  "body_es_text": "Recuerde que Control F es una opción que le permite buscar\n                en la totalidad del texto\n\n                Ir al final del documento\n\n                    - Usted está en la última versión de la norma\n                    -\n\n                        Texto Completo Norma 8494\n\n                        Establece Reserva Forestal Golfo Dulce\n\nTexto Completo acta: AC2F5\nN° 8494-A\n\nN° 8494-A\n\n \n\n \n\nPRESIDENTE DE LA\nREPUBLICA\n\nY EL MINISTRO DE\nAGRICULTURA Y GANADERÍA,\n\n \n\n \n\nEn uso de las\nfacultades que confieren los artículos 1°, 2° inciso b),  22, 27 y 71 de la ley N° 4465 de 25 de\nnoviembre de 1969. y\n\n \n\n \n\nConsiderando:\n\n \n\n \n\n1°-Que es función esencial\ndel Estado velar por la protección, aprovecha­miento, conservación y fomento de\nlos recursos forestales del país, de acuerdo con el principio de uso múltiple\nde los recursos naturales renovables.\n\n2°-Que los cerros\nque existen alrededor del Golfo Dulce v en la Penín­sula de Osa son en su\nmayoría de topografía quebrada hasta fuertemente pen­diente, de suelos\narcillosos con poca fertilidad, y de alta pluviosidad hasta seis metros de\nlluvia anual: y consecuentemente estos terrenos no son aptos ni para la\nagricultura ni para la ganadería. El uso más adecuado para ellos sería la\nexplotación racional de los recursos forestales, protegiendo a la vez las\ncuencas hidrográficas que proveen el agua a las áreas agrícolas de la zona.\n\n3°-Que estas tierras\nen su mayoría se encuentran todavía con mis bosques intactos, los cuales\ncontienen un gran número de árboles de alto valor comercial, y cuentan con\ncapacidad para una regeneración rápida en las zonas manejadas para rendimiento\ncontinuo.\n\n4°-Que la\nexplotación racional de estos bosques bajo un plan ordenado de rendimiento\ncontinuo regulado por la Dirección General Forestal podría ser la base para un\ndesarrollo industrial maderero, lo cual crearía empleo y mejoraría las\ncondiciones de vida para la gente de la zona.\n\n5°-Que la apertura\nreciente de tina trocha que une a la Carretera ínteramericana\ndesde Piedras Blancas con Rincón y Puerto Jiménez de Osa, cons­tituye un\npeligro inmediato para una gran parte de estos recursos forestales, ya que\ntermina con el aislamiento que anteriormente daba protección natural a estos\nterrenos.\n\n \n\n \n\nPor tanto.\n\n \n\n \n\nDECRETAN\n:\n\n \n\n \n\n \n\n \n\nArtículo 1°.-Establécese la Reserva Forestal Golfo  Dulce que comprende el territorio ubicado\ndentro de la siguiente demarcación (según mapas topográficos 1 -50000 IGN-\nChanguera 3542 TV, Rincón 3542 [II. The most appropriate use for them would be the rational exploitation of forest resources, while protecting the watersheds that provide water to the agricultural areas of the zone.\n\n3.—That the majority of these lands still have their forests intact, which contain a large number of trees of high commercial value and have the capacity for rapid regeneration in areas managed for sustained yield.\n\n4.—That the rational exploitation of these forests under a structured plan of sustained yield regulated by the Dirección General Forestal could be the basis for timber industrial development, which would create employment and improve living conditions for the people of the area.\n\n5.—That the recent opening of a trail connecting the Inter-American Highway from Piedras Blancas with Rincón and Puerto Jiménez de Osa constitutes an immediate danger to a large part of these forest resources, as it ends the isolation that previously gave natural protection to these lands.\n\nTherefore.\n\nTHEY DECREE:\n\nArticle 1.—The Golfo Dulce Forest Reserve (Reserva Forestal Golfo Dulce) is established, comprising the territory located within the following demarcation comprises an area of 84,538 Ha and 1,875 m2. The demarcation of said reserve is found on the map prepared by the Dirección General Forestal.\n\nArticle record\n\nArticle 3.—National lands located within the previous delimitation are declared inalienable.\n\nArticle record\n\nArticle 4.—The Procuraduría General de la República shall register the lands within this Reserve's listing in the Public Registry, as an individualized property of the National Patrimony.\n\nArticle record\n\nArticle 5.— The Dirección General Forestal shall be responsible for the work of demarcation, surveillance, and studies aimed at the use of natural resources.\n\nArticle record\n\nArticle 6.—On the lands comprised within the Reserve, the following is prohibited without the prior permission of the Director General Forestal:\n\na) Felling trees and extracting forest products of any kind;\n\nb) Hunting or capturing wild animals or collecting or extracting any of their products or remains; and\n\nc) Carrying out burns and any type of agricultural, livestock, industrial, commercial, or forest exploitation activity.\n\nArticle record\n\nArticle 7.—The use of any of the natural resources of the reserve will only be permitted under technical standards that the Dirección General Forestal will approve in due course and according to the zoning established for this purpose.\n\nArticle record\n\nArticle 8.—Registered properties, properties with ten-year possession (posesión decenal), and properties in precarious possession (posesión precaria) established within the limits of the Reserve are automatically subject to the Forest Regime. The agricultural work carried out on these properties must have the written authorization of the Director General Forestal as long as the State does not acquire them.\n\nArticle record\n\nArticle 9.—The Dirección General Forestal shall manage the direct purchase or expropriation of lands reduced to private domain that are within the demarcation of this Reserve and that are essential for its integration.\n\nArticle record\n\nArticle 10.—The relocation and resettlement of occupants who have possessed lands within this Reserve for more or less than ten years, in accordance with the Forest Law (Ley Forestal), shall be carried out with the intervention of the Instituto de Tierras y Colonización.\n\nArticle record\n\nArticle 11.—The acquisition of necessary lands shall be done in accordance with the census that the Dirección General Forestal or the ITCO will conduct for this purpose.\n\nArticle record\n\nArticle 12.—The Dirección General Forestal may enter into all types of contracts with agencies of the Central Government, autonomous or semi-autonomous entities, Municipalities, International Organizations, and Scientific Associations, if their purpose is the undertaking of studies, the establishment of scientific or experimental fields, ecological control, and tourism within this Reserve zone.\n\nArticle record\n\nArticle 13.—It takes effect upon its publication.\n\nGiven at the Casa Presidencial.—San José, on the twenty-eighth day of April, nineteen hundred seventy-eight.\n\nArticle record\n\nDate of generation: 5/5/2026 05:39:15\n\nGo to the beginning of the document"
