Constitutiva\ndel AyA, artículo 264 de la Ley General de Salud Pública, artículos 17, 32, 33,\n148 y siguientes de la Ley de Aguas Nº 276 del 24 de agosto de 1942, Ley\nGeneral de Agua Potable y es el\nente Rector en todo lo relativo a los Sistemas de Acueductos y Alcantarillados\nen todo el territorio nacional, y se encuentra facultado en delegar la\nadministración de tales sistemas en organizaciones debidamente constituidas al\nefecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la participación de la\ncomunidad o sociedad civil, constituye uno de los instrumentos eficaces para\nlograr la consecución del desarrollo sostenible en Costa Rica, por lo que AyA,\ndesde 1976 ha venido delegando en las comunidades la administración de aquellos\nsistemas en las que las ventajas comparativas de inmediatez, eficacia y\neficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar\nen las comunidades su administración.\n\nII.-Que la comunidad San Bosco y\nEl Progreso de Upala, con aporte de la comunidad, de AyA y del Estado, se ha\nconstruido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes.\n\nIII.-Que en asamblea general de\nvecinos celebrada, dispusieron constituir la organización y solicitar al AyA,\nque delegue la administración de los sistemas en dicha organización.\n\nIV.-Que por las características\ndel sistema, es procedente delegar la administración en la organización comunal\nconstituida al efecto, denominada Asociación Administradora del Acueducto Rural\nde San Bosco y El Progreso de Upala Alajuela, cédula jurídica número tres-cero cero\ndos-doscientos dos mil setecientos sesenta y nueve, que se encuentra debidamente\ninscrita en el Registro de Asociaciones del Registro Nacional, bajo el tomo\nnúmero cuatrocientos treinta y nueve, asiento número ocho mil novecientos\nquince.\n\nV.-Que para los efectos de lo\ndispuesto en el Reglamento, la Dirección de la Región Huetar Norte mediante el\nmemorando Nº RHN-2006-0242 del día 4 de julio del 2006, así como la Dirección\nJurídica en el memorando Nº DJ-2007-1012 del día 9 de marzo del 2007,\nrecomiendan a la Gerencia proceder a la delegación de la administración del\nsistema en la respectiva organización.\n\nVI.-Que mediante el dictamen\nlegal Nº DJ-SC-0053-2006 del día 13 del mes noviembre del 2006, la Asesoría\nLegal de Sistemas Comunales de la Dirección Jurídica, emitió criterio,\nestableciendo que cumplidos los trámites técnicos, es jurídicamente procedente\ndelegar la administración de dicho sistema. therefore, it is imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of the communal systems, as an instrument for the social, economic, industrial, business, agricultural, tourism, and human settlement sustainable development that aqueduct and sewer systems provide.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148, and subsequent of Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation of the Administrative Associations of Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica; therefore, AyA, since 1976, has been delegating the administration of those systems in communities where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit for the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of San Bosco and El Progreso of Upala, with contributions from the community, from AyA, and from the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general assembly of residents held, they decided to form the organization and request that AyA delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto Rural de San Bosco y El Progreso de Upala Alajuela, legal identification number three-zero zero two-two hundred two thousand seven hundred sixty-nine, which is duly registered in the Registry of Associations of the National Registry, under volume number four hundred thirty-nine, entry number eight thousand nine hundred fifteen.\n\nV.-That for the purposes of the provisions in the Regulation, the Directorate of the Huetar Norte Region, through memorandum No. RHN-2006-0242 of July 4, 2006, as well as the Legal Directorate in memorandum No. DJ-2007-1012 of March 9, 2007, recommend that the Management proceed with the delegation of the system's administration to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0053-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate issued a criterion, establishing that once the technical procedures are completed, it is legally appropriate to delegate the administration of said system.
