  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 33781\n\n                        Modifica al Instituto Costarricense de Pesca y Acuicultura, el gasto\npresupuestario máximo del 2007\n\nTexto Completo acta: AB294\nNº 33781\n\nNº 33781\n\n \n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY EL MINISTRO DE\nHACIENDA\n\n \n\nCon fundamento en las\natribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de\nla Constitución Política;\nlos artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2) acápite b) de\nla Ley Nº 6227, Ley General de\nla Administración Pública\nde 2 de mayo de 1978; la Ley Nº\n8131, Ley de la\n Administración Financiera de\nla República y Presupuestos\nPúblicos de 18 de setiembre del 2001 y sus reformas; y su Reglamento, el Decreto\nEjecutivo Nº 32988-H-MP-PLAN de 31 de enero del 2006 y sus reformas;\nla Ley Nº 7384, Ley de Creación\ndel Instituto Costarricense de Pesca y Acuicultura de 16 de marzo de 1994;\nla Ley Nº 8436 Ley de Pesca y\nAcuicultura de 1º de marzo del 2005; el Decreto Ejecutivo Nº 32973-H de 1º de\nmarzo del 2006 y sus reformas y el Decreto Ejecutivo Nº 32452-H de 29 de junio\ndel 2005.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con el\nartículo 5 inciso h) de la Ley Nº\n7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, publicada\nen La Gaceta Nº\n62 de 29 de marzo de 1994, el Instituto Costarricense de Pesca y Acuicultura\n(INCOPESCA) tiene entre sus funciones, la facultad de extender, suspender y\ncancelar los permisos de pesca marina y construcciones de embarcaciones, así\ncomo las licencias y concesiones para la producción en el campo de la\nacuicultura, a las personas físicas o jurídicas que los soliciten.\n\n2º-Que el artículo 13 de\nla Ley Nº 8436, Ley de Pesca y Acuicultura,\npublicada en La Gaceta Nº\n78 de 25 de abril del 2005, señala que INCOPESCA ejercerá el control de la\nactividad pesquera y acuícola que se realice en aguas marinas e interiores y\nbrindará asistencia técnica a la actividad acuícola en aguas continentales y\nmarinas. \n\n3º-Que el Instituto, con el fin\nde incorporar en el Plan Anual Operativo actividades relevantes que son\ncontinuación de metas iniciadas en este período y que no cuentan con el\ncorrespondiente contenido presupuestario, solicita la ampliación del gasto\npresupuestario máximo para el año 2007, para ser utilizado en la compra y\nsustitución de equipo de transporte, construcciones, adiciones y mejoras tales\ncomo: ampliación de la\n Terminal Pesquera, ubicada en Barrio El Carmen de Puntarenas,\nconstrucción del edificio de archivo central y de la oficina regional de Quepos,\nconstrucción del techo y acondicionamiento de la pantalla de atraque en\nla Terminal de\nMultiservicios Pesqueros en el barrio El Carmen de Puntarenas, adquisición de\nequipo y programas de cómputo, mobiliario y equipo de oficina, así como equipo\nde comunicación. \n\n4º-Que los rubros anteriores,\nserán financiados con superávit libre y específico de conformidad con el\nDecreto Ejecutivo Nº 32452-H, publicado en\nLa Gaceta Nº 130 de 6\nde julio del 2005 o \"Lineamiento para la aplicación del artículo 6 de\nla Ley Nº 8131 de\nla Administración Financiera\nde la República\ny Presupuestos Públicos y la regulación de la clase de ingresos del Sector\nPúblico denominada Financiamiento\", así como otros recursos provenientes de\ntransferencias corrientes (Convenio INCOPESCA-JAPDEVA).\n\n5º-Que en el Decreto Ejecutivo Nº\n32973-H, publicado en La\n Gaceta Nº 64 de 30 de marzo del 2006, y sus reformas,\nla Autoridad Presupuestaria\nformuló las Directrices Generales de Política Presupuestaria para el 2007, las\ncuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder\nEjecutivo, estableciendo en el artículo 1° del citado decreto, el gasto presupuestario\nmáximo del año 2007, para las entidades cubiertas por el ámbito del mencionado\nÓrgano Colegiado.\n\n6º-Que con el oficio\nSTAP-Circular-0696-06 de 3 de marzo del 2006, se comunicó al INCOPESCA el gasto\npresupuestario máximo fijado para el año 2007.\n\n7º-Que mediante el oficio Nº\nPESJ-158-03-2007, de 1º de marzo del 2007 el Ministro Rector del Sector\nProductivo, avala la solicitud de ampliación de gasto presupuestario presentada\npor el Instituto.  8º-Que por lo\nanterior, resulta necesario modificar el gasto presupuestario máximo fijado al\nINCOPESCA para el 2007.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Regulation 33781\n\n                        Modifies for the Costa Rican Institute of Fisheries and Aquaculture the maximum\nbudgetary expenditure for 2007\n\nComplete Text of record: AB294\nNº 33781\n\nNº 33781\n\n \n\nTHE PRESIDENT OF THE\nREPUBLIC\n\nAND THE MINISTER OF\nFINANCE\n\n \n\nBased on the\npowers conferred by Articles 140, subsections 3) and 18) and 146 of\nthe Political Constitution;\nArticles 25, subsection 1), 27, subsection 1) and 28, subsection 2) paragraph b) of\nLaw No. 6227, General Law of\nPublic Administration\nof 2 May 1978; Law No.\n8131, Law of the\n Financial Administration of\nthe Republic and Public Budgets\nof 18 September 2001 and its amendments; and its Regulations, Executive\nDecree No. 32988-H-MP-PLAN of 31 January 2006 and its amendments;\nLaw No. 7384, Law Creating\nthe Costa Rican Institute of Fisheries and Aquaculture of 16 March 1994;\nLaw No. 8436, Fisheries and\nAquaculture Law of 1 March 2005; Executive Decree No. 32973-H of 1\nMarch 2006 and its amendments; and Executive Decree No. 32452-H of 29 June\n2005.\n\n \n\nConsidering:\n\n \n\n1º-That in accordance with\nArticle 5, subsection h) of Law No.\n7384, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, published\nin La Gaceta No.\n62 of 29 March 1994, the Costa Rican Institute of Fisheries and Aquaculture\n(INCOPESCA) has among its functions, the power to issue, suspend and\ncancel marine fishing permits and vessel construction permits, as well\nas licenses and concessions for production in the field of\naquaculture, to the individuals or legal entities that request them.\n\n2º-That Article 13 of\nLaw No. 8436, Fisheries and Aquaculture Law,\npublished in La Gaceta No.\n78 of 25 April 2005, states that INCOPESCA shall exercise control over\nfishing and aquaculture activities carried out in marine and inland waters\nand shall provide technical assistance for aquaculture activities in continental and\nmarine waters. \n\n3º-That the Institute, in order\nto incorporate into the Annual Operating Plan relevant activities that are\na continuation of goals initiated in this period and that do not have the\ncorresponding budgetary allocation, requests the expansion of the maximum\nbudgetary expenditure for the year 2007, to be used for the purchase and\nreplacement of transportation equipment, constructions, additions and improvements such\nas: expansion of the\n Fishing Terminal, located in Barrio El Carmen de Puntarenas,\nconstruction of the central archive building and the Quepos regional office,\nconstruction of the roof and conditioning of the docking screen at\nthe Fishing Multiservice Terminal in barrio El Carmen de Puntarenas, acquisition of\ncomputer equipment and programs, office furniture and equipment, as well as communication\nequipment. \n\n4º-That the foregoing items\nshall be financed with free and specific surplus in accordance with\nExecutive Decree No. 32452-H, published in\nLa Gaceta No. 130 of 6\nJuly 2005 or \"Guidelines for the application of Article 6 of\nLaw No. 8131 on\nthe Financial Administration of\nthe Republic\nand Public Budgets and the regulation of the Public Sector revenue class\ncalled Financing\", as well as other resources from\ncurrent transfers (INCOPESCA-JAPDEVA Agreement).\n\n5º-That in Executive Decree No.\n32973-H, published in La\n Gaceta No. 64 of 30 March 2006, and its amendments,\nthe Budgetary Authority\nformulated the General Budgetary Policy Guidelines for 2007, which\nwere known to the Government Council and approved by the\nExecutive Branch, establishing in Article 1 of the cited decree, the maximum budgetary\nexpenditure for the year 2007, for the entities covered by the scope of the aforementioned\nCollegiate Body.\n\n6º-That by official communication\nSTAP-Circular-0696-06 of 3 March 2006, INCOPESCA was notified of the maximum\nbudgetary expenditure set for the year 2007.\n\n7º-That through official communication No.\nPESJ-158-03-2007, of 1 March 2007, the Rector Minister of the Productive\nSector endorses the request for expansion of budgetary expenditure submitted\nby the Institute.  8º-That due to the\nforegoing, it is necessary to modify the maximum budgetary expenditure set for\nINCOPESCA for 2007. Therefore,\n\n \n\nDECREE:\n\n \n\nArticle 1-The maximum budgetary expenditure\nfor 2007, established in Executive Decree No. 32973-H and its amendments,\npublished in La Gaceta No.\n64 of 30 March 2006, is hereby modified for the Costa Rican Institute of Fisheries and Aquaculture,\nwith the budgetary expenditure limit set at the sum\nof ¢1,465,290,000.00 (one thousand four hundred sixty-five million\ntwo hundred ninety thousand colones), for that period.\n\nArticle 2-This Decree shall be effective as of its\npublication.\n\n \n\nGiven at\nthe Office of the President of\nthe Republic, on the seventh\nday of the month of May of two thousand seven."
