Estos programas implicarán\nnecesariamente servicios de trabajo comunal por parte de los beneficiarios,\nconforme al reglamento correspondiente o para la realización de estudios sobre\nla materia.\n\n6º-Que la Ley de Creación del\nInstituto Mixto de Ayuda Social, Nº 4760 del 4 de mayo de 1971, establece en su\nartículo 2º la finalidad de resolver el problema de la pobreza extrema en el\npaís y en su artículo 4º dentro de sus fines de creación, se señala \"atender\nlas necesidades de los grupos sociales o de las personas que deban ser\nprovistas de medios de subsistencia cuando carezcan de ellos.\"\n\n7º-Que el artículo 4º del\nReglamento para la Prestación de Servicios y el Otorgamiento de Beneficios del\nInstituto Mixto de Ayuda Social, publicado en La Gaceta Nº 102 del 29 de\nmayo del 2000, define el concepto de pobreza como: \"Fenómeno o situación\ncompleja de índole coyuntural o estructural multifacético y heterogéneo, que\nafecta a las personas y que se caracteriza por sus precarias condiciones de\nvivienda y sanitarias, bajos niveles educacionales, inserción inestable en el\nsistema productivo, condiciones de riesgo social, con poca o ninguna\nincorporación en mecanismos de participación social, recursos insuficientes\npara satisfacer necesidades básicas (nutricionales, salud, educación y\nvivienda) y en algunos casos ausencia o insuficiencia de destrezas, aptitudes,\nherramientas y oportunidades para generar y acumular ingresos.\"\n\n8º-Que en el artículo 21 inciso\nh) del citado Reglamento, se señala en cuanto a los sujetos de los servicios\ninstitucionales, lo siguiente: \"En casos de excepción debidamente documentados\ny con el correspondiente informe técnico social autorizados por quien ejerza la\nGerencia Regional respectiva, se podrá otorgar beneficios a personas o familias\nque presenten una situación de pobreza coyuntural no necesariamente registrada\ncomo tal en el SIPO, o que mediante algún decreto o ley específica, se\nconsidere beneficiarios de la acción institucional.\"\n\n9º-Que no se cuenta con un fondo\ncompensatorio para brindar un subsidio económico a los pescadores afectados por\nla veda. \n\n10.-Que el período de veda,\nprovoca una situación de pobreza coyuntural en los pescadores por la carencia\nde ingresos por este concepto. Por tanto,\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Declárese en\nsituación de pobreza coyuntural la condición de los pescadores sujetos a las\nrestricciones y condiciones de veda para el Golfo de Nicoya, según el acuerdo\nNº A.J.D.I.P./074-2007, publicado en el Diario Oficial La Gaceta Nº\n58-Jueves 22 de marzo del 2007 de la Junta Directiva de INCOPESCA; y que\ncarezcan de otras fuentes de ingresos.\n\nArtículo 2º-Autorízase al\nInstituto Mixto de Ayuda Social a otorgar beneficios económicos en calidad de\nsubsidio a las personas indicadas en el artículo anterior, en apego a las\ncondiciones que se establecen en el presente decreto.\n\nArtículo 3º-Serán beneficiarías\nde los recursos del IMAS, únicamente aquellas personas que se encuentren\nexpresamente comprendidas dentro de la lista de pescadores que le será remitida\npor INCOPESCA en un plazo no mayor a 30 días naturales contados a partir del 27\nde marzo del 2007, fecha de publicación del Acuerdo Nº A.J.D.I.P./074-2007 de\nINCOPESCA.\n\nDicha lista contendrá los\nsiguientes requisitos mínimos:\n\n \n\na) Nombre completo del\nbeneficiario.\n\n \n\nb) Número de cédula de identidad.\n\n \n\nc) Domicilio exacto de los\nbeneficiarios.\n\nArtículo 4º-El IMAS, procederá a\nla atención de estas personas con base en la resolución debidamente\nfundamentada y aprobada por la Gerente Regional que determine el cumplimiento\nde los requisitos establecidos en este decreto, de conformidad con el listado\ndepurado y reemitido al IMAS por INCOPESCA y con los siguientes requisitos:\n\n \n\na) Fotocopia de la licencia de\npesca vigente, extendida por INCOPESCA.\n\n \n\nb) Declaración jurada de cada\nbeneficiario indicando que no cuenta con más fuentes de ingresos en su núcleo\nfamiliar que la actividad de pesca, antes y durante la veda.\n\nArtículo 5º-El IMAS otorgará un subsidio\na los beneficiarios que cumplan con las condiciones estipuladas en el artículo\nanterior. Dicho subsidio será emitido en dos eventos o tractos, de la siguiente\nmanera:\n\n \n\na) El primero tracto se entregará\na más tardar en el mes de junio y que corresponderá a los meses de mayo y junio\ndel año 2007 por un monto total a subsidiar de noventa mil colones (¢90.000,00)\npor beneficiario.\n\n \n\nb) El segundo tracto\ncorresponderá al mes de julio y será por la suma de cincuenta mil colones\n(¢50.000,00), completando así la entrega del monto total del subsidio.\n\nArtículo 6º-Los subsidios serán\ntramitados por las Gerencias Regionales del IMAS de las zonas de Puntarenas y\nGuanacaste. Los profesionales del IMAS estarán facultados para solicitar a los\npotenciales beneficiarios los requisitos establecidos en el artículo 4º del\npresente decreto y no requerirán que los mismos se encuentren registrados en el\nSistema de Información de la Población Objetivo (SIPO). No obstante, si de la información\ncontenida en dicho sistema o de otros medios se desprende que los potenciales\nbeneficiarios o sus familias cuentan con otros ingresos, proveniente de\nsalarios, actividades remuneradas, renta u otros el IMAS podrá denegar el\notorgamiento del beneficio.\n\nArtículo 7º-Para hacer efectiva\nla entrega del monto económico correspondiente al segundo tracto INCOPESCA\ndeberá verificar y actualizar la información suministrada con base en este\ndecreto. These programs will necessarily involve\ncommunity work services by the beneficiaries,\nin accordance with the corresponding regulation or for conducting studies on\nthe matter.\n\n6º-That the Law Creating the\nJoint Institute for Social Aid, No. 4760 of May 4, 1971, establishes in its\narticle 2 the purpose of solving the problem of extreme poverty in the\ncountry, and in its article 4, among its founding purposes, states \"to attend to\nthe needs of social groups or persons who must be\nprovided with means of subsistence when they lack them.\"\n\n7º-That article 4 of the\nRegulation for the Provision of Services and the Granting of Benefits of the\nJoint Institute for Social Aid, published in La Gaceta No. 102 of May 29,\n2000, defines the concept of poverty as: \"Complex phenomenon or\nsituation of a circumstantial or structural, multifaceted and heterogeneous nature, that\naffects persons and is characterized by their precarious housing\nand sanitary conditions, low educational levels, unstable insertion in\nthe productive system, conditions of social risk, with little or no\nincorporation into mechanisms of social participation, insufficient resources\nto satisfy basic needs (nutritional, health, education, and\nhousing) and in some cases absence or insufficiency of skills, aptitudes,\ntools, and opportunities to generate and accumulate income.\"\n\n8º-That in article 21, subsection\nh) of the cited Regulation, it is stated regarding the subjects of institutional\nservices, the following: \"In duly documented exceptional cases\nand with the corresponding social technical report authorized by the person exercising the\nrespective Regional Management, benefits may be granted to persons or families\nthat present a situation of circumstantial poverty not necessarily registered\nas such in the SIPO, or who, through a specific decree or law, are\nconsidered beneficiaries of the institutional action.\"\n\n9º-That there is no compensatory\nfund to provide an economic subsidy (subsidio económico) to the fishermen affected by\nthe closed season. \n\n10.-That the closed season period\ncauses a situation of circumstantial poverty among fishermen due to the lack\nof income from this source. Therefore,\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1-Declare the condition of fishermen subject to the\nrestrictions and conditions of the closed season for the Gulf of Nicoya, according to agreement\nNo. A.J.D.I.P./074-2007, published in the Official Gazette La Gaceta No.\n58-Thursday, March 22, 2007, of the Board of Directors of INCOPESCA, who\nlack other sources of income, to be in a situation of circumstantial poverty.\n\nArticle 2-The\nJoint Institute for Social Aid is authorized to grant economic benefits as a\nsubsidy to the persons indicated in the previous article, in adherence to the\nconditions established in this decree.\n\nArticle 3-The beneficiaries of the resources of IMAS shall be\nonly those persons who are expressly included\nwithin the list of fishermen that will be sent by INCOPESCA within a period no greater than 30 calendar days counted from March\n27, 2007, the date of publication of INCOPESCA's Agreement No. A.J.D.I.P./074-2007.\n\nSaid list shall contain the\nfollowing minimum requirements:\n\n \n\na) Full name of the\nbeneficiary.\n\n \n\nb) Identity card number.\n\n \n\nc) Exact domicile of the\nbeneficiaries.\n\nArticle 4-IMAS shall proceed to\nattend to these persons based on the resolution duly\nsubstantiated and approved by the Regional Manager that determines compliance\nwith the requirements established in this decree, in accordance with the list\npurified and re-sent to IMAS by INCOPESCA and with the following requirements:\n\n \n\na) Photocopy of the current\nfishing license, issued by INCOPESCA.\n\n \n\nb) Sworn statement (declaración jurada) from each\nbeneficiary indicating that they have no sources of income in their family\nunit other than the fishing activity, before and during the closed season.\n\nArticle 5-IMAS shall grant a subsidy (subsidio)\nto the beneficiaries who meet the conditions stipulated in the previous\narticle. Said subsidy shall be issued in two events or tranches, in the following\nmanner:\n\n \n\na) The first tranche shall be delivered\nno later than in the month of June and shall correspond to the months of May and June\nof the year 2007 for a total amount to be subsidized of ninety thousand colones (¢90,000.00)\nper beneficiary.\n\n \n\nb) The second tranche\nshall correspond to the month of July and shall be for the sum of fifty thousand colones\n(¢50,000.00), thus completing the delivery of the total amount of the subsidy.\n\nArticle 6-The subsidies shall be\nprocessed by the Regional Managements of IMAS in the zones of Puntarenas and\nGuanacaste. The professionals of IMAS shall be authorized to request from the\npotential beneficiaries the requirements established in article 4 of the\npresent decree and shall not require them to be registered in the\nTarget Population Information System (SIPO). However, if from the information\ncontained in said system or from other means it is inferred that the potential\nbeneficiaries or their families have other income, coming from\nsalaries, remunerated activities, rent, or others, IMAS may deny the\ngranting of the benefit.\n\nArticle 7-To make effective\nthe delivery of the economic amount corresponding to the second tranche, INCOPESCA\nmust verify and update the information provided based on this\ndecree. Said information shall be sent to IMAS within the first five\nbusiness days of the month of July 2007.\n\nArticle 8-INCOPESCA is responsible for\nthe supervision and control of the community work that the\nfishermen will perform during the closed season period, in accordance with the respective regulation\nthat governs said activity. INCOPESCA\nshall notify the respective Regional Management of IMAS, within a period no greater than\nthree business days, of the name of those persons who fail to comply with this\ncondition, as well as those who carry out actions that contravene the declaration of\nclosed season or who have complementary income.\nIn these cases, the authorized benefit shall be revoked,\nprior fulfillment of due process.\n\nArticle 9-It shall take effect upon its\npublication.\n\n \n\nGiven at the Presidency of the\nRepublic.-San José, on the eleventh day of the month of April, two thousand seven." }
