Rural de Salitrillos de Puriscal, San José. \n\n \n\nConoce esta Junta Directiva de la\nsolicitud de delegación de la Administración del Sistema de Acueductos y\nAlcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el\nartículo 50, 129 de la Constitución Política, el Estado debe procurar el mayor\nbienestar a los ciudadanos, planificando por los intereses locales, y la Sala Constitucional en\nreiterados pronunciamientos se ha manifestado en el sentido de que se garantiza\nla inviolabilidad de la vida cuando se suministra agua potable y saneamiento\nambiental en los términos del artículo 297 de la Ley General de Salud, por lo\nque resulta imperativo que la Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización\nadministradora de los sistemas comunales, como instrumento de desarrollo\nsostenible social, económico, industrial, empresariales, agrario, turístico y\nde asentamientos humanos que proporcionan los sistemas de acueductos y\nalcantarillados.\n\n3º-Que de conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de la Ley\nConstitutiva del AyA, artículo 264 de la Ley General de Salud Pública, artículos 17, 32, 33, 148 y\nsiguientes de la Ley de Aguas N° 276 del 24 de agosto de 1942, Ley General de Agua Potable y\nReglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados\nComunales N° 39529-S-MINAE, publicado en La Gaceta N° 150 del 5 de agosto del 2005, se establece que\nAyA es el ente Rector en todo lo relativo a los Sistemas de Acueductos y Alcantarillados en todo el\nterritorio nacional, y se encuentra facultado en delegar la administración de tales sistemas en\norganizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad Salitrillos de Puriscal, con aporte de\nla comunidad, de AyA y del Estado, se ha construido\nun sistema de acueductos comunales, para el abastecimiento de una población de\nhabitantes. \n\nIII.-Que en asamblea general de vecinos celebrada, dispusieron constituir la organización y\nsolicitar al AyA, que delegue la administración de los sistemas en dicha organización.\n\nIV.-Que por las características\ndel sistema, es procedente delegar la administración en la organización comunal\nconstituida al efecto, denominada Asociación Administradora del Acueducto Rural\nde Salitrillos de Puriscal, cédula jurídica número\ntres-cero cero dos-ciento ochenta y siete mil doscientos veintiuno, que se\nencuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional, bajo el tomo número quinientos sesenta y cuatro, asiento número\ncuatro mil novecientos cincuenta y dos. \n\nV.-Que para los efectos de lo dispuesto en el Reglamento, la Dirección de la Región Central mediante\nel memorando N° CO-2006-1070 del día 8 de setiembre del 2006, así como la Dirección Jurídica en el\nmemorando N° DJ-2007-1012 del día 9 de marzo del 2007, recomiendan a la Gerencia proceder a la\ndelegación de la administración del sistema en la respectiva organización.\n\nVI.-Que mediante el dictamen\nlegal N° DJ-SC-0065-2006 del día 13 del mes noviembre\ndel 2006, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. Por\ntanto:\n\n \n\nCon fundamento en lo dispuesto en los artículos 11, 21, 18, 50, 129, 169 y 188 de la Constitución\nPolítica; artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva de AyA,\nartículo 264 de la Ley General de Salud Pública N° 5395 de 30 de octubre de 1973, artículo 17, 32,\n33, 148 y siguientes de la Ley de Aguas N° 276 del 27 de agosto de 1942, Ley General de Agua Potable\nN° 1634 del 18 de setiembre de 1953, artículos 1º, 4º, 11, 16, 113.12, 114 de la Ley General de la\nAdministración Pública, Ley del Ambiente N° 7554 del 4 de octubre de 1995, \n\nSUBJECT: Delegation Agreement of the Administrative Association of the Rural Aqueduct of Salitrillos de Puriscal, San José. \n\n \n\nThis Board of Directors hears the request for delegation of the Administration of the Aqueduct and Sewer System.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with articles 50, 129 of the Political Constitution, the State must procure the greatest well-being for citizens, planning production towards an ecologically balanced healthy environment.\n\n2º-That in accordance with articles 11, 21, 129, and 169 of the Political Constitution, it corresponds to the Municipalities to look after local interests, and the Constitutional Chamber in repeated pronouncements has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied under the terms of article 297 of the General Health Law, for which it is imperative that the Municipality contribute especially in relation to zoning regulations, urban development, with the administrative organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agrarian, tourism, and human settlement development that the aqueduct and sewer systems provide.\n\n3º-That in accordance with articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law, articles 17, 32, 33, 148, and following of the Water Law No. 276 of August 24, 1942, General Potable Water Law and Regulation of the Administrative Associations of Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing body in everything related to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments to achieve sustainable development in Costa Rica, for which AyA, since 1976, has been delegating to the communities the administration of those systems in which the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of Salitrillos de Puriscal, with contributions from the community, from AyA, and from the State, has built a communal aqueduct system, for the supply of a population of inhabitants. \n\nIII.-That in a general assembly of neighbors held, they resolved to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto Rural de Salitrillos de Puriscal, legal ID number three-zero zero two-two hundred eighty-seven thousand two hundred twenty-one, which is duly registered in the Associations Registry of the National Registry, under volume number five hundred sixty-four, entry number four thousand nine hundred fifty-two. \n\nV.-That for the purposes of the provisions in the Regulation, the Directorate of the Central Region, through memorandum No. CO-2006-1070 of September 8, 2006, as well as the Legal Directorate in memorandum No. DJ-2007-1012 of March 9, 2007, recommend to the General Management to proceed with the delegation of the system's administration to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0065-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate, issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
