Mayor fuera de las áreas silvestres protegidas\ny, de la pesca en áreas silvestres protegidas)\n\n \n\n \n\nEn el ejercicio de las facultades\nque les confiere los incisos 3) y 18) del artículo 140 y 146 de\nla Constitución\n Política y de conformidad con\nla Convención sobre\nel Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestre\n(CITES), Ley Nº 5605, del 30 de octubre de 1974, publicada el 28 de enero de\n1975, lo establecido en los artículos 6º, 12, 14 y 18 de\nla Ley de Conservación de\nla Vida Silvestre Nº\n7317, del 30 de octubre de 1992, publicada en\nLa Gaceta Nº 235 del\n7 diciembre de 1992 y los artículos 11 y 57 de\nla Ley Nº 7788, Ley de\nBiodiversidad, del 30 de abril de 1998, publicada en\nLa Gaceta Nº 101 del\n27 de mayo de 1998.\n\n \n\nConsiderando:\n\n \n\n1º-Que la administración de los\nrecursos de vida silvestre, como la facultad para dictar medidas y establecer\nprocedimientos necesarios para asegurar la conservación de la diversidad\nbiológica del país, es función del Ministerio de Ambiente y Energía.\n\n2º-Que la destrucción del\nhábitat, la cacería furtiva, la contaminación ambiental y el comercio ilegal de\nanimales vivos o sus productos derivados han disminuido peligrosamente las\npoblaciones de algunas especies de fauna silvestre, al tiempo que otras se\nencuentran en inminente peligro de extinción en el territorio nacional, de\nforma que se hace necesario establecer regulaciones para su aprovechamiento.\n\n3º-Que algunas especies de fauna\nsilvestre son raras o endémicas en áreas muy reducidas del territorio nacional\ny requieren estrictas medidas de control para asegurar su sobrevivencia.\n\n4º-Que la ley de biodiversidad\nestablece criterios preventivo y precautorio cuando exista peligro o amenaza\ngrave o inminente a los elementos que componen la biodiversidad y que la\nausencia de certeza científica no deberá utilizarse como razón para postergar\nla adopción de medidas eficaces de protección. Por tanto,\n\nDECRETAN:\n\n \n\nRegulaciones para la caza menor y mayor fuera de las\n\nÁreas Silvestres Protegidas y de la pesca en Áreas\n\nSilvestres Protegidas\n\n \n\nCAPÍTULO I\n\n \n\nLa caza, la pesca\ny torneos en Áreas Silvestres Protegidas\n\n \n\nArtículo 1º-Se prohíbe la caza\nmayor y menor, la caza menor de aves canoras y de plumaje, así como la pesca en\nParques Nacionales (excepto lo establecido en el artículo 10 de\nla Ley Nº 6084, publicada en\nLa Gaceta Nº 101 del\n7 de setiembre de 1997), Reservas Biológicas, Monumentos Naturales, Reservas\nForestales, Zonas Protectoras, Reservas Indígenas (excepto la caza de\nsubsistencia para los indígenas residentes), Refugios de Vida Silvestre,\n(excepto cuando se trate de programas de manejo de poblaciones que realice el\nSistema Nacional de Áreas de Conservación del MINAE) y las fincas sometidas al\nrégimen de Pago de Servicios Ambientales. Además de aquellas fincas que se\nencuentran bajo la administración de las Áreas de Conservación.\n\nCAPÍTULO II\n\n \n\nProhibiciones\n\n \n\nArtículo 2º-Se prohíbe la caza\nmayor y menor de todas las especies con poblaciones reducidas o en peligro de\nextinción (artículo 58 y 60 del Reglamento de\nla Ley de Conservación de\nla Vida Silvestre) con\nexcepción de lo que disponga técnicamente el Sistema Nacional de Áreas de\nConservación.\n\nArtículo 3º-Queda prohibido de\nigual forma:\n\n \n\na) \"Calentar\" aves silvestres en jaulas con trampas o jaulas\ncogedoras durante los días no autorizados para la caza. \n\nb) La caza de aves silvestres con luz artificial durante la\nnoche, al igual que la captura de aves con pegamentos y redes de niebla. \n\nc) El traslado dentro del país de aves en jaulas con trampas\no jaulas cogedoras en temporadas no autorizadas para la caza. \n\nd) La caza de todas las especies de aves silvestres\nresidentes y migratorias en todo el territorio nacional, con excepción de las\nque se indiquen en el presente Decreto Ejecutivo. \n\ne) Transportar aves canoras (aves con llamativos cantos) o\nde plumaje (aves con plumaje de llamativos colores) en jaulas echadoras o con trampas,\nen temporada no autorizadas para la caza, sin los respectivos permisos del\nSINAC (licencia de caza y permiso de tenencia vigente y permiso de traslado). \n\nf) La caza de aves canoras y de plumaje, en los lugares que\nse indican a continuación:\n\n \n\n1) En los distritos de Los\nÁngeles, Piedades Norte y San Rafael del cantón de San Ramón; la zona\ncomprendida entre Alto Villegas del distrito de Volio del cantón de San Ramón,\nempezando en la Carretera\nque comunica Zarcero con San Ramón en el cruce a Ángeles Norte, siguiendo por\neste camino hasta el puente de\nla Quebrada Plata continuando por el cauce aguas\nabajo hasta la desembocadura en el río Espino, continuando por la margen derecha\naguas arriba hasta el puente en el camino que comunica San Luis con Barranca,\nde este punto continua por el camino hasta Barranca, siguiendo por la carretera\nque conduce a San Ramón '68asta el punto inicial ubicado en Alto Villegas y el\ncruce a Ángeles Norte; en la zona comprendida entre la carretera que conduce de\nSan Ramón a la Fortuna\nentre los ríos la Esperanza\ny Burro, margen izquierda hasta incluir El Bosque Eterno de los Niños en los\ndistritos de La Tigra\nde San Carlos y San Isidro de Peñas Blancas del cantón de San Ramón.\n\n2) En el distrito de Monterrey de\nSan Carlos y en la zona comprendida entre la carretera que lleva de\nla Comunidad del Tanque a Monterrey\nde San Carlos, iniciando en el cruce a Montelimar, siguiendo por este camino a\nla derecha, pasando por el poblado de San Andrés, hasta el poblado de Nieves\nsiguiendo hasta encontrarse con la carretera que conduce a los Chiles, pasando por\nSanta Rosa y Acapulco hasta llegar al paso del río Chimurria, en este sitio se\nsigue a la izquierda sobre el camino que lleva hacia San Jorge hasta\ninterceptar la carretera que une San Jorge con Chambacú, de este punto se sigue\nal sur por la carretera hacia Chambacú, y Cedros, siguiendo hasta Mirador y el\ncruce que lleva a Montelimar en el punto inicial.\n\n3) En los cantones de Puriscal,\nTurrubares, Mora, Dota y Tarrazú y Pérez Zeledón, de la provincia de San José.\n\n4) En el cantón de Aguirre,\nBuenos Aires y Coto Brus de la provincia de Puntarenas.\n\n5) En el cantón del Guarco de la\nprovincia de Cartago.  6) Un kilómetro en\nambas márgenes del río Virilla, en la zona comprendida entre el puente sobre la\nautopista General Cañas y el puente de Piedras Negras en la carretera que\ncomunica Puriscal con Turrúcares de Alajuela.\n\n7) Partiendo del puente sobre el\nrío Aranjuez en la\n Carretera Interamericana Norte, margen derecha siguiendo por\ndicha carretera hasta el punte sobre el río Lagarto, de este punto aguas arriba\npor la margen derecha hasta la confluencia de\nla Quebrada Rodríguez,\ncerca de Santa Elena, de este punto siguiendo por la margen derecha aguas\narriba hasta su nacimiento en el Cerro Chomogo, continuando al sur por la\ndivisoria de aguas y los límites políticos de la provincia de Alajuela y\nPuntarenas hasta intersecar el Cerro Ojo de Agua, siguiendo al sur hasta el\nnacimiento del río Aranjuecito, continuando aguas abajo hasta el punto inicial\nen el puente sobre\nla Carretera Interamericana Norte.  8) Se prohíbe la caza del jilguero (Myadestes\nmelanops) en todo el territorio nacional.\n\nArtículo 4º-Se prohíbe la caza\nmenor de las siguientes aves canoras, de plumaje, y otras especies silvestres\nen todo el territorio nacional en el período que a continuación se indica:\n\n \n\nAves canoras:\n\n \n\na) Aguío coroniamarillo, monjito\n(Euphonia luteicapilla) del 1º de enero al 30 de setiembre.\n\nb) Aguío gorgiamarillo (Euphonia\nhirundinacea) del 1º de enero al 30 setiembre. \n\nc) Euphonia menuda, canaria\n(Euphonia minuta) del 1º de enero al 30 setiembre. \n\nd) Finito gargantinegra, finito\n(Euphonia affinis) del 1º de enero al 30 setiembre.\n\ne) Gallito, semillerito\ncariamarillo (Tiaris olivacea) del 1º de abril al 30 de setiembre.\n\nf) Setillero collarejo\n(Sporophila torqueola) del 1º de abril al 30 de setiembre.\n\ng) Setillero garganta negra\n(Sporophila aurita) del 1º de abril al 30 de setiembre.\n\n \n\nAves de plumaje:\n\n \n\na) Tangara moteada, zebra\n(Tangara guttata) del 1º de marzo al 30 de setiembre. \n\nb) Tangara dorada, Juanita\n(Tangara icterocephata) del 1º de marzo al 30 de setiembre. \n\nc) Tangara capuchidorada, siete\ncolores, mariposa (Tangara larvata) del 1º de marzo al 30 de setiembre. \n\nd) Gorrión común, eléctrico\n(Passer domesticus) del 1º de mayo al 30 agosto.\n\n \n\nCaza menor de aves con arma de fuego:\n\n \n\na) Paloma collareja (Columba\nfasciata) durante el período comprendido del 1º de Febrero al 31 de agosto. \n\nb) Paloma arrocera (Zenaida\nmacroura), paloma alablanca (Zenaida asiática), del 1º de abril al 31 de\noctubre. \n\nc) Piches alablanca (Dendrocygma\nautumnalis) y Cerceta aliazul (Anas discor) del 1º de abril al 31 de octubre. \n\nd) Codorniz común (Colinus\nleucopogon) del 1º de abril al 31 de setiembre. \n\ne) Paloma morada (Columba\nflavirostris, Columba subvinacea, Columba cayanensis, Columba nigrirostris) del\n1 de marzo al 30 setiembre.\n\nCAPÍTULO III\n\n \n\nAutorizaciones\n\n \n\nCaza menor de aves\n\n \n\nArtículo 5º-Se podrá cazar aves\nsilvestres canoras y de plumaje, en las condiciones siguientes:\n\n \n\na) En tiempo autorizado y\núnicamente con una jaula cogedora por cazador. \n\nb) Máximo 2 machos adultos de\ncada especie autorizada por cazador por año, en todo el territorio nacional,\nexcepto lo establecido en el inciso f del artículo 3 de este decreto. \n\nc) Únicamente durante los días\nsábados, domingos y feriados autorizados en este decreto, con horario de 6 a.m. a 5 p.m. \n\nd) En caso de torneos de caza de\naves y la posterior liberación de las aves capturadas, estos torneos son para\nun día específico en un sitio autorizado según la solicitud presentada, con un\nmáximo de dos fechas por temporada para un sitio. Los sitios deben estar a más\nde 5 km\nde distancia uno de otro.\n\nArtículo 6º-Se podrán cazar con\narma de fuego, en tiempo autorizado, las siguientes especies de aves de caza\nmenor, en un horario de 6:00 a.m. a 5:00 p.m., durante los días sábado, domingo\ny feriados autorizados con un límite máximo de piezas según se indica a\ncontinuación, (excepto los extranjeros no residentes que solo podrán cazar en\nGuanacaste y solo paloma arrocera (Zenaida macroura); paloma alablanca (Zenaida\nasiática):\n\n \n\na) Codorniz común (Colinus\nleucopogon), 10 piezas por día por cazador, en todo el territorio nacional en\nel período comprendido entre el 1 de octubre y el 31 de marzo. \n\nb) Zanate (Quiscalus mexicanus),\nsin límite de piezas, en todo el territorio nacional, en fechas autorizados\npara la caza en cada zona (artículos 10, 11, 12, 13 del presente Decreto). En\nla provincia de Guanacaste se permite la caza durante todo el año. \n\nc) Paloma arrocera (Zenaida\nmacroura); paloma alablanca (Zenaida asiática), 20 piezas por día, por cazador,\nen todo el territorio nacional, en el período comprendido entre el 1 de\nnoviembre y el 31 de marzo. \n\nd) Piches alablanca (Dendrocygma\nautumnalis) y cerceta aliazul (Anas discor), 15 piezas por día, por cazador, en\ntodo el territorio nacional, en el período comprendido entre el 1º de noviembre\ny el 31 de marzo. \n\ne) Paloma morada (Columba\nflavirostris, Columba subvinacea, Columba cayanensis, Columba nigrirostris), 10\npiezas por día, por cazador, en todo el territorio nacional, excepto las zonas\ndelimitadas en los incisos 10; 11, 12 y 13 de este decreto, cuando por la\ndistribución de estas especies corresponda, en el período comprendido entre el\n1º de octubre y el 29 de febrero.\n\nf) Paloma\ncollareja (Columba fasciata), 10 piezas por día, por cazador, en el período\ncomprendido entre el 1º de setiembre y el 31 de enero, en los siguientes\nlugares:\n\n \n\n1) En fincas privadas en las\nmárgenes de la\n Carretera Interamericana Sur, entre el kilómetro 34 hasta el\nkm 39, entre el km 41 y el km 47, entre el km 52 y el km 55, entre el km 57 y\nel km 64 (sitio conocido como Madreselva). Únicamente a más de 50 m del límite de la\ncarretera y fuera de los límites de\nla Reserva Forestal Los\nSantos y El Parque Nacional Tapantí Macizo de\nla Muerte. \n En las zonas no autorizadas (entre el kilómetro 39 al\nkm 40, entre el km 41 al km 46, entre el km 52 al km 54, y entre el km 55 al km\n56) que incluye poblados a la orilla de la carretera solo se permitirá la caza\nen fincas particulares fuera de\nla Reservas Forestal Los Santos y El Parque Nacional\nTapantí Macizo de la Muerte\nen sitios que se ubiquen a 1 km\no más de la carretera. \n\n2) En fincas privadas, en ambas\nmárgenes de la carretera entre Carrizal de Alajuela y Poasito, a más de 50 metros de los límites de\ncarretera.\n\n3) En fincas privadas en ambas\nmárgenes de las carreteras entre Tarbaca y Vuelta de Jorco, a más de 50 metros de los límites\nde carretera.\n\nCAPÍTULO IV\n\n \n\nZonas autorizadas\npara la caza\n\n \n\nArtículo 7.-Se declaran las siguientes zonas de caza:\n\n \n\nZona 1. Provincia de Guanacaste\n\nZona 2. Provincias de Alajuela y\nHeredia\n\nZona 3. Provincias de Puntarenas\ny San José Zona 4. Provincias de Cartago y Limón\n\nLa caza se permite solamente de\n6:00 a.m. a 5:00 p.m. en los días autorizados.\n\nCAPÍTULO V\n\n \n\nDe la caza menor y\nmayor con armas y métodos de caza autorizados\n\nen el Reglamento de la Ley\nde Conservación de la\n Vida Silvestre\n\n \n\nArtículo 8.-Se deberá de observar\nlas regulaciones para las temporadas de caza, de acuerdo con las zonas\ndeclaradas en el artículo 7.\n\nArtículo 9.-Se autoriza\núnicamente la utilización de un perro por cazador.\n\nArtículo 10.-Zona 1. (Guanacaste)\nSe prohíbe la caza mayor y menor, con excepción de los siguientes días: 7, 8,\n21, 22 y 25 de julio de 2007; 2, 4, 5, 15, 18 y 19 de agosto de 2007, 1, 2, 15\ny 16 de setiembre de 2007, 6, 7, 12, 20 y 21 de octubre de 2007; y 3, 4, 17 y\n18 de noviembre de 2007 durante los cuales se permite la caza.\n\n \n\nAdemás se prohíbe la caza mayor y\nmenor en los siguientes sitios:\n\n \n\na) En la zona comprendida entre\nlos siguientes puntos en la hoja cartográfica Tilarán: Partiendo del pueblo de\nSanta Elena de Monteverde, en el puente sobre\nla Quebrada Rodríguez,\nen la carretera que lleva a Las Nubes de Río Chiquito, margen derecha hasta el\npunto conocido como la\n Esperanza, de este lugar siguiendo el camino que lleva a San\nPedro hasta intersectar el río Chiquito, siguiendo por este cauce en la margen\nderecha hasta su desembocadura en\nla Laguna Arenal continuando por la margen derecha\ndel camino que conduce a el Castillo, hasta la desembocadura del río Caño\nNegro, siguiendo aguas arriba hasta su nacimiento, de este punto siguiendo al\nnorte por la divisoria de aguas y los limites políticos de\nla Provincia de Guanacaste\ny Alajuela hasta el Cerro Amigos\n\nb) En el área delimitada por la\ncarretera y comprendida entre las siguientes poblaciones: Playa El Coco,\nSardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo,\nPortegolpe, Huacas y Brasilito; siguiendo la línea de la costa en dirección\nnorte hasta la Playa El\nCoco. \n\nc) En la zona comprendida entre\nel punto de las coordenadas 364,500 y 315,500 de la hoja cartográfica\nMurciélago Nº 3048 1 sobre la carretera interamericana norte, siguiendo por\nesta carretera hasta la ciudad de Liberia, luego siguiendo la carretera 21 del\nMOPT hasta el cruce entre el poblado de Paso Tempisque y el poblado de San\nBlas, comprendido en el punto de las coordenadas 364,699 y 274,509 de la hoja\ncartográfica Belén 3047 II, luego siguiendo la carretera hacia el poblado de\nSan Blas hasta el poblado de Sardinal, siguiendo la carretera 151, con sentido\noeste hasta su final en Playas del Coco, esta área comprende la zona del Polo\nTurístico Golfo Papagayo así como el área de influencia inmediata al mismo,\ncontinuando por la costa hasta el punto de coordenadas 354,500 y 302; Hoja Cartográfica\nAhogados Nº 3048 2, en el Cerro Carbonal, limite del Parque Nacional Santa\nRosa, continuando por el límite sur de dicho parque hasta el sitio inicial en\ncoordenadas 364,500 y 315,500 sobre\nla Carretera Interamericana. \n\nd) En el área comprendida entre\nlos siguientes puntos: de Punta Coyote, en coordenadas 193950 N 396400 E,\nsiguiendo al noreste al camino que inicia en Caletas, en coordenadas 193950 N\n397150 E. Se continúa al noreste por ese mismo camino hasta San Francisco de\nCoyote, en coordenadas 198650 N 399900 E. Se sigue al NE por el camino hasta Javillo,\nen coordenadas 205925 N 401725 E. Sigue al NW por ese camino hasta el cruce que\nva hacia Quebrada Grande, en coordenadas 207375 N 396425 E, continúa luego al\nNW por el camino hasta el cruce que va hacia Los Ángeles, en coordenadas 209525\nN 395675 E, de este cruce se continúa al NW por ese camino hasta el cruce con el\ncamino a San Ramón (río Ora), en coordenadas 213150 N 393650 E, continúa al NW\npor el camino a San Ramón hasta la intersección que va de Cangrejal a San Ramón\nen coordenadas 214275 N 389850 E. Sigue al NE por el camino a San Ramón hasta\nla intersección de este con el río Chiles en coordenadas 214300 N 389875 E,\ncontinúa al Suroeste aguas abajo del río Chiles hasta su confluencia con el río\nOra, en coordenadas 213950 N 389600 E, continúa al suroeste aguas abajo del río\nOra hasta su desembocadura en coordenadas 205300 N 376950 E, sigue luego al SE\npor la orilla de la playa hasta el punto inicial en Punta Coyote coordenadas\n193950 N 396400 E. \n\ne) En la zona comprendida en los\ncerros Caballito y Quebrada Honda, área delimitada por el camino que conduce de\nQuebrada Honda, Caballito y Corralillo hasta encontrar el camino entre Puerto\nHumo y Nicoya, siguiendo por esta ruta hasta el cruce de Santa Ana, continuando\npor este camino pasando por los poblados de Santa Ana y Barra Honda hasta la\ncarretera hacia Puerto Moreno, siguiendo hasta el poblado de Quebrada Honda,\npunto original de partida.  Dicha área se\nencuentra ubicada en las hojas cartográficas Talolinga y Matambú, Provincia de\nGuanacaste.  f) En las Reservas Indígenas\n(excepto la caza de subsistencia que realicen los indígenas con permiso del\nSINAC).\n\nArtículo 11.-Zona 2. (Alajuela,\nHeredia) Se prohíbe la caza mayor y menor, con excepción de los siguientes\ndías: 7 y 8, 11, 21 y 22 de abril de 2007; 1, 5 y 6, 19 y 20 de mayo de 2007;\n1, 5, 6, 19 y 20 de enero de 2008; 2, 3, 16 y 17 de febrero de 2008; y 1, 2, 15\ny 16 de marzo de 2008, en los cuales se permite la caza.\n\n \n\nAdemás se prohíbe la caza mayor y\nmenor en los siguientes sitios:\n\n \n\na) En el cantón de Grecia y en\nlos distritos de Piedades Norte, Los Ángeles, San Isidro de Peñas Blancas,\nSantiago, Piedades Sur, San Rafael y Zapotal del cantón de San Ramón; el\ndistrito de Monterrey del cantón de San Carlos, En la zona comprendida en los\ndistritos de Los Ángeles y Volio del cantón de San Ramón; la zona comprendida entre\nAlto Villegas del distrito de Volio del cantón de San Ramón, empezando en\nla Carretera que comunica\nZarcero con San Ramón en el cruce a Angeles Norte, siguiendo por este camino\nhasta el puente de la\n Quebrada Plata continuando por el cauce aguas abajo hasta la desembocadura\nen el río Espino, continuando por la margen derecha aguas arriba hasta el\npuente en el camino que comunica San Luis con Barranca, de este punto continua\npor el camino hasta Barranca, siguiendo por la carretera que conduce a San\nRamón hasta el punto inicial ubicado en Alto Villegas y el cruce a Ángeles\nNorte; en la zona comprendida entre la carretera que conduce de San Ramón a\nla Fortuna entre los ríos\nla Esperanza y Burro,\nmargen izquierda hasta incluir El Bosque Eterno de los Niños en los distritos\nde La Tigra de San\nCarlos y San Isidro de Peñas Blancas del cantón de San Ramón. \n\nb) En la zona comprendida entre\nla carretera que conduce de San Ramón a\nla Fortuna entre los ríos\nla Esperanza y río Burro,\nmargen izquierda hasta colindar con El Bosque Eterno de los Niños en los\ndistritos de La Tigra\nde San Carlos y San Isidro de Peñas Blancas del Cantón de San Ramón. \n\nc) 100 m en ambas márgenes del\nrío San Rafael en Muelle de San Carlos, entre el puente sobre la carretera que\ncomunica la comunidad de Muelle con Pital y la desembocadura del río San Rafael\nen el río San Carlos. \n\nd) En la zona comprendida entre\nla carretera que lleva de la\n Comunidad del Tanque a Monterrey de San Carlos, iniciando en\nel cruce a Montelimar, siguiendo por este camino a la derecha, pasando por el poblado\nde San Andrés, hasta el poblado de Nieves siguiendo hasta encontrarse con la\ncarretera que conduce a los Chiles, pasando por Santa Rosa y Acapulco hasta\nllegar al paso del río Chimurria, en este sitio se sigue a la izquierda sobre\nel camino que lleva hacia San Jorge hasta interceptar la carretera que une San\nJorge con Chambacú, de este punto se sigue al sur por la carretera hacia\nChambacú, y Cedros, siguiendo hasta Mirador y el cruce que lleva a Montelimar\nen el punto inicial. \n\ne) Un kilómetro en la margen\nderecha aguas abajo del río Virilla, en la zona comprendida entre el Puente\nsobre la autopista General Cañas y el Puente de Piedras Negras en la carretera\nque comunica Puriscal con Turrúcares de Alajuela. \n\nf) En las Reservas Indígenas\n(excepto la caza de subsistencia que realicen los indígenas con permiso del\nSINAC).\n\nArtículo 12.-Zona 3. (Puntarenas,\nSan José). Se prohíbe la caza mayor y menor, con excepción de los siguientes\ndías: 7, 8, 21, 22 y 25 de julio de 2007; 2, 4, 5, 15, 18 y 19 de agosto de\n2007, 1, 2, 15 y 16 de setiembre de 2007, 6, 7, 12, 20 y 21 de octubre de 2007;\ny 3, 4, 17 y 18 de noviembre de 2007 durante los cuales se permite la caza.\n\n \n\nAdemás se prohíbe la caza mayor y\nmenor en los siguientes sitios:\n\n \n\na) En la isla San Lucas. \n\nb) En la zona comprendida entre\nlos siguientes puntos en la hoja cartográfica las Juntas: Partiendo del puente\nsobre el río Aranjuez en\nla Carretera Interamericana Norte, margen derecha\nsiguiendo por dicha carretera hasta el punte sobre el río Lagarto, de este punto\naguas arriba por la margen derecha hasta la confluencia de\nla Quebrada Rodríguez,\ncerca de Santa Elena, de este punto siguiendo por la margen derecha aguas\narriba hasta su nacimiento en el Cerro Chomogo, continuando al sur por la\ndivisoria de aguas y los límites políticos de la provincia de Alajuela y\nPuntarenas hasta intersecar el Cerro Ojo de Agua, siguiendo al sur hasta el\nnacimiento del río Aranjuecito, continuando aguas abajo hasta el punto inicial\nen el puente sobre\nla Carretera Interamericana Norte. \n\nc) En la zona comprendida en el\ndistrito único Parrita, del cantón de Parrita, partiendo del poblado de Valle\nVasconia entre el camino que conduce a\nla Fila Aguacate hasta\nintersectar el cauce del río Negro, siguiendo a partir de este punto el cauce\ndel mismo río aguas abajo hasta su confluencia con el río Chires. A partir de\neste punto se sigue el cauce de este río hasta intersectar la carretera\nPuriscal Parrita a la altura del poblado de Vista de Mar; y de aquí se sigue\nla Carretera Costanera\nhasta intersectar el río Pirris, aguas arriba hasta llegar al poblado de Valle\nVasconia. \n\nd) En la zona comprendida entre\nGolfito de la provincia de Puntarenas, siguiendo por la carretera que conduce\nhasta Río Claro, continuando por la margen izquierda de\nla Carretera Interamericana\nSur hasta el puente sobre el río Térraba, en Palmar Sur, de este punto continua\npor la margen derecha del río hasta\nla Boca Coronado, para cerrar finalmente en Golfito,\npunto original, se exceptúa de esta prohibición la caza de patos y palomas que\nse realice en lagunas y áreas sembradas de arroz ubicadas fuera de áreas\nprotegidas. \n\ne) Un kilómetro en ambas márgenes\ndel río María Aguilar, en la zona comprendida entre el puente Los Anonos en la\ncarretera vieja que comunica a San José con Escazú y la desembocadura en el río\nVirilla. \n\nf) Un kilómetro en la margen\nizquierda del río Virilla, aguas abajo, en la zona comprendida entre el Puente\nsobre la autopista General Cañas y el puente de Piedras Negras en la carretera\nque comunica Puriscal con Turrúcares de Alajuela. \n\ng) La caza de la paloma collareja\nen la carretera que conduce entre Vuelta de Jorco y Palmichal de Acosta, en\nambas márgenes y en el Cerro el Guabal ubicado en coordenadas 205,500 latitud\nNorte y 51,800 longitud Oeste, Lambert Norte, Hoja Caraigres. \n\nh) En las Reservas Indígenas\n(excepto la caza de subsistencia que realicen los indígenas con permiso del SINAC). \n\ni) En los cantones de Pérez\nZeledón, Buenos Aires y Coto Brus, excepto lo establecido en el inciso f del\nartículo 6 de este decreto, en donde se podrá cazar luego de los 50 metros medidos de la\nmargen de la carretera y hasta los límites de la zona protegida.\n\nArtículo 13.-Zona 4. (Cartago,\nLimón). Se prohíbe la caza mayor y menor, con excepción de los siguientes días:\n7 y 8, 11, 21 y 22 de abril de 2007; 1, 5 y 6, 19 y 20 de mayo de 2007; 1, 5,\n6, 19 y 20 de enero de 2008; 2, 3, 16 y 17 de febrero de 2008; y 1, 2, 15 y 16\nde marzo de 2008, en los cuales se permite la caza.\n\nAdemás se prohíbe la caza mayor y\nmenor en los siguientes sitios:\n\n \n\na) Cantones de Jiménez y\nTurrialba, provincia de Cartago. \n\nb) En el distrito de Orosi del\ncantón de Paraíso y el distrito de Tobosi, San Isidro y Patio de Agua del\ncantón del Guarco, excepto los sitios establecidos en el inciso f del artículo\n6 de este decreto, en esta zona se podrá cazar luego de los 50 metros medidos de la\nmargen de la carretera y hasta los límites de la zona protegida. \n\nc) De conejos silvestres en los\ncantones: Cartago, Paraíso, La\n Unión, Jiménez, Alvarado y Oreamuno todos de la provincia de\nCartago, con excepción de las fechas 6, 7, 12, 20 y 21 de octubre de 2007; y 3,\n4, 17 y 18 de noviembre de 2007. \n\nd) En las Reservas Indígenas,\nexcepto la caza de subsistencia que realicen los indígenas con permiso del\nSINAC.\n\nArtículo 14.-Se declaran como\nespecies de caza mayor los mamíferos listados en este artículo; se podrán\ncazar, de acuerdo a las fechas autorizadas (artículos 11 al 14 de este decreto)\npara cada zona, excepto las zonas delimitadas en los incisos 10; 11, 12 y 13 de\neste Decreto. \n\n \n\na) Odocoileus virginianus: Venado\ncola blanca; 2 machos por año. \n\nb) Canis latrans: coyote; 6\nanimales por año, sujeto a temporada de caza autorizada por zona.\n\nArtículo 15.-Se declaran como\nespecies de caza menor los animales listados en este artículo, se podrán cazar\nde acuerdo a las fechas autorizadas para cada zona, excepto en las zonas\ndelimitadas en los artículos 10; 11, 12 y 13 de este Decreto:\n\n \n\na) Didelphis marsupialis: zorro\npelón; 5 piezas por año, por cazador. \n\nb) Didelphis virginiana: zorro\npelón; 5 piezas por año, por cazador. \n\nc) Sylvilagus brasilensis: conejo\nde monte; 10 piezas por año, por cazador. \n\nd) Sylvilagus floridanus: conejo\nde monte; 10 piezas por año, por cazador. \n\ne) Sciurus variegatoides: ardilla\ncomún; 10 piezas por año, por cazador. \n\nf) Agouti paca: tepezcuintle; 2\npiezas por año por cazador. \n\ng) Dasyprocta punctata: guatuza;\n2 piezas por año, por cazador. \n\nh) Urocyon cineroargenteus: zorra\ngris; 2 piezas por año, por cazador. \n\ni) Ctenosaura similis: garrobo; 4\npiezas por año, por cazador.\n\nCAPÍTULO VI\n\n \n\nGeneralidades\nsobre la caza mayor y menor\n\n \n\nArtículo 16.-Tratándose de fincas\nprivadas, los cazadores deberán obtener el correspondiente permiso por escrito\ndel propietario registral, de conformidad con lo establecido en el artículo 32\nde la Ley de\nConservación de la Vida\n Silvestre y presentarlo en\nla Oficina Subregional\nen donde tramito la licencia, con tres días de antelación.\n\nArtículo 17.-De conformidad con\nlo establecido en los artículos 12, 17, 30 y 63 de\nla Ley Nº 7317, Ley de\nConservación de la Vida\n Silvestre, las Oficinas Subregionales, así como las oficinas\nde Administración de los Refugios Nacionales de Fauna Silvestre y aquellas\notras oficinas que se establezcan con este fin en las diferentes Áreas de\nConservación, que conforman el Sistema Nacional de Áreas de Conservación, serán\nlas encargadas de autorizar, emitir y suscribir o denegar las licencias de caza\ny pesca deportiva continental. En aquellas áreas protegidas que incluyen extensiones\nmarinas, las oficinas administradoras de dichas áreas, serán las encargadas de\nautorizar, emitir y suscribir o denegar los permisos de pesca deportiva.\n\nArtículo 18.-Se define como\n\"límite de piezas\" al máximo número de animales de caza autorizada en el\npresente decreto. El límite de piezas podrá ser acumulativo por días de caza en\nel caso de los patos, palomas y codornices. El cazador tiene la obligación de\nreportar el número de piezas cazado por día, en la oficina del Área de\nConservación del MINAE o a\nla Delegación de\nla Policía de\nProximidad más cercana a la zona de caza visitada, quienes deberán llevar un\nregistro detallado de los reportes proporcionados por los cazadores.\n\nArtículo 19.-El Sistema Nacional\nde Áreas de Conservación (SINAC) a través de sus oficinas subregionales podrá\nautorizar la realización de torneos de caza de conformidad con el Art. 24 del\nreglamento de la Ley\nde Conservación de la\n Vida Silvestre, mediante resolución administrativa, solo\ncuando se trate de:\n\n \n\na) Se prohíben los torneos de\ncaza en los meses de junio - julio -agosto. \n\nb) Rastreo de huellas preparadas\npara los efectos del torneo en un día determinado; para lo cual no se autoriza\nel acoso, maltrato o muerte de animales silvestres. \n\nc) Torneos de caza menor de aves\ncanoras y de plumaje y su liberación en el mismo sitio de captura, con un\nmáximo de 2 fechas por sitio por el período autorizado. Las asociaciones\núnicamente podrán realizar un torneo por sitio por año. \n\nd) Torneos de canto de aves\ncanoras en sitios bajo techo o cerrados y acondicionados para tal efecto.\n\n \n\nPara los torneos de caza menor de\naves canoras y de plumaje, los participantes deberán portar y mostrar si fuera\nrequerido la correspondiente licencia de caza vigente. Los torneos de caza\ndeberán ser fiscalizados por funcionarios del SINAC del Área de Conservación\ncorrespondiente. Las asociaciones deberán presentar un informe sobre las aves\ncapturadas y liberadas.\n\nCAPÍTULO VII\n\n \n\nActividades de\npesca deportiva en áreas protegidas\n\n \n\nArtículo 20.-Se autoriza la pesca\ndeportiva de:\n\n \n\na. De guapote\n(Parachromis spp), róbalo (Centropomus undecimalis),sábalo (Megalops\natlanticus) y demás especies de peces, en, lagunas del Refugio de Fauna\nSilvestre de Caño Negro y el Refugio de Fauna Silvestre las Camelias, que\npermiten la pesca deportiva en su plan de manejo, entre el 1º de agosto del\n2007 y el 31 de marzo del 2008 inclusive. Se podrá pescar con un límite de 5\npeces con un tamaño mínimo de 25\n cm. de longitud, por persona por día, pudiendo acumular\nlas piezas atrapadas siempre que demuestre ante la autoridad competente la\npresencia en el Área hasta por tres días. \n\nb. Del gaspar (Atractosteus tropicus) en las lagunas\ndel Refugio de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre las\nCamelias, entre el 1 setiembre 2007 y el 28 de febrero del 2008 inclusive. Se\npodrá pescar con un límite de 2 peces con un tamaño mínimo de 60 cm. de longitud, por\npersona por día pudiendo acumular las piezas capturadas según demuestre ante la\nautoridad competente la permanencia en el área hasta por tres días. \n\nc. En Refugios de Fauna Silvestre y Parques Nacionales fuera\nde las fechas indicadas en incisos a y b, cuando la actividad esté contemplada en\nel Plan de Manejo o reglamentos de uso público y la pesca sea de subsistencia o\nde consumo familiar debiendo estar registrado en\nla Administración\ndel Área Silvestre Protegida como residente de los poblados aledaños y requerir\nde la utilización del recurso pesquero para alimentación del grupo familiar. \n\nd. Con caña y carrete, así como cuerdas de mano, en un\nhorario de 6:00 a.m. a 5:00 p.m.\n\nArtículo 21.-Se prohíbe la pesca\ndeportiva en la Laguna\nde Hule, ubicada en el Refugio de Fauna Mixto Bosque Alegre, Cariblanco. \n\nArtículo 22.-De conformidad con\nlo establecido en los artículos 12, 17, 63 y 65 de\nla Ley de Conservación de\nla Vida Silvestre, Nº\n7317, las Oficinas Subregionales, las oficinas de Administración de los\nRefugios Nacionales de Vida Silvestre y otras que se establezcan con este fin\nen las diferentes Áreas de Conservación que conforman el Sistema Nacional de Áreas\nde Conservación, serán las encargadas de autorizar, emitir y suscribir o\ndenegar las licencias de pesca, así como las licencias de subsistencia, dentro\nde las áreas silvestres protegidas, cuando así lo estipule el plan de manejo.\n\nArtículo 23.-El SINAC podrá\nautorizar la realización de torneos de pesca deportiva a grupos organizados, de\nconformidad con el artículo 51 del Reglamento de\nla Ley de Conservación de\nla Vida Silvestre,\nDecreto Ejecutivo Nº 32633, en áreas silvestres protegidas cuando su plan de manejo\nlo permita, dependiendo del comportamiento de las poblaciones, mediante\nresolución administrativa, a través de las respectivas oficinas en las\ndiferentes áreas de conservación. Therefore,\n\nTHEY DECREE:\n\n \n\nRegulations for small and large game hunting outside\n\nProtected Wilderness Areas and for fishing in Protected\n\nWilderness Areas\n\n \n\nCHAPTER I\n\n \n\nHunting, fishing, and tournaments in Protected Wilderness Areas\n\n \n\nArticle 1.—Large and small game hunting, small game hunting of songbirds and plumage birds, as well as fishing, are prohibited in National Parks (except as established in Article 10 of Law No. 6084, published in La Gaceta No. 101 of September 7, 1997), Biological Reserves, Natural Monuments, Forest Reserves, Protected Zones, Indigenous Reserves (except subsistence hunting for resident indigenous people), Wildlife Refuges (except in cases of population management programs carried out by the National System of Conservation Areas of MINAE), and farms subject to the Payment for Environmental Services (Pago de Servicios Ambientales) regime. In addition, those farms that are under the administration of the Conservation Areas.\n\nCHAPTER II\n\n \n\nProhibitions\n\n \n\nArticle 2.—Large and small game hunting of all species with reduced populations or in danger of extinction (Article 58 and 60 of the Regulation of the Wildlife Conservation Law) is prohibited, with the exception of what is technically ordered by the National System of Conservation Areas.\n\nArticle 3.—Likewise, the following is prohibited:\n\n \n\na) \"Heating up\" wild birds in cages with trap-cages or catching-cages during days not authorized for hunting. \n\nb) Hunting wild birds with artificial light during the night, as well as capturing birds with adhesives and mist nets. \n\nc) The transfer within the country of birds in trap-cages or catching-cages during seasons not authorized for hunting. \n\nd) The hunting of all species of resident and migratory wild birds throughout the national territory, with the exception of those indicated in this Executive Decree. \n\ne) Transporting songbirds (birds with striking songs) or plumage birds (birds with striking plumage colors) in throwing-cages or with traps, in seasons not authorized for hunting, without the respective permits from SINAC (hunting license and valid possession permit and transfer permit). \n\nf) The hunting of songbirds and plumage birds in the following places:\n\n \n\n1) In the districts of Los Ángeles, Piedades Norte, and San Rafael of the canton of San Ramón; the area between Alto Villegas of the district of Volio of the canton of San Ramón, starting at the Highway that connects Zarcero with San Ramón at the junction to Ángeles Norte, continuing along this road to the bridge over the Quebrada Plata, continuing along the channel downstream to its mouth in the río Espino, continuing along the right bank upstream to the bridge on the road connecting San Luis with Barranca, from this point continuing along the road to Barranca, following the highway that leads to San Ramón to the starting point located at Alto Villegas and the junction to Ángeles Norte; in the area between the highway that leads from San Ramón to La Fortuna between the ríos la Esperanza and Burro, left bank up to include the Bosque Eterno de los Niños in the districts of La Tigra de San Carlos and San Isidro de Peñas Blancas of the canton of San Ramón.\n\n2) In the district of Monterrey de San Carlos and in the area between the road leading from the Comunidad del Tanque to Monterrey de San Carlos, starting at the junction to Montelimar, continuing along this road to the right, passing through the village of San Andrés, to the village of Nieves, continuing until meeting the highway leading to Los Chiles, passing through Santa Rosa and Acapulco until reaching the crossing of the río Chimurria, at this site continuing left on the road leading towards San Jorge until intercepting the highway uniting San Jorge with Chambacú, from this point continuing south on the highway towards Chambacú and Cedros, continuing to Mirador and the junction that leads to Montelimar at the starting point.\n\n3) In the cantons of Puriscal, Turrubares, Mora, Dota and Tarrazú and Pérez Zeledón, of the province of San José.\n\n4) In the canton of Aguirre, Buenos Aires and Coto Brus of the province of Puntarenas.\n\n5) In the canton of El Guarco of the province of Cartago. 6) One kilometer on both banks of the río Virilla, in the area between the bridge on the Autopista General Cañas and the Puente de Piedras Negras on the highway connecting Puriscal with Turrúcares de Alajuela.\n\n7) Starting from the bridge over the río Aranjuez on the Carretera Interamericana Norte, right bank following said highway to the bridge over the río Lagarto, from this point upstream along the right bank to the confluence of the Quebrada Rodríguez, near Santa Elena, from this point continuing along the right bank upstream to its spring (naciente) in Cerro Chomogo, continuing south along the watershed divide and the political boundaries of the province of Alajuela and Puntarenas until intersecting Cerro Ojo de Agua, continuing south to the spring (naciente) of the río Aranjuecito, continuing downstream to the starting point at the bridge on the Carretera Interamericana Norte. 8) The hunting of the black-faced solitaire (jilguero, Myadestes melanops) is prohibited throughout the national territory.\n\nArticle 4.—Small game hunting of the following songbirds, plumage birds, and other wild species is prohibited throughout the national territory during the period indicated below:\n\n \n\nSongbirds:\n\n \n\na) Yellow-crowned euphonia, monjito (Aguío coroniamarillo, Euphonia luteicapilla) from January 1 to September 30.\n\nb) Yellow-throated euphonia (Aguío gorgiamarillo, Euphonia hirundinacea) from January 1 to September 30. \n\nc) White-vented euphonia, canaria (Euphonia menuda, Euphonia minuta) from January 1 to September 30. \n\nd) Scrub euphonia, finito (Finito gargantinegra, Euphonia affinis) from January 1 to September 30.\n\ne) Yellow-faced grassquit, semillerito cariamarillo (Gallito, Tiaris olivacea) from April 1 to September 30.\n\nf) White-collared seedeater (Setillero collarejo, Sporophila torqueola) from April 1 to September 30.\n\ng) Variable seedeater (Setillero garganta negra, Sporophila aurita) from April 1 to September 30.\n\n \n\nPlumage birds:\n\n \n\na) Speckled tanager, zebra (Tangara moteada, Tangara guttata) from March 1 to September 30. \n\nb) Silver-throated tanager, Juanita (Tangara dorada, Tangara icterocephata) from March 1 to September 30. \n\nc) Golden-hooded tanager, siete colores, mariposa (Tangara capuchidorada, Tangara larvata) from March 1 to September 30. \n\nd) House sparrow, eléctrico (Gorrión común, Passer domesticus) from May 1 to August 30.\n\n \n\nSmall game hunting of birds with firearms:\n\n \n\na) Band-tailed pigeon (Paloma collareja, Columba fasciata) during the period from February 1 to August 31. \n\nb) Mourning dove (Paloma arrocera, Zenaida macroura), white-winged dove (paloma alablanca, Zenaida asiatica), from April 1 to October 31. \n\nc) Black-bellied whistling-duck (Piches alablanca, Dendrocygma autumnalis) and Blue-winged teal (Cerceta aliazul, Anas discor) from April 1 to October 31. \n\nd) Crested bobwhite (Codorniz común, Colinus leucopogon) from April 1 to September 31. \n\ne) Red-billed pigeon, Short-billed pigeon, Pale-vented pigeon, Black-billed pigeon (Paloma morada, Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba nigrirostris) from March 1 to September 30.\n\nCHAPTER III\n\n \n\nAuthorizations\n\n \n\nSmall game hunting of birds\n\n \n\nArticle 5.—Wild songbirds and plumage birds may be hunted under the following conditions:\n\n \n\na) During authorized times and only with one catching-cage per hunter. \n\nb) Maximum of 2 adult males of each authorized species per hunter per year, throughout the national territory, except as established in subsection f of Article 3 of this decree. \n\nc) Only on Saturdays, Sundays, and holidays authorized in this decree, from 6 a.m. to 5 p.m. \n\nd) In the case of bird hunting tournaments and the subsequent release of captured birds, these tournaments are for a specific day at an authorized site according to the submitted application, with a maximum of two dates per season for a site. The sites must be more than 5 km apart from one another.\n\nArticle 6.—The following species of small game birds may be hunted with firearms, during authorized times, from 6:00 a.m. to 5:00 p.m., on authorized Saturdays, Sundays, and holidays, with a maximum bag limit as indicated below (except non-resident foreigners, who may only hunt in Guanacaste and only mourning dove (paloma arrocera, Zenaida macroura); white-winged dove (paloma alablanca, Zenaida asiatica)):\n\n \n\na) Crested bobwhite (Codorniz común, Colinus leucopogon), 10 pieces per day per hunter, throughout the national territory in the period between October 1 and March 31. \n\nb) Great-tailed grackle (Zanate, Quiscalus mexicanus), no bag limit, throughout the national territory, on dates authorized for hunting in each zone (Articles 10, 11, 12, 13 of this Decree). In the province of Guanacaste, hunting is permitted throughout the year. \n\nc) Mourning dove (Paloma arrocera, Zenaida macroura); white-winged dove (paloma alablanca, Zenaida asiatica), 20 pieces per day per hunter, throughout the national territory, in the period between November 1 and March 31. \n\nd) Black-bellied whistling-duck (Piches alablanca, Dendrocygma autumnalis) and blue-winged teal (cerceta aliazul, Anas discor), 15 pieces per day per hunter, throughout the national territory, in the period between November 1 and March 31. \n\ne) Red-billed pigeon, Short-billed pigeon, Pale-vented pigeon, Black-billed pigeon (Paloma morada, Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba nigrirostris), 10 pieces per day per hunter, throughout the national territory, except for the zones delimited in subsections 10; 11, 12, and 13 of this decree, when applicable based on the distribution of these species, in the period between October 1 and February 29.\n\nf) Band-tailed pigeon (Paloma collareja, Columba fasciata), 10 pieces per day per hunter, in the period between September 1 and January 31, in the following locations:\n\n \n\n1) On private farms along the Carretera Interamericana Sur, between kilometer 34 and km 39, between km 41 and km 47, between km 52 and km 55, between km 57 and km 64 (site known as Madreselva). Only at more than 50 m from the highway limit and outside the limits of the Reserva Forestal Los Santos and El Parque Nacional Tapantí Macizo de la Muerte. In unauthorized zones (between kilometer 39 and km 40, between km 41 and km 46, between km 52 and km 54, and between km 55 and km 56) which include villages along the roadside, hunting is only permitted on private farms outside the Reserva Forestal Los Santos and El Parque Nacional Tapantí Macizo de la Muerte at sites located 1 km or more from the highway. \n\n2) On private farms, on both sides of the highway between Carrizal de Alajuela and Poasito, at more than 50 meters from the highway limits.\n\n3) On private farms, on both sides of the highways between Tarbaca and Vuelta de Jorco, at more than 50 meters from the highway limits.\n\nCHAPTER IV\n\n \n\nAuthorized zones for hunting\n\n \n\nArticle 7.—The following hunting zones are declared:\n\n \n\nZone 1. Province of Guanacaste\n\nZone 2. Provinces of Alajuela and Heredia\n\nZone 3. Provinces of Puntarenas and San José Zone 4. Provinces of Cartago and Limón\n\nHunting is permitted only from 6:00 a.m. to 5:00 p.m. on authorized days.\n\nCHAPTER V\n\n \n\nOn small and large game hunting with authorized weapons and hunting methods\n\nin the Regulation of the Wildlife Conservation Law\n\n \n\nArticle 8.—The regulations for hunting seasons must be observed, in accordance with the zones declared in Article 7.\n\nArticle 9.—The use of only one dog per hunter is authorized.\n\nArticle 10.—Zone 1. (Guanacaste) Large and small game hunting is prohibited, with the exception of the following days: July 7, 8, 21, 22, and 25 of 2007; August 2, 4, 5, 15, 18, and 19 of 2007; September 1, 2, 15, and 16 of 2007; October 6, 7, 12, 20, and 21 of 2007; and November 3, 4, 17, and 18 of 2007, during which hunting is permitted.\n\n \n\nFurthermore, large and small game hunting is prohibited in the following sites:\n\n \n\na) In the area between the following points on the Tilarán cartographic sheet: Starting from the village of Santa Elena de Monteverde, at the bridge over the Quebrada Rodríguez, on the road leading to Las Nubes de Río Chiquito, right bank to the point known as La Esperanza, from this place following the road leading to San Pedro until intersecting the río Chiquito, continuing along this channel on the right bank to its mouth in the Laguna Arenal, continuing along the right bank of the road leading to El Castillo, to the mouth of the río Caño Negro, continuing upstream to its spring (naciente), from this point continuing north along the watershed divide and the political boundaries of the Province of Guanacaste and Alajuela to Cerro Amigos.\n\nb) In the area delimited by the highway and comprised between the following villages: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo, Portegolpe, Huacas and Brasilito; following the coastline northward to Playa El Coco. \n\nc) In the area comprised between the point at coordinates 364,500 and 315,500 of the cartographic sheet Murciélago No. 3048 1 on the Carretera Interamericana Norte, following this highway to the city of Liberia, then following MOPT Highway 21 to the junction between the village of Paso Tempisque and the village of San Blas, comprised at the point with coordinates 364,699 and 274,509 of the cartographic sheet Belén 3047 II, then following the highway towards the village of San Blas to the village of Sardinal, following Highway 151 westward to its end at Playas del Coco, this area comprises the Golfo Papagayo Tourism Pole area as well as its immediate area of influence, continuing along the coast to the coordinate point 354,500 and 302; Cartographic Sheet Ahogados No. 3048 2, at Cerro Carbonal, boundary of Parque Nacional Santa Rosa, continuing along the southern boundary of said park to the initial site at coordinates 364,500 and 315,500 on the Carretera Interamericana. \n\nd) In the area comprised between the following points: from Punta Coyote, at coordinates 193950 N 396400 E, continuing northeast to the road starting at Caletas, at coordinates 193950 N 397150 E. Continue northeast along that same road to San Francisco de Coyote, at coordinates 198650 N 399900 E. Continue NE along the road to Javillo, at coordinates 205925 N 401725 E. Continue NW along that road to the junction going towards Quebrada Grande, at coordinates 207375 N 396425 E, then continue NW along the road to the junction going towards Los Ángeles, at coordinates 209525 N 395675 E, from this junction continue NW along that road to the junction with the road to San Ramón (río Ora), at coordinates 213150 N 393650 E, continue NW along the road to San Ramón to the intersection going from Cangrejal to San Ramón at coordinates 214275 N 389850 E. Said area is located on the cartographic sheets Talolinga and Matambú, Province of Guanacaste. f) In Indigenous Reserves (except subsistence hunting carried out by indigenous people with permission from SINAC).\n\nArticle 11.—Zone 2. From this point follow the channel of this river until intersecting the Puriscal Parrita highway at the height of the village of Vista de Mar; and from here follow the Carretera Costanera until intersecting the río Pirris, upstream until reaching the village of Valle Vasconia. \n\nd) In the area comprised between Golfito of the province of Puntarenas, following the highway leading to Río Claro, continuing along the left bank of the Carretera Interamericana Sur to the bridge over the río Térraba, in Palmar Sur, from this point continue along the right bank of the river to La Boca Coronado, to finally close at Golfito, the original point; exempted from this prohibition is the hunting of ducks and pigeons carried out in lagoons and rice-planted areas located outside protected areas. \n\ne) One kilometer on both banks of the río María Aguilar, in the area comprised between the Puente Los Anonos on the old highway connecting San José with Escazú and its mouth in the río Virilla. \n\nf) One kilometer on the left bank of the río Virilla, downstream, in the area comprised between the Bridge on the Autopista General Cañas and the Puente de Piedras Negras on the highway connecting Puriscal with Turrúcares de Alajuela. \n\ng) The hunting of the band-tailed pigeon on the highway leading between Vuelta de Jorco and Palmichal de Acosta, on both banks, and in Cerro el Guabal located at coordinates 205,500 North latitude and 51,800 West longitude, Lambert Norte, Hoja Caraigres. \n\nh) In Indigenous Reserves (except subsistence hunting carried out by indigenous people with permission from SINAC). \n\ni) In the cantons of Pérez Zeledón, Buenos Aires, and Coto Brus, except as established in subsection f of Article 6 of this decree, where hunting may be carried out beyond 50 meters measured from the edge of the highway and up to the limits of the protected zone.\n\nArticle 13.—Zone 4. (Cartago, Limón). Large and small game hunting is prohibited, with the exception of the following days: April 7 and 8, 11, 21 and 22 of 2007; May 1, 5 and 6, 19 and 20 of 2007; January 1, 5, 6, 19 and 20 of 2008; February 2, 3, 16 and 17 of 2008; and March 1, 2, 15 and 16 of 2008, on which hunting is permitted.\n\nFurthermore, large and small game hunting is prohibited in the following sites:\n\n \n\na) Cantons of Jiménez and Turrialba, province of Cartago. \n\nb) In the district of Orosi of the canton of Paraíso and the district of Tobosi, San Isidro, and Patio de Agua of the canton of El Guarco, except the sites established in subsection f of Article 6 of this decree; in this zone, hunting may be carried out beyond 50 meters measured from the edge of the highway and up to the limits of the protected zone. \n\nc) Of wild rabbits in the cantons: Cartago, Paraíso, La Unión, Jiménez, Alvarado, and Oreamuno, all of the province of Cartago, with the exception of the dates October 6, 7, 12, 20, and 21 of 2007; and November 3, 4, 17, and 18 of 2007. \n\nd) In Indigenous Reserves, except subsistence hunting carried out by indigenous people with permission from SINAC.\n\nArticle 14.—The mammals listed in this article are declared as large game species; they may be hunted according to the authorized dates (articles 11 through 14 of this decree) for each zone, except for the zones delimited in subsections 10; 11, 12, and 13 of this Decree. \n\n \n\na) Odocoileus virginianus: White-tailed deer; 2 males per year. \n\nb) Canis latrans: Coyote; 6 animals per year, subject to the authorized hunting season by zone.\n\nArticle 15.—The animals listed in this article are declared as small game species; they may be hunted according to the authorized dates for each zone, except in the zones delimited in Articles 10; 11, 12, and 13 of this Decree:\n\n \n\na) Didelphis marsupialis: Common opossum; 5 pieces per year, per hunter. \n\nb) Didelphis virginiana: Virginia opossum; 5 pieces per year, per hunter. \n\nc) Sylvilagus brasilensis: Forest rabbit; 10 pieces per year, per hunter. \n\nd) Sylvilagus floridanus: Eastern cottontail; 10 pieces per year, per hunter. \n\ne) Sciurus variegatoides: Variegated squirrel; 10 pieces per year, per hunter. \n\nf) Agouti paca: Paca (tepezcuintle); 2 pieces per year per hunter. \n\ng) Dasyprocta punctata: Central American agouti (guatuza); 2 pieces per year, per hunter. \n\nh) Urocyon cineroargenteus: Gray fox; 2 pieces per year, per hunter. \n\ni) Ctenosaura similis: Black spiny-tailed iguana (garrobo); 4 pieces per year, per hunter.\n\nCHAPTER VI\n\n \n\nGeneral provisions on large and small game hunting\n\n \n\nArticle 16.—In the case of private farms, hunters must obtain the corresponding written permission from the registered owner, in accordance with the provisions of Article 32 of the Wildlife Conservation Law, and present it at the Subregional Office where the license was processed, three days in advance.\n\nArticle 17.—In accordance with the provisions of Articles 12, 17, 30, and 63 of Law No. 7317, Wildlife Conservation Law, the Subregional Offices, as well as the Administration offices of the National Wildlife Refuges and those other offices established for this purpose in the different Conservation Areas that make up the National System of Conservation Areas, shall be responsible for authorizing, issuing, and granting or denying hunting and continental sport fishing licenses. In those protected areas that include marine extensions, the administrating offices of said areas shall be responsible for authorizing, issuing, and granting or denying sport fishing permits.\n\nArticle 18.—\"Bag limit\" (límite de piezas) is defined as the maximum number of game animals authorized in this decree. The bag limit may be cumulative per hunting days in the case of ducks, pigeons, and quail. The hunter is obligated to report the number of pieces hunted per day, at the MINAE Conservation Area office or the nearest Proximity Police Station to the hunting zone visited, who must keep a detailed record of the reports provided by the hunters.\n\nArticle 19.—The National System of Conservation Areas (SINAC), through its subregional offices, may authorize the holding of hunting tournaments in accordance with Art. 24 of the regulation of the Wildlife Conservation Law, via administrative resolution, only when dealing with:\n\n \n\na) Hunting tournaments are prohibited in the months of June - July - August. \n\nb) Tracking of tracks prepared for the purposes of the tournament on a specific day; for which the harassment, mistreatment, or killing of wild animals is not authorized. \n\nc) Small game hunting tournaments for songbirds and plumage birds and their release at the same capture site, with a maximum of 2 dates per site per authorized period. Associations may only hold one tournament per site per year.\n\nd) Tournaments of songbirds in roofed or enclosed sites conditioned for that purpose.\n\nFor tournaments involving the small-game hunting of songbirds and ornamental birds, participants must carry and show, if required, the corresponding valid hunting license (licencia de caza). Hunting tournaments must be supervised by officials of SINAC from the corresponding Conservation Area (Área de Conservación). The associations must submit a report on the birds captured and released.\n\nCHAPTER VII\n\nSport fishing activities in protected areas\n\nArticle 20.-The sport fishing of the following is authorized:\n\na. Guapote (Parachromis spp), róbalo (Centropomus undecimalis), sábalo (Megalops atlanticus) and other fish species, in lagoons of the Refugio de Fauna Silvestre de Caño Negro and the Refugio de Fauna Silvestre las Camelias, which allow sport fishing in their management plan (plan de manejo), between August 1, 2007 and March 31, 2008 inclusive. Fishing shall be permitted with a limit of 5 fish with a minimum size of 25 cm in length, per person per day, being able to accumulate the caught specimens provided that presence in the Area for up to three days is demonstrated before the competent authority.\n\nb. Gaspar (Atractosteus tropicus) in the lagoons of the Refugio de Fauna Silvestre de Caño Negro and the Refugio de Fauna Silvestre las Camelias, between September 1, 2007 and February 28, 2008 inclusive. Fishing shall be permitted with a limit of 2 fish with a minimum size of 60 cm in length, per person per day, being able to accumulate the caught specimens according to proof of stay in the area for up to three days demonstrated before the competent authority.\n\nc. In Wildlife Refuges (Refugios de Fauna Silvestre) and National Parks (Parques Nacionales) outside the dates indicated in subsections a and b, when the activity is contemplated in the Management Plan (Plan de Manejo) or public use regulations and the fishing is for subsistence or family consumption, the individual must be registered with the Administration of the Protected Wildlife Area (Área Silvestre Protegida) as a resident of the surrounding towns and require the use of the fishery resource for feeding the family group.\n\nd. With rod and reel, as well as hand lines, during a schedule from 6:00 a.m. to 5:00 p.m.\n\nArticle 21.-Sport fishing is prohibited in the Laguna de Hule, located in the Refugio de Fauna Mixto Bosque Alegre, Cariblanco.\n\nArticle 22.-In accordance with the provisions of articles 12, 17, 63 and 65 of the Ley de Conservación de la Vida Silvestre, No. 7317, the Subregional Offices, the Administration offices of the National Wildlife Refuges (Refugios Nacionales de Vida Silvestre) and others established for this purpose in the different Conservation Areas (Áreas de Conservación) that make up the Sistema Nacional de Áreas de Conservación, shall be responsible for authorizing, issuing and signing or denying fishing licenses (licencias de pesca), as well as subsistence licenses (licencias de subsistencia), within protected wildlife areas, when stipulated by the management plan (plan de manejo).\n\nArticle 23.-SINAC may authorize the holding of sport fishing tournaments for organized groups, in accordance with article 51 of the Reglamento de la Ley de Conservación de la Vida Silvestre, Decreto Ejecutivo No. 32633, in protected wildlife areas when their management plan (plan de manejo) allows it, depending on the behavior of the populations, by means of an administrative resolution, through the respective offices in the different conservation areas (áreas de conservación). Permittees must present the corresponding fishing license (licencia de pesca), issued by INCOPESCA when the type of fishing to be carried out so requires.\n\nCHAPTER VIII\n\nOn the possession of wild animals in captivity\n\nArticle 24.-In accordance with article 19 of Law No. 7317 of October 30, 1992, regulated individuals who capture wild animals authorized by this decree and under the protection of the corresponding license (licencia), must register said animals before the subregional office of the Sistema Nacional de Áreas de Conservación of MINAE that corresponds within the month following the capture.\n\nIn the case of possession of ornamental birds in captivity in aviaries with minimum dimensions of 4 cubic meters adequately conditioned, a limit of 15 birds in total per aviary per licensed permittee is established.\n\nArticle 25.-The hunting or capture of species that do not appear contemplated in the lists of species authorized for hunting in articles 4, 6, 14 and 15 of this Decree is prohibited for an indefinite period.\n\nArticle 26.-The sale, possession and exhibition of songbirds or ornamental birds at farmers' markets and commercial establishments of any kind is prohibited.\n\nArticle 27.-The possession of wild birds in captivity must be governed by the provisions of this Decree and Decreto Ejecutivo number No. 32633.\n\nArticle 28.-Hunting farms (fincas cinegéticas) duly registered with the Sistema Nacional de Áreas de Conservación of MINAE are excepted from the application of this Decree.\n\nArticle 29.-Decreto Ejecutivo No. 32403-MINAE of June 9, 2005 is repealed.\n\nArticle 30.-It shall be effective upon its publication in the Official Gazette and expires on March thirtieth, two thousand eight.\n\nGiven at the Presidency of the Republic.-San José, at eight o'clock on the fourteenth day of the month of March of the year two thousand seven." }
