  "body_es_text": "en la totalidad del texto\n\n                    -\n\nTexto Completo Norma 099\n\n                        Permite la importación de embarcaciones para las actividades de Pesca\nComercial con Palangre y Pesca de Camarón\n\nTexto Completo acta: E43A8\n\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUICULTURA\n\n \n\nAJDIP/099-2007.-Puntarenas, a los\ntrece días del mes de abril del 2007.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con\nla Ley 7384, es competencia del Instituto\nCostarricense de Pesca y Acuicultura, normar el aprovechamiento de los recursos\npesqueros, así como regular los aspectos pertinentes en cuanto al otorgamiento\nde permisos y licencias de pesca y acuicultura, características de\nembarcaciones, y aspectos pertinentes en cuanto al ejercicio de la actividad\npesquera,\n\n2º-Que en materia de sustitución\nde embarcaciones debe considerarse que cada tipo de pesquería debe tener\nconsideraciones distintas donde se considere el efecto del esfuerzo pesquero,\ncapacidad de pesca y disponibilidad del recurso.\n\n3º-Que las pesquerías actualmente\nse ven afectadas por los adelantos tecnológicos creados para mejorar el\nrendimiento económico y de capturas de las especies marinas,\n\n4º-Que los países ribereños, debe\nal igual que otros que ya lo han hecho adoptar regulaciones para disminuir el\nimpacto sobre las poblaciones de especies marinas y así garantizar su\nrenovación constante. \n\n5º-Que el Código de Conducía para\nla Pesca Responsable,\ndetermina la obligatoriedad de los países del mundo de regular adecuadamente\nlas cantidades de pesca permisibles de manera que se garantice la protección de\nlas mismas. Por tanto,\n\n \n\nSE\nACUERDA:\n\n \n\n1º-Se permitirá la importación de\nembarcaciones para las actividades de pesca comercial con palangre y pesca de\ncamarón, con el fin de sustituir embarcaciones que cuenten con permisos o\nlicencias de pesca vigentes cuyas artes de pesca sea palangre o de arrastre,\nsegún corresponda, en el tanto se cumpla con las disposiciones legales\naplicables en la materia bajo las siguientes condiciones:\n\n \n\na. No se permitirá importar embarcaciones de pesca construidas\nde madera de cualquier tamaño que sean.\n\nb. (Derogado mediante acuerdo\nA.J.D.I.P/155-2012 del 29 de marzo del 2012)\n\nc. Therefore,\n\n \n\nIT IS\nAGREED:\n\n \n\n1º-The importation of\nvessels for commercial longline fishing and shrimp fishing activities will be permitted, with the aim of replacing vessels that hold valid fishing permits or\nlicenses whose fishing gear is longline or trawl,\nas applicable, insofar as compliance with the applicable legal\nprovisions on the matter is met under the following conditions:\n\n \n\na. The importation of fishing vessels built\nof wood of any size shall not be permitted.\n\nb. (Repealed by agreement\nA.J.D.I.P/155-2012 of March 29, 2012)\n\nc. (Repealed by agreement\nA.J.D.I.P/155-2012 of March 29, 2012)\n\n2º-For\nthe purposes of importation and replacement of vessels, the\nmaximum length overall (eslora) increase permitted per vessel according to the provisions of\nagreement AJDIP/308-97 of November 26, 1997, and its amendments, must be respected, defined as\nfifty percent more length overall (eslora) than the vessel to be replaced, provided\nthat the new vessel does not exceed\n24 meters\n of total linear length overall (eslora), as defined supra. \n\n3º-(Repealed\nby agreement A.J.D.I.P/155-2012 of March 29, 2012)\n\n4º-The\nreplacement of small-scale, medium-scale,\nadvanced, and semi-industrial vessels shall not be permitted when the new vessel does not comply with\nthe provisions relating to the type of license held by the permit holder; in\nany event, the replacement of the vessel shall never imply the modification\nof the license to one different from the original.\n\n     Article 4 Bis.-The\nreplacement of vessels with a measurement greater than\n24 meters\n length overall (eslora) shall be permitted, only in the case of those vessels that, before the\neffectiveness of this agreement, were registered in the Ship Registry of Costa Rica, with a fishing license and with a measurement greater than that indicated, in\nwhich case the exceptional maintenance of that measurement shall be permitted without\nthe possibility of increasing the same.\"\n\n(Thus added by article 1 of agreement AJDIP-136-2009\nof April 17, 2009).\n\n5º-Repeal\nany previous provision that contradicts this provision.\n\n6º-It shall take effect\nupon its approval.\n\n  \n\nLet it be published.\nFinal agreement."
