si la\n\nConferencia de las Partes constata\n\n \n\na)         que pruebas dignas de confianza, que incluyen los\nmejores datos científicos disponibles, demuestran que dicha especie ya no está\nen peligro; y\n\nb)         que dicha especie no corre el riesgo de verse de nuevo\nen peligro si ya no existe la protección que le daba la inclusión en el\nApéndice I.\n\n \n\n4.         Las\nPartes que sean Estados del área de distribución de una especie migratoria que\nfigura en el Apéndice I se esforzarán por:\n\n \n\na)         conservar y, cuando sea posible y apropiado, restaurar\nlos hábitats que sean importantes para preservar dicha especie del peligro de extinción;\n\nb)         prevenir, eliminar, compensar o minimizar en forma\napropiada, los efectos negativos de actividades o de obstáculos que dificultan seriamente\no impiden la migración de dicha especie; y\n\nc)         prevenir, reducir o controlar, cuando sea posible y\napropiado, los factores que actualmente ponen en peligro o implican el riesgo\nde poner en peligro en adelante a dicha especie, inclusive controlando estrictamente\nla introducción de especies exóticas, o vigilando o eliminando las que hayan\nsido ya introducidas.\n\n \n\n5.         Las\nPartes que sean Estados del área de distribución de una especie migratoria que\nfigure en el Apéndice I prohibirán sacar de su ambiente natural animales de esa\nespecie. Las excepciones a esta prohibición sólo estarán permitidas:\n\n \n\na)         cuando la captura sirva a finalidades científicas;\n\nb)         cuando la captura esté destinada a mejorar la\npropagación o la supervivencia de la especie en cuestión;\n\nc)         cuando la captura se efectúe para satisfacer las necesidades\nde quienes utilizan dicha especie en el cuadro de una economía tradicional de\nsubsistencia; o\n\nd)         cuando circunstancias excepcionales las hagan\nindispensables;\n\n \n\nestas excepciones deberán ser exactamente determinadas en\ncuanto a su contenido, y limitadas en el espacio y en el tiempo. Tal hecho de\nsacar de su ambiente natural no deberá actuar en detrimento de dicha especie.\n\n \n\n6.        \nLa Conferencia de las\nPartes puede recomendar, a las Partes que sean Estados del área de distribución\nde una especie migratoria que figura en el Apéndice I, que adopten cualquier\notra medida que se juzgue apropiada para favorecer a dicha especie.\n\n \n\n7.         Las\nPartes informarán lo más pronto posible a\nla Secretaría de\ntoda excepción concedida conforme al párrafo 5 del presente Artículo.\n\nArtículo IV\n\n \n\nEspecies migratorias que deban ser objeto de ACUERDOS: Apéndice II\n\n \n\n1.         El\nApéndice II enumera las especies migratorias cuyo estado de conservación sea\ndesfavorable y que necesiten que se concluyan acuerdos internacionales para su\nconservación, cuidado y aprovechamiento, así como aquellas cuyo estado de\nconservación se beneficiaría considerablemente de la cooperación internacional\nresultante de un acuerdo internacional.\n\n2.         Si\nlas circunstancias lo exigen, una especie migratoria puede figurar a la vez en\nlos Apéndices I y II.\n\n3.         Las Partes\nque son Estados del área de distribución de las especies migratorias que\nfiguran en el Apéndice II, se esforzarán por concluir ACUERDOS en beneficio de\ndichas especies, concediendo prioridad a las especies que se encuentran en un\nestado desfavorable de conservación.\n\n4.         Se invita a\nlas Partes a adoptar medidas en orden a concluir acuerdos sobre toda población\no toda parte de ella geográficamente aislada, de toda especie o de todo grupo\ntaxonómico inferior de animales silvestres, si individuos de esos grupos\nfranquean periódicamente uno o varios límites de jurisdicción nacional.\n\n5.         Se enviará a\nla Secretaría\nuna copia de cada ACUERDO concluido conforme a las disposiciones del presente\nArtículo.\n\nARTÍCULO V\n\n \n\nDIRECTIVAS SOBRE\nLA CONCLUSIÓN DE\nACUERDOS\n\n \n\n1.         Será\nobjeto de cada ACUERDO volver a poner, o mantener, en estado de conservación\nfavorable a la especie migratoria en cuestión. \nCada ACUERDO tratará todos los aspectos de la conservación, cuidado y aprovechamiento\nde la respectiva especie migratoria, que permitan alcanzar dicho objetivo.\n\n2.         Cada\nACUERDO deberá cubrir el conjunto del área de distribución de la especie\nmigratoria a que se refiere, y estar abierto a la adhesión de todos los Estados\ndel área de distribución de dicha especie, sean o no Partes de la presente\nConvención.\n\n3.         Un\nACUERDO deberá, siempre que sea posible, abarcar más de una especie migratoria.\n\n4.         Cada\nACUERDO deberá\n\n \n\na)         designar la especie migratoria a que se refiere;\n\nb)         describir el área de distribución y el itinerario de\nmigración de dicha especies;\n\nc)         prever que cada Parte designe las autoridades nacionales\nencargadas del cumplimiento del ACUERDO;\n\nd)         establecer, en caso necesario, mecanismos\ninstitucionales apropiados para ayudar al cumplimiento del ACUERDO, velar por su\neficacia y preparar informes para\nla Conferencia de las Partes;\n\ne)         prever procedimientos para la reglamentación de las\ncontroversias que puedan presentarse entre las Partes del ACUERDO; y\n\nf)          como mínimo, prohibir para toda especie migratoria del\norden de los cetáceos cualquier acto que implique sacarla de su ambiente natural\nque no esté permitido por algún acuerdo multilateral sobre la especie\nmigratoria en cuestión, y cuidar de que los Estados que no son Estados del área\nde distribución de dicha especie migratoria, puedan adherirse a dicho ACUERDO.\n\n \n\n5.         Todo\nACUERDO, en la medida en que sea adecuado y posible, debería prever, sin\nlimitarse sin embargo a esto, lo siguiente:\n\n \n\na)         exámenes periódicos del estado de conservación de la\nespecie migratoria en cuestión, así como identificación de factores eventualmente\nnocivos para dicho estado de conservación;\n\nb)         planes coordinados de conservación, cuidado y aprovechamiento;\n\nc)         investigaciones sobre la ecología y la dinámica de\npoblación de la especie migratoria en cuestión, concediendo particular atención\na las migraciones de esta especie;\n\nd)         intercambio de informaciones sobre la especie migratoria\nen cuestión, concediendo particular importancia al intercambio de informaciones\nrelativas a los resultados de las investigaciones y de las correspondientes\nestadísticas;\n\ne)         la conservación y, cuando sea necesario y posible, la\nrestauración de los hábitats que sean importantes para el mantenimiento de un estado\nde conservación favorable, y la protección de dichos hábitats contra\nperturbaciones incluido el estricto control de la introducción de especies\nexóticas nocivas para la especie migratoria en cuestión, o el control de tales\nespecies ya introducidas;\n\nf)          el mantenimiento de una red de hábitats apropiados a la\nespecie migratoria en cuestión, repartidos adecuadamente a lo largo de los itinerarios\nde migración;\n\ng)         cuando ello parezca deseable, la puesta a disposición de\nla especie migratoria en cuestión de nuevos hábitats que les sean favorables, o\nla reintroducción de dicha especie en tales hábitats;\n\nh)         en toda la medida de lo posible, la eliminación de actividades\ny obstáculos que dificulten o impidan la migración, o la toma de medidas que\ncompensen el efecto de estas actividades y obstáculos;\n\ni)          la prevención, reducción, o control de las inmisiones\nde sustancias nocivas para la especie migratoria en cuestión en el hábitat de\ndicha especie;\n\nj)          medidas que estriben en principios ecológicos bien\nfundados y que tiendan a ejercer un control y una regulación de actos que\nimpliquen sacar de su ambiente natural ejemplares de la especie migratoria en cuestión;\n\nk)         procedimientos para coordinar las acciones en orden a la\nrepresión de capturas ilícitas;\n\nl)          intercambio de informaciones sobre las amenazas serias\nque pesen sobre la especie migratoria en cuestión;\n\nm)        procedimientos de urgencia que permitan reforzar\nconsiderable y rápidamente las medidas de conservación en el caso de que el estado\nde conservación de la especie migratoria en cuestión se vea seriamente\nafectado; y\n\nn)         información al público sobre el contenido y los\nobjetivos del\n\nACUERDO.\n\nArtículo VI\n\n \n\nEstados del área\nde distribución\n\n \n\n1.        \nLa Secretaría,\nutilizando las informaciones que reciba de las Partes, mantendrá al día una\nlista de los Estados del área de distribución de las especies migratorias\nenumeradas en los Apéndices I y II.\n\n2.         Las\nPartes mantendrán informada a\nla Secretaría sobre las especies migratorias\nenumeradas en los Apéndices I y II respecto a las cuales se consideren como\nEstados del área de distribución; a estos fines, suministrarán, entre otras\ncosas, informaciones sobre los buques que naveguen bajo su pabellón y que fuera\nde los límites de la jurisdicción nacional lleven a cabo actos que impliquen\nsacar de su ambiente natural ejemplares de las especies migratorias en cuestión\ny, en la medida de lo posible, sobre sus proyectos futuros relativos a dichos\nactos.\n\n3.         Las\nPartes que sean Estados del área de distribución de especies migratorias\nenumeradas en los Apéndices I y II deben informar a\nla Conferencia de las\nPartes, por mediación de\nla Secretaría, y por lo menos 6 meses antes de cada\nreunión ordinaria de la\n Conferencia, sobre las medidas que adoptan para aplicar las\ndisposiciones de la presente Convención con respecto a dichas especies.\n\nArtículo VII\n\n \n\nLa Conferencia\nde las Partes\n\n \n\n1.        \nLa Conferencia de las\nPartes constituye el órgano de decisión de la presente Convención.\n\n2.        \nLa Secretaría\nconvocará una reunión de la\n Conferencia de las Partes a más tardar dos años después de la\nentrada en vigor de la presente Convención.\n\n3.         Posteriormente,\nla Secretaría\nconvocará, con intervalos de 3 años como máximo, reuniones ordinarias de\nla Conferencia de las\nPartes, a menos que la\n Conferencia decida otra cosa, y reuniones extraordinarias en cualquier\nmomento, a solicitud por escrito de por lo menos un tercio de las Partes.\n\n4.        \nLa Conferencia de las\nPartes establecerá el reglamento financiero de la presente Convención y lo\nsometerá a un examen regular. La\n Conferencia de las Partes, en cada una de sus reuniones\nordinarias, aprobará el presupuesto para el ejercicio siguiente. Cada una de\nlas Partes contribuirá a ese presupuesto conforme a una escala de ponderaciones\nque será convenida por la\n Conferencia. El reglamento financiero, comprendidas las disposiciones\nrelativas al presupuesto y a la escala de contribuciones así como sus\nmodificaciones, serán adoptadas por unanimidad de las Partes presentes y\nvotantes.\n\n5.         En\ncada una de sus reuniones, la\n Conferencia de las Partes procederá a un examen de la\naplicación de la presente Convención y podrá en particular:\n\n \n\na)         controlar y constatar el estado de conservación de las\nespecies migratorias;\n\nb)         pasar revista a los progresos realizados en materia de\nconservación de las especies migratorias y en particular de las enumeradas en\nlos Apéndices I y II;\n\nc)         en la medida en que sea necesario, adoptar disposiciones\ny dar directrices que hagan posible al Consejo Científico y a\nla Secretaría el\ncumplimiento de sus funciones;\n\nd)         recibir y considerar los informes presentados por el\nConsejo Científico, la\n Secretaría, una de las Partes o un organismo permanente constituido\nen virtud de un ACUERDO;\n\ne)         formular recomendaciones a las Partes en orden a mejorar\nel estado de conservación de las especies migratorias, y comprobar los progresos\nlogrados en aplicación de los ACUERDOS;\n\nf)          en el caso de que no se haya concertado ningún ACUERDO,\nrecomendar la convocación de reuniones de las Partes que sean Estados del área\nde distribución de una especie migratoria, o de un grupo de especies\nmigratorias, para discutir las medidas destinadas a mejorar el estado de\nconservación de estas especies;\n\ng)         formular recomendaciones a las Partes en orden a mejorar\nla eficacia de la presente Convención; y\n\nh)         decidir toda medida suplementaria que debiera adoptarse\npara la realización de los objetivos de la presente Convención.\n\n \n\n6.        \nLa Conferencia de las\nPartes, en cada una de sus reuniones, debería determinar la fecha y el lugar de\nsu próxima reunión.\n\n7.         En\ntoda reunión, la\n Conferencia de las Partes establecerá y adoptará un\nreglamento para esa misma reunión. Las decisiones de\nla Conferencia de las\nPartes serán tomadas por mayoría de dos tercios de las Partes presentes y\nvotantes, a no ser que en la presente Convención se haya dispuesto otra cosa.\n\n8.         Las\nNaciones Unidas, sus Organismos Especializados, el Organismo Internacional de\nEnergía Atómica, así como cualquier Estado que no sea Parte en la presente\nConvención y, para cada ACUERDO, el órgano designado por las Partes del mismo,\npodrán ser representados por observadores en las reuniones de\nla Conferencia de las\nPartes.\n\n9.         Cualquier\norganismo o entidad de las categorías abajo mencionadas, técnicamente\ncalificado en el campo de la protección, conservación, así como del cuidado y\naprovechamiento de especies migratorias y que haya informado a\nla Secretaría de su\ndeseo de estar representado por observadores en las reuniones de\nla Conferencia de las\nPartes, será admitido, salvo que objeten por lo menos un tercio de las Partes\npresentes:\n\n \n\na)         organismos o entidades internacionales, tanto\ngubernamentales como no gubernamentales, así como organismos o entidades gubernamentales\nnacionales; y\n\nb)         organismos o entidades nacionales no gubernamentales que\nhayan sido autorizados para ese efecto por el Estado en que se encuentran ubicados.\n\n \n\nUna vez admitidos, estos observadores tendrán el derecho de\nparticipar sin voto en la reunión.\n\nArtículo VIII\n\n \n\nEl Consejo\nCientífico\n\n \n\n1.        \nLa Conferencia de las\nPartes, en su primera reunión, instituirá un Consejo Científico encargado de\nasesorar en cuestiones científicas.\n\n2.         Cualquier\nParte puede nombrar un experto calificado como miembro del Consejo Científico.\nEl Consejo Científico comprende además expertos calificados escogidos y\nnombrados como miembros por la\n Conferencia de las Partes. El número de estos expertos, los\ncriterios para su selección, y la duración de su mandato serán determinados por\nla Conferencia\nde las Partes.\n\n3.         El\nConsejo Científico se reunirá a invitación de\nla Secretaría cada\nvez que la Conferencia\nde las Partes lo demanda.\n\n4.         A\nreserva de la aprobación de la\n Conferencia de las Partes, el Consejo Científico establecerá\nsu propio reglamento interno.\n\n5.        \nLa Conferencia de las\nPartes decide las funciones del Consejo Científico. Entre ellas pueden figurar:\n\n \n\na)         El asesoramiento científico a\nla Conferencia de las\nPartes, a la\n Secretaría y, si\nla Conferencia lo aprueba, a toda institución establecida\nen virtud de la presente Convención o de un ACUERDO, o a cualquier Parte;\n\nb)         recomendaciones para trabajos de investigación y\ncoordinación de los mismos sobre las especies migratorias, evaluación de los resultados\nde dichos trabajos de investigación, a fin de comprobar el estado de\nconservación de las especies migratorias, e informes a\nla Conferencia de las\nPartes sobre este estado de conservación, así como sobre las medidas que\npermitan mejorarlo;\n\nc)         recomendaciones a\nla Conferencia de las\nPartes sobre las especies migratorias que deben ser inscritas en los Apéndices\nI y II, inclusive información sobre el área '64e distribución de estas\nespecies;\n\nd)         recomendaciones a\nla Conferencia de las\nPartes sobre las medidas particulares de conservación, así como de cuidado y\naprovechamiento que deben incluirse en los ACUERDOS relativos a las especies migratorias;\ny\n\ne)         recomendaciones a\nla Conferencia de las\nPartes para la solución de problemas relativos a aspectos científicos en la\nrealización de la presente Convención, especialmente los referentes a los\nhábitats de las especies migratorias.\n\nArtículo IX\n\n \n\nLa Secretaría\n\n \n\n1.         A\nfines de la presente Convención se establece una Secretaría.\n\n2.         Al\nentrar en vigor la presente Convención, el Director Ejecutivo del Programa de\nlas Naciones Unidas para el Medio Ambiente proveerá lo necesario para\nla Secretaría. En\nla medida y forma en que lo considere apropiado, podrá ser ayudado por\norganismos y entidades internacionales o nacionales, intergubernamentales o no\ngubernamentales, con competencia técnica en la protección, conservación,\ncuidado, y aprovechamiento de la fauna silvestre.\n\n3.         En el\ncaso de que el Programa de las Naciones Unidas para el Medio Ambiente no se\nencontrase ya en condiciones de organizar\nla Secretaría,\nla Conferencia de las\nPartes tomará las disposiciones necesarias para proveer de otra manera.\n\n4.         Las\nfunciones de la\n Secretaría incluirán las siguientes:\n\n \n\na)      organizar y prestar su asistencia\npara las reuniones:\n\n \n\ni)          de la\n Conferencia de las Partes, y\n\nii)         del Consejo Científico;\n\n \n\nb)         mantener y fomentar las relaciones con y entre las\nPartes, las instituciones permanentes creadas en el marco de los ACUERDOS, y\notras organizaciones internacionales que se ocupan de las especies migratorias;\n\nc)         obtener de todas las fuentes apropiadas informes y otras\ninformaciones útiles para los objetivos y la realización de la presente\nConvención, y cuidar de la adecuada difusión de dichas informaciones;\n\nd)         llamar la atención de\nla Conferencia de las\nPartes sobre todos los asuntos que se relacionen con los objetivos de la\npresente Convención;\n\ne)         elaborar para\nla Conferencia de las Partes, informes sobre la\nlabor de la\n Secretaría y la ejecución de la presente Convención;\n\nf)          llevar y publicar la lista de los Estados del área de\ndistribución de todas las especies migratorias enumeradas en los Apéndices I y\nII;\n\ng)         fomentar, bajo la dirección de\nla Conferencia de las\nPartes, la conclusión de ACUERDOS;\n\nh)         llevar y poner a disposición de las Partes una lista de\nlos ACUERDOS y, si la Conferencia\nde las Partes lo demanda, suministrar toda la información a ellos referente;\n\ni)          llevar y publicar una relación de las recomendaciones\ndadas por la Conferencia\nde las Partes conforme al Artículo VII párrafo 5, subpárrafos e), f) y g), o de\nlas decisiones adoptadas conforme al subpárrafo h) del mismo párrafo;\n\nj)          informar a la opinión pública sobre la presente\nConvención y sus objetivos; y\n\nk)         asumir todas las demás funciones que se le confíen en el\nmarco de la presente Convención o por\nla Conferencia de las Partes.\n\nArtículo X\n\n \n\nEnmiendas a\nla Convención\n\n \n\n1.         La\npresente Convención puede ser enmendada en cualquier reunión ordinaria o\nextraordinaria de la\n Conferencia de las Partes.\n\n2.         Cualquier\nParte podrá proponer enmiendas.\n\n3.         El\ntexto de la enmienda propuesta, así como su motivación, será comunicado a\nla Secretaría con\nuna antelación no menor de 150 días a la fecha de la reunión en la que ha de\ntratarse, y será comunicado sin dilación por\nla Secretaría a\ntodas las Partes. Cualquier observación de las Partes referente al texto de la\npropuesta de enmienda será comunicada a\nla Secretaría por\nlo menos 60 días antes de la apertura de la reunión.\nLa Secretaría,\ninmediatamente después de expirado este plazo, comunicará a las Partes todas\nlas observaciones recibidas hasta ese día.\n\n4.         Las\nenmiendas serán adoptadas por una mayoría de dos tercios de las Partes\npresentes y votantes.\n\n5.         Cualquier\nenmienda adoptada entrará en vigor para todas las Partes que la hayan aceptado\nel día primero del tercer mes siguiente a la fecha en la que dos tercios de las\nPartes hayan depositado ante el Depositario un instrumento de aceptación. Para\ntoda Parte que haya entregado un instrumento de aceptación después de la fecha\nen que lo hayan hecho dos tercios de las Partes, la enmienda entrará en vigor\ncon respecto a dicha Parte el día primero del tercer mes después de haber\nentregado su instrumento de aceptación.\n\nArtículo XI\n\n \n\nEnmiendas a los\nApéndices\n\n \n\n1.         Los\nApéndices I y II pueden ser enmendados en cualquier reunión ordinaria o extraordinaria\nde la Conferencia\nde las Partes.\n\n2.         Cualquier\nParte podrá proponer enmiendas.\n\n3.         El\ntexto de cada enmienda propuesta, así como su motivación, fundada en los\nmejores conocimientos científicos disponibles, será comunicado a\nla Secretaría con\nuna antelación no menor de 150 días a la fecha de la reunión, y será comunicado\nsin dilación por la\n Secretaría a todas las Partes. Las observaciones de las\nPartes referentes al texto de la propuesta de enmienda serán comunicadas a\nla Secretaría por\nlo menos 60 días antes de la apertura de la reunión.\nLa Secretaría,\ninmediatamente después de expirado este plazo, comunicará a las Partes todas\nlas observaciones recibidas hasta ese día.\n\n4.         Las\nenmiendas serán adoptadas por una mayoría de dos tercios de las Partes presentes\ny votantes.\n\n5.         Las\nenmiendas a los Apéndices entrarán en vigor para todas las Partes, a excepción\nde aquellas que hayan formulado una reserva conforme al siguiente párrafo 6, 90\ndías después de la reunión de la\n Conferencia de las Partes en que hayan sido aprobadas.\n\n6.         Durante\nel plazo de 90 días previsto en el precedente párrafo 5, toda Parte podrá,\nmediante notificación escrita al Depositario, formular una reserva a dicha\nenmienda. Una reserva a una enmienda podrá ser retirada mediante notificación\nescrita al Depositario; la enmienda entrará entonces en vigor para dicha Parte\n90 días después de retirada dicha reserva.\n\nArtículo XII\n\n \n\nEfectos de la\n Convención sobre las convenciones internacionales y demás\ndisposiciones legales\n\n \n\n1.         La\npresente Convención no afectará a la codificación y ulterior desarrollo del\nderecho del mar por la\n Conferencia del Derecho del Mar de las Naciones Unidas\nconvocada en aplicación de\nla Resolución 2750 C (XXV) de\nla Asamblea General\nde las Naciones Unidas, así como tampoco a las actuales o futuras\nreivindicaciones y posiciones jurídicas de cualquier Estado relativas al\nderecho del mar así como a la naturaleza y extensión de su competencia ribereña\ny de la competencia que ejerza sobre los buques que naveguen bajo su pabellón.\n\n2.         Las\ndisposiciones de la presente Convención no afectan en modo alguno a los\nderechos y obligaciones de las Partes que se deriven de cualquier tratado,\nconvención o acuerdo actualmente vigente.\n\n3.         Las\ndisposiciones de la presente Convención no afectan en modo alguno al derecho de\nlas Partes a adoptar medidas internas más estrictas en orden a la conservación\nde las especies migratorias enumeradas en los Apéndices I y II o medidas\ninternas en orden a la conservación de las especies no enumeradas en los\nApéndices I y II.\n\nArtículo XIII\n\n \n\nArreglo de\ncontroversias\n\n \n\n1.         Cualquier\ncontroversia que pudiera surgir entre dos o más Partes con respecto a la\ninterpretación o aplicación de las disposiciones de la presente Convención será\nobjeto de negociaciones entre las Partes en la controversia.\n\n2.         Si la\ncontroversia no pudiere resolverse de acuerdo con el párrafo 1 del presente\nArtículo, las Partes podrán, por consentimiento mutuo, someter la controversia\na arbitraje, en especial a\nla Corte Permanente de Arbitraje de\nLa Haya y las Partes que así\nsometan la controversia quedarán obligadas por la decisión arbitral.\n\nArtículo XIV\n\n \n\nReservas\n\n \n\n1.         Las\ndisposiciones de la presente Convención no están sujetas a reservas generales.\nSe podrán hacer reservas específicas de conformidad con lo dispuesto en el\npresente Artículo y el Artículo XI.\n\n2.         Cualquier\nEstado u organización de integración económica regional podrá, al depositar su\ninstrumento de ratificación, aceptación, aprobación, o adhesión, formular una\nreserva específica con relación a la inclusión ya sea en el Apéndice I, o en el\nApéndice II, o en ambos, de cualquier especie migratoria, y no será considerado\ncomo Parte con respecto al objeto de dicha reserva, hasta que hayan pasado 90\ndías desde la notificación del Depositario a las Partes de la retirada de la\nreserva.\n\nArtículo XV\n\n \n\nFirma\n\n \n\nLa presente Convención estará\nabierta en Bonn a la firma de todos los Estados, o de toda organización de\nintegración económica regional, hasta el 22 de junio de 1980.\n\nArtículo XVI\n\n \n\nRatificación,\naceptación, aprobación\n\n \n\nLa presente Convención estará\nsujeta a ratificación, aceptación, o aprobación. Los instrumentos de\nratificación, aceptación, o aprobación, serán depositados en poder del Gobierno\nde la\n República Federal de Alemania el cual será el Depositario.\n\nArtículo XVII\n\n \n\nAdhesión\n\n \n\nLa presente Convención, a partir\ndel 22 de junio de 1980, estará abierta a la adhesión de todos los Estados u\norganizaciones de integración económica regional no signatarios. Los\ninstrumentos de adhesión serán depositados en poder del Depositario.\n\nArtículo XVIII\n\n \n\nEntrada en vigor\n\n \n\n1.         La\npresente Convención entrará en vigor el primer día del tercer mes siguiente a\nla fecha en que se haya depositado en poder del Depositario el decimoquinto\ninstrumento de ratificación, aceptación, aprobación, o adhesión.\n\n2.         Para\ncada Estado u organización de integración económica regional que ratifique,\nacepte, o apruebe la presente Convención, o se adhiera a la misma después del\ndepósito de decimoquinto instrumento de ratificación, aceptación, aprobación, o\nadhesión, la presente Convención entrará en vigor el primer día del tercer mes\ndespués de que dicho Estado o dicha organización haya depositado su instrumento\nde ratificación, aceptación, aprobación, o adhesión.\n\nArtículo XIX\n\n \n\nDenuncia\n\n \n\nCualquier Parte podrá denunciar\nla presente Convención mediante notificación por escrito al Depositario en\ncualquier momento. For\nthe purposes of this Convention:\n\na) \"migratory species\" means the entire population, or any\ngeographically separate part of the population, of any species or lower\ntaxonomic group of wild animals, a significant portion of whose members\ncyclically and predictably cross one or more national jurisdictional\nboundaries;\n\nb) \"conservation status (estado de conservación) of a migratory species\" means\nthe sum of the influences acting on that migratory species that may affect its\nlong-term distribution and abundance;\n\nc) \"conservation status (estado de conservación)\" will be taken as\n\"favorable\" when:\n\n \n\n(1) population dynamics data for the migratory species in question\nindicate that this species is maintaining itself on a long-term basis as a\nviable component of its ecosystems;\n\n(2) the extent of the area of distribution (área de distribución) of this migratory\nspecies is not currently being reduced, nor is it likely to be reduced, on a\nlong-term basis;\n\n(3) there is, and will continue to be in the foreseeable future,\nsufficient habitat (hábitat) to maintain the population of this migratory species on\na long-term basis; and\n\n(4) the distribution and abundance of the population of this\nmigratory species approach historic levels in terms of extent and numbers to\nthe degree that potentially suitable ecosystems exist, and to the degree\nconsistent with its prudent care and use (aprovechamiento);\n\n \n\nd) \"conservation status (estado de conservación)\" will be taken as\n\"unfavorable\" when any one of the conditions set out in subparagraph\nc) is not met;\n\ne) \"endangered (en peligro)\" means, for a given migratory\nspecies, that it is threatened with extinction in all or a significant portion\nof its area of distribution (área de distribución);\n\nf)  \"area of distribution (área de distribución)\" means all the terrestrial or\naquatic areas that a migratory species inhabits, stays in temporarily, crosses,\nor overflies at any time along its normal migration route;\n\ng) \"habitat (hábitat)\" means any area within the area of distribution (área de distribución) of a\nmigratory species that offers the living conditions necessary for the species\nin question;\n\nh) \"Range State (Estado del área de distribución)\" means, for a given migratory\nspecies, any State (and, where appropriate, any other Party referred to in\nsub-paragraph k)) that exercises jurisdiction over any part of the area of distribution (área de distribución) of that migratory\nspecies, or also, a State whose flag vessels are engaged in taking (sacar de su ambiente natural) migratory\nspecies from their natural environment (sacar de su ambiente natural) outside national jurisdictional\nlimits;\n\ni)  \"taking (sacar de su ambiente natural)\" means taking, hunting,\nfishing, capturing, harassing, deliberate killing, or any other similar\nendeavor;\n\n \n\nj)  \"AGREEMENT\" means an international agreement\nfor the conservation of one or more migratory species in accordance with\n\nArticles IV and V of this\nConvention; and\n\nk) \"Party\" means a State or any regional organization for\neconomic integration constituted by sovereign States for which this Convention\nis in force and that has competence to negotiate, conclude, and apply\ninternational agreements in matters covered by this Convention.\n\n \n\n2. In matters falling within their competence,\nthe regional organizations for economic integration that are Parties to this\nConvention shall, in their own name, exercise all the rights and fulfill all\nthe duties that this Convention confers on their member States; in these cases,\nthe member States may not exercise such rights separately.\n\n \n\n3. Where this Convention provides for a\ndecision to be taken by a two-thirds majority or by unanimity of the \"Parties\npresent and voting\", this means \"Parties present and casting an\naffirmative or negative vote\". In determining the majority, Parties\nabstaining shall not be counted among the \"Parties present and voting\".\n\nArticle II\n\n \n\nFundamental\nPrinciples\n\n \n\n1. In\nparticular, the Parties:\n\n \n\na) should promote, support, or cooperate in research on\nmigratory species;\n\nb) shall endeavor to provide immediate protection to the\nmigratory species listed in Appendix I; and\n\nc) shall endeavor to conclude AGREEMENTS on the conservation,\ncare, and use (aprovechamiento) of the migratory species listed in Appendix II.\n\nArticle III\n\n \n\nEndangered (en peligro) Migratory\nSpecies: Appendix I\n\n \n\n1. Appendix\nI lists endangered (en peligro) migratory species.\n\n2. A\nmigratory species may be included in Appendix I if reliable evidence, including\nthe best scientific data available, indicates that the species is endangered (en peligro).\n\n3. A\nmigratory species may be removed from Appendix I if the\n\nConference of the Parties determines\n\n \n\na) that reliable evidence, including the best scientific\ndata available, indicates that the species is no longer endangered (en peligro); and\n\nb) that the species is not likely to become endangered (en peligro) again if the\nprotection afforded by its inclusion in Appendix I were removed.\n\n \n\n4. Parties\nthat are Range States (Estados del área de distribución) of a migratory species listed in Appendix I shall\nendeavor to:\n\n \n\na) conserve and, where feasible and appropriate, restore\nthose habitats (hábitats) which are important to preserving the species from the danger of\nextinction;\n\nb) prevent, eliminate, compensate for, or appropriately\nminimize, the adverse effects of activities or obstacles that seriously impede\nor prevent the migration of the species; and\n\nc) to the extent feasible and appropriate, prevent, reduce,\nor control factors that are endangering or are likely to further endanger the\nspecies, including strictly controlling the introduction of, or monitoring and\neliminating, exotic species that have already been introduced.\n\n \n\n5. Parties\nthat are Range States (Estados del área de distribución) of a migratory species listed in Appendix I shall\nprohibit the taking (sacar de su ambiente natural) of animals of that species from their natural environment (sacar de su ambiente natural).\nExceptions to this prohibition may be permitted only when:\n\n \n\na) the taking is for scientific purposes;\n\nb) the taking is aimed at enhancing the propagation or\nsurvival of the affected species;\n\nc) the taking is to meet the needs of those who use the\nspecies within the framework of a traditional subsistence economy; or\n\nd) exceptional circumstances make it indispensable;\n\n \n\nsuch exceptions must be precisely defined as to their\ncontent, and limited in space and time. Such taking (sacar de su ambiente natural) should not operate to\nthe detriment of that species.\n\n \n\n6.\nThe Conference of the\nParties may recommend to the Parties that are Range States (Estados del área de distribución) of a migratory species\nlisted in Appendix I that they adopt any other measure deemed appropriate to\nbenefit that species.\n\n \n\n7. The\nParties shall inform the Secretariat as soon as possible of any exception\ngranted pursuant to paragraph 5 of this Article.\n\nArticle IV\n\n \n\nMigratory Species to be the subject of AGREEMENTS: Appendix\nII\n\n \n\n1. Appendix\nII lists migratory species whose conservation status (estado de conservación) is unfavorable and which\nrequire international agreements for their conservation, care, and use (aprovechamiento), as well\nas those whose conservation status (estado de conservación) would significantly benefit from the\ninternational cooperation that could be achieved by an international agreement.\n\n2. If\ncircumstances so warrant, a migratory species may be listed in both Appendices I\nand II.\n\n3. Parties\nthat are Range States (Estados del área de distribución) of migratory species listed in Appendix II shall\nendeavor to conclude AGREEMENTS for the benefit of these species, giving\npriority to species in an unfavorable conservation status (estado de conservación).\n\n4. Parties\nare invited to take action with a view to concluding agreements for any\npopulation or any geographically separate part of the population of any species\nor lower taxonomic group of wild animals, whenever individuals of such groups\nperiodically cross one or more national jurisdictional boundaries.\n\n5. A copy\nof each AGREEMENT concluded pursuant to the provisions of this Article shall be\ntransmitted to the Secretariat.\n\nARTICLE V\n\n \n\nGUIDELINES FOR\nCONCLUDING\nAGREEMENTS\n\n \n\n1. The\nobject of each AGREEMENT shall be to restore, or maintain, the migratory\nspecies concerned in a favorable conservation status (estado de conservación). Each AGREEMENT shall deal\nwith those aspects of the conservation, care, and use (aprovechamiento) of the migratory species\nconcerned which serve to achieve that objective.\n\n2. Each\nAGREEMENT shall cover the whole of the area of distribution (área de distribución) of the migratory\nspecies concerned, and shall be open to adhesion by all Range States (Estados del área de distribución) of\nthat species, whether or not they are Parties to this Convention.\n\n3. An\nAGREEMENT shall, wherever possible, cover more than one migratory species.\n\n4. Each\nAGREEMENT shall\n\n \n\na) designate the migratory species concerned;\n\nb) describe the area of distribution (área de distribución) and the migration route of the\nspecies;\n\nc) provide for each Party to designate its national\nauthorities responsible for the implementation of the AGREEMENT;\n\nd) establish, if necessary, appropriate institutional\nmachinery to assist in implementing the AGREEMENT, to monitor its\neffectiveness, and to prepare reports for the Conference of the Parties;\n\ne) provide for procedures for the settlement of disputes\nthat may arise between Parties to the AGREEMENT; and\n\nf)  at a minimum, prohibit, for any migratory species of\nthe order Cetacea, any taking (sacar de su ambiente natural) that is not permitted under some\nmultilateral agreement concerning the migratory species in question, and\nprovide for accession by States that are not Range States (Estados del área de distribución) of that\nmigratory species.\n\n \n\n5. Where\nappropriate and feasible, each AGREEMENT should provide for, but not be limited\nto:\n\n \n\na) periodic review of the conservation status (estado de conservación) of the migratory species\nconcerned and the identification of factors that may be harmful to that\nconservation status (estado de conservación);\n\nb) co-ordinated conservation, care, and use (aprovechamiento) plans;\n\nc) research on the ecology and population dynamics of the\nmigratory species concerned, with special attention to the migrations of this\nspecies;\n\nd) the exchange of information on the migratory species\nconcerned, with special emphasis on the exchange of research results and\nrelated statistics;\n\ne) conservation and, when required and feasible, the\nrestoration of the habitats (hábitats) which are important for maintaining a favorable\nconservation status (estado de conservación), and the protection of such habitats (hábitats) from disturbances,\nincluding strict control of the introduction of exotic species detrimental to\nthe migratory species concerned, or control of such species already introduced;\n\nf)  maintenance of a network of suitable habitats (hábitats) for the migratory\nspecies concerned, appropriately distributed throughout the migration routes;\n\ng) where it appears desirable, the provision of new\nhabitats (hábitats) favorable to the migratory species concerned, or the reintroduction\nof the species into such habitats (hábitats);\n\nh) elimination of, to the maximum extent possible, or\ncompensation for activities and obstacles that hinder or impede migration;\n\ni)  prevention, reduction, or control of the release of\nsubstances harmful to the migratory species concerned into the habitat (hábitat) of that\nspecies;\n\nj)  measures based on sound ecological principles to\ncontrol and manage the taking (sacar de su ambiente natural) of the migratory species concerned;\n\nk) procedures for co-ordinating action to suppress illegal\ntaking (sacar de su ambiente natural);\n\nl)  exchange of information on substantial threats\nfacing the migratory species concerned;\n\nm) emergency procedures whereby conservation measures would\nbe considerably and rapidly strengthened in cases where the conservation status (estado de conservación) of\nthe migratory species concerned is seriously affected; and\n\nn) making the general public aware of the contents and aims\nof the\n\nAGREEMENT.\n\nArticle VI\n\n \n\nRange States (Estados del área de distribución)\n\n \n\n1.\nThe Secretariat,\nusing the information it receives from the Parties, shall maintain an up-to-date\nlist of the Range States (Estados del área de distribución) of the migratory species listed in Appendices I\nand II.\n\n2. The\nParties shall keep the Secretariat informed as to the migratory species listed\nin Appendices I and II for which they consider themselves to be Range States (Estados del área de distribución); for these\npurposes, they shall provide, among other things, information on their flag\nvessels that carry out taking (sacar de su ambiente natural) of the migratory species concerned outside\nnational jurisdictional limits and, to the extent possible, on their future\nplans in respect of such taking (sacar de su ambiente natural).\n\n3. The\nParties which are Range States (Estados del área de distribución) for migratory species listed in Appendices I\nand II shall inform the Conference of the Parties, through the Secretariat, at least six months prior to each ordinary meeting of the\nConference, on the measures that they are taking to implement the provisions of\nthis Convention for these species.\n\nArticle VII\n\n \n\nThe Conference\nof the Parties\n\n \n\n1.\nThe Conference of the\nParties shall be the decision-making body of this Convention.\n\n2.\nThe Secretariat\nshall convene a meeting of the Conference of the Parties not later than two years after the entry into force of this Convention.\n\n3. Thereafter,\nthe Secretariat shall convene ordinary meetings of the Conference of the Parties at intervals of not more than three years, unless the\nConference decides otherwise, and extraordinary meetings at any time, at the\nwritten request of at least one-third of the Parties.\n\n4.\nThe Conference of the\nParties shall establish and keep under review the financial regulations for\nthis Convention. The Conference of the Parties, at each of its ordinary meetings, shall approve the\nbudget for the following financial period. Each Party shall contribute to this\nbudget according to a scale of contributions agreed by the Conference. The financial regulations, including the provisions on the budget\nand the scale of contributions as well as their modifications, shall be adopted\nby unanimous vote of the Parties present and voting.\n\n5. At\neach of its meetings, the Conference of the Parties shall review the implementation of this Convention and may\nin particular:\n\n \n\na) review and assess the conservation status (estado de conservación) of migratory\nspecies;\n\nb) review the progress made towards the conservation of\nmigratory species, especially those listed in Appendices I and II;\n\nc) make such provisions and provide such guidance as may be\nnecessary to enable the Scientific Council and the Secretariat to carry out\ntheir duties;\n\nd) receive and consider any reports presented by the\nScientific Council, the Secretariat, any Party, or any standing body\nestablished pursuant to an AGREEMENT;\n\ne) make recommendations to the Parties for improving the conservation status (estado de conservación) of migratory species and review the progress\nbeing made under AGREEMENTS;\n\nf)  in cases where no AGREEMENT has been concluded,\nrecommend the convening of meetings of the Parties that are Range States (Estados del área de distribución) of a\nmigratory species or group of migratory species to discuss measures to improve\nthe conservation status (estado de conservación) of this species;\n\ng) make recommendations to the Parties for improving the\neffectiveness of this Convention; and\n\nh) decide on any additional measure that should be taken to\nimplement the objectives of this Convention.\n\n \n\n6.\nThe Conference of the\nParties, at each of its meetings, should determine the time and venue of its\nnext meeting.\n\n7. At\nany meeting, the Conference of the Parties shall establish and adopt rules of\nprocedure for that meeting. Decisions of the Conference of the Parties shall be taken by a two-thirds majority of the Parties\npresent and voting, unless otherwise provided for in this Convention.\n\n8. The\nUnited Nations, its Specialized Agencies, the International Atomic Energy\nAgency, as well as any State not a Party to this Convention and, for each\nAGREEMENT, the body designated by the Parties to that AGREEMENT, may be\nrepresented by observers at meetings of the Conference of the Parties.\n\n9. Any\nagency or body of the categories mentioned below, technically qualified in the\nfield of protection, conservation, and care and use (aprovechamiento) of migratory species and which\nhas informed the Secretariat of its desire to be represented by observers at\nmeetings of the Conference of the Parties, shall be admitted unless at least\none-third of the Parties present object:\n\n \n\na) international agencies or bodies, both governmental and\nnon-governmental, as well as national governmental agencies and bodies; and\n\nb) national non-governmental agencies or bodies which have\nbeen approved for this purpose by the State in which they are located.\n\n \n\nOnce admitted, these observers shall have the right to\nparticipate but not to vote.\n\nArticle VIII\n\n \n\nThe Scientific\nCouncil\n\n \n\n1.\nThe Conference of the\nParties, at its first meeting, shall establish a Scientific Council to provide\nadvice on scientific matters.\n\n2. Any\nParty may appoint a qualified expert as a member of the Scientific Council. The\nScientific Council shall also include qualified experts selected and appointed\nas members by the Conference of the Parties. The number of these experts, the criteria for their selection,\nand the duration of their mandate shall be determined by the Conference of the Parties.\n\n3. The\nScientific Council shall meet at the invitation of the Secretariat as required\nby the Conference of the Parties.\n\n4. Subject\nto the approval of the Conference of the Parties, the Scientific Council shall establish its own rules\nof procedure.\n\n5.\nThe Conference of the\nParties shall decide the functions of the Scientific Council. These may\ninclude:\n\n \n\na) providing scientific advice to the Conference of the Parties, to the Secretariat, and, if the Conference approves, to\nany institution established under this Convention or an AGREEMENT, or to any\nParty;\n\nb) recommending and co-ordinating research on migratory\nspecies, evaluating the results of such research in order to ascertain the conservation status (estado de conservación) of migratory\nspecies, and reporting to the Conference of the Parties on this conservation status (estado de conservación) and\non measures to improve it;\n\nc) making recommendations to the Conference of the Parties on the migratory species to be included in\nAppendices I and II, including information on the area of distribution (área de distribución) of these\nspecies;\n\nd) making recommendations to the Conference of the Parties on specific measures of conservation and care and use (aprovechamiento)\nto be included in AGREEMENTS on migratory species; and\n\ne) making recommendations to the Conference of the Parties to resolve problems relating to scientific aspects of\nthe implementation of this Convention, especially concerning the habitats (hábitats) of\nmigratory species.\n\nArticle IX\n\n \n\nThe Secretariat\n\n \n\n1. A\nSecretariat is established for the purposes of this Convention.\n\n2. Upon\nentry into force of this Convention, the Executive Director of the United\nNations Environment Programme shall provide for the Secretariat. In the manner and to the extent he\nconsiders appropriate, he may be assisted by suitable international and\nnational, intergovernmental and non-governmental, agencies and bodies\ntechnically qualified in the protection, conservation, care, and use (aprovechamiento) of wild fauna.\n\n3. If\nthe United Nations Environment Programme is no longer able to provide for the Secretariat,\nthe Conference of the\nParties shall make alternative arrangements for the Secretariat.\n\n4. The\nfunctions of the Secretariat shall include the following:\n\n \n\na) organizing and servicing meetings:\n\n \n\ni)  of the Conference of the Parties, and\n\nii) of the Scientific Council;\n\n \n\nb) maintaining and developing relations with and between the\nParties, the standing bodies set up under AGREEMENTS, and other international\norganizations concerned with migratory species;\n\nc) obtaining reports and other information from any\nappropriate source that will further the objectives and implementation of this\nConvention, and arranging for the appropriate dissemination of such information;\n\nd) bringing to the attention of the Conference of the Parties any matter related to the objectives\nof this Convention;\n\ne) preparing for the Conference of the Parties reports on the work of the Secretariat and the\nimplementation of this Convention;\n\nf)  maintaining and publishing a list of the Range States (Estados del área de distribución) of all\nmigratory species listed in Appendices I and II;\n\ng) promoting, under the direction of the Conference of the Parties, the conclusion of AGREEMENTS;\n\nh) maintaining and making available to the Parties a list of\nAGREEMENTS and, if required by the Conference of the Parties, providing any information thereon;\n\ni)  maintaining and publishing a list of the\nrecommendations made by the Conference of the Parties pursuant to Article VII, paragraph 5, sub-paragraphs\ne), f) and g), or of the decisions taken pursuant to sub-paragraph h) of that\nsame paragraph;\n\nj)  providing for the general public information\nconcerning this Convention and its objectives; and\n\nk) performing any other function entrusted to it under this\nConvention or by the Conference of the Parties.\n\nArticle X\n\n \n\nAmendments to\nthe Convention\n\n \n\n1. This\nConvention may be amended at any ordinary or extraordinary meeting of the Conference of the Parties.\n\n2. Any\nParty may propose an amendment.\n\n3. The\ntext of any proposed amendment and the reasons therefor shall be communicated\nto the Secretariat not later than 150 days before the meeting at which it is to\nbe considered, and shall promptly be communicated by the Secretariat to all\nParties. Any comments by the Parties on the text of the proposed amendment shall\nbe communicated to the Secretariat not less than 60 days before the opening of\nthe meeting. The Secretariat, immediately after the expiry of this period, shall\ncommunicate to the Parties all comments received to that date.\n\n4. Amendments\nshall be adopted by a two-thirds majority of the Parties present and voting.\n\n5. Any\namendment adopted shall enter into force for all Parties that have accepted it\non the first day of the third month following the date on which two-thirds of\nthe Parties have deposited an instrument of acceptance with the Depositary. For\nany Party that deposits an instrument of acceptance after the date on which\ntwo-thirds of the Parties have done so, the amendment shall enter into force\nfor that Party on the first day of the third month following the deposit of its\ninstrument of acceptance.\n\nArticle XI\n\n \n\nAmendments to\nthe Appendices\n\n \n\n1. Appendices\nI and II may be amended at any ordinary or extraordinary meeting of the Conference of the Parties.\n\n2. Any\nParty may propose an amendment.\n\n3. The\ntext of each proposed amendment, along with its justification based on the best\nscientific knowledge available, shall be communicated to the Secretariat not\nlater than 150 days before the meeting, and shall promptly be communicated by\nthe Secretariat to all Parties. Comments by the Parties on the text of the\nproposed amendment shall be communicated to the Secretariat not less than 60 days\nbefore the opening of the meeting. The Secretariat, immediately after the expiry of this period, shall\ncommunicate to the Parties all comments received to that date.\n\n4. Amendments\nshall be adopted by a two-thirds majority of the Parties present and voting.\n\n5. Amendments\nto the Appendices shall enter into force for all Parties, with the exception of\nthose that have made a reservation in accordance with the following paragraph\n6, 90 days after the meeting of the Conference of the Parties at which they were approved.\n\n6. During\nthe period of 90 days provided for in the preceding paragraph 5, any Party may,\nby notification in writing to the Depositary, make a reservation with respect\nto that amendment. A reservation to an amendment may be withdrawn by\nnotification in writing to the Depositary; the amendment shall then enter into\nforce for that Party 90 days after the reservation is withdrawn.\n\nArticle XII\n\nEffects of the Convention on International Conventions and Other Legal Provisions\n\n1. This Convention shall not affect the codification and progressive development of the law of the sea by the United Nations Conference on the Law of the Sea convened pursuant to Resolution 2750 C (XXV) of the General Assembly of the United Nations, nor shall it affect the present or future claims and legal positions of any State concerning the law of the sea as well as the nature and extent of its coastal jurisdiction and the jurisdiction it exercises over vessels flying its flag.\n\n2. The provisions of this Convention shall in no way affect the rights and obligations of the Parties deriving from any treaty, convention, or agreement currently in force.\n\n3. The provisions of this Convention shall in no way affect the right of the Parties to adopt stricter domestic measures for the conservation of migratory species listed in Appendices I and II or domestic measures for the conservation of species not listed in Appendices I and II.\n\nArticle XIII\n\nSettlement of Disputes\n\n1. Any dispute that may arise between two or more Parties regarding the interpretation or application of the provisions of this Convention shall be subject to negotiation between the Parties to the dispute.\n\n2. If the dispute cannot be resolved in accordance with paragraph 1 of this Article, the Parties may, by mutual consent, submit the dispute to arbitration, in particular to the Permanent Court of Arbitration in The Hague, and the Parties so submitting the dispute shall be bound by the arbitral decision.\n\nArticle XIV\n\nReservations\n\n1. The provisions of this Convention shall not be subject to general reservations. Specific reservations may be made in accordance with the provisions of this Article and Article XI.\n\n2. Any State or regional economic integration organization may, when depositing its instrument of ratification, acceptance, approval, or accession, formulate a specific reservation with regard to the inclusion in either Appendix I or Appendix II, or both, of any migratory species, and shall not be considered a Party with respect to the subject of such reservation until 90 days have elapsed from the Depositary's notification to the Parties of the withdrawal of the reservation.\n\nArticle XV\n\nSignature\n\nThis Convention shall be open for signature in Bonn by all States or any regional economic integration organization until 22 June 1980.\n\nArticle XVI\n\nRatification, Acceptance, Approval\n\nThis Convention shall be subject to ratification, acceptance, or approval. Instruments of ratification, acceptance, or approval shall be deposited with the Government of the Federal Republic of Germany, which shall be the Depositary.\n\nArticle XVII\n\nAccession\n\nThis Convention shall, from 22 June 1980, be open for accession by all non-signatory States or regional economic integration organizations. Instruments of accession shall be deposited with the Depositary.\n\nArticle XVIII\n\nEntry into Force\n\n1. This Convention shall enter into force on the first day of the third month following the date on which the fifteenth instrument of ratification, acceptance, approval, or accession has been deposited with the Depositary.\n\n2. For each State or regional economic integration organization which ratifies, accepts, or approves this Convention or accedes to it after the deposit of the fifteenth instrument of ratification, acceptance, approval, or accession, this Convention shall enter into force on the first day of the third month after such State or organization has deposited its instrument of ratification, acceptance, approval, or accession.\n\nArticle XIX\n\nDenunciation\n\nAny Party may denounce this Convention by written notification to the Depositary at any time. The denunciation shall take effect 12 months after the Depositary has received the notification.\n\nArticle XX\n\nDepositary\n\n1. The original of this Convention, whose German, Spanish, French, English, and Russian texts are equally authentic, shall be deposited with the Depositary, which shall transmit certified copies of each of these versions to all States and all regional economic integration organizations that have signed it or deposited instruments of accession.\n\n2. The Depositary, after consultation with the Governments concerned, shall prepare official versions of the text of this Convention in the Arabic and Chinese languages.\n\n3. The Depositary shall inform all States and all regional economic integration organizations, signatories and acceding parties, as well as the Secretariat, regarding signatures, deposits of instruments of ratification, acceptance, approval, or accession, the entry into force of this Convention, as well as amendments, formulations of specific reservations, and notifications of denunciation.\n\n4. When this Convention enters into force, the Depositary shall transmit a certified copy to the Secretariat of the United Nations for registration and publication, in accordance with Article 102 of the Charter of the United Nations.\n\nIN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed this Convention.\n\nDone at Bonn, on 23 June 1979.\n\nAppendices I and II\n\nof the Convention on the Conservation\n\nof Migratory Species of Wild Animals (CMS)\n\n(as amended by the Conference of the Parties in\n\n1985, 1988, 1991, 1994, 1997, 1999 and 2002)\n\nEffective as of 23 December 2002\n\nAppendix I\n\nInterpretation\n\n1. In this Appendix, reference is made to migratory species in the following manner:\n\na) by the name of the species or subspecies; or\n\nb) as the totality of the migratory species of a higher taxon or of a specified part thereof.\n\n2. Other references to taxa higher than the species are included exclusively for informational or classification purposes.\n\n3. The abbreviation \"(s.l.)\" means that the scientific name is used in its broad sense.\n\n4. Da keine der Vertragsparteien oder Unterzeichnerstaaten Einspruch gegen die vorgeschlagenen Sprachfassungen erhoben hat, sind die geänderten Sprachfassungen, denen in der Anlage auch die Fassungen in Englisch, Spanisch und Chinesisch beigefügt sind, gültig.\n\nDes Weiteren sind germäB Art.
