  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 144\n\n                        Convenio de delegación de Asociación Administradora del Acueducto y\nAlcantarillado Comunal de Zapote de Pejibaye de Pérez Zeledón, San José\n\nTexto Completo acta: A946D\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNº 2007-144\n\n \n\nASUNTO: Convenio de delegación de\nAsociación Administradora del Acueducto y Alcantarillado Comunal de Zapote de\nPejibaye de Pérez Zeledón, San José.\n\n \n\n            Conoce esta\nJunta Directiva de la solicitud de delegación de la Administración del Sistema\nde Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el\nartículo 50, 129 de la Constitución Política, el Estado debe procurar el mayor\nbienestar a los ciudadanos, planificando la producción hacia un ambiente sano\necológicamente equilibrado.\n\n2º-Que de conformidad con los\nartículos 11, 21, 129 y 169 de la Constitución Política, corresponde a las\nMunicipalidades velar por los intereses locales, y la Sala Constitucional en\nreiterados pronunciamientos se ha manifestado en el sentido de que se garantiza\nla inviolabilidad de la vida cuando se suministra agua potable y saneamiento\nambiental en los términos del artículo 297 de la Ley General de Salud, por lo\nque resulta imperativo que la Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización administradora\nde los sistemas comunales, como instrumento de desarrollo sostenible social,\neconómico, industrial, empresariales, agrario, turístico y de asentamientos\nhumanos que proporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los\nartículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva\ndel AyA, artículo 264 de la Ley General de Salud Pública, artículos 17, 32, 33,\n148 y siguientes de la Ley de Aguas Nº 276 del 24 de agosto de 1942, Ley\nGeneral de Agua Potable y Reglamento de la Asociaciones Administradoras de los\nSistemas de Acueductos y Alcantarillados Comunales Nº 39529-S-MINAE, publicado\nen La Gaceta Nº 150 del 5 de agosto del 2005, se establece que AyA es el\nente Rector en todo lo relativo a los Sistemas de Acueductos y Alcantarillados\nen todo el territorio nacional, y se encuentra facultado en delegar la\nadministración de tales sistemas en organizaciones debidamente constituidas al\nefecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la participación de la\ncomunidad o sociedad civil, constituye uno de los instrumentos eficaces para\nlograr la consecución del desarrollo sostenible en Costa Rica, por lo que AyA,\ndesde 1976 ha venido delegando en las comunidades la administración de aquellos\nsistemas en las que las ventajas comparativas de inmediatez, eficacia y\neficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar\nen las comunidades su administración.\n\nII.-Que la comunidad Zapote de\nPejibaye de Pérez Zeledón, con aporte de la comunidad, de AyA y del Estado, se\nha construido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes.\n\nIII.-Que en asamblea general de\nvecinos celebrada, dispusieron constituir la organización y solicitar al AyA,\nque delegue la administración de los sistemas en dicha organización.\n\nIV.-Que por las características\ndel sistema, es procedente delegar la administración en la organización comunal\nconstituida al efecto, denominada Asociación Administradora del Acueducto y\nAlcantarillado Comunal de Zapote de Pejibaye de Pérez Zeledón, cédula jurídica\nnúmero tres-cero cero dos-trescientos cincuenta y cinco mil novecientos sesenta\ny siete, que se encuentra debidamente inscrita en el Registro de Asociaciones del\nRegistro Nacional, bajo el tomo número quinientos veintidós, asiento número\nsiete mil doscientos veinticuatro.\n\nV.-Que para los efectos de lo\ndispuesto en el Reglamento, la Dirección de la Región Brunca mediante el\nmemorando Nº DIRB-2006-0509 del día 19 de junio del 2006, así como la Dirección\nJurídica en el memorando Nº DJ-2007-1012 del día 9 de marzo del 2007,\nrecomiendan a la Gerencia proceder a la delegación de la administración del\nsistema en la respectiva organización.\n\nVI.-Que mediante el dictamen\nlegal Nº DJ-SC-0052-2006 del día 13 del mes noviembre del 2006, la Asesoría\nLegal de Sistemas Comunales de la Dirección Jurídica, emitió criterio,\nestableciendo que cumplidos los trámites técnicos, es jurídicamente procedente\ndelegar la administración de dicho sistema.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Standard 144\n\n                        Delegation Agreement of the Administrative Association for the Communal Aqueduct and Sewer System of Zapote de Pejibaye de Pérez Zeledón, San José\n\nFull Text of record: A946D\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNº 2007-144\n\n \n\nSUBJECT: Delegation agreement of the Administrative Association for the Communal Aqueduct and Sewer System of Zapote de Pejibaye de Pérez Zeledón, San José.\n\n \n\n            This Board of Directors reviews the request for delegation of the Administration of the Aqueduct and Sewer Systems.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with articles 50 and 129 of the Political Constitution, the State must procure the greatest well-being for citizens, planning production towards a healthy, ecologically balanced environment.\n\n2º-That in accordance with articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in reiterated pronouncements, has stated that the inviolability of life is guaranteed when drinking water and environmental sanitation are supplied under the terms of article 297 of the General Health Law, making it imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development provided by the aqueduct and sewer systems.\n\n3º-That in accordance with articles 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law, articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Drinking Water Law, and the Regulation of the Administrative Associations of the Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to the communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of Zapote de Pejibaye de Pérez Zeledón, with contributions from the community, AyA, and the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general assembly of residents held, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto y Alcantarillado Comunal de Zapote de Pejibaye de Pérez Zeledón, legal identification number three-zero zero two-three hundred fifty-five thousand nine hundred sixty-seven, which is duly registered in the Registry of Associations of the National Registry, under volume number five hundred twenty-two, entry number seven thousand two hundred twenty-four.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Brunca Region, through memorandum No. DIRB-2006-0509 of June 19, 2006, as well as the Legal Directorate in memorandum No. DJ-2007-1012 of March 9, 2007, recommend to the General Management proceeding with the delegation of the system's administration to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0052-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate issued a criterion, establishing that once the technical procedures are completed, it is legally appropriate to delegate the administration of said system. Therefore:\n\n \n\nBased on the provisions of articles 11, 21, 18, 50, 129, 169, and 188 of the Political Constitution; articles 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law No. 5395 of October 30, 1973, articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 27, 1942, General Drinking Water Law No. 1634 of September 18, 1953, articles 1º, 4º, 11, 16, 113.12, 114 of the General Law of Public Administration, Environment Law No. 7554 of October 4, 1995, articles 4º and 33 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996 and its amendments, Wildlife Conservation Law No. 7317 of October 30, 1992, article 7º of the Public Roads Law No. 5060 of August 22, 1972, Regulation of the National Water Laboratory of AyA Decree No. 26066-S, published in La Gaceta No. 109 of June 9, 1997, Regulation for Water Quality Executive Decree No. 32327 of February 10, 2005, Regulation on the Use and Discharge of Wastewater Executive Decree No. 26042-S-MINAE of June 19, 1997, Regulation for the Approval and Operation of Wastewater Treatment Systems Executive Decree No. 31545 of October 9, 2003, and Regulation of Septic Tank Sludge Executive Decree No. 21279-S of May 15, 1992, Sectoral Regulation for the Regulation of Aqueduct and Sanitary Sewer Services No. 30413-MP-MINAE-S-MEIC of March 25, 2002, Regulation of the Administrative Associations of the Communal Aqueduct and Sewer Systems No. 32529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, and Regulation for the Provision of Services to Clients, published in the Official Journal La Gaceta No. 159 of August 20, 1997.\n\n \n\nRESOLVES:\n\n \n\n1º-To agree to the delegation of the administration of the community's aqueduct and sanitary sewer systems to the Asociación Administradora del Acueducto y Alcantarillado Comunal de Zapote de Pejibaye de Pérez Zeledón, legal identification number three-zero zero two-three hundred fifty-five thousand nine hundred sixty-seven; record this in our internal registries.\n\n2º-To authorize the Administration to sign the Delegation Agreement with the legal representative of the Association, in which, in addition to compliance with current legislation, specific obligations and considerations assumed by the parties will be specified and it will repeal any agreements previously signed.\n\n3º-To order that the Directorate of Communal Systems and the Regional Directorate corresponding to the geographic location of the systems, carry out all activities of technical, environmental, financial, legal, organizational, and communal advisory, control, and training as established by the Laws and Regulations.\n\n4º-Once the Delegation Agreement is signed, submit it for approval to the General Comptroller of the Republic.\n\n5º-Once the Agreement is approved, notify all users of the system and residents of the respective community, by means of publication in the Official Journal La Gaceta, so that they may exercise all their rights, duties, and obligations concerning the system in accordance with the Laws and Regulations.
