del\nAcueducto Rural de Llano Azul y El Higuerón de Upala, Alajuela.\n\n            Conoce esta\nJunta Directiva de la solicitud de delegación de\nla Administración del\nSistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el\nartículo 50, 129 de la\n Constitución Política, el Estado debe procurar el mayor\nbienestar a los ciudadanos, planificando la producción hacia un ambiente sano\necológicamente equilibrado.\n\n2º-Que de conformidad con los\nartículos 11, 21, 129 y 169 de\nla Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y\nla Sala Constitucional\nen reiterados pronunciamientos se ha manifestado en el sentido de que se\ngarantiza la inviolabilidad de la vida cuando se suministra agua potable y\nsaneamiento ambiental en los términos del artículo 297 de\nla Ley General de Salud,\npor lo que resulta imperativo que\nla Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización administradora\nde los sistemas comunales, como instrumento de desarrollo sostenible social,\neconómico, industrial, empresariales, agrario, turístico y de asentamientos\nhumanos que proporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los\nartículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de\nla Ley Constitutiva\ndel AyA, artículo 264 de la\n Ley General de Salud Pública, artículos 17, 32, 33, 148 y\nsiguientes de la Ley\nde Aguas N° 276 del 24 de agosto de 1942, Ley General de Agua Potable y\nReglamento de\nla Asociaciones Administradoras de los Sistemas de\nAcueductos y Alcantarillados Comunales N° 39529-S-MINAE, publicado en\nLa Gaceta N° 150 del\n5 de agosto del 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nnacional, y se encuentra facultado en delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la participación de la\ncomunidad o sociedad civil, constituye uno de los instrumentos eficaces para\nlograr la consecución del desarrollo sostenible en Costa Rica, por lo que AyA,\ndesde 1976 ha\nvenido delegando en las comunidades la administración de aquellos sistemas en\nlas que las ventajas comparativas de inmediatez, eficacia y eficiencia; costo y\nbeneficio a las poblaciones, resulte más adecuado asignar en las comunidades su\nadministración.\n\nII.-Que la comunidad Llano Azul y\ndel Higuerón de Upala, con aporte de la comunidad, de AyA y del Estado, se ha\nconstruido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes.\n\nIII.-Que en asamblea general de\nvecinos celebrada, dispusieron constituir la organización y solicitar al AyA,\nque delegue la administración de los sistemas en dicha organización.\n\nIV.-Que por las características\ndel sistema, es procedente delegar la administración en la organización comunal\nconstituida al efecto, denominada Asociación Administradora y Alcantarillado\nSanitario del Acueducto Rural de Llano Azul y del Higuerón de Upala, Alajuela,\ncédula jurídica número tres-cero cero dos-cuatrocientos ocho mil quinientos veintitrés,\nque se encuentra debidamente inscrita en el Registro de Asociaciones del\nRegistro Nacional, bajo el tomo número quinientos cuarenta y ocho, asiento\nnúmero cinco mil setecientos setenta y cuatro.\n\nV.-Que para los efectos de lo\ndispuesto en el Reglamento, la\n Dirección de\nla Región Huetar Norte mediante el memorando N°\nRHN-06-0105 del día 20 de noviembre del 2006, así como\nla Dirección Jurídica\nen el memorando N° DJ-2007-1012 del día 9 de marzo del 2007, recomiendan a\nla Gerencia proceder a la\ndelegación de la administración del sistema en la respectiva organización.\n\nVI.-Que mediante el dictamen\nlegal N° DJ-SC-0074-2006 del día 19 del mes diciembre del 2006,\nla Asesoría Legal de\nSistemas Comunales de la\n Dirección Jurídica, emitió criterio, estableciendo que\ncumplidos los trámites técnicos, es jurídicamente procedente delegar la\nadministración de dicho sistema. Por tanto:\n\n \n\nCon fundamento en lo dispuesto en\nlos artículos 11, 21, 18, 50, 129, 169 y 188 de\nla Constitución Política;\nartículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de\nla Ley Constitutiva\nde AyA, artículo 264 de la\n Ley General de Salud Pública N° 5395 de 30 de octubre de\n1973, artículo 17, 32, 33, 148 y siguientes de\nla Ley de Aguas N° 276 del 27 de\nagosto de 1942, Ley General de Agua Potable N° 1634 del 18 de setiembre de\n1953, artículos 1º, 4º, 11, 16, 113.12, 114 de\nla Ley General de\nla Administración Pública,\nLey del Ambiente N° 7554 del 4 de octubre de 1995, artículos 4º y 33 de\nla Ley Forestal N° 7575\ndel 13 de febrero de 1996 y sus reformas, Ley de Conservación de Vida Silvestre\nN° 7317 de 30 de octubre de 1992, artículo 7º de\nla Ley de Caminos Públicos N°\n5060 del 22 de agosto de 1972, Reglamento del Laboratorio Nacional de Aguas de\nAyA Decreto N° 26066-S, publicado en\nLa Gaceta N° 109 del 9 de junio de 1997,\nReglamento para la del 15 de\nmayo de 1992, Reglamento Sectorial para\nla Regulación de los Servicios\nde Acueducto y Alcantarillado Sanitario N° 30413-MP-MINAE-S-MEIC del 25 de\nmarzo del 2002, Reglamento de las Asociaciones Administradoras de los Sistemas de\nAcueductos y Alcantarillados Comunales N° 32529-S-MINAE, publicado en\nLa Gaceta Nº 150 del\n5 de agosto del 2005, y Reglamento de Prestación de Servicios a los Clientes,\npublicado en el Diario Oficial La\n Gaceta N° 159 del 20 de agosto de 1997.\n\n \n\nACUERDA:\n\n \n\n1º-Acordar la delegación de la\nadministración de los sistemas de acueducto y alcantarillado sanitario de la\ncomunidad, en la\n Asociación Administradora y Alcantarillado Sanitario del\nAcueducto Rural de Llano Azul y del Higuerón de Upala, Alajuela, A9523\n\nCOSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS\n\nINSTITUTO\nCOSTARRICENSE DE ACUEDUCTOS Y\nALCANTARILLADOS\n\n \n\nNo. 2007-164\n\n \n\nSUBJECT: Delegation Agreement of the Administering Association and Sanitary Sewerage of the\nRural Aqueduct of Llano Azul and El Higuerón de Upala, Alajuela.\n\n This Board of Directors reviews the request for delegation of\nthe Administration of the\nAqueduct and Sewerage System.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with\narticles 50 and 129 of the\n Political Constitution, the State must procure the greatest\nwell-being for citizens, planning production towards an ecologically balanced\nhealthy environment.\n\n2º-That in accordance with\narticles 11, 21, 129 and 169 of\nthe Political Constitution,\nthe Municipalities are responsible for looking after local interests, and\nthe Constitutional Chamber,\nin reiterated pronouncements, has stated that the inviolability of life is guaranteed\nwhen potable water and environmental sanitation are supplied, in the terms of article 297 of\nthe General Health Law,\nmaking it imperative that\nthe Municipality contribute, especially regarding\nzoning regulations and urban development, with the administering organization\nof communal systems, as an instrument of sustainable social,\neconomic, industrial, business, agricultural, and tourism development, and of human settlements\nthat the aqueduct and sewerage systems provide.\n\n3º-That in accordance with\narticles 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 and 23 of\nthe Constitutive Law\nof AyA, article 264 of the\n General Public Health Law, articles 17, 32, 33, 148 and\nfollowing of the Water\nLaw No. 276 of August 24, 1942, the General Potable Water Law, and the\nRegulation of\nAdministering Associations of Communal\nAqueduct and Sewerage Systems No. 39529-S-MINAE, published in\nLa Gaceta No. 150 of\nAugust 5, 2005, it is established that AyA is the Governing Entity in all\nmatters relating to Aqueduct and Sewerage Systems throughout the national\nterritory, and is empowered to delegate the administration of such\nsystems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the\ncommunity or civil society constitutes one of the effective instruments for\nachieving sustainable development in Costa Rica, and therefore, AyA,\nsince 1976 has\nbeen delegating to communities the administration of those systems where\nthe comparative advantages of immediacy, effectiveness, and efficiency; cost and\nbenefit to the populations, make it more appropriate to assign their\nadministration to the communities.\n\nII.-That the Llano Azul and\nEl Higuerón de Upala community, with contributions from the community, from AyA, and from the State, has\nbuilt a communal aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general assembly of\nneighbors held, they resolved to constitute the organization and request that AyA\ndelegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics\nof the system, it is appropriate to delegate the administration to the communal organization\nconstituted for this purpose, named Asociación Administradora y Alcantarillado\nSanitario del Acueducto Rural de Llano Azul y del Higuerón de Upala, Alajuela,\nlegal identification number three-zero zero two-four hundred eight thousand five hundred twenty-three,\nwhich is duly registered in the Registry of Associations of the\nNational Registry, under volume number five hundred forty-eight, entry\nnumber five thousand seven hundred seventy-four.\n\nV.-That for the purposes of the provisions\nof the Regulation, the\n Directorate of\nthe Huetar Norte Region, via memorandum No.\nRHN-06-0105 of November 20, 2006, as well as\nthe Legal Directorate,\nin memorandum No. DJ-2007-1012 of March 9, 2007, recommend to\nthe General Management to proceed with the\ndelegation of the system's administration to the respective organization.\n\nVI.-That through legal opinion\nNo. DJ-SC-0074-2006 of December 19, 2006,\nthe Legal Advisory Office for\nCommunal Systems of the\n Legal Directorate issued a criterion, establishing that\nonce the technical procedures are completed, it is legally appropriate to delegate the\nadministration of said system.
